Board of Commissioners September 8, 2008 Township of Haverford SEPTEMBER 11 TH REMEMBRANCE MANOA POST Opening of Meeting - Meeting was called to order by Commissioner Wechsler at 8 p.m. a. Roll Call 9 Commissioners were present at roll call. Present were: Commissioners D Emilio, Oliva, Rushforth, Heilmann, Holmes, McGarrity, Broido, Trumbull and Wechsler. Also present were: Lawrence J. Gentile, Township Manager, Tim Denny, Assistant Township Manager, James Byrne, Township Solicitor, Carl O Fria, Township Solicitor, George Rementer, Finance Director, Lt. Charles Moore, Acting Police Chief, Lori Hanlon Widdop, Codes Enforcement Director, Jim McCans, Paramedic Director, Dave Pennoni, Township Engineer and Gloria Cugini, Minutes Secretary. b. Opening Prayer by Rev. Stanis, Temple Lutheran Church Manoa Post 667 s Color Guard was present for the Township s Annual 9-11 Remembrance Members included: Bobby Wingate, Joe Donnelly, Phil Miller, Pat Lavin, Fred Bayer, John McGregor, Chuck McGovern and Jim Simms c. Pledge of Allegiance led by Lt. Charles Moore **Mr. Wechsler stated that the Board met prior in Executive Session to discuss a Real Estate Matter and a Personnel Issue. 2. Presentation: EAC ICLEI Final Report Presented by Al Baginski, member of the EAC, Missy Stults, ICLEI Representative, Jon Knauer, ICLEI Representative and Carol McCabe, member of the EAC (see attachment in Minute Book) Synopsis: Mr. Baginski, member of the EAC opened the presentation and stated that EAC is very supportive of the Final Plan with the ultimate objective is very patriotic. Ms. Missy Stults, from ICLEI, gave an overall synopsis of the goals and history. The goals are to reduce energy and gas emissions. This is a 5-Milestone Climate Protection process and Haverford Township has agreed to: Milestone #1: Inventory Milestone #2: Emissions Milestone #3: Establish local plan Milestone #4: Implement local action plan Milestone #5: Monitor/evaluate progress Milestone #4 is what ICLEI and the EAC is requesting approval tonight. Milestone #5 Monitor/evaluate progress Tim Denny has agreed to head-up a permanent Green Team to monitor the progress and purchasing policy for LED lights, trees and green fleet as examples. Now is the time to Reach Out and Educate the public. Haverford Township s Object and Commitment: Target is 30% below 2005 levels by Citizen s Forum - 20 minutes Registered Speakers 20 minutes Agenda Items Mike Levin 414 Mill Road - Deer Management (see attachment in Minute Book) Mr. Levin opposes the upcoming deer kill Mr. Wechsler thanked Mr. Levin for his vocal opposition Mr. Houseworth 129 Landover Road Medical Coverage and Open Records Policy Mr. Houseworth wants the board to think of the taxpayers when it comes time to renegotiate medical coverage.

3 Page 3 Mr. Houseworth spoke on the new Open Records Policy law. Why is it difficult to obtain information? Bill Toal, III 45 Woodcroft Road - Havertown Day DA Booth Mr. Toal advertised Havertown Day the DA s Office will again have their fingerprinting and picture taking booth at Havertown Day, October 4 th. This is great for parents to have done in case of an emergency pertaining to their child or children. The Bomb Squad will also be present. Mr. Wechsler thanked Bill and the DA s Office for their participation. Chad Brooks 300 Campbell Avenue Paul Molino 624 Washington Avenue Dave McArdle 2304 Belevedere Avenue } Havertown Day This year s theme for the Township s 14 th Annual Havertown Day is: Haverford Township a Green Friendly Town. Mr. Wechsler thanked the Committee for all their work. Dan Siegel 1705 Marilyn Drive Redistricting and Real Estate Matters Mr. Siegel stated that hopefully Redistricting is coming to an end and that voters need to be educated. He also asked where is the Township going with Bubble Gum Factory? The community needs to be informed. Mr. Wechsler stated that the County will take care of the voters. As soon as the Board has more information to report to the residents regarding real estate matters, it will be placed on the website. Don Kelly 135 E. Hathaway Lane Civic Survey Mr. Kelly stated that maybe the Township can offer a survey asking residents to prioritize What they think is more important: e.g. library, recreation, township building, etc. Mr. Wechsler stated that this is a good idea.

4 Page 4 Open Forum Mike Levin 414 Mill Road - Deer Mr. Levin opposes the deer kill and has sent a letter to the Game Commission. Adeline Ciannella Library Director The Library supports ICLEI. The Library will be providing energy monitors to residents. There will be a series of green programs coming up. The Final ICLEI Report will be available at the Library. Mr. Wechsler thanked Mrs. Ciannella. Jeff Miller 3 West Clearfield - Funding Mr. Miller is asking the Board to support extra funding to the Library. Mr. Wechsler indicated that the Board will listen to whoever on the Board brings up their request. Josephine Pogue Hermosa Lane Deer Mrs. Pogue indicated that Deer are now in the front, back and at her front door. END OF CITIZENS FORUM 5. Motion made by Commissioner D Emilio and second by Commissioner Trumbull to Approve Minutes of Regular Meeting of August 11, Edits have been noted and changed. Roll Called. Approved Resolution No Greenhouse Gas Action Plan ***For the record Resolution No was moved up for vote. Originally listed later in the Agenda. Motion made by Commissioner Trumbull and second by Commissioner D Emilio to adopt Resolution No formally adopting the Final Climate Change Action Plan and

5 Page 5 direct the Township Manager to commence implementation of the measures, including the formation of a committee to oversee the implementation, assist in public outreach and education and prepare an annual report. Roll Called. All were in favor. Approved Approval of Warrants Motion made by Commissioner McGarrity and second by Commissioner Broido to approve the following warrants: G.F. P/R Warrant No. 279 in the amount of $ 477, G.F. P/R Warrant No. 280 in the amount of $ 468, G.F. Bus. Warrant No. 768 in the amount of $ 1,000, S.F. P/R Warrant No. 377 in the amount of $ 24, S.F. P/R Warrant No. 378 in the amount of $ 24, S.F. Bus. Warrant No. 769 in the amount of $ 577, H.U.D. Warrant No in the amount of $ 169, Township Manager and Finance Director are to work on distinguishing payroll hours as 35 or 70 pertaining to employees that work in two different departments. For example, the Fire Marshal position. Roll Called. All were in favor. Approved Ordinance No. P Modification to Utility Cuts/Restoration (2 nd Reading) Motion made by Commissioner Holmes and second by Commissioner Oliva to adopt the second reading of Ordinance No. P AN ORDINANCE OF THE TOWNSHIP OF HAVERFORD, COUNTY OF DELAWARE, COMMONWEALTH OF PENNSYLVANIA, AMENDING THE GENERAL LAWS OF THE TOWNSHIP OF HAVERFORD, CHAPTER 157, ARTICLE III, EXCAVATIONS AND OPENINGS, SECTION , RESTORATION OF SERVICE FOLLOWING EXCAVATIONS, TO REQUIRE PERMITTEE TO BACKFILL, RESTORE AND REPAIR EXCAVATIONS AND ESTABLISHING STANDARDS FOR SUCH WORK. Roll Called. All were in favor. Approved 9-0.

Ordinance No. P Traffic (2nd Reading) Motion made by Commissioner Holmes and second by Commissioner Trumbull to adopt the second reading of Ordinance No. P authorizing installation of traffic restrictions on the following highways: Special Purpose Parking Zones at 552 Wales Road Roll Called. All were in favor. Approved Ordinance No. P Telecommunication Lease Agreements with Zayo (2nd Reading) Motion made by Commissioner Holmes and second by Commissioner Broido to adopt the second reading of Ordinance No. P authorizing lease agreements with Zayo for installation of certain telecommunication equipment on the following grounds: 2080 Old West Chester Pike, Havertown, PA, 2325 Darby Road, Havertown, PA and 3500 Darby Road, Haverford, PA, with further review by the Township Solicitor and further subject to the approval of the Township Manager. Roll Called. All were in favor. Approved Ordinance No. P Amendment to Chapter 175 Vehicles and Traffic (2 nd Reading) Motion made by Commissioner Heilmann and Commissioner Oliva to adopt the second reading of Ordinance No. P by further amending and supplementing Chapter 175, Vehicles and Traffic to add an additional Special Parking Zone to Schedule XX ( ) Parking on Public Property, by further regulating the use and parking of motor vehicles in public parks. This ordinance pertains to the Polo Field. Roll Called. All were in favor. Approved Ordinance No. P Amendment to Chapter 126 Parks, Playgrounds and Township Property (2nd Reading)

7 Page 7 Motion made by Commissioner Heilmann and second by Commissioner Trumbull to adopt the second reading of Ordinance No. P by further amending and supplementing Chapter 126, Parks, Playgrounds and Township property, Section 126-3, General Regulations Governing Parks, is hereby amended by the inclusion of additional regulations for the use and parking of motor vehicles in public parks. This is the second part of the Polo Field Ordinance. Roll Called. Approved Ordinance No. P Traffic (1 st Reading) Motion made by Commissioner Broido and second by Commissioner McGarrity to adopt the first reading of Ordinance No. P authorizing installation of traffic restrictions on the following highways: ESTABLISH RESIDENTIAL PARKING ONLY on the following roadway: a. on the south side of Old Manoa Road, Monday thru Friday, 8 am to 4 pm. ESTABLISH SPECIAL PURPOSE PARKING ZONES on the following roadway: a. in front of the property at 210 Hastings Avenue. Mr. Broido and Mr. McGarrity have spoken about the need for extra parking spaces for those that take the R100. They will be looking into Go Green Parking (extra parking spaces) at the corner of Karakung and Manoa Road Mr. Broido will contact State Rep to see if funding can be provided. Roll Called. Approved 8-1. Mr. McGarrity voted no until further investigation of the go green parking. 14. Ordinance No. P Carbon Monoxide Detectors (1 st Reading) Motion made by Commissioner D Emilio and second by Commissioner Holmes to adopt the first reading of Ordinance No. P further amending and supplementing Chapter 86, Fire Prevention, Section 86-5, additions, deletions and modifications to Fire Prevention Code, to add Carbon Monoxide Detectors to the alarm requirements of high hazard buildings and multi family dwellings. Mr. D Emilio stated that this Ordinance is necessary to protect employees and residents due to the Carbon Monoxide leak which occurred in Manoa Shopping Center.

8 Page 8 The Fire Marshal, prior to issuing a Certificate of Occupancy, will take care of the inspection for detectors. 15. Acceptance of 2009 Civilian and Police Pension Plan (Minimum Municipal Obligation) Motion made by Commissioner Broido and second by Commissioner Trumbull to accept the Township s 2009 Civilian and Police Pension Plan - Minimum Municipal Obligation (MMO). Roll Called. All in favor Discussion and Action: a. Board of Commissioners 90 Minute Work Session Each Month Motion made by Commissioner Broido and second by Commissioner Holmes to add a 90 Minute Work Session of the Board, to be scheduled no more than two weeks prior to the regularly scheduled Board of Commissioners Monthly Meeting. Mr. McGarrity made the motion to TABLE this motion because Mrs. Rushforth will not be sitting on the Board after the Special Election. Mr. D Emilio second to TABLE. Roll called to TABLE NO TO TABLE 7 2. Mr. D Emilio and Mr. McGarrity voted Yes. Motion was amended to read until the end of 2008 by Mr. Oliva and accepted by Mr. Broido and second by Mr. Holmes. Citizen s Forum needs to be part of the work session. Meetings will be televised. Roll Called. Vote was Mr. D Emilio and Mr. McGarrity voted No and Mrs. Rushforth abstained. b. Discharge Tank RHM Motion made by Commissioner Broido and Commissioner Oliva to grant permission to the Radnor-Haverford-Marple Sewer Authority to: explore locations along Darby Creek, owned by Haverford Township, to determine if and where it might be appropriate and feasible to locate a tank or other equipment necessary to address the overflow problem which occurred during wet weather conditions, place the matter on the agenda of any

9 Page 9 Township subsidiary boards to commence public meetings as soon as possible. RHM will bear the costs associated with the exploratory process and any projects proposed as a result of any recommendations made following the exploratory process. This needs to be approved due to excessive sewage that occurs during storms and is a safety issue. There will be no expense to the Township but to RHM. Roll Called. Approved 8-0. Commissioner Trumbull not present for vote. 17. Presentation by Larry Gentile, Township Manager - Single Stream Recycling Mr. Gentile presented a PowerPoint overview of Single Stream Recycling to the Board and residents. The advantages of single stream recycling are: recyclables all are put in one container, picked up once per week, less fuel used by vehicles, more residents will recycle which will bring up tonnage and higher grant money to the township and lower the tonnage of trash fees that the Township will now have to pay to drop off trash at the County. Mr. Gentile and staff members will begin to educate residents beginning tomorrow. 18. Contract Awards Public Works Salt Contract Motion made by Commissioner Trumbull and second by Commissioner Oliva to award the Salt Contract to Oceanport Industries, in the amount of $69.04 per ton, submitting the lowest responsible bid. Roll Called. All in favor Finance iseries Upgrade (AS400) Motion made by Commissioner Trumbull and second by Commissioner Oliva to purchase a iseries Upgrade - CPW 3,800 from Essex Technology Group, Inc., Rochelle Park, NJ, in the amount of $22, The AS400 is what the Finance Department runs their software with. This is a must upgrade. Roll Called. All in favor. 9-0.

10 Page Continuation of Non-Agenda Items - Mr. Houseworth 129 Landover Road Recycling/Trash Mr. Houseworth is in favor of Single Stream and remembers when pick up was one day a week. He questioned the 40 lb limit it is not very heavy. 20. Other business Commissioner D Emilio 1 st Ward Mr. D Emilio would like to have a disk made on Single Stream Recycling. He thanked all Emergency Services personnel for all their help with the Carbon Monoxide leak at the Manoa Shopping Center. Flu shots will again be available in October. Commissioner Oliva 2 nd Ward Ribbon cutting ceremony will be held on September 19 th at 10:00 a.m. at Haverford Reserve. Ribbons will be placed throughout the Township remembering Ovarian Cancer Month. Motion was made to accept Single Stream Recycling and second by Commissioner Rushforth. All were in favor Commissioner Rushforth 4 th Ward (see attachment in Minute Book) Mrs. Rushforth announced Haverford Reserve, Havertown Day, the Library s Open Book Gala and thanked everyone for Single Stream Recycling. Commissioner Heilmann 5 th Ward Commissioner Heilmann announced Coopertown Civic and Brynford Civic Association upcoming party. Mr. Heilmann made a motion which was second by Mr. Oliva to send a letter to DEP stating the displeasure of the Township in not being adequately informed about the Mosquito Spraying.

11 Page 11 All were in favor Mr. Heilmann made a motion to add an additional $30,000. to help the Library with expenses until the end of the year. Motion second by Mr. Trumbull. Mr. Holmes made a motion to TABLE until the Work Session. This was second by Mr. Oliva. All in favor to TABLE He has placed the additional signage below STOP Signs at Blackburn and Highland stressing to drivers to STOP and lists fees. Full stop free, rolling stop $108. Your choice. Courtesy of the Haverford Police Department He thanked everyone involved in the investigation of Speed Hump Research. This will be on next months Agenda for Highland Lane. Commissioner Trumbull 3 rd Ward Mr. Trumbull reiterated that the Spraying was the responsibility of DEP and not Greg Vitali. Commissioner Holmes 6 th Ward Mr. Holmes reminded everyone that school is back be careful His next newsletter will announce his upcoming meeting at Chestnutwold School. He thanked the Police Department for addressing the traffic concerns around Chestnutwold School. He is very happy about Single Stream Recycling. We need to support this. He announced Havertown Day on October 4 th. Commissioner McGarrity 7 th Ward Mr. McGarrity offered sympathy to Lori Widdop and her family upon the recent death of her father. He offered get well wishes to Steve Campetti. The Grange would like to have a meeting in October and would like Commissioners Wechsler, Rushforth and Oliva present. He thanked Manoa Post 667 for attending tonight and reminded everyone of the upcoming Toys for Tots Christmas Collection.

12 Page 12 Commissioner Broido 8 th Ward Mr. Broido indicated that a Proposed test for parking at Chatham Park Elementary School have been delayed due to 2 Modular classrooms taking up space in the parking lot. Mr. Broido is requesting support from Mr. D Emilio for the 90 minute work session. Commissioner Wechsler 9 th Ward Mr. Wechsler thanked Dave Pennoni and Police Department for helping to cut the speeding at Peach Lane and on Stump. He thanked all Emergency staff that participated in the crisis last week at the Manoa Shopping Center. It does prove that all staff can work affectively together. 911 Dispatch Center Effective November 4 th at 10:00 a.m. The Township will convert over to 911. Do not call Residents will be using Mr. Wechsler asked for motion to adjourn which was made by Mr. Holmes. All were in favor. ADJOURNED 11:15 P.M.
