COMMISSION PRIORITIES: Business Requirement EXPLANATION: (see next page for additional explanation) The Baker s Badcock Furniture Store Building was built in 1957 set back from 6th Street between two alleys. This Moderne style structure is situated on a concrete slab foundation, with concrete block walls clad in a stucco finish. The building is comprised of two different elements with a single-story showroom of storefront glass that extends around much of the building so that the building appears transparent. The other part of the structure is a two-story masonry storeroom with small windows and a garage door for loading covered by a canopy. The building was designed by architect Thomas V. Talley of Lakeland, and built by LaGasse Brothers Construction Company of Sarasota. Still retaining much of it original historic fabric, this is an excellent example of the post World War II Period Mid-century Modern Building. The Baker s Badcock Furniture Store Building meets the following criteria for the historic designation of this property as it exemplifies or reflects the broad cultural, political, economic or social history of the city, the county, the state or the United States of America. 3 ADDITIONAL EXPLANATION: AGENDA REQUEST On July 12, 2016, the Historic Preservation Board voted unanimously 5-0 to recommend the City Commission approve the local historic designation of The Baker s Badcock Furniture Store Building located at 1570 Boulevard of the Arts. On August 15, 2016 the City Commission voted 4/1 to approve Ordinance No on first reading. I South School A venue, Suite 700 Sarasota, Florida ORDINANCE NO AN ORDINANCE OF THE CITY OF SARASOTA, FLORIDA PROVIDING FOR THE DESIGNATION OF THE STRUCTURE LOCATED AT 1570 BOULEVARD OF THE ARTS HISTORICALLY KNOWN AS THE BAKER'S BADCOCK FURNITURE STORE BUILDING AS A STRUCTURE OF HISTORIC SIGNIFICANCE PURSUANT TO THE HISTORIC DESIGNATION REGULATIONS OF THE CITY FOUND IN ARTICLE IV, DIVISION 8 OF THE ZONING CODE (2002 EDITION) ALL AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING FOR READING BY TITLE ONLY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, BOTA Center, LLC through its agent Lorrie Muldowney, AICP, Associates, as fee simple owner of the subject property, hereinafter referred to as Owner has filed Historic Designation Application No. 16-HD-01 requesting designation of the structure known as the Baker's Badcock Furniture Store Building located at 1570 Boulevard of the Arts as an historically significant structure; and WHEREAS, Historic Designation Application No. 16-HD-01 shall be considered according to the requirements and procedures set forth in Article IV, Division 8, of the Zoning Code (2002 Edition) pertaining to historic designation; and WHEREAS, the Historic Preservation Board held a duly noticed public hearing pertaining to Historic Designation Application No. 16-HD-01 on July 12, 2016; and WHEREAS, the Historic Preservation Board considered the written staff analysis and the testimony at the public hearing and specifically found that Historic Designation Application No. 16-HD-01 satisfied the standards for review set forth in Section IV-806 (1) a., Zoning Code (2002 edition) and recommended approval to the City Commission; and WHEREAS, the City Commission held a duly noticed public hearing pertaining to Historic Designation Application No. 16-HD-01 on August 15, NOW THEREFORE BE IT ENACTED BY THE PEOPLE OF THE CITY OF SARASOTA, FLORIDA: Section 1. The structure known as the Baker's Badcock Furniture Store Building existing upon the real property located at 1570 Boulevard of the Arts within the City of Sarasota, Page 1 of 4

5 Florida is hereby designated as an historic structure pursuant to Article IV, Division 8, Zoning Code (2002 edition). The legal description of the real property located at 1570 Boulevard of the Arts and subject to this Ordinance is as follows: Lots 15, 17 and 19, Block 27, Burns Resubdivision of Blocks 23 and 27, Plat of Sarasota, according to the Plat thereof as recorded in Plat Book 1, Page 218, Public Records of Manatee County, Florida, and Plat Book A, Page 66 of the Public Records of Sarasota County, Florida. This is Parcel ID No The structure known as the Baker's Badcock Furniture Store Building located at 1570 Boulevard of the Arts is hereby designated as historically significant. This designation does not apply to the site, grounds or any other improvements in or around the property described above. Section 2. The structure known as the Baker's Badcock Furniture Store Building which is hereby designated as historically significant shall be eligible for all incentives for preservation which are contained within Section IV-813 and Section IV-814, Zoning Code (2002 edition) as said sections presently provide or may hereinafter be amended. Section 3. The Director of the Department of Neighborhood and Development Services is hereby directed to refer all completed applications for exterior building permits, demolition permits or moving permits concerning the structure known as the Baker's Badcock Furniture Store Building hereby designated as historically significant to the Historic Preservation Board for review and approval. No such permit shall be issued until the Historic Preservation Board has Issued a Certificate of Appropriateness authorizing the proposed activity as provided in Article IV, Division 8, Zoning Code (2002 edition). Section 4. Section 5. This Ordinance shall take effect immediately upon second reading. Upon the effective date hereof, the terms of this Ordinance shall bind the property owners, its successors in interest and its assigns. Subsequent to the effective date hereof, consent of the property owners to the historic designation of the subject structure may not be revoked. 2 Page 2 of 4

7 NOTICE OF PUBLIC HEARING APPLICATION NO. 16-HD-01 Notice is hereby given that the CITY COMMISSION of the City of Sarasota, Florida will meet on Monday, August 15, 2016 at 6:00 p.m. in the Commission Chambers, City Hall, 1565 First Street. Starting at 6:00 p.m. or as soon thereafter as possible, the City Commission will open the scheduled Public Hearings in the order they appear on the Agenda. The following ordinance will be considered for approval at the above scheduled meeting: ORDINANCE NO AN ORDINANCE OF THE CITY OF SARASOTA, FLORIDA PROVIDING FOR THE DESIGNATION OF THE STRUCTURE LOCATED AT 1570 BOULEVARD OF THE ARTS HISTORICALLY KNOWN AS THE BAKER S BADCOCK FURNITURE STORE BUILDING AS A STRUCTURE OF HISTORIC SIGNIFICANCE PURSUANT TO THE HISTORIC DESIGNATION REGULATIONS OF THE CITY FOUND IN ARTICLE IV, DIVISION 8 OF THE ZONING CODE (2002 EDITION) ALL AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING FOR READING BY TITLE ONLY; AND PROVIDING FOR AN EFFECTIVE DATE. Said proposed application is on file in the Department of Neighborhood and Development Services and the Office of the City Auditor and Clerk at City Hall at the above address for public inspection from 8:00 a.m. to 5:00 p.m., Monday through Friday. This is a public hearing; therefore, all interested persons will be entitled to personally testify at the hearing and to submit documents or letters. Persons granted status as an Affected Person by the City Commission will additionally be allowed to present the sworn testimony of other witnesses, relevant exhibits and other documentary evidence and to cross-examine witnesses. In order to qualify as an Affected Person, a person who may be adversely affected by the action of the City Commission must file a Request for Affected Person Status form with the Office of the City Auditor and Clerk at least five (5) complete working days prior to the quasi-judicial hearing. The Request for Affected Person Status form is available at the Office of the City Auditor and Clerk, 1565 First Street, Sarasota, Florida, telephone number (941) If a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. In accordance with the Americans with Disabilities Act of 1990 and Section , Florida Statutes, persons with disabilities needing special accommodation to participate in such public hearing should contact the Office of the City Auditor and Clerk at (941) at least two (2) business days prior to the date of the public hearing as to the nature of the aid and/or service desired. Reasonable auxiliary aids and services will be made available to qualified disabled individuals to the extent that no undue financial or administrative burden results. For the benefit of individuals utilizing hearing aids with a T-coil, the City Commission Chambers and SRQ Media Studio are outfitted with a Hearing Induction Loop for enhanced hearing assistance.
