1 FILLMORE CITY COUNCIL MEETING June 7, 2016 Minutes of the regular meeting of the Fillmore City Council held June 7, 2016 in the Council Chambers of the Fillmore City Building. Notice of the time and place of the meeting was posted on the Utah State Public Notice website, the Fillmore City website, the Council Chambers, the City Office bulletin board, and the President Millard Fillmore Library. Notice was also provided to the Chronicle-Progress, radio station KMTI and each member of the governing body on June 3, Those present were: Mayor: Eugene R. Larsen Council: Michael D. Rhinehart Others: Forrest Roper, Darren Brunson, Tracy Whatcott, Wayne Jackson, and Cloyd Day 6:30 p.m. Welcome and Pledge of Allegiance - Mayor Larsen ADMINISTRATIVE BUSINESS Minutes MOTION: To approve the minutes of the meeting held May 17, By: Councilmember Mitchell Bills Payroll MOTION: To approve the May 31, 2016 payroll and payment of bills listed on the invoice register dated May 18, 2016 June 7, By: Councilmember Rhinehart Second: Councilmember Holt COMMUNICATIONS AND REQUESTS Law Enforcement Report Lieutenant Burton Lieutenant Burton summarized law enforcement activity in Fillmore for the month of April. There were 2 traffic accidents, 7 citations issued for 9 violations, 124 CAD calls were received and there were 102 incidents that resulted in 4 arrests for 8 offenses. The juvenile/ youth offenders department has no one available to supervise a re-painting project at the freeway underpass. The work crew at the jail will schedule a time for the jail inmates to paint.

2 Fire Department Report Chief Darren Brunson There have been twenty-nine fire calls since the first of this year. Eight of those calls came in the month of May. The burn season will be closed on June 15, The fire department is expecting a very busy fire season this year. The wet winter and spring have allowed plenty of growth. Recently there were two fires set deliberately, including one at Mountain View Mushrooms that caused significant damage and loss of inventory. Law enforcement is searching for those responsible. The number of freeway crashes has significantly dropped since the speed limit was increased to eighty miles per hour, however, when there are crashes, they are more serious. The new fire truck is in service and is being used. The fire crew has spent the last two weeks training to use the truck. They are fully trained. Results from Planning Commission voting for Chair and Vice-Chair positions for Ryan Hansen is now the Fillmore City Planning Commission Chairman and Chad Kunz is the Vice-Chairman. Ryan Hansen s term expires June 30, 2018 and Chad Kunz s term expires June 30, Emergency Preparedness Exercise on June 9, 2016 with the Utah Health Department Forrest Roper The Millard County Sheriff s Department will be working with the Utah Health Department to conduct a community assessment for public health emergency response. The assessment will be done throughout Fillmore by trained volunteers to assess the health and preparedness of citizens in Millard County. BUSINESS Wildland Fire Mitigation Agreement The council discussed the terms of the agreement as explained in the May 17, 2016 council meeting, including the in-kind work that should be completed and reported to fulfill the $8,000 insurance payment in exchange for wildland fire protection. MOTION: To accept the wildfire prevention, preparedness, and suppression contract with the Utah Wildland Fire when it comes due in By: Councilmember Holt Property Exchange with Utah National Guard Wayne Jackson, Tracy Whatcott, and Cloyd Day A deed needs to be drafted for the land exchange proposal. Items that need to be included in the deed are: 50 acres with a possibility of additional acreage if needed A deed to the State Army Board A revisory plan to state that the land will be returned to Fillmore City should nothing be done with the land after 15 years Land can only be used for things that are considered Military Active Utility hook-ups will be available to the property

3 There was a question asked as to why Fillmore City would want to acquire the National Guard Building. It could be used for a convention center. 4H currently uses the building, and other organizations may want to also make use of it. The building will experience more usage if the city takes ownership. The council is looking at costs associated with the building, such as monthly utility usages. The building is ADA compliant and asbestos removal has been completed. Electric Cost of Service Study The city needs to be able to provide accurate information in terms of being able to explain electricity rate changes when renewable energy sources are introduced to the city electric system. Utah Association of Municipal Power Systems (UAMPS) will provide a company to provide a highly detailed study of what it takes to keep the system operational. Upon completion of the study, the city will know what price to set the rates for those who will be using renewable energy sources. It is necessary for the city to conduct this by a third party professional organization to avoid problems by arbitrarily setting new rates. The city will need to expedite this study as the current power hook-up moratorium expires August 16, MOTION: To approve the study to be conducted at a cost of $16, By: Councilmember Holt Second: Councilmember Jenson Closed Executive Session MOTION: To go into a closed executive session to discuss the acquisition of real property. By: Councilmember Jenson At 8:13 p.m. the city council came out of the closed executive session and resumed in the open meeting. COUNCIL REPORTS Councilmember Jenson Electric The power outage that lasted several hours last week was possibly due to a damaged transformer at the Creamery Substation. The repair costs will be very extensive. The damaged transformer is being bypassed and the airport substation is carrying most of the load for the city. Councilmember Mitchell Parks The pine tree and sprinkler system that were damaged by a lightning strike in the North Park have been replaced and repaired, respectively.

4 Garbage Millard County has not yet filled the new landfill position. The landfill has been operating six days a week. Councilmember Rhinehart Cemetery The sprinkler system has been installed at the corner where the old city building used to be. There will be a service project done to lay the sod that will be overseen by Public Works Director Mitchell. There will be a bid closing on June 9, 2016 for the cemetery paving and the city council will vote on accepting a bid in the June 21, 2016 council meeting. Airport The Bureau of Land Management is willing to contribute $96,000 towards the airport apron project. Fillmore City may need to contribute 10% of the total cost of the entire project. The entire project is expected to cost $250,000. Councilmember Adams Celebrations The names submitted to Mayor Larsen for 4 th of July Grand Marshall are Don Fullmer, Ag Neilson, Jere Brinkerhoff and Jerry Warner. Disaster and Emergency The CERT team will change the training program to include more frequent, incremental training sessions as opposed to setting training dates that are few and far between and that take up a whole weekend at a time. A more gradual approach aims to encourage more training participation. Councilmember Holt Sidewalks There will be an Eagle Scout project to do sidewalk repair work in needed areas of Fillmore. Greg Greathouse There are several easements on the recently purchased property south of Cluff s Drive- In. The reason for the purchase is to put a settling pond on the property to be included in the Main Street storm drain project. Sunrise Engineering will investigate to see if any easements may affect the project. Recorder Orton The city is offering to purchase a piece of property next to the one mentioned above (near Cluff s) and an agreement has not been reached. Mayor Larsen Mayor Larsen asked if any council members can attend the Intergenerational Poverty Meeting in Delta on June 14, 2016 at 10:00 a.m. Councilmember Holt will attend that meeting and report back to the council. Councilmember Mitchell may also be able to attend.
