Discussion on the issue to include options of seeding versus sodding and utilizing city employees or prisoner labor to install the sod to reduce the costs of sod installation. 2 CITY OF PHILLIPSBURG CITY COUNCIL MEETING March 18, 2013 The Phillipsburg City Council met in regular session on March 18, 2013, 6:00 P.M., at the Phillipsburg City Office, 945 Second Street. CALL TO ORDER ATTENDANCE The meeting was called to order by Mayor Fred Robinson. PRESENT: Council members Mike James; Shane Kinter; Marilyn Goracke; Linda Flipse ; Rod Innes. ABSENT: Council members Doug Jerry. ALSO PRESENT: Scott Sage, City Attorney; Kirby Ross, reporter Phillips County Review; Tad Felts, reporter KKAN/KQMA; Shawn Ellenberger; Dan Wells; Brenda Chance, City Clerk. PROPERTY CLEAN-UP B&B REDIMIX Dan Wells, Kansas Department of Health & Environment Northwest District Environmental Administrator, provided information to the Council concerning complaints he had received about the need for clean-up at the B&B Redimix property. Discussion followed. Information was also provided to the Council concerning the state illegal dumping program. It was the consensus of the Council to move forward with enforcement of health nuisance, junk vehicle and fence ordinances. Wells left the meeting at 6:25 p.m. MINUTES Moved by Flipse, seconded by Goracke, to approve the minutes of the March 4, 2013 APPROVED meeting. Voting Aye: ALL. Opposed: NONE. APPROPRIATION ORDINANCE # A ATTORNEY KMU DUMPSTERS Moved by Innes, seconded by James, to approve an ordinance to pay the bills for the month of March. Voting Aye: ALL. Opposed: NONE. Statutory majority having voted for this ordinance; the city clerk assigned it ordinance # A. Sage reported the outcome of the Roy Bretton sentencing review held at the Phillips County District Court. Moved by Innes, seconded by Kinter, to appoint Randy DeWitt as the KMU voting delegate. Voting Aye: ALL. Opposed: NONE. No alternate was appointed. Moved by James, seconded by Kinter, to sell the dumpsters for $1,040. Voting Aye: ALL. Opposed: NONE. CDBG It was the consensus of the Council for Chance to attend the KDOC CDBG meeting 4/17 & 4/18 in Hutchinson and to consider submitting a housing application. CITY CLERK AIRPORT MAJESTIC THEATRE Chance reported on the recent meetings she had attended and utilizing electronic records more. Moved by Innes, seconded by Kinter, to authorize the mayor to sign the agreement with Olsson & Associates. Voting Aye: ALL. Opposed: NONE. Moved by Kinter, seconded by Innes, to provide materials and labor for a new water service at the Majestic Theatre at no charge. Voting Aye: ALL. Opposed: NONE.

3 SEWER STUDY SOLID WASTE WATER LEGISLATIVE ADJOURN Moved by Innes, seconded by James, to authorize the mayor to sign an agreement with BG Consultants for a sanitary sewer study after the agreement is reviewed by the city attorney. Voting Aye: ALL. Opposed: NONE. DeWitt reported on the status of the solid waste truck order. Discussion was held concerning upcoming water conservation issues. Pool Committee meeting overview and recommendations for Open House: Recommended Open House Thursday, May 16, 3 p.m. 8 p.m. No swimming just viewing Events: 1) Sign up for swim lessons 2) Purchase passes 3) Tours of facility staff and pool committee members to provide 4) Sign up for drawings for opening day events including: 1 st patron to use the slide, 1 st patron off the board, etc. 5) Handout flyer with hours & rules as well as website information for alerts 6) Commemorative item to be given out to attendees? Recommended Opening Day Saturday, May 25, 1 p.m. - 6 p.m. B. Bronze plaque for project Information to be included: Mayor & City Council names Architect Contractor Donor names and items sponsored Pool Committee names Pool Consultant Opening date C. Lifeguards 23 applicants Training to begin as soon as pool has water and temperature allows. D. Concession options Information by Brenda 1) Hire city employee to operate concession stand a. Due to tax exempt bonds city cannot contract out concessions to individual/organization for profit 2) Snack vending machines a. City owned machines with city purchasing supplies etc. i.pros higher income potential; can use any product; city staff can refill as needed; if machine fails after money is inserted there is no conflict with who is responsible for return of money. ii.cons would need to find service provider if machine fails b. Lease vending machines i.pros if machine fails it is vendors problem ii.cons lower income; machine may need refilled prior to vendor returning; previous experience with this type of arrangement was not positive.

13 3) Drink vending machine a. City owned machine i.pros Can use any kind of product; city staff can refill as needed ii.cons would need to find service provider if machine fails b. Utilize Pepsi or Coke for drink vending machine i.city purchase product and fill 1. Pros higher income; if machine is empty city staff can refill; machine owner provide any repairs 2. Cons Must use specific providers products ii.pepsi/coke service machine 1. Pros city does not have to provide or do anything 2.
