1 BOARD OF ALDERMEN CITY OF TOWN AND COUNTRY NOVEMBER 26, 2018 WORK SESSION The work session meeting of the Board of Aldermen of the City of Town and Country was held at 6:30 PM on Monday, November 26, Present were: Aldermen Allen, Benigas, Butler, Frautschi, Mange, Meyland-Smith, Reuter and Wright. City Attorney Steve Garrett was present to represent the City. 1. Discussion Regular Meeting Agenda Items Mayor Dalton recused himself from agenda item #21 regarding Town Square Change Order No. 12. Acting President Meyland-Smith presided over discussion of that item. No votes were taken. REGULAR MEETING The regular meeting of the Board of Aldermen of the City of Town and Country was held at 7:00 PM on Monday November 26, 2018 at the Municipal Center, 1011 Municipal Center Drive. PLEDGE OF ALLEGIANCE Tim Welby, Ward 2 resident, led the Pledge of Allegiance. ROLL CALL The 7:08 PM roll call indicated Aldermen Allen, Benigas, Butler, Frautschi, Mange, Meyland- Smith, Reuter and Wright. Mayor Dalton presided. City Attorney Steve Garrett was present to represent the City. PROCLAMATION Mayor Dalton read aloud a proclamation congratulating the Town and Country Symphony on their 20 th anniversary and expressing appreciation for all they bring to the community. MINUTES 11/13/18 Regular Meeting Alderman Frautschi moved for approval, seconded by Alderman Wright. Mayor Dalton called for any corrections or amendments. Hearing no further, the minutes of 11/13/18 were unanimously approved. HEARING FROM CITIZENS PUBLIC HEARING(S) A court reporter with Alaris Litigation was present to record the following public hearings: A public hearing on the proposed 2019 Budget for the City of Town and Country. Mayor Dalton opened the public hearing and the City Clerk entered the following exhibits: 1. Affidavit of publication Notice of Hearing published in the St. Louis Countian on November 5, 2018.
2 Board of Aldermen Page 2 of 8 November 26, Typewritten notice of hearing posted at the Municipal Center, Longview Farm House, the Firehouse and on the City s website. Finance Director Pamela Reitz was present for the hearing and provided highlights of the proposed 2019 Budget. Alderman Mange noted that the City has made large infrastructure expenditures to benefit residents in recent years. He added that it was time to consider future plans and the proposed Infrastructure Task Force would be able to assist with prioritization. Alderman Butler stated that she will be requesting that the Deer Management Program and Beatification Grant expenditures be moved back into the General Fund. Discussion ensued about appropriateness of having these particular expenditures in the Road Fund. Ms. Reitz noted that the location of both programs in the Road Fund was acceptable by accounting standards, by City policy, and by the City s auditing firm. Attorney Steve Garrett stated that he believed that there was sufficient nexus for the programs to be located in the Road Fund. Ms. Reitz confirmed that if the programs were moved into the General Fund, a negative structural balance would result and cuts would need to be made to balance the Budget. Mayor Dalton called for public comments. John Hoffmann, Manor Hill Road, noted that the logic described by Attorney Garrett for the Road Fund could be used to move ticket revenue to the Road Fund. He added that the City policy could be amended by the Board, if desired. Hearing no further, the public hearing was closed. APPOINTMENTS COMMUNICATIONS AND REPORTS Alderman Butler Alderman Butler announced that the Conservation Commission would meet on Monday, December 3. She added that the Commission has begun to collect newspaper sleeves to use for Arbor Day seedlings. She also stated that an Alderman from Des Peres recently reached out about the City s Deer Management Program and information was shared. Alderman Wright Alderman Wright thanked staff for another fun and well-attended Turkey Trot event. Mayor Dalton echoed Alderman Wright s appreciation and noted that the 11 th annual event has become a tradition for many people both in and outside of the community. She announced that the Parks and Trails Commission would meet at 5:30 PM on December 3, at the Longview Farm House. She also thanked City Administrator Bob Shelton for providing the Board with updates about the various ongoing trail projects. Alderman Mange Alderman Mange reported that the Art Commission will be meeting at 6:00 PM on Wednesday, November 28, at the Longview Farm House. Alderman Frautschi Alderman Frautschi stated that the Topping Road Task Force would meet at 5:00 PM on Wednesday, December 5, at the Municipal Center.
3 Board of Aldermen Page 3 of 8 November 26, 2018 She also announced that the Ward 2 Coffee would be held on Saturday, December 8, from 8-9 AM at the Mason Woods Village Starbucks. She added that the next Ward 2 Forum is scheduled at 9:30 AM on Monday, December 10, at the Longview Farm House. Mayor Dalton Mayor Dalton noted that Officer Katie Exline would be recognized by various news outlets and asked Chief Gary Hoelzer to provide related details. Chief Hoelzer explained that Officer Exline is this month s recipient of the Proud to Serve recognition from Fox 2 and KPLR 11. He added that he was happy to nominate her because she epitomizes excellence. UNFINISHED BUSINESS BILL NO , AN ORDINANCE AUTHORIZING AN AGREEMENT WITH DELTA DENTAL PLAN OF MISSOURI FOR PARTICIPATION BY THE CITY OF TOWN AND COUNTRY IN A GROUP DENTAL BENEFIT PLAN FOR ITS EMPLOYEES (sponsored by the Board as a Whole) (1 st reading 11/13/18) 86 was read for the second time and placed upon its final passage. Alderman Frautschi moved for approval, seconded by Alderman Wright. The motion carried unanimously and Bill No became Ordinance No BILL NO , AN ORDINANCE ACCEPTING THE BID AND AUTHORIZING AN AGREEMENT WITH GERSTNER ELECTRIC, INC. FOR TRAFFIC SIGNAL MAINTENANCE AND REPAIR (sponsored by Aldermen Butler, Reuter & Frautschi) (1 st reading 11/13/18) 87 was read for the second time and placed upon its final passage. Alderman Frautschi moved for approval, seconded by Alderman Butler. The motion carried unanimously and Bill No became Ordinance No BILL NO , AN ORDINANCE ACCEPTING THE BID AND AUTHORIZING AN AGREEMENT WITH T. HILL CONSTRUCTION FOR THE 2019 ON-CALL ROADWAY MAINTENANCE PROGRAM (sponsored by Aldermen Reuter, Butler & Frautschi) (1 st reading 11/13/18) 88 was read for the second time and placed upon its final passage. Alderman Frautschi moved for approval, seconded by Alderman Wright. Alderman Butler confirmed with City Administrator Bob Shelton that the City was comfortable moving forward with T. Hill Construction in light of the Mason Road Trail Project circumstances.

The motion carried unanimously and Bill No became Ordinance No BILL NO , AN ORDINANCE APPROVING A TWENTIETH AMENDED FINAL SITE DEVELOPMENT PLAN FOR THE DEVELOPMENT KNOWN AS MARYVILLE UNIVERSITY, CITY OF TOWN AND COUNTRY, MISSOURI, WITH CONDITIONS TO BE COMPLIED WITH AND AUTHORIZING CERTIFICATION OF THE TWENTIETH AMENDED FINAL SITE DEVELOPMENT PLAN (sponsored by Aldermen Allen & Meyland- Smith) (1 st reading 11/13/18) 91 was read for the second time and placed upon its final passage. Alderman Allen moved for approval, seconded by Alderman Benigas. The motion carried unanimously and Bill No became Ordinance No ARCHITECTURAL REVIEW Alderman Benigas moved to approve the Architectural Review for Maryville University at 650 Maryville University Drive. Alderman Allen seconded the motion and a voice vote carried. BILL NO , AN ORDINANCE APPROVING AN AMENDED FINAL SITE DEVELOPMENT PLAN FOR THE DEVELOPMENT KNOWN AS TD AMERITRADE, LOCATED AT 675 MARYVILLE CENTRE DRIVE, CITY OF TOWN AND COUNTRY, MISSOURI, WITH CONDITIONS TO BE COMPLIED WITH AND AUTHORIZING CERTIFICATION OF THE AMENDED FINAL SITE DEVELOPMENT PLAN (sponsored by Aldermen Allen & Meyland-Smith) (1 st reading 11/13/18) 92 was read for the second time and placed upon its final passage. Alderman Allen moved for approval, seconded by Alderman Benigas. Alderman Meyland-Smith moved to amend the site plan reference date in Section 1 and Section 1A from 9/28/18 to 11/20/18. Alderman Wright seconded the motion. Alderman Meyland-Smith explained that the amendment accounts for the revised site plan that includes a signalized intersection, as was described by the owner s representative during the Work Session.

Alderman Meyland-Smith moved for approval, seconded by Alderman Benigas. WARRANT LIST-11/26/18 Alderman Frautschi moved for approval, seconded by Alderman Wright. Mayor Dalton called for any amendments. Hearing none, a voice vote was taken and the warrant list of November 26, 2018, in the amount of $82, was unanimously approved. OTHER In response to Alderman Butler, City Administrator Bob Shelton stated that the City has received some preliminary recommendations from the recently completed IT audit. He noted that a report would be provided later in the week with an RFP process to follow.
