1 BOARD OF ALDERMEN CITY OF TOWN AND COUNTRY FEBRUARY 9, 2015 WORK SESSION The work session meeting of the Board of Aldermen of the City of Town and Country was held at 6:30 PM on Monday, February 9, Present were: Aldermen Anderson, Crawford, Mange, Meyland-Smith, Rallo, Welby, and Wright. Alderman Benigas was absent. Mayor Dalton presided. City Attorney Steve Garrett represented the City. 1. Discussion-Regular meeting agenda items No votes were taken. REGULAR MEETING The regular meeting of the Board of Aldermen of the City of Town and Country was held at 7:00 PM on Monday, February 9, 2015 at the Municipal Center, 1011 Municipal Center Drive. PLEDGE OF ALLEGIANCE Susan Crandall, Ward 2 resident, led the pledge of allegiance. SPECIAL RECOGNITION Mayor Dalton recognized Alderman Crawford s birthday and asked everyone to join in singing to her. ROLL CALL The 7:05 PM roll call indicated Aldermen Anderson, Crawford, Mange, Meyland-Smith, Rallo, Welby, and Wright to be present. Alderman Benigas was absent. Mayor Dalton presided. City Attorney Steve Garrett represented the City. MINUTES 01/26/15 Alderman Welby moved for approval, seconded by Alderman Crawford. Mayor Dalton called for any corrections or amendments. Hearing none, the minutes of 01/26/15 were unanimously approved by voice vote. HEARING FROM CITIZENS Barbara Ann Hughes, 101 Hawthorne Estates, distributed two documents to the Board, Rochester Hills Deer-Motorist Related Accidents Decrease 25% and Averting Deer-Car Collisions in Town and Country, and gave an overview of the information. She also referenced the 2011 Deer Management Report and spoke about the projected costs included in the report as compared to actual dollars spent. Per Ms. Hughes request, both documents and the report are attached to and made a part of these minutes. Al Gerber, Mason Village Court, referenced his experience as an Alderman. He encouraged the Board to hold to the original sign regulations as they are written.

2 Board of Aldermen Page 2 of 7 February 9, 2015 Dorothy Cooke, 962 Delvin Drive, distributed photos depicting her backyard in both 2014 and 2015 and updated the Board about the solar array on an adjoining property. She spoke about her experience and urged the Board to consider the impact of approving new structures in residential areas. The photos and a related written statement are attached to and made a part of these minutes. Dr. Cooke also spoke about the City s new website and her concerns with its functionality and content. She expressed her desire to access more information in detail via the website as opposed to having to come to the Municipal Center in person, and her hope for its future progress. A related written statement is attached to and made a part of these minutes. Diane Elfenbein, Mason Estates, complimented City staff for being efficient and courteous. She spoke in opposition to the proposed Children s Specialty Care signs with regard to the design and necessity. PUBLIC HEARING(S) Mayor Dalton recused himself due to a perceived conflict of interest and left the dais. A public hearing on the application of Warren Sign Company, representing BJC HealthCare, owner, for variances from Chapter 420, the Sign Regulations of the Municipal Code for five wall business identification signs, one monument business identification sign and one Welcome wall sign for Children s Specialty Care located at 599 S. Mason Rd, in the Planned Medical Office (PMO) Zoning District. A court reporter with Midwest Litigation was present to record the hearing. Acting President Welby opened the public hearing. The City Clerk entered the following exhibits: 1. Typewritten notice of hearing posted at the Municipal Center and on the subject property, and mailed to property owners within 300 ft. of subject property, with a list of property owners attached. 2. Resolution No. R George Stock, Stock and Associates Consulting Engineers, and Jon Krone, Warren Sign Company, were present on behalf of the request. Utilizing a PowerPoint presentation, Mr. Krone detailed the how the project addresses the five items considered in granting a sign variance including the compatibility, appropriateness, legibility, appearance and safety. Examples of similar signage were shown as well as building views from various directions of travel. An aerial photo with the site plan superimposed was used to point out the location of each requested sign. Renderings of the requested signs were shown and explained as well as a sample of the aluminum face cabinet. Mr. Stock spoke about the changes to the request that were made in consideration of area residents. In response to Alderman Rallo, Mr. Stock explained that the placement of the building was parallel to the north outer road and pushed as far away from residences as possible. Alderman Anderson clarified that when approaching from the east, one would not see the sign until on or at the Mason Road ramp. Further discussion was held regarding the size and location of the signs relative to visibility from each direction of travel.

3 Board of Aldermen Page 3 of 7 February 9, 2015 Acting President Welby called for public comments. Sue Danner, 527 Windy Hill, spoke in opposition to the west wall sign. She stated that the examples shown depicted signs facing the highway not a residential area. Amanda Mueller, 328 Doulton, inquired about the necessity of the east and west wall signs and if any examples shown were specifically in the City of Town and Country. In response, Mr. Krone stated that the west wall sign was located on the most visible spot of the building and the east wall sign was for directing those from the ramp and intersection to the building. He added that none of the examples were within the City limits. Mariette Palmer, 604 Greenwich Green, stated that all of the comparison signage shown was located outside of city limits. She also inquired about the buildings name, as it had changed. Mr. Stock confirmed that the name is Children s Specialty Care. Mr. Stock explained that the Sign Code allows for signs to be 8% of the building s wall surface up to a maximum of 60 square feet, which does not allow buildings of that size to use 8% of the surface area. He added that all of the proposed signs are well under the 8% of the wall on which they are attached. Al Gerber, Mason Village Court, stated that he is a mathematician and gave an example regarding the line of sight calculations. He also urged the Board to look at the application closely. Hearing no further comments, the public hearing was closed. Mayor Dalton returned to the dais. APPOINTMENTS Mayor Dalton announced his intent to make the following appointments: Police Commission-Susan Crandall, Ward 2 Planning and Zoning Commission-, Amanda Mueller 4 COMMUNICATIONS AND REPORTS Alderman Welby Alderman Welby reported that due to President s Day, the Public Works & Stormwater Commission meeting would be moved to 7:00 PM on Tuesday, February 17, at the Longview Farm House. Alderman Wright Alderman Wright announced that the Parks & Trails Commission will be meeting at 6:30 PM on Monday, March 9, at the Longview Farm House. She further reported that the Public Art Commission would be meeting at 6:15 PM on Wednesday, February 11, at the American Kennel Club Museum of the Dog. She also stated that the Parks & Trails Foundation will meet at 5:30 PM on Wednesday, February 11, at the Longview Farm House. Lastly, she reported that the Art, Wine & Music was a fantastic event held by the Public Art and Community Relations Commissions. She added that the event was well attended and thanked staff. Alderman Crawford Alderman Crawford likewise noted that the Art, Wine & Music was a great event. She added that it was sold out and both the food and musician were wonderful.

Without objection, Bill No was read for the second time and placed upon its final passage. Alderman Wright moved for approval, seconded by Alderman Meyland-Smith. Alderman Mange moved to amend the Bill as follows:...during the month of August 2014, dated and sealed January 8 30, 2015 Alderman Anderson seconded the motion and a voice vote carried unanimously. R , A RESOLUTION APPROVING SIGN CODE VARIANCES FOR CHILDREN S SPECIALTY CARE Mayor Dalton recused himself and left the dais due to a perceived conflict of interest. Acting President Welby presided. Alderman Meyland-Smith moved for approval, seconded by Alderman Crawford. Alderman Meyland-Smith moved to accept Substitute Resolution R for consideration. Alderman Mange seconded the motion and a voice vote carried unanimously. Alderman Rallo stated that the name change was a positive one because it helps prevent confusion and point out that the facility is for specialty care and is not a hospital. She added that due to the orientation of the building, the size and placement of the signs were important for recognizing the purpose of the facility. Alderman Meyland-Smith reiterated the importance of the signage being very clear due to the many daily visitors to the facility. He also echoed Alderman Anderson s compliment to BJC for being both responsive and good neighbors. Alderman Meyland-Smith moved to amend the Substitute Resolution as follows: 13. Section A.11.c. states that letter sizes shall not exceed eighteen (18) inches in height. Plans show letters that range from inches to inches and a logo that is inches. A inch variance will be required for the letters and a inch variance will be required for the size of the logo.

6 Board of Aldermen Page 6 of 7 February 9, Plans show this sign to be square feet. A variance of square feet will be required for the size of the sign. Discussion was held regarding the lighted signs being extinguished during certain times. The following addition was made to the motion to amend: 20. These sign code variances are granted on the condition that the east and west wall sign s illumination will be extinguished between the hours of 9:00 PM and 6:00 AM. Alderman Anderson seconded the motion to amend and a voice vote carried unanimously. A voice vote was held on the Substitute Resolution, as amended, and carried unanimously. Mayor Dalton returned to the dais. BILL NO , AN ORDINANCE ACCEPTING THE BID AND AUTHORIZING AN AGREEMENT WITH T. HILL CONSTRUCTION FOR THE HORTON LANE DRAINAGE IMPROVEMENTS (sponsored by Aldermen Mange, Wright & Welby) Mayor Dalton called for a first reading, without objection. Without objection, Bill No was read for the first time by title only. Mayor Dalton declared Bill No continued to the meeting of Monday, February 23, 2015 for the second reading and consideration. APPROVAL OF A PURCHASE ORDER Alderman Welby moved for approval of a purchase order to Lou Fusz Commercial Network in the amount of $39,538.00, for a one (1) Chevrolet Silverado HD3500 truck. Alderman Meyland-Smith noted for the record that the item was included in the 2015 Budget. Alderman Crawford seconded the motion and a voice vote carried unanimously. BILL NO , AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 370 OF TITLE III OF THE MUNICIPAL CODE OF THE CITY OF TOWN AND COUNTRY, MISSOURI, SPECIFICALLY SECTION RELATING TO VEHICLE EQUIPMENT (sponsored by Aldermen Anderson & Crawford) Mayor Dalton called for a first reading, without objection. Without objection, Bill No was read for the first time by title only. Mayor Dalton declared Bill No continued to the meeting of Monday, February 23, 2015 for the second reading and consideration. WARRANT LIST-02/09/15 Alderman Rallo moved for approval, seconded by Alderman Wright. Mayor Dalton called for any amendments. Hearing none, a voice vote was taken and the warrant list of February 9, 2015 in the amount of $183,006.92, was unanimously approved by voice vote. OTHER

BARNETT, MAYOR FOR IMMEDIATE RELEASE October 6, 2011 Media Contact: Tara Beatty Phone: (248) beattyt@rochesterhills.org Rochester Hills Deer-Motorist Related Accidents Decrease 25% Rochester Hills, Michigan- With the arrival of fall, comes the inevitable increase in deer activity, with October and November being the most dangerous months in Michigan for deer/vehicle crashes. Rochester Hills has done its part in educating residents in the previous years and the efforts are showing significantly positive results. According to the data provided by The Southeastern Michigan Council of Governments (SEMCOG), the DeerNehicle Crash (DVC) awareness campaign has resulted in an improvement in the safety of residents and the driving public. The recently released data for the 2010 DVC indicates that despite a 34% increase in the Rochester Hills deer herd numbers since 2009, the city shows a 25% reduction in DVCs. That decline far surpasses those of Oakland County (-5.7%) and the SEMCOG region (-7.6%) as a whole. "The distinct variable that has set Rochester Hills apart from other areas has been the intense driver awareness campaign that was championed by their Deer Management Advisory Committee (DMAC)," states Mike Hartner, Parks and Forestry Director. The Rochester Hills administration, with the support of City Council, has worked alongside the DMAC by utilizing all of its media resources and by installing highly visible deer crossing signs at every "hot spot" throughout the city. Additionally, in 2010 the city coordinated the "Don't Veer for Deer" campaign and arranged for changeable message board signs that warn motorists not to veer for deer. These signs were displayed at multiple locations during the rut season of October and November and will be used again in "Our strategy and awareness campaign is working and over time has produced tremendous results in improving the safety of our residents and driving public," states Mayor Bryan K. Barnett. Drivers are reminded once again this season, in the event you encounter a deer in your path, "Don't Veer for the Deer." Statistics show that most motorist injuries occur when drivers swerve to avoid hitting a deer and, instead, hit a ftxed object such as a tree or another vehicle. Motorists are encouraged to keep a lookout for the message boards and remain alert in deer crossing zones. 12 "'"""~~ J ~~{,.;,.(~,.,.,~~ THE HUMANE SOCIETY OF THE UNITED STATES Averting Deer-Car Collisions in Town and Country Written by Laura Simon, Wildlife Ecologist (1/10/2015) It seems counter-intuitive, but reducing the deer population doesn't necessarily result in fewer deer- car collisions. A study done by the Virginia Department of Transportation (VDOT) assessed hunting pressure, deer density, and other factors for 228 road segments (each 250 miles in length) to see which correlated with deer-vehicle collisions. The surprising result was that deer density was a non-significant factor and that "there is little evidence that increased deer harvest reduced deer/vehicle collisions (McShea et al. 2007). " The problem is that many factors contribute to deer car collisions, such as traffic volume and speed, extent to which roads bisect habitat, development patterns, extent of visual barriers, speed limit, etc -which is why merely reducing the deer population does not necessarily result in fewer collisions. Solutions for lowering the accident rate should start by collecting information on the number and location of deer-car collisions, and assessing what habitat and road features may be contributing to the accident rate and "hotspots." DIRECTORS Solutions should be tailored to particular sites, and include lowered speed limits, removal of visual barriers (such as shrubs and other vegetation which may block driver sight lines), and the use of motion-activated warning devices which alert drivers (and deer) to the oncoming presence of each other. As part of a public education program, drivers should be advised to be vigilant when driving at dawn and dusk, and that when one deer crosses the road others may follow. A Model Solution for Town and Country The City of Rochester Hills, Michigan, created a highly successful program to reduce deer-car collisions and backyard problems. Key components included highly visible deer warning signs at collision hot spots, removal of sightline barriers, along with a well- publicized "Don't Veer for Deer" educational campaign. 14 Utilizing professional sharpshooters Time to achieve population goal: 2 years I 350 deer killed Cost to achieve population goal: $161,500 (includes processing) Annual cost to maintain goal: $17, deer Summary Contracting with a professional wildlife management company that specializes in sharpshooting is the quickest and most effective method of quickly reducing the deer population in an urban area. Within two years the problems associated with an overpopulation of deer-over browse, ecological imbalance, property damage, and the threat to public safety due to vehicle collisions; will either be reduced or eliminated. The cost estimates in this section were provided by White Buffalo. Background As stated in the final report of the West St. Louis County Deer Task Force, 'If the goal of a deer management program is to decrease deer numbers quickly, sharpshooting is the best method to use' (p.so). Reducing the deer herd to 30 deer I mi2 would cost approximately $161,500 over a two-year period utilizing a contractor like White Buffalo. This cost includes $31,500 to process 350 deer for the Share the Harvest program that supplies food to needy families who may otherwise lack a dependable source of protein. The optimal period for sharpshooting is in the heart of winter-from mid January to early March. Going forward once the population goal is attained, the annual projected cost to maintain the deer population at acceptable levels utilizing professional sharpshooters would cost approximately $17,000. 15 Gira Solar Array Update Board of Aldermen 2/9/2015 Good Evening... it's time for the annual update on the ground mounted solar array on the property adjoining mine. This is the 4th update. Some of you are not familiar with this issue so I printed a few of last years photos to give you an idea of my view of the solar array for the last 4 years. To allow this structure,multiple landscaping parameters were attached to the bill. So tonight there is good news... as you can see from the recent photos... the solar array is finally concealed to what I consider an acceptable level. I don't know how long it will last but it's been good now for the last 6 or 7 months... usually by now plantings were dead or dying... so I have great hope. I'm sure you all wonder why I keep bringing this to your attention. The reason is this: Many less than eye-pleasing projects go on in every community, most often in and around commercial areas or with building on previously vacant land. This structure from its inception til its current form has been 6 years in the making. It is in a residential area totally surrounded by lovely homes on 1 acre + lots that are impressive for their natural beauty and peacefulness. It is that natural beauty and peace that drew me to Town and Country 28 years ago with the idea that in my /lgolden" years I would have that beauty and peace to freely enjoy. When you are 30, 40 even years may not seem a long time, but when you are approaching 70, it can be and for many, it is a lifetime. I want you all to think about this when you approve building in Town and Country's beautiful, peaceful residentia I areas. I hope there is no fifth annual update.

16 Comment regarding the new website: Board of Aldermen 2/9/15 1. It looks very nice 2. The sign in procedure necessary to be able to access information from the site is a bit daunting and reasonably off-putting... but those of us with dull lives and several addresses are not deterred. 3. I understand it is new and is therefore a work in progress... so I would like to let you know what I would like to be able to do with the website. My earnest hope is that someday the website will provide detail (not all or every detail), but sufficient detail on projects and agenda items so that one does not have to come up to the City Hall to get a good sense of what is entailed. An example: I noted on tonight's agenda that my 2 Ward 1 aldermen are sponsoring a bill to approve and record a record Plat for Rosewood Acres. Since they are Ward 1, I assume that this is in Ward 1 and I am interested in what that might be. I went to the minutes and agendas and looked at Planning and Zoning, Board of Adjustment and Board of Aldermen for 9/1/14 to 2/ search says "no results found" So I went to the home page and searched for Rosewood Acres... answer... 3 results... the B of A agendas for 1/12, 1/26 and tonight all of which say the same thing with no further indication of what or where this is. The old website attached the actual bills to the agendas so you could get more information. This is no longer so... perhaps it's coming and just not there yet. But, my early assessment of the website is that it is off-puttng and unhelpful. Always... thank you for listening and for being here.
