1 FILLMORE CITY COUNCIL MEETING April 19, 2016 Minutes of the regular meeting of the Fillmore City Council held April 19, 2016 in the Council Chambers of the Fillmore City Building. Notice of the time and place of the meeting was posted on the Utah State Public Notice website, the Fillmore City website, the Council Chambers, the City Office bulletin board, and the President Millard Fillmore Library. Notice was also provided to the Chronicle- Progress, radio station KMTI and each member of the governing body on April 15, Those present were: Mayor: Eugene R. Larsen Council: Michael D. By: Councilmember Mitchell Second: Councilmember Jenson Purchase Order MOTION: To approve Purchase Order # $9, to purchase crack seal for city streets from Staker Parson Companies. 2 COMMUNICATIONS AND REQUESTS Community Family Night Out - Ammon Thompson A community Family Night Out event will take place on April 27 th, 2016 from 6:00pm to 8:00pm. The goal of the event is to promote a healthier, drug-free community. Dinner will be provided at the Millard High School Gymnasium. There will be a couple of work sessions and presentations to educate the community on prevention topics and issues. Games will also be provided for the younger children. Update on National Guard Possibly Moving to Fillmore Wayne Jackson Officials from the National Guard will be meeting with officials from Fillmore City and Millard County on May 16, 2016 where a proposal drafted by the National Guard Committee will be presented. A large facility will be built in Nephi, Utah, however, there remains a chance that Fillmore can accommodate operational needs for the Guard at the Fillmore City Airport location. The main concern is utilities and how much it will cost the city to get it set up for them. It remains unknown exactly what the Guard needs until a layout is given to the committee. All members of the city council and county commission are encouraged to attend the luncheon that will be held when the National Guard arrives on May 16 th. Flowell Electric Request to Regulate Location of Power Meters for all New Construction Flowell requests to be involved in establishing the location of the meters on all new builds in Fillmore. Their desire is to be involved in the construction inspection process that the city currently uses. They want to ensure they have a good public utility easement and access to facilitate in maintenance and meter reads. The Fillmore city office and Flowell Electric will need to meet together to determine what will need to happen in terms of policy changes to allow Flowell Electric to be involved in the construction inspection process. MOTION: To table this item until the next regularly scheduled city council meeting. By: Councilmember Rhinehart Second: Councilmember Mitchell Jamon Davies Eagle Scout Project There are a few Eagle Scout projects that can be done to enhance the property between the pool and the city office building and next to the splash pad. A lengthy discussion ensued regarding what can be done, including repairing the slide on the playground, getting rid of some unwanted lawn, laying some concrete for an ADA compliant sidewalk, and cleaning up the unkempt pea gravel. The city council is in support of these Eagle projects.

3 BUSINESS Resolution Six County Pre-Disaster Mitigation Plan Chelsea Bakaitis, Six County Association of Governments Chelsea Bakaitis presented the Pre-Disaster Mitigation Plan. Council adoption of the plan will allow the city to be eligible to apply for mitigation grants through the Federal Emergency Management Agency over the next five years. Adoption of the resolution includes recognition of the threat that natural disasters pose on citizens and property within Fillmore City, and what the city can proactively do to mitigate these threats. These funds cover all natural disaster hazards. Amount of Power Fillmore City Will Sign for on New Intermountain Power Project (IPP)Natural Gas Plant The current percentage of power share for Fillmore City is.512%. This percentage amounts to approximately nine megawatts from the coal-fired plant that produces 1,800 megawatts. IPP will be building a 600 to 800 megawatt power system. At 800 megawatts, Fillmore City s share at the current percentage will amount to about four megawatts. Fillmore City does not make payments on its.512% ownership in IPP; cities in southern California make the payments. If the city were to need more power, it could call some of that power back and then make payments on that additional amount of power called back. MOTION: To approve Fillmore City to sign for.512% share of power from the new Intermountain Power Project gas plant; also to authorize the Mayor to purchase more shares if needed and when available upon consulting the city council first. By: Councilmember Jenson Second: Councilmember Mitchell Land Purchase of Two Lots Located at Approximately 250 North Main Street There are two properties south of Cluff s Carhop café that need to be purchased by Fillmore City in order to be able to complete the Main Street Drainage project. The land will be used to place a settling pool for the drainage water before it is released into the creek.

4 MOTION: To approve Fillmore City to purchase the north lot for a price of $32, and the south lot for a price of $12, located at approximately 250 North Main Street. By: Councilmember Adams Second: Councilmember Rhinehart Fire Department Request for Emergency Use Credit Card A lengthy discussion ensued regarding issuing the Fire Department an emergency use credit card. MOTION: To approve an emergency use credit card for the Fillmore Fire Department with stipulations governing it s use. Those stipulations include making purchases with the card only in emergency situations. There will be a $ purchase limit on the card. Any time a purchase is made on the credit card a receipt must be submitted to the city office not longer than 24 hours upon returning from the trip. All purchases must adhere to the Fillmore City Purchasing Policy. Any violations of these stipulations will result in revocation of any and all credit card purchasing privileges. By: Councilmember Holt Second: Councilmember Mitchell Amendment to Sterling Codifiers Contract In reviewing the original Sterling Codifiers contract, it was requested that Sterling Codifiers create a current 1995 code, and that it remain in the same order as it is currently before they do any recodification. This request resulted in an additional contract amount of $ The additional $ for this service will result in less cost to the city because if Sterling Codifiers were not to perform this step, both Attorney Greathouse s and Recorder Orton s time reviewing it would result in a greater cost to the city. The addition moves the base price of the project from $8, to $9, MOTION: To approve the additional $ cost to the Sterling Codifier contract to recodify the Fillmore City codebook. 5 COUNCIL REPORTS Councilmember Jenson (Lars Rasmussen) Water Lars Rasmussen updated the council on the Natural Resources Conservation Service (NRCS) funding project to mitigate the Center Street flooding problem. The sponsor of the project will be responsible to pay 25% of the project. The original damage report submitted to Congress was not approved for funding. There has since been a new damage report submitted and it is anticipated that this one will be approved based on changes made. The city council will meet with the county commission to discuss how they want to move forward with the project. The culinary water system upgrade is moving along fine. The city needs to start acquiring easements to facilitate the completion of the project. Electric Councilmember Jenson attended a meeting with NuScale and UAMPS to discuss a nuclear reactor project. They have a goal of getting the reactors up and running by the year Councilmember Mitchell Landfill Councilmember Mitchell will have amounts available to share at the next meeting regarding a possible part-time landfill employee. Once that information is provided Recorder Orton and Mayor Larsen will determine if the budget will allow for that expense. Parks The city public works department does a great job of keeping the parks clean and looking good. There is more work needed to bring them to an exceptional level of cleanliness and appearance. The council will consider allowing service projects to be completed by community members or those who are required to provide community service. Councilmember Rhinehart Cemetery The cemetery expansion project is complete as far as funding is concerned. A sprinkler system needs to be installed. Any additional work will need to be funded from interest earned in the city s perpetual fund account. Airport The Bureau of Land Management is likely to contribute $42,000 to the airport apron resurfacing project. Councilmember Adams Celebrations The Celebration Committee will be meeting on April 25 th to begin preparations for the Fourth of July Celebration. Disaster and Emergency There will be a Community Emergency Response Team (CERT) conference on April 22, 2016 in Richfield. There will be sixteen people from Fillmore attending.

6 Streets The Department of Wildlife has been approved to eliminate up to 100 deer in Fillmore City. This will take place during the end part of April of this year. The city council will need to vote to authorize the removal. Councilmember Holt Sidewalks Public works will be going around the city repairing damage to sidewalks as soon as they complete a few priority projects currently under way. Fire Department Members of the State Department of Wildland Fires will be visiting the Millard County commission to discuss funding for wild land fires. The new fire truck has arrived. Animal Control There were several complaints about dogs over the last two weeks. There are six dogs in the shelter. A dog attacked another dog that resulted in a citation being issued. Attorney Greathouse Attorney Greathouse is working on the IPA agreement. It is currently a top priority. Recorder Orton A tentative budget for the 2017 fiscal year will be ready for review in the first city council meeting in May. Mayor Larsen In order to entice the National Guard to locate operations to Fillmore, it will be necessary to run utility services to the airport. All members of the council agree that this should be done.
