Discuss a proposed private burial site at 8800 Rolling Rd, request by Douglas D. and Sharon R. Laird. Discuss request for telephone system upgrade for Iowa Department of Human Services. Discuss a Citizen Review Board for the Linn County Water and Land Legacy Bond. Discuss and decide on the Urban County Coalition's 2017 State Legislative Priorities Report on the purchase of real estate that was the subject of prior sessions of the Board of Supervisors that were closed pursuant to Iowa Code 21.5(1)(j) PUBLIC COMMENT: 5 Minute Limit Per Speaker This is an opportunity for the public to address the Board on any subject pertaining to Board business. 15 Prepared by and to be returned to: Mike Tertinger, Linn County Planning & Development 935 2nd Street S.W., Cedar Rapids, Iowa (319) RESOLUTION APPROVING A PRIVATE BURIAL SITE MAINTENANCE AGREEMENT RESOLUTION # WHEREAS, a Private Burial Site Maintenance Agreement executed by Douglas D. and Sharon R. Laird, husband and wife, (both hereinafter referred to as Laird ), has been submitted for approval affecting property legally described therein. AND WHEREAS, said Private Burial Site Maintenance Agreement has been found to conform to the requirements of the Linn County Unified Development Code, specifically Article 6, section 4 Standards for Institutional and Civic Uses, paragraph 15. AND WHEREAS, Laird has agreed to the creation of a Private Burial Site Maintenance Agreement which identifies Laird, or the current deed holder(s) of the property, as the persons responsible for the preservation and protection of the burial or grave site for themselves only. Laird, or the current deed holder(s) of the property agree to hold Linn County harmless for all cost, liability, or expense incurred for such preservation and protection of the burial or grave site. AND WHEREAS, Laird did grant a perpetual easement to and from such burial or grave site from and to the public thoroughfare abutting the subject property described in the Private Burial Site Maintenance Agreement for the benefit of members of the Laird family and future visitors to such burial site. The actual grave site shall be located as shown on the site plan appended thereto as Exhibit A and is an approximate dimension of twelve (12) feet N-S and ten (10) feet E-W. AND WHEREAS, Laird agrees to file the Private Burial Site Maintenance Agreement with the Linn County, Iowa Recorder in order to provide constructive notice of the maintenance responsibility for and location of the grave site on Exhibit A and to designate the property as a private burial site pursuant to the requirements of the Linn County Unified Development Code. NOW, THEREFORE, BE IT RESOLVED, by the Linn County Board of Supervisors that said Private Burial Site Maintenance Agreement is hereby approved.
