PZ2018-5: A Public Hearing to consider a map amendment (rezoning) for an approximate acre tract of land located at Woodhaven Lane in the City of Pacific (Franklin County Parcel Ids and ). The property is generally bounded by Silver Lakes Subdivision to the north, Riverbend School to the east, and private residential properties to the south and west. The applicant is requesting a change from the current zoning, R-1E Single Family Estate District, to R-1C, Single Family Residential. Rich Gullet & Sons, Inc., applicant. 5. 3 CITY OF PACIFIC RECORD OF PROCEEDINGS REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION AT THE PACIFIC CITY HALL, 300 HOVEN DRIVE JANUARY 23, 2018 The Planning and Zoning Commission Meeting was called to order by Chairman Bruns at 7:02 P.M. on January 23, 2018, at Pacific City Hall, 300 Hoven Drive, Pacific, Missouri. The roll call was taken with the following results: PRESENT Chairman Bruns Alderman Chlebowski Commissioner Smith Commissioner Miles Commissioner Koelling Commissioner Graham Commissioner Bates Commissioner Eversmeyer ABSENT Administrator Steve Roth, Attorney Lumley, and Rae Cowsert were also in attendance APPROVAL OF MINUTES A. Planning & Zoning Meeting January 9, 2018 A motion was made by Alderman Chlebowski and seconded by Commissioner Eversmeyer to approve the minutes of the January 9, 2018 Regular Planning and Zoning Meeting. A voice vote was taken and the motion was approved 8-0. PUBLIC HEARINGS: 1. PZ : A Public Hearing to consider an application for approval of a Lot Consolidation Subdivision Plat, proposing to combine five existing tracts of property into one lot of acres. The five existing tracts are described as Part of Tracts Allenton Acres, in Section 8, US Survey 148 Township 43 North, St. Louis County, MO and are generally located at US Highway 66, 5882 Hill

4 View Drive, 5844 Hill View Drive, 5840 Hill View Drive and 5836 Hill View Drive, Pacific, MO. ADB Companies, applicant. Chairman Bruns introduced the public hearing and asked if it was posted. Rae Cowsert stated it had been posted. Chairman Bruns asked Administrator Roth for the staff report. Administrator Roth stated he would give both staff reports together for ADB Companies. Chairman Bruns opened the second public hearing for ADB Companies. Administrator Roth stated the plat is a simple plan. There does not seem to be any issues and the easements appear to be fine. The City would recommend approval of this Application. 2. PZ : A Public Hearing to consider an application for a PUD-PDM zoning approval for development of an approximate 15-acre site (as described in the proposed Lot Consolidation Plat above) for light industrial and office uses. The property is located at U.S. Highway 66 and is generally bounded by Eureka Fire Protection District property to the east, Hill View Drive to the west, and residential property to the north. The project includes construction of an approximate 20,370 square foot office building, an approximate 26,400 square foot maintenance building, parking area improvements, storm water detention facilities, fenced outside storage, and other improvements. ADB Companies, applicant. Chairman Bruns previously opened this public hearing along with the first application. Administrator Roth continued to present the staff report. The entrance to the Employee parking lot is proposed to be from Hill View Drive, as MoDot would not approve access from Highway 66. Administrator Roth also stated there currently is no water source to the property but the sewer is in place. Hill View Drive is a St. Louis County road and they have given preliminary approval for access to the parking lot from Hill View Drive. The office building will be constructed from concrete and glass. The maintenance building will be metal. The proposed plan for the parking lot does not meet the City code in two areas, there is no vertical curb around parking lot and there is no landscaping within the lot proposed. Administrator Roth stated this project would be a welcome addition to the community and there will be buffers against the existing properties. The staff recommends approval. Lenny Mears, engineer for ADB, talked about the redevelopment of the property. The plans are currently for a 35,000 square foot, two story office building constructed of concrete panels and glass. The maintenance building will have 10 bays for repair of ADB equipment only. Mr. Mears stated MoDot did not approve three accesses from Highway 66. St. Louis County has potentially approved access from Hill View Drive. Equipment vehicles will be entering and exiting from Highway 66. The plan calls for a buffer from the creek to the north property line with an 8 foot vinyl fence on top. There will be trees on the outside of the fence. The storage lot in back of the maintenance will be rock with a void in the rock for a detention area. There will be a wet lake in the front for a detention area for the office building, front parking lot and employee parking lot. Also in the plan is a five foot pathway around for employee walking and exercise area. The proposed lighting on the site is to have 42 foot poles with LED lights on them. All of the lights will be directed toward the site only and shielded from the residential area. Commissioner Smith stated Highway 66 has been deadly for some time and the county road may have to be improved. Chairman Bruns asked Mr. Mears how many cars would use it everyday. Mr. Mears stated there are approximately 144 employees. Commissioner Bates stated he owns property on Hill View Drive and would not be voting on this issue. Alderman Chlebowski commented about having curb along the office

5 building. Chairman Bruns stated she is concerned about the traffic and asked how far down Hill View Drive the entrance would be. Mr. Mears stated the drive is approximate 300 feet from Highway 66. Alderman Chlebowski stated the traffic should be going against each other. Commissioner Koelling questioned if Hill View Drive would stand up to the traffic or should it be widened. Chairman Bruns questioned the use of gravel on the back lot. Alderman Chlebowski stated the Board of Aldermen changed the ordinance to allow gravel. William Scholan from 5710 Hill View Drive, is concerned about drainage in to the creek and flooding. He also is concerned about the noise at 6 a.m. in the mornings. He also wants to know who will keep Highway 66 clear of dirt and rocks. Connie Abeln, 5815 Hill View Drive, voiced concerns about the access from Hill View Drive and the culvert which has been fixed several times already. She also has concerns about flooding. Tony French, 5665 Hill View Drive, stated he was here when the Board of Aldermen and ADB said there would not be any access from Hill View Drive. He feels the trees should be along the road. He also feels the hours of operation should be courteous to the residents in the area. He would like to see a larger buffer area along Hill View Drive. Pat Croat, 5600 Hill View Drive, stated she would like the city to reconsider allowing this development to go on this property. She also stated she is not in favor of the entrance from Hill View Drive. Dr. Tom Croat, 5600 Hill View Drive, stated his main concern is the entrance from Hill View Drive. Dana French, 5665 Hill View Drive, chose not to speak. Tim Diggs did not fill out a speaker card, but asked the commission what would stop other properties from being approved for M-1 zoning. Administrator Roth stated he does not see that being an issue. Alderman Chlebowski stated the property was rezoned to M-1 when it was annexed into the City. Commissioner Smith stated he feels the property values will increase in the area. Highway 66 will be growing from East to West. He stated there are no easy answers to difficult questioins. There being no further comments or questions, Chairman Bruns closed the public hearings for ADB. 3. PZ2018-4: A Public Hearing to consider an application for a Conditional Use Permit for retail firearms sales to be located at 115 W. St. Louis Street. AX2 Sporting Arms, LLC, applicant. Chairman Bruns opened the public hearing and asked if it was posted. Rae Cowsert stated it was posted. Administrator Roth presented the staff report. The proposed building is located between Nettie Suze and the library. The City code is silent on this proposed use. Administrator Roth went through the Seven Finding of Fact. Administrator Roth stated the Comprehensive Plan does make Downtown revitalization a priority. He stated the zoning code for the Downtown area does need to be addressed.

6 Commissioner Smith stated the applicant has taken an under utilized space and made it very nice. The building has been opened back up and already has a vault in it. The applicant plans to put decorative rails on the windows. He feels it is a really cool thing to have Downtown. Commissioner Eversmeyer stated retail is retail. It is not a resale shop and therefore it will be highly regulated. Commissioner Bates feels it will draw people to the Downtown area. He also stated the Pawn Shop sells guns as well. Alderman Chlebowski stated he is concerned due to the amount of gun shops that have been broken in to in the St. Louis area. The security has to be a priority. Alderman Chlebowski feels it fits out City well and just wants to make sure it will be secured well. Commissioner Koelling stated growing up there were shops in all of the buildings downtown. He stated we have the opportunity to bring another business to town and is happy someone wants to come to town. Brad Reed, 116 Janey Lane, stated he doesn t feel it is the Commissions place to tell someone how to run their business. The Pawn Shop has not had any issues. Mr. Reed has a business across the street and stated he has talked to several of the other business owners in the downtown area, and no one voiced any concerns with this business coming to town. Mr. Reed stated he will welcome him to town. Alderman Chlebowski stated he does not want to see crime come to town. Commissioner Smith stated the security is controlled by State Laws. There being to further comments or questions, Chairman Bruns closed the public hearing. SPEAKER CARDS The speakers were included in the public hearing comments. NEW BUSINESS: 1. PZ : Consideration of an application for approval of a Consolidation Subdivision Plat of five lots into one lot located at U.S. Highway 66. ADB Companies, applicant. Commissioner Bates stated he would be abstaining from the vote. A motion was made by Commissioner Eversmeyer and seconded by Alderman Chlebowski to approve the application as proposed. A vote was taken with the following results: Yays, Commissioner Eversmeyer, Chairman Bruns, Alderman Chlebowski, Commissioner Smith, Commissioner Miles, Commissioner Koelling, Commissioner Graham; Nays, none; Abstain, Commissioner Bates. The motion was approved 7-0 and will be presented to the Board of Aldermen on February 6, PZ2018-3: Consideration of a Planned Unit Development-PlannedDistrict Manufacturing for construction of an office building and a maintenance building for light industrial to be located at U.S. Highway 66. ADB Companies, applicant.

7 Alderman Chlebowski asked the engineer to clarify the setbacks. Mr. Mears stated the property line is 10 foot from the roadway and the buffer and fence are behind that. The Commission is still concerned about the traffic and safety. Alderman Chlebowski stated they cannot put conditions on ADB for the roads. The City has no control over the roads. He stated the best they can do is to relay their concerns to MoDot and St. Louis County in regard to safety. A motion was made by Commissioner Eversmeyer and seconded by Commissioner Smith to approve the application as presented. A voice vote was taken with the following results: Ayes, Chairman Bruns, Alderman Chlebowski, Commissioner Smith, Sommissioner Miles, Commissioner Koelling, Commissioner Graham, Commissioner Eversmeyer; Nays, none; Abstain, Commissioner Bates. The motion was approved 7-0 and will be presented to the Board of Aldermen on February 6, Alderman Chlebowski stated to the commission that he would relay their concerns to the Board. 3. PZ : Consideration of a Planned Unit Development-Planned District Residential (PUD-PDR) to be located at 2305 Old Gray Summit Road. Stonebridge Custom Homes, applicant. Administrator Roth stated the applicant called and asked that this be tabled until the next meeting. COMMITTEE REPORTS A. Board of Aldermen Alderman Chlebowski stated the Board has discussed working on the zoning to meet the Comprehensive Plan in order to simplify it. Commissioner Bates stated not to promise something and then allow it. Their reputation will be tarnished.

8 B. Board of Adjustment There are currently two Variance applications which are scheduled to be heard on January 31, 2018, at 9 a.m. in the Board Room. OTHER BUSINESS Administrator Roth stated there will be a meeting on February 13 and Stonebridge will be back on that agenda. The Commission stated the 24 foot streets and 6 foot setbacks will not be approved. ADJOURNMENT Chairman Bruns stating there being no further discussion asked for a motion to adjourn. A motion was made by Alderman Chlebowski and seconded by Commissioner Miles. A voice vote was taken and the meeting was adjourned at 9:20 p.m. Jerry Eversmeyer, Secretary
