MINUTES OF THE COMMON COUNCIL MEETING HELD JUNE 6, 2017

1 The meeting was called to order at 7:05 p.m. by Mayor St. Marie-Carls. Following the Pledge of Allegiance and a moment of silence for the community, roll call was taken. Present: Mayor St. Marie-Carls, Alderpersons Wattawa, Schandel, Brickner, McSweeney, Klug and Tutaj Also Present: City Administrator Johnsrud, City Attorney Alexy, City Clerk/Treasurer Uecker, Police Chief Dietrich, City Engineer Dejewski, Building Inspector Vretenar, Fire Captain Buckhalter and interested citizens Statement of Open Meetings Compliance: City Clerk/Treasurer Uecker stated that the meeting had been properly posted and noticed. Public Hearing: Presentation: Project Recognition 2 nd Grade from Willow Glen and Historical Society Miss St. Francis 2017 Kayla Knuth Moved by Alderwoman Schandel, seconded by Alderman Tutaj to take a ten minute recess. Motion carried. Consent Agenda: Moved by Alderwoman Schandel, seconded by Alderman Brickner to remove Item #6 from the Consent Agenda. Motion carried. Moved by Alderman Brickner, seconded by Alderman Wattawa to place on file with reference in the minutes and approve the items listed under Consent Agenda on the June 6, 2017 Common Council Agenda with the exception of Item #6. Motion carried. Items Removed from Consent Agenda: Moved by Alderwoman Schandel, seconded by Alderman Klug to place on file with reference in the minutes the WCMA Summer Conference City Administrator Johnsrud and to grant the request with the necessary expenses as it is a budgeted item. Motion carried. Mayor s Report and Referral: Moved by Alderwoman Schandel, seconded by Alderman McSweeney to place on file with reference in the minutes the Mayor s Report and Referral dated June 1, Motion carried. Recommendation of Action from Committees/Commissions/Boards: Moved by Alderman Wattawa, seconded by Alderman Klug to approve Amusement Device Supplier Licenses plus Tags for Diamond Vending, LLC. Motion carried.

2 Moved by Alderman Wattawa, seconded by Alderman Klug to approve of Beverage Operator s Licenses New for Kari Wolf and Mercedes Zarate. Motion carried. Moved by Alderman Wattawa, seconded by Alderman Klug to approve of a Temporary Class B License for the St. Francis Civic Association Rick Hackl for Music in the Park summer events to be held June 22, 2017; June 29, 2017; July 13, 2017; July 20, 2017; August 2, 2017 and August 17, 2017 at Vretenar Memorial Park located at 4230 South Kirkwood Avenue. Motion carried with Alderman McSweeney abstaining. Moved by Alderman Wattawa, seconded by Alderman Klug to approve of Renewal Amusement Device Supplier License plus Tags as listed on the June 6, 2017 License Committee agenda. Motion carried. Moved by Alderman Wattawa, seconded by Alderman Klug to approve of Renewal Beverage Operator s Licenses as listed on the June 6, 2017 License Committee agenda. Motion carried with Alderman McSweeney abstaining. Moved by Alderman Wattawa, seconded by Alderman Klug to approve of a Temporary Class B Retail License for Sisters of St. Francis of Assisi John Schmidt for the annual Wine and Vine event on August 26, 2017 at 3221 South Lake Drive. Motion carried. Moved by Alderman McSweeney, seconded by Alderman Klug to concur with the recommendation by the Board of Public Works to send the survey to all the targeted areas at the same time, that residents with children should have priority per DNR and EPA guidelines, and to reimburse residents up to $5000 for the lead service lateral replacements not to exceed $300,000. Motion carried. Moved by Alderman Tutaj, seconded by Alderman McSweeney to concur with the recommendation by the Planning Commission regarding the Sisters of St. Francis of Assisi Initial PUD Submittal, to schedule a public hearing and refer the proposal to staff for further discussions with the developer concerning staff recommendations. Motion carried. Resolutions and Ordinances: Moved by Alderman McSweeney, seconded by Alderman Tutaj to introduce and adopt a Resolution Authorizing Execution of the Department of Natural Resources Principal Forgiven Financial Assistance Agreement. Motion carried. Resolution No Discussion Items with Possible Action: Appointments to Committees/Commissions/Boards: Correspondence with Possible Action or Referral to Committees/Commissions/Boards: Moved by Alderman Wattawa, seconded by Alderman McSweeney to place on file with reference in the minutes the Application for Special Use Permit for 3770 South Pennsylvania Avenue and to forward a copy to the Planning Commission. Motion carried.

3 Moved by Alderman McSweeney, seconded by Alderman Klug to place on file with reference in the minutes the Letter of Engagement for the Annual Tax Incremental District Report from Ehlers and to enter into the agreement with Ehlers for the TIF Reporting. Motion carried. Moved by Alderwoman Schandel, seconded by Alderman Tutaj to place on file with reference in the minutes the correspondence from Kristy Wargin regarding parking on South Pennsylvania Avenue and to limit the parking restrictions for Monday Friday, to eliminate holidays and to direct the City Attorney to prepare the appropriate ordinance. Motion carried. Moved by Alderman Klug, seconded by Alderman McSweeney to place on file with reference in the minutes the Request for Acceptance of the Nojoshing Trail Head Information Box donation from the Girl Scout Troup and to accept the donation. Motion carried. Announcement by Mayor concerning Closed Session: Convene into Closed Session: Moved by Alderman Brickner, seconded by Alderman Wattawa to convene into closed session pursuant to Wis. Stat. sec (1)(e) for purposes of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. Items for discussion: Zimmers Landscaping, LLC (2517 East Norwich Avenue); Bear Development TID Agreement and Wis. Stat. sec (1) (c) for purposes of considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. Item for discussion - Department of Public Works Equipment Operator. The following voted aye : Alderman Tutaj, Alderwoman Schandel, Alderman McSweeney, Alderman Klug, Alderman Wattawa and Alderman Brickner. Time: 8:49 p.m. Reconvene into Open Session: Moved by Alderman McSweeney, seconded by Alderman Klug to reconvene into Open Session. Motion carried. Time: 11:20 p.m. Action taken from Closed Session: Moved by Alderman Wattawa, seconded by Alderman Klug to concur with the recommendation by the CDA to pursue the transaction with Zimmers Landscaping consistent with the terms discussed by City Administrator Johnsrud in Closed Session and to accept the Offer to Purchase and the Developers Agreement. Motion carried. Moved by Alderman Brickner seconded by Alderman Tutaj to approve a TID Incentive for Bear Development, LLC in the amount of $4,800,000 for a guaranteed income stream from real estate

4 taxes paid to TID #5 in the amount of $12,420,000 and an additional incentive to Bear Development, LLC of 80% of real estate taxes paid above $12,420,000 payable on an annualized basis and to direct the City Administrator and City Attorney to prepare the TID Incentive Agreement consistent with the specified terms of this motion. Alderman Brickner requested a roll call vote. The following voted aye : Alderman Klug, Alderwoman Schandel, and Alderman Brickner. The following voted no : Alderman Wattawa, Alderman McSweeney, and Alderman Tutaj. Motion carried with Mayor St. Marie-Carls voting aye. 5 RESOLUTION NO RESOLUTION AUTHORIZING EXECUTION OF THE DEPARTMENT OF NATURAL RESOURCES PRINCIPAL FORGIVEN FINANCIAL ASSISTANCE AGREEMENT WHEREAS, the City of St. Francis (the Municipality ) wishes to undertake a project to replace private lead service lines at residents, pre K-12 schools and licensed day care centers, identified as DNR No (the Project ); and WHEREAS, the Municipality has applied to the Safe Drinking Water Loan Program (the SDWLP ) for financial assistance in the form of a loan made by the SDWLP to the Municipality of which all the principal will be forgiven at the time that the loan disbursements are made to the Municipality, pursuant to the DNR Financial Assistance Agreement; and WHEREAS, the SDWLP has determined that it can provide a loan with principal forgiveness in an amount up to $300,000 that it has identified as being eligible for SDWLP funding; NOW, THEREFORE, the Mayor and City Clerk are authorized by and on behalf of the Municipality to execute the Principal Forgiven Financial Assistance Agreement that contains the terms and conditions of the SDWLP award for the Project.
