1 BOARD OF ALDERMEN CITY OF TOWN AND COUNTRY MAY 08, 2017 WORK SESSION The work session meeting of the Board of Aldermen of the City of Town and Country was held at 6:30 PM on Monday, May 08, Present were: Aldermen Benigas, Butler, Crawford, Frautschi, Mange, Meyland-Smith, Rallo and Wright. Mayor Dalton presided. City Attorney Steve Garrett was present to represent the City. 1. Discussion-Regular meeting agenda items No votes were taken. REGULAR MEETING The regular meeting of the Board of Aldermen of the City of Town and Country was held at 7:00 PM on Monday, May 08, 2017 at the Municipal Center, 1011 Municipal Center Drive. PLEDGE OF ALLEGIANCE August Hellmuth, Boy Scout with Troop 624 in Des Peres, led the Pledge of Allegiance. ROLL CALL The 7:14 PM roll call indicated Aldermen Benigas, Butler, Crawford, Frautschi, Mange, Meyland-Smith, Rallo and Wright to be present. Mayor Dalton presided. City Attorney Steve Garrett was present to represent the City. MINUTES 04/24/17 Regular Meeting Alderman Crawford moved for approval, seconded by Alderman Butler. Mayor Dalton called for any corrections or amendments. Hearing none, the minutes of 04/24/17 were unanimously approved by voice vote. HEARING FROM CITIZENS Mariette Palmer, 604 Greenwich Green, spoke about the Arbor Day event that was held on Sunday, May 7, at Longview Farm Park. She commented on how wonderful the day was which including activities for children, information sharing, and the seedling giveaway. She also expressed excitement about the opening of the Little Library. Mayor Dalton thanked staff and both the Conservation and Parks & Trails Commissions for a wonderful event. PUBLIC HEARING(S) A court reporter with Midwest Litigation was present to record the public hearing. A public hearing to review a request by Laura and Michael Saracino, owners, for approval of a Conditional Use Permit for an accessory structure, a pool house, located at 3000 Trafalgar Drive in the Suburban Estate (SE) Zoning District. Mayor Dalton opened the public hearing and the City Clerk entered the following exhibits:

Bill No Mike Brimer, contractor, was present on behalf of the request. Mr. Brimer explained that the Planning & Zoning Commission asked for landscape drawings and that neighbor approval be documented. It was noted for the record that both items were provided for the Board s review. Mayor Dalton called for public comments. Hearing none, the public hearing was closed. APPOINTMENTS Mayor Dalton announced the following appointments: Planning & Zoning Liaison: Alderman Meyland-Smith Architectural Review Board: Alderman Benigas Police, Fire & EMS: Alderman Frautschi Public Art: Alderman Rallo Parks & Trails: Alderman Wright Ways & Means: Alderman Crawford Conservation: Alderman Butler Public Works: Alderman Mange Alderman Mange moved for approval, seconded by Alderman Meyland-Smith. Mange, Meyland-Smith, and Wright; NAY, Rallo; ABSTAIN, none; ABSENT, none. The motion carried 7-1. COMMUNICATIONS AND REPORTS Alderman Wright Alderman Wright stated that the Arbor Day event was held and several hundred tree seedlings were given out. She noted that it was a fabulous event and that the Parks & Trails Commission would not have a formal meeting in May. UNFINISHED BUSINESS BILL NO , AN ORDINANCE AMENDING TITLE IV, CHAPTER 405, OF THE TOWN AND COUNTRY MUNICIPAL CODE BY THE ADDITION OF ARTICLE XXIII, ENTITLED SPECIAL ZONING DISTRICTS (sponsored by Alderman Meyland-Smith) (1 st reading 04/10/17) Mayor Dalton called for a second reading, without objection. Without objection, Bill No was read for the second time and placed upon its final passage. Alderman Mange moved for approval, seconded by Alderman Crawford.

Land uses may be more restrictive than the base or existing zoning district allows, but not less restrictive shall be specifically delineated for each application. Alderman Frautschi seconded the motion and a voice vote carried. Mange, Meyland-Smith, Rallo and Wright; NAY, none; ABSTAIN, none; ABSENT, none. The motion carried unanimously and Bill No , as amended, became Ordinance No BILL NO , AN ORDINANCE AMENDING THE 2017 BUDGET BY INCREASING CAPITAL IMPROVEMENTS FUND REVENUE AND EXPENDITURE ACCOUNTS FOR THE PURCHASE OF A LASER RADAR UNIT AND THE RELATED INSURANCE SETTLEMENT, AND APPROPRIATING FUNDS TO COVER THE INCREASES (sponsored by the Board as a Whole) Mayor Dalton called for a second reading, without objection. Without objection, Bill No was read for the second time and placed upon its final passage. Alderman Crawford moved for approval, seconded by Alderman Frautschi. Mange, Meyland-Smith, Rallo and Wright; NAY, none; ABSTAIN, none; ABSENT, none. The motion carried unanimously and Bill No became Ordinance No BILL NO , AN ORDINANCE APPROVING AN AGREEMENT WITH GEORGE STOCK AND ASSOCIATES AND A PURCHASE ORDER WITH MICHAEL CONVY FOR SERVICES TO BE PERFORMED IN CONNECTION WITH THE DEVELOPMENT OF THE TOWN SQUARE SITE DEVELOPMENT PLAN, AND AMENDING THE 2017 BUDGET BY INCREASING A CAPITAL IMPROVEMENTS FUND EXPENDITURE ACCOUNT AND APPROPRIATING FUNDS TO COVER THE INCREASE (sponsored by the Board as a Whole) Mayor Dalton called for a second reading, without objection. Upon Alderman Rallo s inquiry, Mayor Dalton confirmed that because the agreements under consideration are for professional services, bids were not required. The motion carried unanimously and Bill No became Ordinance No NEW BUSINESS BILL NO , AN ORDINANCE APPROVING THE PRELIMINARY SITE DEVELOPMENT PLAN FOR PROMISE CHRISTIAN ACADEMY, LOCATED AT SOUTH OUTER FORTY (sponsored by Aldermen Benigas, Rallo and Meyland-Smith)

Brandon Harp, CEDC, utilized a PowerPoint presentation to give an overview of the project. An aerial view with a superimposed site plan was shown and described, as well as proposed elevations and the landscaping plan. He explained that the school was amenable to a request from Alderman Meyland-Smith that the light standards be lowered in an effort to lessen the impact on surrounding neighbors while still maintaining safety standards. Alderman Benigas inquired about feedback received from surrounding neighbors. In response, Ben Stegmann, Promise Christian Academy Board Member, stated that neighbor meetings were held prior to a Board of Adjustment variance hearing and all were supportive. He added that at the Planning & Zoning Commission meeting the issue of storm water mitigation was addressed, in addition to the suggestion about light standards. He explained that there would be no negative impact on surrounding properties from storm water runoff. Mayor Dalton declared Bill No continued to the meeting of Monday, May 22, 2017 for the second reading and consideration. BILL NO , AN ORDINANCE APPROVING A CONDITIONAL USE AND AUTHORIZING A CONDITIONAL USE PERMIT FOR AN ACCESSORY STRUCTURE, A POOL HOUSE, LOCATED AT 3000 TRAFALGAR DRIVE IN THE CITY OF TOWN AND COUNTRY (sponsored by Aldermen Mange and Wright) Mayor Dalton called for a first reading, without objection. BILL NO , AN ORDINANCE AUTHORIZING AN ENGINEERING SERVICES AGREEMENT FEE AMENDMENT WITH BURNS & MCDONNELL IN RELATION TO THE CLAYTON ROAD AT BALLAS ROAD CROSSWALK IMPROVEMENTS PROJECT (sponsored by Aldermen Wright and Mange) Mayor Dalton called for a first reading, without objection. Without objection, Bill No was read for the first time by title only. Mayor Dalton declared Bill No continued to the meeting of Monday, May 22, 2017 for the second reading and consideration. BILL NO , AN ORDINANCE AMENDING THE 2017 BUDGET BY INCREASING CAPITAL IMPROVEMENTS FUND REVENUE AND EXPENDITURE ACCOUNTS FOR INSURANCE PROCEEDS FOR A POLICE VEHICLE AND APPROPRIATING FUNDS TO COVER THE INCREASE (sponsored by Aldermen Crawford and Frautschi) Mayor Dalton called for a first reading, without objection. Without objection, Bill No was read for the first time by title only. Mayor Dalton declared Bill No continued to the meeting of Monday, May 22, 2017 for the second reading and consideration. RESOLUTION NO. R , A RESOLUTION APPROVING THE ADOPTION OF AN ACCEPTANCE OF PUBLIC ART POLICY FOR THE CITY OF TOWN AND COUNTRY Alderman Butler moved to continue the Resolution to the meeting of May
5 B o a r d o f A l d e r m e n P a g e 5 o f 6 M a y 8, Alderman Benigas seconded the motion and a voice vote carried. WARRANT LIST-05/08/17 Alderman Crawford moved for approval, seconded by Alderman Wright. Mayor Dalton called for any amendments. Hearing none, a voice vote was taken and the warrant list of May 8, 2017, in the amount of $220, was unanimously approved. OTHER Town Square Project-Discussion Utilizing a PowerPoint presentation, George Stock and Mike Convy displayed and described a site plan that was updated with the Board s recent comments. Mr. Stock pointed out the main changes to be the access to the site, the deletion of improvements along the east property line, removal of several parking spaces, and the addition of landscaping features to break up the plaza. He also noted that the previously proposed pavilion was decreased in size in order to accommodate public restrooms. He explained that a second pavilion with public restrooms was added on the opposite side of the property. Finally, he stated that the walking trail has been dropped onto the inside bank of the lake with an adjacent retaining wall proposed to be landscaped and include seating areas. Site lines from each adjoining property were shown to include berm elevations as well as current and proposed landscaping buffers. Mr. Stock noted that a meeting would be held with each individual property owner to discuss appropriate landscaping. Discussion was held about the safety of the trail s location in relation to the lake. Potential issues with the tunnel with respect to the location of utilities were discussed at length and pointed out on the site plan. Mr. Stock stated that soils and utility testing would be completed in approximately two weeks. Alderman Butler suggested connecting the southernmost point of the parking lot in a more direct fashion with the neighboring pavilion. In response to Alderman Meyland-Smith, Mr. Stock confirmed that a guardrail of some sort will need to be added because the tunnel s entrance is about 10 feet from the edge of the asphalt of Clayton Road. Alderman Meyland-Smith commended the addition of a maintenance building to make tools for upkeep readily accessible to staff. Discussion was held about the potential cost of adding a 30 in. tall retaining wall along the trail on the southern perimeter of the lake. City Administrator Gary Hoelzer explained that it was the City s hope that preliminary results from the soils and utility testing, along with a better understanding of potential tunnel costs, would be available for discussion on May 22. He added that discussion about commercial uses would be underway soon, possibly at an aldermanic retreat on June 3. In conclusion, he stated that if the Board could reach consensus, the plan could potentially go before the Planning & Zoning Commission in June. Mayor Dalton urged the Board and members of the public to forward additional comments to his, or Mr. Hoelzer s, attention.

Mange, Meyland-Smith, Rallo and Wright; NAY, none; ABSTAIN, none; ABSENT, none. The motion carried unanimously and the Board moved to closed meeting at 8:31 PM.
