1 1 P age January 3, 2017 Chairman Watne called the regular meeting of the Wright County Board of Supervisors to order at 9:00 a.m. Members present were Helgevold, Watne, and Rasmussen. First order of business was to give the Oath of Office to the newly elected officials. The oath was given by Chairman Watne to Supervisor, Supervisor, Sheriff Jason Schluttenhofer, and Auditor Betty Ellis. The meeting resumed with Rasmussen, Watne, and Helgevold taking their seat as the 2017 elected Wright County Supervisors. There was then a motion by Watne and seconded by Helgevold to elect as Chairman and as Chairman Pro-Tem. Motion carries. Minutes of the previous regular meeting of December 27, 2016 were read and approved. Approved claims for payment. Motion by Watne and seconded by Helgevold to set the reimbursable mileage rate for employees at 48 cents per mile. Motion carries. Motion by Watne and seconded by Helgevold to set the drainage warrant interest rate at 6%. Currently the State of Iowa public funds unpaid warrant rate is at 6 percent and the board wishes to match this percentage. Motion carries. Bryce Davis, Wright County Economic Development Director, presented a loan request from BC Rails, Inc. out of Eagle Grove. This loan will be for $125,000 at 5% interest with a 10 year balloon payment figured on a 15 year amortization schedule. The funds will be used to expand the current facility at the current property address. This was approved by the Economic Development Board. Motion by Watne and seconded by Helgevold to approve this loan with no future advanced security agreement. Motion carries. Motion by Watne and seconded by Helgevold to approve the Holidays for 2017 as listed. Motion carries. Resolution duly passes and reads as follows: RESOLUTION # CONSTRUCTION EVALUATION RESOLUTION WHEREAS, Iowa Code section (3) sets out the procedure if a board of supervisors wishes to adopt a construction evaluation resolution relating to the construction of a confinement feeding operation structure; and WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR s decision regarding a specific application; and WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2017 and January 31, 2018 and submit an adopted recommendation regarding that application to the DNR; and WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section , but the board s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WRIGHT COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section (3). Resolution duly passes and reads as follows: RESOLUTION RECORD RETENTION POLICY FOR MANURE MANAGEMENT PLANS WHEREAS, the Wright County Environmental Health Officer has requested that a policy be adopted governing retention of records related to manure management plans (MMPs) provided to the County, as described in Iowa Code Chapter 459 (2015) and the Iowa Administrative Code; and WHEREAS, Iowa Code Chapter 554D sets forth the authority to maintain records in electronic format, IT IS THEREFORE RESOLVED by the Wright County Board of Supervisors that the following is established as the MMP Record Retention Policy for Wright County. IT IS FURTHER RESOLVED that the County Auditor, on behalf of the Board of Supervisors, shall accept MMPs from all parties required to file them. The County Auditor shall also forward the copy of any accepted MMP to the Wright County Environmental Health Officer. IT IS FURTHER RESOLVED that the County shall retain an MMP for a minimum of four (4) years from the date of its acceptance. The County shall further retain a copy of any matrix-construction permit associated with a related operation for a minimum of fifty (50) years after the closure of the operation. IT IS FURTHER RESOLVED that the County, at its discretion, may retain records for a period longer than those established by this policy. IT IS FURTHER RESOLVED that this policy will automatically change to comply with retention requirements set forth in the Iowa Code or the Iowa Administrative Code, as amended. IT IS FURTHER RESOLVED that the County, at its discretion, may receive and retain records in electronic format as provided by Iowa Code Chapter 554D and said records will meet the requirements for record retention unless Iowa law specifically requires the original record to be retained.
