3 RESOLUTION NO. 17R-2621 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA, DECLARING THE OFFICIAL RESULTS OF THE FIRST ELECTION OF MARCH 14, 2017; DIRECTING THE CITY AUDITOR AND CLERK TO NOTIFY THE CANDIDATES WHO RECEIVED THE HIGHEST NUMBER OF VOTES, BUT DID NOT RECEIVE THE SUPPORT OF A MAJORITY OF VOTERS, THAT THEIR NAMES WILL APPEAR ON THE MAY 9, 2017 BALLOT FOR THE SECOND ELECTION; PROVIDING FOR READING BY TITLE ONLY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in accordance with Article IX, Section 6(a) of The Charter of the City of Sarasota, Florida, the returns of the first election, held on the 14th day of March, 2017, duly certified by the Supervisor of Elections of Sarasota County, were delivered to the City Auditor and Clerk and the City Commission shall declare by resolution the official results of the election; and WHEREAS, Article IX, Section S(b )(1) of The Charter of the City of Sarasota, Florida, provides that when three (3) or more persons qualify as a candidate for the Office of City Commissioner for the two (2) at-large seats on the City Commission, the qualifiers shall have their names placed on the ballot for the city election held on the 2nd Tuesday in March, to be known as first election; and that the two (2) candidates receiving the highest number of votes cast in the first election who have also received the support of a majority of the voters shall be declared elected; and WHEREAS, Article IX, Section S(b )(1) of The Charter of the City of Sarasota, Florida, further provides that if no candidate receives the support of a majority of the voters in the first election, a second election shall be held on the second Tuesday in May, to fill the two (2) at-large seats; and that the three (3) candidates receiving the highest number of votes in the first election shall have their names placed on the ballot for the second election; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA: Section 1. The City Commission does hereby find that the Certificate of Election Results as certified by the Supervisor of Elections is as shown in Exhibit A; and that the final tabulation of ballots cast in said election in each of the Precincts is as shown in Exhibit B, attached hereto and made part hereof. 4 Section 2. The City Commission further finds and declares that the total number of voters in the first election held on March 14, 2017, for the Office of City Commissioner, At-Large, totaled 7,194 voters, including 3,280 precinct voters, 814 early voters, and 3,100 vote-by-mail voters (includes ~ provisional ballots). As such, the number of votes required to obtain a majority was set at 3,598. Section 3. The City Commission further finds that no candidate received the support of a majority of voters, and therefore a second election will be required on the second Tuesday in May, in accordance with Article IX, Section 5(b )(1) of The Charter of the City of Sarasota, Florida. Section 4. The City Commission further finds that the three (3) candidates receiving the highest number of votes in the first election were Jen Ahearn-Koch, Hagen Brody and Martin Hyde, and shall have their names placed on the ballot for the second election in accordance with Article IX, Section 5(b )(1) of the Charter of the City of Sarasota, Florida. Section 5. The City Auditor and Clerk is hereby directed to notify in writing the candidates whose name will appear on.the ballot for the second election to be held on May 9, Section 6. This Resolution shall take effect immediately upon adoption. ADOPTED by the City Commission of the City of Sarasota, Florida, upon reading by title only, after posting on the bulletin board at City Hall for at least three (3) workdays prior to adoption, as authorized by Article IV, Section 2(h) of the Charter of the City of Sarasota, this 20th day of March Page 2 of 5
