3 Authority Section 23 of the U.S. Code of Federal Regulations, Part makes the Governor responsible to approve each metropolitan planning organizations boundary and apportionment plans. History In July 1979 the Florida Legislature enacted , Florida Statutes requiring metropolitan planning organizations be established in designated urbanized areas by January In compliance with this directive the Metropolitan Planning Organization for the Jacksonville Urbanized Area (MPO) was subsequently created. In March 2000 the MPO officially changed its name to the First Coast Metropolitan Planning Organization (First Coast MPO), and in September 2008 was rebranded as the North Florida Transportation Planning Organization (North Florida TPO). The original MPO boundary included all of Duval and only a small portion of northern Clay (Orange Park) and St. Johns Counties (North of CR 210). Membership of the Policy Board was composed of the Jacksonville Mayor, three City Council members, one Clay County Commissioner, one St. Johns County Commissioner and a Board Member of the Jacksonville Transportation Authority. The boundary was revisited in 1992 following designation of the Jacksonville urbanized area by the U.S. Census Bureau following the 1990 Census. The boundary must include at least the metropolitan planning area, which is the existing urbanized area and the contiguous area expected to become urbanized within a 20 year forecast period, and may encompass the entire metropolitan statistical area (MSA) or the consolidated metropolitan statistical area (CMSA). Following the census a map is provided to the MPO roughly outlining the boundary of the urbanized area. Staff was provided the opportunity to review this map and work with the Florida Department of Transportation (FDOT) District II staff to smooth the edges of boundary. The map was returned to FDOT and forwarded to the Federal Highway Administration (FHWA) for finalization and eventually returned to the MPO for signature. Staff utilized the map to estimate where the planning area boundary could reasonably be expected to be in 20 years. This effort was undertaken working cooperatively with staff from Clay and St. Johns Counties and FDOT, and in accordance with state and federal guidelines. The planning area boundary map was then forwarded to FHWA and FTA for review and approval. In 1992 the MPO boundary was extended south in Clay County to Middleburg, but remained at CR 210 in St. Johns County In 1992 as per changes in Federal law, representation on the Policy Board was expanded to Page 3
4 include the Jacksonville Port Authority. Also, representation was added for Atlantic Beach, Neptune Beach and Jacksonville Beach with one of the three Mayors serving on a rotating basis. In 2001, following the split of the Jacksonville Port Authority into the Jacksonville (Sea) Port Authority and the Jacksonville Airport Authority, with the Governor s approval, membership was adjusted to allow representation for both authorities, increasing total membership on the Policy Board to 10. In October 2003 the MPO boundary was expanded to add the St. Augustine urbanized area (UA) which was designated for the first time following the 2000 U.S. Census. The planning area boundary was expanded to include most of St. Johns County (excluding portions south of SR 206 outside the St. Johns County St. Augustine Urbanized Area), and in Clay County south of SR 16 and north in Nassau County to US 301 to I 95 and from I 95 north to the state line. Membership was expanded to include an additional Commissioner from Clay County, the Mayor of St. Augustine, a Nassau County Commissioner and a member of the Board of Directors of the Nassau County Ocean Highway and Port Authority, and the St. Augustine St. Johns County Airport Authority, increasing total voting membership to 15. North Florida TPO Boundary The North Florida TPO approved Envision 2035, the long range transportation plan for the region on December 10, This LRTP is truly a regional plan addressing the needs of the entire four counties. As part of the study effort the TPO also expanded the North East Florida Regional Planning Model to include Baker and Putnam Counties to provide these counties with a tool to address growth and to facilitate future expansion of the TPO boundary. With Envision 2035 completed, the North Florida TPO can fully and adequately plan for the 808 square mile area previously excluded from the planning area boundary. Table 1 illustrates the change in the TPO planning area boundary. Table 2 shows the change in TPO planning area population between 2000 and A map of the new boundary follows on page 8. Page 4

7 Methodology Chapter (4), Florida Statutes outlines how the Governor will apportion membership of individual MPOs. The Chapter specifies that the Governor shall, with the agreement of the affected units of generalpurpose local government as required by federal rules and regulations, apportion the membership of the applicable TPO/MPO among the various governmental entities within the area. TPO/MPO members shall serve 4 year terms. A member who is a public official automatically terminates upon the member's leaving his or her elective or appointive office for any reason, or may be terminated by a majority vote of the total membership of the entity's governing board. These provisions are further elaborated upon in the North Florida TPOs Rules of Procedure and Bylaws. Boundary Expansion. Whereas this boundary adjustment is being made prior to releasing the findings of the 2010 U.S. Census of Population, the North Florida TPO is utilizing the same methodology used to evaluate the apportionment of membership for the previous boundary and apportionment adjustment (2003). Apportionment is evaluated based both on reported 2000 and 2008 population estimates by the U.S. Census and the official population estimates of the State of Florida. The Census estimates were released on July 1, The estimates from.the Bureau of Economic and Business Research (BEBR) at the University of Florida, are reported on April 1 of 2008, and are the most recent available. Equitable Geographic Population Ratio In the previous plan after the boundary was established the apportionment of membership was determined by establishing an equitable geographic population ratio as specified in State law. Chapter (3), Florida Statutes, Voting Membership, specifies that the voting membership of the policy board shall consist of not fewer than five members or more than 19. Section 134 of Title 23, U.S. Code of Federal Regulation (CFR) further specifies that in areas designated as transportation management areas all public agencies that administer or operate a major mode of transportation within the metropolitan area be represented. Currently, five independent transportation authorities are within the expanded boundary of the North Florida TPO and include the following: The Jacksonville Aviation Authority The Jacksonville Port Authority The Jacksonville Transportation Authority Page 7
8 The Nassau County Ocean, Highway and Port Authority The St. Augustine St. Johns County Airport Authority Tables 3, 4 and 5 show the population of each County as a percentage of total TPO population for a Policy Board with 13 elected officials (19 less the representatives of the six authorities). Table 4 is based on a July 1, 2008 estimate of population by the U.S. Census. Table 5 represents the April 1, 2008 BEBR (High) estimates, which are those used by the Florida Department of Transportation. The Florida estimates are slightly higher than the Census figures, but do not change the ultimate apportionment. To reduce the number of individuals at the table, the representatives of the City of Jacksonville consisting of the Mayor and three member of the Jacksonville City Council will have double weighted votes. The voting membership of the North Florida TPO is outlined in Table 6. The North Florida TPO also offers non voting membership to one member of the Baker, Flagler and Putnam County Commissions. 5 As specified in both Florida Statute and in the Rules and Procedures and Bylaws of the North Florida TPO all members have Alternate Members. If the voting membership is increased to 16 members further revisions will be needed to address the possibility of tied votes and how they will be handled. As per Inter local Agreement, North Florida TPO members contribute to the financial support of the independent agency with a modest annual assessment not to exceed $1 per capita population, the amount to be approved by the Policy Board annually. 4 Originally the language stated Mayor of St. Augustine and St. Augustine Beach rotated annually. Unfortunately, neither Mayor participated. Since 2008 the Mayor of St. Augustine has designated a City Commissioner as his alternate and the City has been an active participant. 5 This is a courtesy extended to neighboring counties and does not imply that the North Florida TPO will extend the TPO boundary to include these counties or require these counties to contribute to the financial support of the TPO through an annual assessment of fees. 11 Related Action As part of the boundary adjustment the North Florida TPO has coordinated with FDOT District II to evaluate the functional classification of major roads within the expanded boundary area. The most significant impact will be to Interstate lane miles between the existing TPO planning area boundary and the new TPO boundary at the county limit. Currently designated as rural, this area will now be designated as transitioning with an automatic lowering of the level of service standard by one letter grade (ie. B becomes C). Table 7 below summarizes the changes to LOS Standards for highway facilities on the Strategic Intermodal System (SIS) due to the proposed boundary change. JOHNS SIS (Arterial) SR 207 Putnam County Line to current TPO Boundary (Allan Nease Road at SR 207) B B C C The Area Type designation of the section of I 95 in St. Johns County between the Flagler County Line and SR 206 would also change, from Rural to Transitioning. For this approximately 8.1 mile section of Interstate, the Interchange Spacing Standard would change from 6 miles to 3 miles. The two interchanges in this section (US 1 and SR 206) are approximately 7.2 miles apart, therefore, one new interchange would be permissible under the proposed boundary expansion (assuming other requirements for new interchanges are met). In Nassau County, a small section of I 10 (0.70 miles) would now be within the TPO boundary, resulting in a Transitioning Area designation for that section as well. The section of I 10 is approximately 3 mile from the US 301 interchange and 3 miles from the CR 228 interchange in Baker County. Subsequent Action Upon approval of the Boundary and Apportionment Plan the North Florida TPO will: Amend existing Inter local Agreements with expanded boundary description. If circumstances warrant and funding is available the North Florida TPO will: Amend the Long Range Transportation Plan (LRTP) to add capacity projects outside the current boundary Page 12
13 Amend the Unified Planning Area Program Amend the Public Improvement Plan, and Amend the Greenway and Trails Plan. Otherwise, the planning area of the TPO will be expanded to incorporate the areas added in the regular planning calendar and effort will be made to study and collect data in these areas prior to the next update of the LRTP.
