1 MINUTES OF THE CITY OF FRONTENAC BOARD OF ALDERPERSON APRIL 19, 2016 The April 19, 2016 regular meeting of the Board of Alderpersons of the City of Frontenac was called to order at 7:00 p.m. with Mayor Keith Krieg, presiding. The Alderpersons present were Chris Kehr, Bud Guest, Mike Schoedel, John O Connell, Margot Martin and Tom O Brien. Also in attendance was City Administrator, Bob Shelton; City Clerk, Leesa Ross; City Attorney, Kevin O Keefe; Fire Chief, Jack Trout; Police Chief, Tom Becker; Building Commissioner and Zoning Administrator, John Morgan; Public Works Director, Jeff Wappelhorst and Finance Officer, Lea Ann Layden. After the Pledge of Allegiance, Mayor Krieg asked for a motion to approve tonight s agenda. A. MOTION TO APPROVE AGENDA Alderman O Brien asked that item #3 under new business be moved to item #1 under new business and stated the reasoning is it matches the numbering of the public hearing. MOTION: Alderperson O Brien motioned and Alderperson Guest seconded to amend tonight s agenda by moving item #3 under new business to item #1 under new business. All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. MOTION: Alderperson Martin motioned and Alderperson Schoedel seconded the approval of tonight s agenda as amended. All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. B. VOTE TO APPROVE MINUTES: Tuesday, March 29, 2016 MOTION: Alderperson Schoedel motioned and Alderperson Martin seconded the approval of the minutes. All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED.

3 D. VOTE TO APPROVE ELECTION RESULTS Mayor Krieg asked for a motion to approve the certified results of the April 5, 2016 municipal election. MOTION: Alderperson Schoedel motioned and Alderperson Martin seconded to approve the certified election results from the April 5, 2016 election. All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. Mayor Krieg presented plaques to outgoing Aldermen Mike Schoedel and Chris Kehr. Mr. Kehr served for many years on the Public Works Commission and was appointed Alderman after the death of Alderman Hizar. Mr. Schoedel served on the Ways & Means Committee and the Public Works Commission. Mr. Schoedel worked for the City of Frontenac from 1996 to 1999 serving as city administrator and went on to serve as City Manager for the Cities of Richmond Heights and Clayton. Mayor Krieg thanked them both for their service. E. SWEARING IN OF NEWLY ELECTED OFFICIALS Ms. Ross swore in Alderperson Brian Warner, Alderperson Margot Martin and Alderperson David Bray. F. ROLL CALL Mayor Krieg asked for a roll call. Roll Call: Alderperson Bray, Alderperson Guest, Alderperson Warner, Alderperson O Connell, Alderperson Martin and Alderperson O Brien, all present. G. PUBLIC HEARING Ms. Burkhart of Huntleigh Downs thanked former Aldermen Kehr and Schoedel for their service. She stated this has been quite a process regarding the Ladue Early Childhood Property. She stated the process has been tedious and arduous and through the process most residents are comfortable with low density villas. Ms. Culleton of Spoede Road stated they need a plan before they rezone. She said she was told she will not be a part of the rezoning. Mr. Samuels of Capitol Place stated the historic nature of Frontenac will change if multi-family homes are allowed. He said the Board will be setting precedence for the entire area of Frontenac and said this is not in the historical character of the City. He said he is opposed to the proposed ordinances. 4 Mr. Schaumburg of Spoede Road said he is opposed to assisted living and said the board was giving in to villas. He said he hopes they follow through with R-3 villas and no assisted living. Mr. Friedman of Hermitage Hill said he feels betrayed that the alderman did not come to the citizens to get their opinion. He said petitions were submitted regarding the change of zoning. He said the government does not want to listen to the citizens. Mr. Vince Keady said he represents the applicants who filed an application with the city for a planned development district with villas and an assisted living facility. He said he has a copy of the staff report approved by the Planning & Zoning Commission. He said on September 16, 2015, they filed a plan. He said on October 20, 2015 a moratorium was approved. He said the Planning & Zoning Commission studied the site. He said in the Planning & Zoning Report, states villas are not economically feasible for the LECC and their recommendation was to move forward with assisted living. He said their application was on hold because of the moratorium. He said tonight there is a proposal to change PDR zoning and to remove senior living community. He said there is a proposed bill to also go forward with rezoning the property to R- 3. He said the city is taking away his clients rights, and asked them to consider the Planning & Zoning Commissioners report when voting. Ms. Lisa Berns, an attorney representing the Ladue School District, read a statement, which is attached. Mr. Ballman of Lynnbrook stated it is the responsibility of the board to keep the integrity of Frontenac. He said he does not want the city to rezone the property to be economically feasible. He said we don t need the money for a commercial property. He said any changes from R-1; we are trying to meet the economic needs of others. MOTION: Alderperson Martin motioned and Alderperson Guest motioned to adjourn the public hearing. All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. H. PUBLIC FORUM (PRESENTATION OF REMARKS AND/OR PETITIONS) Judge Gaertner and Mr. McHenry of Devondale Lane stated they were the trustees of the subdivision and they have a lot of cut through traffic from Bopp to Clayton Road. He said they have received a number of complaints from the residents. He said gates and speed bumps are not an option. Judge Gaertner said the trustees and neighbors of the subdivision are in favor of the bill which is on tonight s agenda. Mr. Schoedel of Portland Drive stated he would like to facilitate and form a group to improve the roundabouts off of Spoede and the North Outer Road. He said he would like to form a group of resident to put in plants to beautify the roundabouts, and will work with the city. PAGE 4 OF 14

5 Mr. Samuels of Capitol Place asked for an explanation of the city holding secret meetings between city officials and developers. He said city officials and Pulte held a meeting to put duplexes in the quarry. Mayor Krieg stated the City has received no proposals. Mr. Samuels asked why the meeting was not publicized. Alderperson Guest stated the city has plenty of meetings with potential developers, and said it s just how the city works. Mr. Samuels asked who attended the meeting. Mr. Shelton stated the attendees were Alderperson Guest, Alderperson Martin, Mr. Shelton and Mr. Morgan. He reiterated that there is no proposal before the Board. Alderperson O Connell stated meetings such as this, are scheduled a lot. He said it is custom in municipal government to have exploratory discussions with city officials, and said they go on every day, and that some are planned in advance. Alderperson O Connell stated until a proposal is presented, it is a waste of time to have the entire city involved. Mr. Samuels asked Mr. Shelton for the agenda. Mr. Shelton stated there was no agenda. I. MAYOR S COMMENTS 1. Service Award to Corporal Todd Nothdurft of the Frontenac Police Department for 20 years of service to the City. Chief Tom Becker stated Todd was employed by the City on April 22, He graduated from McCluer North High School and the University Missouri St. Louis. He was appointed to acting corporal in 2007 and promoted to corporal in September He is the part-time watch commander and also serves as one of three firearm instructors. He said Todd has a number of letters, thanks and commendations in his file. Todd was presented with a plaque, and flowers were given to Todd, to give to his wife Ruth. Everyone congratulated Todd. 2. Introduction of Floyd Blake the newly appointed Captain of the Frontenac Fire Department. Chief Trout stated Floyd was appointed to the fire department in 2011 and served previously as a volunteer firefighter in Pacific. He said he served from 2009 to 2015 in the Meramec Ambulance District. Chief Trout said after a recent retirement, there was an opening for a new captain. He said after testing and interviews the best candidate was selected. He said Floyd brings a great deal of leadership. He said Floyd is the father of two children. Chief Trout stated Floyd will do a great job for the city, the fire department and the residents. Everyone congratulated Floyd. Mayor Krieg stated he has an aldermanic vacancy on the Planning & Zoning Commission and said he would like to appoint Alderperson Guest to serve. He asked for a motion from the Board. MOTION: Alderperson Bray motioned and Alderperson O Brien seconded the appointment of Alderperson Guest to serve as the aldermanic representative to the Planning & Zoning Commission. 6 J. COMMENTS BY BOARD OF ALDERPERSON MEMBERS No comments were made at this time. K. REPORTS OF OFFICERS AND COMMITTEES AND APPROVED MINUTES 1. Planning & Zoning Commission: February 23, Ways & Means Committee: March 8, Public Works Commission: None 5. Building Commissioner & Zoning Administrator March 2016 Mayor Krieg stated the above reports will stand as submitted. L. CITY ADMINISTRATOR S REPORT 1. Finance Report Ms. Layden stated monthly revenues are lower than budget by $40,000 or 8% and are mainly due to sales tax and court fines. Monthly revenues are below March 2015 by $219,000 or 33% which is mainly due to sales tax, grant revenue, PILOT payments and court fines. Year to date revenues have underperformed budget by $11,000 or.2%. Year to date revenues are lower than last year by $503,000 or 8%, mainly due to real estate, road & bridge tax, grant revenue and court fines. The monthly expenses are below budget expectations by $23,000 or 3%. Monthly expenses are higher than March 2015 by $160,000 of 31.9% due to three payrolls in March 2016 versus two payrolls in March Year to date expenses are lower than budget by $124,000 of 2% and year to date expenses are higher than last year by $236,000 of 5%, mainly due to payroll and fire department overtime. Sales taxes for March were slightly below budget due to some non-reporting but are slightly up year to date compared to budget. Ms. Layden stated looking ahead to sales tax received in April, which are not reflected in March financials, the one-cent sales tax for April are 10% over budget and the others are outperforming budget by almost 2%. Year to date sales taxes have outperformed budget by 1.6%. 2. City Administrator s Report Mr. Shelton stated he would like to remind the Board of Aldermen and the residents of the Frontenac Festival, which will be held on Saturday, May 14 th from 11:00 am to 2:00 pm. He said we will also have a shred truck event that day from 8:00 am to 10:45 am. He also stated we have a giveaway that reflects Frontenac being named, the Happiest City in America. Alderperson Martin asked about collection of expired prescription drugs. Chief Becker stated the City of Ladue has a permanent drop box in their lobby. PAGE 6 OF 14

7 M. UNFINISHED BUSINESS None N. NEW BUSINESS: 1. Bill No : An ordinance amending Section of the Code of Ordinances of the City of Frontenac, Missouri, pertaining to Planned District Zoning Regulations. Mr. Shelton stated this was the subject of the public hearing; however there was no recommendation on this matter by the Planning & Zoning Commission. He said in this bill, senior living was removed from the PDR. This is an ordinance previously reviewed by the Board of Alderpersons. City Clerk Ross gave the first reading of Bill No Mayor Krieg asked for a motion for a second reading. MOTION: Alderperson O Connell motioned and Alderperson Martin seconded approval of the second reading of Bill No All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. Mayor Krieg asked City Clerk Ross to give the second reading of Bill No Bill No : An ordinance amending Section of the Code of Ordinances of the City of Frontenac, Missouri, pertaining to Planned District Zoning Regulations. Bill No became Ordinance No Bill No : An ordinance amending Article II of Chapter 405 of the Code of Ordinances of the City of Frontenac, Missouri, to adopt regulations for the R-3 Villa Residence Zoning District. 8 City Clerk Ross gave the first reading of Bill No Mr. Shelton stated this bill creates a new R-3 zoning classification. He said it was favorably recommended by the Planning& Zoning Commission at their meeting on April 11, He said any use in R-1 is allowed villas at 3 ½ units per acre, with no more than two units attached. He also said the minimum will be five acres for any R-3 development. Mayor Krieg asked for a motion for a second reading. MOTION: Alderperson Martin motioned and Alderperson O Connell seconded approval of the second reading of Bill No All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. Bill No became Ordinance No Bill No : An ordinance to rezone properties known as Clayton Road, the rear lot of Clayton Road and Clayton road from R-1 Single Family Residence to R-3 Villa Residence Zoning District. City Clerk Ross gave the first reading of Bill No Mr. Shelton stated this will rezone the LECC school property, which is nine acres, to the R-3 zoning classification. He said proposals for redevelopment will be accepted. He said the Planning & Zoning Commission did not make a recommendation on this bill nor did they elect to rezone the property at 1408 S. Spoede, which was requested by the owner. That property will remain R-1. The entire property being considered is currently owned by the Ladue School District. PAGE 8 OF 14

9 Alderperson O Connell stated there is nothing barring the process to happen to add adjacent parcels to the R-3 zoning classification. Mr. O Keefe stated that is correct. Any of the four could petition to be rezoned to R-3, however they would need a minimum of five acres. Mr. O Keefe said anyone can ask for rezoning of their property. Alderperson Martin asked if one of the property owners could join the LECC property and be rezoned. Mr. O Keefe stated it is used in common but if they did they could create a non-conforming use. Mr. Shelton stated there is a change in whereas clause #2, which should read west instead of east. Mayor Krieg asked for a motion for a second reading. MOTION: Alderperson Warner motioned and Alderperson O Brien seconded approval of the second reading of Bill No All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. Mayor Krieg asked City Clerk Ross to give the second reading of Bill No Bill No : An ordinance to rezone properties known as Clayton Road, the rear lot of Clayton Road and Clayton Road from R-1 Single Family Residence to R-3 Villa Residence Zoning District. Alderperson O Connell read the following statement: It is my habit to explain my vote on important issues that come before the Board. Therefore, I will share the basis for my vote tonight. First, I will note that the City s Comprehensive Plan identified a desire for opportunities for Frontenac citizens to age in place and remain in Frontenac even after maintaining a 1-acre lot and free-standing home is no longer workable, and specifically mentioned villas as a future housing consideration. Second, the Comprehensive Plan identified the area including the LECC property as suitable for development uses other than 1-acre residential. Next I will recognize that there has been vocal support of development of the LECC property with villas at a density of 3.5 per acre on average, both here tonight, and previously in meetings with applause from the assembled citizenry, and in person. Support was also demonstrated visually with a great number of Villa s Only 3.5 acre yard signs. In response to questions or comments, I will point out that I do not believe anyone on the BOA is voting on this due to the financial situation of the City, as a villas-only development has no lasting financial benefit to the City (given that the real property tax impact of a real estate development is a 1-year benefit to the City (which immediately reverses permanently in the following year). Further in response to comments made, I will note that I cannot imagine how anyone could be basing a vote on the economics of the development since (a) we are in no way privy to any economic information, and (b) with regards to this issue a development PAGE 9 OF 14

10 comprised of 3.5 villas/acre there is to my knowledge no such development currently proposed nor do I believe one has ever been proposed to the City. Finally, I will share my opinion that what we have in the LECC is an abandoned, undermaintained, ugly eyesore property that will never be developed as 1-acre residential properties. It has been empty for several years and no one has come forward with such a proposal, and other than alleged friends-of-friends who say they know someone who would, I ve not heard of anyone who has such a thought. I do not know if it is feasible to develop the property as 3.5 villas/acre, but I believe there s a better chance than the no chance of 1-acre residential. For these reasons, I will vote Yes. Mayor Krieg asked for a motion to approve Bill No Alderman Bray asked City Attorney, if he would have a conflict of issue voting on this bill. Mr. O Keefe stated no, because he has no financial interest, so there would be no conflict of interest to prevent him for voting on this issue. MOTION: Alderperson O Connell motioned and Alderperson Warner seconded approval of Bill No Mayor Krieg asked Ms. Ross for a poll vote. Bill No became Ordinance No , Bill No : An ordinance of the City of Frontenac, Missouri, authorizing and directing the Missouri Department of Revenue to resume application and collection of the local sales tax on the titling of motor vehicles, trailers, boats and outboard motors that were purchased from a source other than a licensed Missouri dealer. City Clerk Ross gave the first reading of Bill No Mr. Shelton stated this was voted on and approved overwhelming by the voters. This is being passed to be sent to the State of Missouri, Department of Revenue, to continue the collection of the tax. Mayor Krieg asked for a motion for a second reading. PAGE 10 OF 14

Mayor Krieg asked City Clerk Ross to give the second reading of Bill No Bill No : An ordinance of the City of Frontenac, Missouri, authorizing and directing the Missouri Department of Revenue to resume application and collection of the local sales tax on the titling of motor vehicles, trailers, boats and outboard motors that were purchased from a source other than a licensed Missouri dealer. Bill No became Ordinance No Bill No : An ordinance of the City of Frontenac, Missouri, imposing local use tax at the same rate as the local sales tax of the City of Frontenac, Missouri for purchases from out-of-state vendors that exceed two thousand dollars. City Clerk Ross gave the first reading of Bill No Mr. Shelton stated this was voted on and approved overwhelming by the voters. This will notify the State of Missouri, Department of Revenue to begin collecting this tax. He said they will begin imposing the tax in July. Mayor Krieg asked for a motion for a second reading. MOTION: Alderperson Martin motioned and Alderperson O Connell seconded approval of the second reading of Bill No All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. Bill No became Ordinance No Bill No : An ordinance enacting a new Section 365 of the Code of Ordinances of the City of Frontenac, Missouri, pertaining to traffic regulations. City Clerk Ross gave the first reading of Bill No Mr. Shelton stated the trustees were here earlier asking for the passage of this bill. Vehicles are turning down Devondale Lane to avoid the traffic signal. The only other intersection this could reference as written is the area of German and Lindbergh Blvd. He said the police department is in favor of this ordinance. Alderperson Bray stated there is an ordinance for Oak Valley and said it is handled differently. Chief Becker stated on Oak Valley it is resident traffic only. He said Devondale is small and you can tell who is not a resident. Alderperson Bray asked will a simple stop sign work. Chief Becker stated if they would follow them. He said his department receives a number of complaints and believes most of them are the kids cutting though on their way to school. Mayor Krieg asked for a motion for a second reading. MOTION: Alderperson O Connell motioned and Alderperson Martin seconded approval of the second reading of Bill No All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. Mayor Krieg asked City Clerk Ross to give the second reading of Bill No Bill No : An ordinance enacting a new Section 365 of the Code of Ordinances of the City of Frontenac, Missouri, pertaining to traffic regulations. 13 Alderperson O Connell stated he would like to change Section B on the top of page two to read Motorists shall be prohibited from driving on Devondale Lane between Clayton Road and Bopp Road for the purpose of avoiding the traffic signal. MOTION: Alderperson O Connell motioned and Alderperson Martin seconded to amend Bill No with the change to Section B, page 2 above. All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED. Mayor Krieg asked for a motion to approve Bill No as amended. MOTION: Alderperson O Connell motioned and Alderperson Martin seconded approval of Bill No as amended. Mayor Krieg asked Ms. Ross for a poll vote. Bill No became Ordinance No Resolution No : A resolution authorizing the Mayor, on behalf of the City of Frontenac, Missouri, to enter in to a contract extension for financial auditing services. Mr. Shelton stated this is a three year extension to the current financial auditing contract. Mr. Shelton stated the governmental audit standards, recommends an auditor perform for five years and we have had Hochchild Bloom for three years. He said this was reviewed by the Ways & Means Committee. MOTION: Alderperson O Connell motioned and Alderperson Bray seconded approval of Resolution No All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED by a vote of Resolution No : A resolution authorizing the Mayor, on behalf of the City of Frontenac, Missouri, to enter into an agreement with the Metropolitan Sewer District (MSD) for reimbursement of the Glen Abbey Storm Improvements. Mr. Shelton stated the City has an excellent working relationship with MSD. He said they have work planned and we undertake the work along with our projects and the city is reimbursed. This agreement is for the reimbursement of $325,000 from MSD. MOTION: Alderperson Martin motioned and Alderperson Bray seconded approval of Resolution No All Alderpersons present voted Aye. Resolution No : A resolution authorizing the Mayor, on behalf of the City of Frontenac, Missouri, to enter into an agreement with the Metropolitan Sewer District (MSD) for reimbursement of the Oak Valley East Storm Improvements. Mr. Shelton stated this is the same as the last resolution. The city is doing the work and MSD will reimburse the city for their work at a cost of $185,000. MOTION: Alderperson Warner motioned and Alderperson Guest seconded approval of Resolution No All Alderpersons present voted Aye. The vote was unanimous. MOTION PASSED by a vote of 6-0. O. APPROVAL OF WARRANT LISTS: March 1, 2015 through March 31, 2015 Mayor Krieg asked for consideration and approval of the warrant list. MOTION: Alderperson Martin motioned and Alderperson O Connell seconded the above warrant lists be approved. Mayor Krieg asked if there was any discussion. There was none. Mayor Krieg asked Ms. Ross for a roll call vote.
