1 FILLMORE CITY COUNCIL MEETING January 3, 2019 Minutes of the regular meeting of the Fillmore City Council held January 3, 2019 in the Council Chambers of the Fillmore City Building. Notice of the time and place of the meeting was posted on the Utah State Public Notice website, the Fillmore City website, the Council Chambers, the City Office bulletin board, and the President Millard Fillmore Library. Notice was also provided to the Chronicle- Progress, radio station KMTI and each member of the governing body on December 28, Those present were: Mayor: Michael D. Alldredge Others: Dan Rowley, Peter Robison, Harold Robison, Zach Leavitt, and Darren Brunson. 6:30 p.m. Welcome and Pledge of Allegiance Mayor Holt Mayor Holt excused Councilmember Dearden ADMINISTRATIVE BUSINESS Minutes MOTION: To accept the minutes from the December 18, 2018 council meeting as corrected. By: Councilmember Alldredge Purchase Orders Purchase Order # for $139, payable to Honnen Equipment Company for purchase of a John Deere 544L wheel loader. MOTION: To approve purchase order # By: Councilmember Mitchell Bills Payroll MOTION: To approve the December 31, 2018 payroll and payment of bills listed on the invoice register dated December 16, 2018 January 3, By: Councilmember Jenson

2 PUBLIC COMMENT Peter Robison asked the council if he can replace the monument base and bricks in the Blue Star Park for his Eagle Scout project. The council gave Peter the okay to go ahead with the project and also told him to let them know if they can help with funding. Mayor Holt wants before and after pictures taken of the monument. Licenses and Permits Building Permit Application #18-51 for Alan Roper/Roper Lumber at 35 West 100 North for a new storage building. Building Permit Application #18-52 for David Barton/TDFI at 735 S Airway Drive for a new storage building. PUBLIC HEARING MOTION: To go into a public hearing at 6:46 p.m. to receive public comment regarding amending the Fillmore City operating budgets for the fiscal year By: Councilmember Mitchell Mayor Holt explained that the purpose of the public hearing is to discuss how to fund a sewer extension project at the Fillmore Airport. Three options suggested were 1) Borrow enough funds from the Electric fund to be paid back from the Sewer fund. 2) Make application for a bond to fund the project. 3) Pay cash for the project from the Sewer fund balance. The council wants to go with the 3 rd option of paying for the project from the Sewer fund balance so that the city does not incur any additional debt. The council also wants to add additional funds to the current year sewer budget to include extending the sewer line at the North Park. Councilmember Dearden arrived at this point in the meeting. MOTION: To go out of the public hearing at 7:13 p.m. By: Councilmember Mitchell Second: Councilmember Jenson A resolution will be proposed at the January 15, 2019 city council meeting to open the sewer fund and increase the budget by $650,000.

3 COMMUNICATIONS AND REQUESTS Fire Department Report Chief Darren Brunson December of 2018 was a relatively quiet month for the fire department. There were 63 fire calls for the year 2018, most of which were grass fires. The average for calls in a year is 57. There were a higher-than-average number of semi-truck calls on Interstate 15. There were a less-than-average number of in-town calls for the year. Mayor Holt asked Chief Brunson about receiving payment for the Interstate fire calls. Chief Brunson said the fire department receives compensation for some of the calls. Typically, trucking companies that are insured by large insurance companies provide payment to the department for the calls. Discussion on Updating the City General Plan Zach Leavitt of Six County Association of Governments A city general plan is required by State statute. A current and updated city plan opens up funding sources such as Community Impact Board (CIB) funds and many other funding sources. Cities that have a plan in place are more likely to receive those funds and grants. Many successful cities will put in place a general plan advisory board, where several participants work together to make recommendations to the planning commission, who then in turn make official recommendations to the city council. Councilmember Adams would like to see the city form an advisory board. Councilmember Mitchell said he would like the current council to include a method in the plan of when and how much to raise utility rates. Mr. Leavitt said that the CIB is often willing to fund utility rate increase studies. Councilmember Adams expressed an interest in using Professor Michael Clay of Brigham Young University to assist in the plan update as that would cost the city much less than retaining a consultant. Attorney Waddingham asked how detailed the general plan should be. Mr. Leavitt said it depends on what the city s needs are and that if it becomes too detailed, then the whole thing would need to be updated more frequently as changes are needed. The general plan is meant to be an advisory document for the city and should provide broad and general guidelines. Specific changes that are needed can be addressed through ordinances. MOTION: To table approval of city general plan assistance services. 4 Resolution Amending the Fillmore City Personnel Policy The resolution provides a new section in the Fillmore City Personnel Policy that will provide a dress policy specific to public works employees to ensure safety in the work place and to identify public works employees as representatives of Fillmore City. MOTION: To adopt Resolution (formerly presented as Resolution 18-14) with the changes to include removing #5 of section A) Public Works Employee Uniforms, and removing the words from sun exposure /damage from #4 of the same section. By: Councilmember Adams Second: Councilmember Dearden Roll-Call Vote: Unanimous in favor. Motion carried. Ordinance Amending Chapter 16 of the Fillmore Municipal Code Regarding Dogs MOTION: To adopt Ordinance (formerly presented as Ordinance 18-05) with the presented changes. By: Councilmember Alldredge Second: Councilmember Jenson Roll-Call Vote: Unanimous in favor. Motion carried. Resolution Amending the Fillmore City Fee Schedule MOTION: To strike this action item. By: Councilmember Adams Second: Councilmember Dearden COUNCIL REPORTS Councilmember Jenson Other Utah Department of Transportation is recommending a speed limit change on Highway 99 in front of Maverik from 50 miles per hour to 45 miles per hour. There also needs to be a stop sign coming from the road going through the Myers subdivision onto Highway 99. Councilmember Mitchell Streets Councilmember Mitchell suggested the city look into purchasing their own crack sealing machine and doing road repairs themselves. The designated ATV route signs should be taken down

5 184 Fire Department Other Millard County wants to take responsibility over fire suppression. That would mean that the district fire commander would be in charge of all fire suppression. Before decisions are made by the city to approve this action, Councilmember Mitchell will review the agreement(s) between the city and fire district, and by-laws that are currently in place. Councilmember Mitchell recommended the city look into adding additional providers to help with building inspections in order to expedite the building permit process. A policy will need to be adopted and a list of providers created that contractors can choose from Councilmember Dearden Library A steam lab will be introduced in the library as a result of the building renovation. A Dr. Suess event and a princess party are two events that are being planned. Celebrations The winners for the Christmas lighting contest were: Richard and Judy Krause and Tracy and Lynette Keel tied for 1 st place. Brandon and Darci Winget and Shane and Kristi Crosland tied for 3 rd place. Honorable mentions included Charles Carling, Josh Cranney, Brandon Cummings, Steve Frampton, Craig Grose, Richard Robins, Marshall Sheriff, Travis Stephens, and Jay Wilcox. Councilmember Adams Justice Court The number of traffic violation cases in December was 28. There were 5 misdemeanor cases. Councilmember Adams will provide a yearly review in the January 15, 2019 council meeting. Councilmember Alldredge No report Attorney Waddingham There was a dog case that went to the District Court recently where the defendant did not show up. The case was remanded back to the city justice court. That case is now closed. Mayor Holt Corrina Kesler will be retiring as the city CERT (Community Emergency Response Team) Commander. There may be a new member elected to the Community Impact Board (CIB) who is from Sanpete County. Sanpete County is the second largest recipient in Utah of CIB funding.

6 Sunrise Engineering is assisting the city with a CIB application to help fund an airport development project.
