1 NAZARETH BOROUGH COUNCIL--REGULAR MEETING--JANUARY 7, 2019 The regular monthly meeting of the Borough of Nazareth was held on Monday, January 7, 2019 at 6:00 p.m. at the Nazareth Borough Municipal Building. The meeting was called to order by the President, followed by the recitation of the Pledge of Allegiance to the Flag. Present were President Daniel Chiavaroli, Vice President Larry Stoudt, Mayor Lance E. Colondo, Councilpersons Jessica Teel, Carl A. Fischl, Frank S. Maurek, Michael Kopach, Charles A. Donello and Christopher D. Crook, Solicitor Alfred S. Pierce, Police Commissioner Randall Miller and Public Works Superintendent Robert Reimer. Absent were Councilman Carl R. Strye Jr. and Borough Engineer Albert Kortze, Mayor Colondo administered the Fire Chief Oath to Fire Chief John Deutsch, First Assistant Chief Jerry Johnson and Second Assistant Chief Joe Ionovale. Mayor Colondo administered the Special Fire Police Oath to Captain William Keifer, John Gostony, Kerry Frey, Tyler Keifer, Angela Barnes, Ray Fogel and Mark Morella. Recognition of Citizens From the Floor: Susan Ellis, the new Director of the Moravian Historical Society, introduced herself to Council. Communications: The Secretary/Treasurer reminded everyone of their obligation to fill out their "Statements of Financial Interest" and turn them in by May 1, The Secretary s minutes from the regular meeting of December 3, 2018 were approved as presented. On a motion by Charles A. Maurek moved and Michael Kopach seconded a motion to approve the payment of bills totaling $287, The report of the Zoning & Code Officer for the month of December 2018 was presented and approved. An Emergency Management Report for the month of December 2018 was not presented. An Ambulance Report for December 2018 was presented and approved. Public Works: The Public Works Report for December 2018 was approved as presented. Larry Stoudt moved and Carl A. Fischl seconded a motion to waive the necessity for compliance with the Borough's Parks/Events/Facilities Use Policy for all Vigilance Hose Fire Company events in Easter Egg Hunt, Carnival, Road Rally, Fireworks, Money Raffle and Halloween Parade. Discussion followed. Frank S. Maurek told Council that all requesters for use of Borough facilities should follow the same regulations and provide all of the needed documents and deposits. Larry Stoudt moved and Carl A. Fischl seconded a motion to send Robert Reimer and Glenn Recker to a PSATS seminar for CDL Supervisory Training and CMV/CDL Records Management on March 5, Fire: The Fire Report for December 2018 was presented and approved. Jessica Teel moved and Larry Stoudt seconded a motion to appoint Nancy Shiffert Herman to a five (5 yr) year term on the Ambulance Board. Jessica Teel moved and Carl A. Fischl seconded a motion to appoint Inge Mattei to a two (2 yr) year term as an "alternate" on the Ambulance Board. Jessica Teel moved and Charles A. Donello seconded a motion to approve the Fireman's/Kiwanis Carnival in our Park for June 5, 2019, June 6, 2019, June 7, 2019 and June 8, Jessica Teel moved and Charles A. Donello seconded a motion to approve the Fireman's Firework's Show for Nazareth Day, Saturday, July 20, 2019 at dusk. Discussion followed. Frank S.

3 Maurek asked if the show could begin earlier as there have been complaints about keeping children up to see the show. Jessica Teel moved and Larry Stoudt seconded a motion to approve the Fireman's Easter Egg Hunt to be held on Sunday, April 14, 2019 at the Nazareth Park at 2:00 pm. No rain date was requested. Jessica Teel moved and Christopher D. Crook seconded a motion to approve the Fireman's Money Raffle in the Park on Saturday, September 7, Jessica Teel moved and Christopher D. Crook seconded a motion to approve the annual Halloween Parade through the Downtown on Saturday, October 19, 2019 at 1:00 pm. Police: Carl A. Fischl moved and Michael Kopach seconded a motion to approve the appointment of Zack Audenried to a six (6 yr) year term on the Borough's Civil Service Commission. Public Property: Frank S. Maurek moved and Michael Kopach seconded a motion to approve the request of the Nazareth/Bath Area Chamber of Commerce to hold its annual Kazoo Parade on Thursday, July 4, 2019 from 9:30 till conclusion at Council Chambers. The approval includes the use of Council Chambers for the closing ceremonies. A signed contract, certificate of insurance and $100 deposit is required before the approval becomes official. Frank S. Maurek moved and Charles A. Donello seconded a motion to approve the request of the Nazareth/Bath Area Chamber of Commerce to hold its annual Tree Lighting ceremony on Thursday, December 5, 2019 at 7:00 pm in the Circle. A signed contract, certificate of insurance and $100 deposit is required before the approval becomes official. Frank S. Maurek moved and Charles A. Donello seconded a motion to send a letter to Norman and Michelle Boell requesting that they return the signed lease for the Park Refreshment Stand by the Borough's February 4, 2019 Business Meeting. If that deadline is not met, the Borough will seek another tenant.

4 Frank S. Maurek moved and Carl A. Fischl seconded a motion to approve the request of Nazareth Soccer for use of Essroc Field for Spring practices and games. The approval is contingent on receipt of a signed contract and a one hundred ($100.00) dollar deposit. A certificate of insurance was received with the original request and a followup letter informed Nazareth Soccer of the need for the signed contract and the $ deposit. Neither has been received to date. Frank S. Maurek moved and Charles A. Donello seconded a motion to approve the request of the Nazareth/Bath Area Chamber of Commerce to hold the annual Martin on Main event on Saturday, August 3, 2019 from 1:00 pm to 7:00 pm in the downtown. The Borough has received a signed contract, an insurance4 certification and a one hundred ($100.00) dollar deposit. Frank S. Maurek moved and Carl A. Fischl seconded a motion to approve the request of the Girl Scouts of Eastern Pennsylvania to hold their annual Summer Camp in the Park from June 24, 2019 through June 29, Charges include a one hundred ($100.00) dollars per day rental fee and regular charges for Pool use. Finance: Larry Stoudt moved and Michael Kopach seconded a motion to approve Resolution No. 1-19, the yearly resolution prohibiting member contributions to the Police Pension Plan for all of 2019 as follows: WHEREAS, Chapter 1, Part 6, of the Code of Ordinances of the Borough of Nazareth provides for a police pension plan, WHEREAS, Act No. 600 requires that the elimination of member contributions under the police pension plan be done annually by resolution following authorization by the plan s actuary, WHEREAS, Conrad M. Siegel, Inc., the auditor of the pension plan has authorized the elimination of member contributions for 2019, NOW, THEREFORE, BE IT RESOLVED, and it is hereby resolved in Borough Council assembled, that member contributions to the Nazareth Police Pension Plan for the calendar year 2019, are hereby eliminated. Larry Stoudt moved and Christopher D. Crook seconded a motion to hire Palmer & Company to perform the real estate audit of Tax Collector Carole Bowers for the Year 2018.

5 Larry Stoudt moved and Michael Kopach seconded a motion to hire Palmer & Company to do the annual Borough audit for 2018 and submit it to the Pennsylvania DCED by the March 31, 2019 deadline. Larry Stoudt moved and Charles A. Donello seconded a motion to name Alfred Pierce as the Borough s 2019 delegate to the Northampton County Tax Collection Commission and Paul Kokolus as the Borough s alternate delegate. Larry Stoudt moved and Charles A. Donello seconded a motion to issue a $ tax "overpayment" refund to Morningstar Senior Living following a reassessment reduction of $17,500 Larry Stoudt moved and Charles A. Donello seconded a motion to approve the refund of the $100 deposit of the Lehigh Valley Chamber of Commerce following their Christmas in Nazareth event and the successful cleanup Larry Stoudt moved and Christopher D. Crook seconded a motion to approve the refund of the $100 deposit of the Nazareth Chamber of Commerce following their Tree Lighting event and the successful cleanup Larry Stoudt moved and Michael Kopach seconded a motion to approve the refund of the original $100 deposit for the Luminaires Event. Law: Michael Kopach moved and Frank S. Maurek seconded a motion to appoint Barbara Fischl to serve a four (4 yr) year term on the Borough s Planning Commission. Michael Kopach moved and Larry Stoudt seconded a motion to appoint John Huber to a three (3 yr) year term on the Borough's Zoning Hearing Board. Michael Kopach moved and Christopher D. Crook seconded a motion to appoint Sharlene Laureigh as an "alternate" to a three (3 yr) year term on the Borough's Zoning Hearing Board.

6 Michael Kopach moved and Charles A. Donello seconded a motion to appoint Gail Kromer to a one (1 yr) year term on the Borough s Vacancy Board Michael Kopach moved and Larry Stoudt seconded a motion to appoint Cynthia Anderson to a one (1 yr) year term on the Borough's Nazareth Day Commission. Michael Kopach moved and Charles A. Donello seconded a motion to set times and dates for Borough Workshops and General Business Meetings during Michael Kopach moved and Frank S. Maurek seconded a motion to direct the Secretary to advertise in a publication of general circulation, the dates for Borough Workshops and General Business Meetings during Michael Kopach moved and Charles A. Donello seconded a motion to direct the Secretary- Treasurer to send a notice to each resident with a handicapped parking space reminding them of their obligation to annually submit a renewal application on or before June 1, 2019 or they will lose their space. The fee for a renewal application is $10.00 for the year. Michael Kopach moved and Larry Stoudt seconded a motion to vote on an ordinance which would amend Chapter 15, Motor Vehicles and prohibit parking at all times on the east side of Wonderly Street between Sage Street and Seip Avenue. A "Roll Call" vote followed. Voting "Yes" for passage were Councilpersons Stoudt, Teel, Fischl, Maurek, Kopach, Donello, Crook and Chiavaroli. Eight (8) voting "Yes" for passage and Ordinance #840 is adopted into the Borough Code of Ordinances. Michael Kopach moved and Carl A. Fischl seconded a motion to advertise for an ordinance change to remove a twenty five (25 ft) easement...15 minute parking zone...on the south side of Park Street in front of the former Walter's Cleaners. Michael Kopach moved and Christopher D. Crook seconded a motion to approve Resolution No B, a 90 day resolution granting handicapped parking spaces at 135 S. Whitfield Street and another at 101 N. Green Street.

7 Ecology: The December 2018 Refuse and Recycling Report was presented and approved. Charles A. Donello moved and Michael Kopach seconded a motion to appoint Harry Lance to a five (5 yr) year term on the Nazareth Borough Municipal Authority. Charles A. Donello moved and Christopher D. Crook seconded a motion to vote on an ordinance which would amend Chapter 20 Solid Waste. A "Roll Call" vote followed. Voting "Yes" for passage were Councilpersons Stoudt, Teel, Fischl, Maurek, Kopach, Donello, Crook and Chiavaroli. Eight (8) voting "Yes" for passage and Ordinance #839 is adopted into the Borough Code of Ordinances. Charles A. Donello moved and Carl A. Fischl seconded a motion to accept the $263, proceeds of the 2018 Pennsylvania DEP Environmental Grant Technology: Christopher D. Crook moved and Michael Kopach seconded a motion to accept the December 2019 NEDC Report. Christopher D. Crook moved and Michael Kopach seconded a motion to appoint Roberta Targonski to a three year term on the Library Board. Christopher D. Crook moved and Carl A. Fischl seconded a motion to approve the request of the NEDC for the staging of the Farmer's Market in the Circle on Saturday mornings from May 4, 2019 through October 26, Mayor: Mayor Colondo presented the Police Report for the month of December Mayor Colondo asked citizens to report all suspicious activity to police including activity around vehicles. Colondo reported that he had performed five wedding ceremonies in Old Business: Frank S. Maurek stated that warning tickets should be issued to those who park illegally at Holy Family Church during religious services. Maurek stated that the illegal parking has increased and caused problems. Carl A. Fischl stated that it would be best to call the parish and have the pastor and his assistants warn and caution church attendees to park legally or they will be ticketed.
