1 SPECIAL MEETING MONDAY, OCTOBER 7, :00 p.m. A Special Meeting of the Anahuac City Council was held in the Council Chambers of Anahuac City Hall located at 501 Miller Street, Anahuac, Texas on Monday, October 7, 2013 at the above noted time. There were present: Miguel Anderson Linda Palmer Hall Whitley Danny Thompson Richard Baker Julie Harvill Mayor Pro Tem Alderwoman Alderman Alderman City Attorney City Secretary Those not present: Cheryl Sanders Scott Wible Amanda Hornsby-Abshier Mayor City Administrator Alderwoman Guests: Dayna Haynes Tammy Hale Kaitlin Broussard The Progress Citizen Employee Special Meeting Mayor Pro Tem Anderson called the regular meeting to order at 7:07 p.m. Alderman Whitley led the invocation and Alderman Thompson led the pledges. Mayor Pro Tem Anderson moved to item 1 comments for the audience. Mayor Pro Tem asked City Secretary Harvill if anyone had signed up to speak before council, Mrs. Harvill informed Mayor Pro Tem that no one had signed up to speak. Mayor Sanders moved to item 2 discussion and possible action on citizen s agenda request.

2 a. Tammy Hale Discussion regarding the blocking of roads for the Veteran s Day Parade. Mrs. Hale informed council that the streets would be closed off on November 9 th, 2013 for the Veteran s Day Parade. Mrs. Hale asked if the City could help around the Chambers House again as they did last year. A motion to approve the road blocks and for the City to assist where they could was made by Alderman Whitley. The motion was seconded by Alderman Thompson, all were in favor and the motion carried. b. Tammy Hale Discussion regarding the blocking of roads for the Christmas Day Parade. Mayor Pro Tem moved to item 3 discussion and possible action on Ordinance No , Ordinance of the City of Anahuac, Texas authorizing the suspension of the effective date for an additional ninety (90) days beyond the October 30, 2013, effective date proposed by Entergy Texas, Inc. in connection with its rate increase application entitled Application of Entergy Texas, Inc., authority to change rates and to reconcile fuel cost, filed on September 5, 2013; authorizing the City s participation to the full extent permitted by law at the public utility commission of Texas, requiring reimbursement of municipal rate case expenses; finding that the meeting complies with the open meetings act; making other findings and provisions related to the subject, and declaring an effective date. A motion to approve and adopt the Ordinance was made by Alderman Thompson. The motion was seconded by Alderman Whitley, all were in favor and the motion carried. Mayor Pro Tem Anderson moved to item 4 discussion and possible action on Ordinance No , Ordinance amending ordinance numbers and (A) (2) payment of service; late charges and disconnection for late payment of the City of Anahuac. A motion to approve and adopt the ordinance was made by Alderman Whitley. The motion was seconded by Alderwoman Palmer, all were in favor and the motion carried. Mayor Pro Tem Anderson moved to item 5 discussion and possible action Resolution No , A resolution of the City Council of the City of Anahuac, Texas, establishing a meeting place and time. A motion to approve

3 and adopt the resolution was made by Alderwoman Palmer. The motion was seconded by Alderman Whitley, all were in favor and the motion carried. Mayor Pro Tem Anderson moved to item 6 discussion and possible action on accounts payable, including Jerry Walley Construction invoice # Although the explanation on the events that took place for the work that was done by Jerry Walley Construction was not exactly what council was looking for, council stated that Jerry Walley Construction has been doing business with the City for several years and they do good work. A motion to approve accounts payable including Jerry Walley Construction invoice # was made by Alderwoman Palmer. The motion was seconded by Alderman Thompson, all were in favor and the motion carried. Mayor Pro Tem Anderson moved to item 7 discussion and possible action on approval for training for the following: Code Enforcement, Animal Control Officer, Building Inspector. A motion to approve the training that did not go over what is budgeted was made they Alderwoman Palmer. The motion was seconded by Alderman Whitley, all were in favor and the motion carried. Mayor Pro Tem Anderson moved to item 8 discussion and possible action on approval of minutes from September 04, 2013, September 09, 2013, and September 11, A motion to approve the minutes was made by Alderman Whitley. The motion was seconded by Alderman Thompson, all were in favor and the motion carried. Mayor Pro Tem Anderson moved to item 9 discussion and possible action on bookkeepers report for September No action was taken on this item due to the bookkeeper not being able to prepare in the report for the meeting. Mayor Pro Tem Anderson moved to item 10 discussion and possible action on the hiring of an interim City Administrator. A motion keep checking with the step son of John Finn and also adding the job description to TML website and to the City website for hiring was made by Alderman Thompson. The motion was seconded by Mayor Pro Tem Anderson, all were in favor and the motion carried. Mayor Pro Tem Anderson moved to item 11 discussion and possible action on hiring an interim Water/Wastewater Plant Operator. There was no action taken on this item. Mayor Pro Tem Anderson moved to item 12 convene into closed session on the following:

4 a. Pursuant to Section of the Texas Government Code Personnel Matters discussion and possible action on hiring Shaun Gilmore full time for the position of Water/Wastewater Operator Trainee. b. Pursuant to Section of the Texas Government Code Personnel Matters discussion and possible action on hiring Louis Baldwin full time for the position of Maintenance Worker. c. Pursuant to Section of the Texas Governmental Code Personnel Matters discussion and possible action on salary of Kaitlin Broussard pay rate. Held in open session at Mrs. Broussard s request d. Pursuant to Section of the Texas Governmental Code Personnel Matters discussion and possible action on making Kaitlin Broussard Assistant City Secretary. Held in open at Mrs. Broussard s request. e. Pursuant to Open Meeting Act, Chapter 551, Section of the Texas Government Code Consultations with Attorney; regards pending/possible Litigation. Mayor Pro Tem Anderson asked if there was motion to convene into closed on item b. A motion to convene into closed session was made by Alderman Thompson. The motion was seconded by Mayor Pro Tem Anderson. Council convened into closed session at 7:45 p.m. A motion to convene into closed session at 7:42 p.m. was made by Alderman Thompson. The motion was seconded by Alderman Whitley, all were in favor and the motion carried. Council reconvened into open session at 8:24 p.m. Mayor Pro Tem Anderson moved to item 13 reconvene into open session and take action, if necessary, on closed session items. A motion to reconvene into open session and take action on the items was made by Alderman Thompson. The motion was seconded by Alderwoman Palmer, all were in favor and the motion carried. Item C Pursuant to Section of the Texas Government Code Personnel Matters discussion and possible action on salary of Kaitlin Broussard pay rate, a motion to raise Ms. Broussard s pay rate from $11.50 per hour to $12.50 per hour was made by Alderwoman Palmer. The motion was seconded by Alderman Thompson, all were in favor and the motion carried. Item D - Pursuant to Section of the Texas Government Code Personnel Matters discussion and possible action on making Kaitlin Broussard

5 Assistant City Secretary, a motion to make Ms. Broussard Assistant City Secretary was made by Alderwoman Palmer. The motion was seconded by Alderman Whitley, all were in favor and the motion carried. Item A - Pursuant to Section of the Texas Government Code Personnel Matters discussion and possible action on hiring Shaun Gilmore full time for the position of Water/Wastewater Operator Trainee, a motion to hire Mr. Gilmore full time for the position and to waive the 90 day probation period due to Mr. Gilmore being a temporary employee for almost a year was made by Alderman Whitley. The motion was seconded by Alderman Thompson, all were in favor and the motion carried. Item B - Pursuant to Section of the Texas Government Code Personnel Matters discussion and possible action on hiring Louis Baldwin full time for the position of Maintenance Worker, a motion to hire Mr. Baldwin full time for the position and to waive the 90 day probation period due to Mr. Baldwin being a temporary employee for almost a year was made by Alderwoman Palmer. The motion was seconded by Alderman Whitley, all were in favor and the motion carried. Item E Pursuant to Open Meetings Act, Chapter 551, Section of the Texas Government Code Consultations with Attorney; regarding pending/possible litigation. No action was taken on this item. Mayor Pro Tem Anderson moved to item 14 discussion and possible action on the manufactured home permit for Wayne Morris. Mayor Pro Tem Anderson asked Mr. Wayne Morris had proof of owner ship. Mr. Morris did not have proof at the present time. By agreement the City and Mr. Morris chose to reconvene the hearing on November 4, Item # 15 discussion and possible action on department reports, was skipped. With no further business needed to be brought before council, Mayor Pro Tem Anderson moved to item 16 and asked for a motion to adjourn. A motion to adjourn was made by Alderman Thompson.
