5 Ph: LEGISLATIVE ISSUES SUBCOMMITTEE JANUARY 7, 2013 MEETING SUMMARY Discussed the intent behind adopting the TPO s Legislative Priorities and the format that should be used for each priority Recommended that the Volusia TPO be involved in Volusia Day in Tallahassee this year Reviewed the MPO Advisory Council s (MPOAC) draft 2013 Legislative Priorities and Policy Positions Requested representatives of Palm Coast be invited to the next Legislative Issues Subcommittee meeting to provide input regarding their city s priorities Agreed to postpone incorporating the MPOAC s 2013 legislative priorities as part of the Volusia TPO list until they are finalized by the MPOAC; in the interim, the Legislative Issues Subcommittee will develop TPO-specific priorities to present to the TPO Board for adoption in February Directed subcommittee members and/or FDOT and TPO staff to research the following information and provide clarification prior to the next Legislative Issues Subcommittee meeting: o Volusia County s Legislative Priorities o Flagler County s Legislative Priorities o Red Light Cameras o Trail Funding Priorities o Definition of controlled access state facilities Directed TPO staff to ask local governments if they had any specific transportation issues Directed TPO staff to work with Mayor Pro Tem Matusick and the Bicycle & Pedestrian Advisory Committee (BPAC) to draft language better defining the proposed pedestrian safety legislative issues Discussed and agreed to support reform to the Consultants Competitive Negotiation Act (CCNA) Law to introduce an optional best value alternative THE NEXT MEETING OF THE LEGISLATIVE ISSUES SUBCOMMITTEE WILL BE MONDAY, FEBRUARY 4, 2013 AT 2:00 P.M. 6 EXECUTIVE DIRECTOR SEARCH COMMITTEE MEETING SUMMARY JANUARY 14, 2013 Received an update from the consultant on the status of the candidates and the background checks Discussed the remaining candidate s qualifications and approved a motion to recommend to the TPO Board that they authorize the TPO Chairman and consultant to negotiate a contract with Ms. Lois Bollenback and to bring it back before the board for approval Directed the TPO Chairman to send a letter to Sheriff Ben Johnson and Mr. T.J. 7 Ph: REPORT TO THE VOLUSIA TPO BOARD ON THE MEETING OF THE CENTRAL FLORIDA MPO ALLIANCE (CFMPO) JANUARY 11, 2013 Delegation Reports the Chairperson recognized the delegation reports from each of the member organizations included in the agenda. FDOT District Reports o Ms. Amy Perez, System Planning Administrator for FDOT, provided the board with an update from District 1 including I-4 coordination plans, the status of a freight study and project activity on the Polk Parkway. o Mr. Jim Brown, MPO Liaison for FDOT, provided an update on District 5 including the development of the tentative Work Program and public hearing results and the status of project activity along I-4. o Ms. Alice Gilmartin provided a brief report of Florida Turnpike Enterprise s activities. o Mr. Harry Barley, Executive Director of MetroPlan Orlando, provided information about recent legislation proposed by Senator Simmons pertaining to the consolidation of expressway authorities (there is no bill number). Discussion also included consideration of expanding the authority of these agencies to include fixed guideway facilities. Action Items o The board approved the meeting minutes for the October 12, 2012 meeting of the CFMPOA. o The board approved a set of transportation priorities for the 2013 legislative session including banning the use of hand-held electronic devices while driving, protecting the Transportation Trust Fund from diversion to other portions of the state budget, expanding eligibility for the Charter County and Regional Transportation Surtax, authorizing a rental car surcharge and closing the gaps in the statewide trail system. Additional issues were identified for support and monitoring (the list is pending review). Presentations / Discussion o Ms. Tawny Olore, FDOT, provided an update on SunRail development noting that the trains will be delivered in July, the Rand Yard facility will begin to be occupied in March and the project is on schedule to begin in Spring o Mr. Harry Barley, MetroPlan Orlando, provided an overview of two private sector rail initiatives in the Central Florida. The roughly $1.5 billion proposal requires obtaining access to right-of-way from the existing line in Cocoa to the Orlando Airport and is expected to follow an ambitious schedule with service beginning in The second project is an unsolicited proposal by American Maglev Technology (AMT). This project would utilize private sector funding and maglev technology for a rail connection between the convention center and the Orlando Airport with a stop at the Florida Mall. These projects are in various stages of review. o Mr. Gary Huttmann, MetroPlan Orlando, provided an update on the Orlando International Airport (OIA) refresh study updating an alternatives analysis completed in 2005 as well as a SR 441 corridor alternatives analysis that was placed on hold due to changes in MAP-21. The study is expected to begin in the very near future. o Mr. Mighk Wilson, MetroPlan Orlando, presented activities surrounding the close the gaps efforts underway throughout Central Florida including projects and estimated costs for completing the trails outlined in his presentation. Mr. Richard Dunkel, Florida Greenways and Trails, expressed his interest in addressing these needs. Member comments indicated that additional work needed to be done to include all regional trail activity such as the River to Sea Loop that extends northward into Flagler County from Brevard and Volusia Counties. o Mr. T.J. Fish, Lake-Sumter MPO, discussed transportation projects under several categories and approaches that could be supported by the CFMPOA to develop regional priorities. A meeting of directors has been scheduled for January 30, 2013 to continue this discussion. Member Comments o Mayor Pro Tem Ray Goodgame suggested the committee consider starting the meetings earlier and staff was directed to poll committee members and report at the next meeting. o Chairperson Matusick announced the upcoming ASHE event in Orlando on February 21, 2013 titled On the Road to Regionalism. 9 Safety 2013 Legislative Session Transportation Priorities (Adopted January 11, 2013) Ban Use of Hand-held Electronic Devices While Driving Enact legislation to prohibit the use of hand-held electronic devices while driving. Funding Protect the State Transportation Trust Fund and Transportation Disadvantaged Trust Fund In addition to revenues generated by transportation-related surcharges already directed outside the Transportation Trust Fund, millions of transportation dollars have been diverted each year from the Transportation Trust Fund for other purposes. Overall, such diversions and lost revenues degrade the state s infrastructure and impact Central Florida s competitiveness for federal discretionary funding. Likewise, negative impacts to the Transportation Disadvantaged Trust Fund should be avoided. Amend Charter County and Regional Transportation System Surtax to Make Eligible to all Counties with an MPO The current legislation allows a surtax to be taken before voters as a referendum to fund transportation projects through an up to one percent consumption tax. The law has evolved through the last 25 years to now be eligible to all charter counties, as well as to any non-charter county that is part of a Regional Transportation Authority. The transportation surtax is an appropriate referendum option for urban counties and therefore should be extended to all counties served by a metropolitan planning organization in order to provide funding for cost-feasible transportation plans. Local Option Rental Car Surcharge Authorize a $2.50/day local option rental car surcharge (implemented through a public referendum) with proceeds committed to regional transit projects. Statewide Trail System Close the Gaps in the Statewide Trail System Seek inclusion of proviso language from the legislature for the Florida Department of Transportation and the Florida Department of Environmental Protection to work with the Florida Greenways and Trails Foundation and appropriate metropolitan planning organizations to close the gaps in the statewide trail system with a plan submitted to the legislature by December 30, 2013 and progress reports submitted each year for the next three years. 10 The CFMPOA will support legislation that: Returns all motor vehicle fees to the State Transportation Trust Fund. Allows up to a one-cent municipal option sales tax for cities with population in excess of 150,000 (or the largest municipality in a county). Allows for indexing of local option fuel taxes to CPI, consistent with indexing allowed for state fuel taxes. Preserves the existing coordinated system for paratransit service. Advances Florida s Comprehensive, Statewide Rail System Plan. Continues investments in Space Transportation Infrastructure. Prohibits additional increases in federal truck weight limits in the State of Florida. The CFMPOA will monitor legislation that: Proposes changes in Chapter , Florida Statutes pertaining to metropolitan planning organization Board composition and operations. Proposes creation of a Central Florida Regional Expressway Authority (CFREA). Seeks to alter or repeal Red Light Camera Enforcement legislation. Municipal representation including the small city alliance will total 66.6% of the overall vote. Each municipality in this group would have a nonrotating seat that would be weighted based on the respective populations included in the planning area boundary. 23 Volusia TPO Board 2012 WPPH Presentation 1/22/13 Tentative Projects PROJECT A : FM# (Priority Project # 3) Project A is an Intersection Improvement Project on US 1 at Dunlawton Avenue and Herbert Street. The Construction Phase is being proposed for Fiscal Year 2013 for approximately $535,000. PROJECT B : FM# (Priority Project # 3) Project B is an Intersection Improvement Project on US 1 at Canal Street. The Right of Way Phase is being proposed for Fiscal Year 2015 for approximately $1.9 million, and the Construction Phase is being proposed for Fiscal Year 2018 for approximately $3.4 million. PROJECT C : FM# (Priority Project # 3) Project C is an Intersection Improvement Project on US 1 at Reed Canal Road. The Right of Way Phase is being proposed for Fiscal Year 2015 for approximately $1.7 million, and the Construction Phase is being proposed for Fiscal Year 2018 for approximately $1 million.
