1 A Publication of the Manufactured Housing Industry of Arizona Volume 14, Issue 06 H.R Passes U.S. House of Representatives The Manufactured Housing Industry has fought hard on regulations that were a result of the Dodd-Frank Act during President Obama s first term. The almost 6 year battle has started to sway our way at last. On December 1st, the House of Representatives voted in favor of HR 1699 (Preserving Access to Manufactured Housing Act). Seven of our nine members of Congress (Sinema, Biggs, Franks, Schweikert, McSally, O Halleran, and Gosar) voted in favor of the bill, which passed with a vote of 256 to 153 (see full roll call of ayes on page 8). These seven were also cosponsors of the Bill. Ken Anderson President H.R is bipartisan legislation introduced by Representatives Andy Barr (R-KY), Kyrsten Sinema (D-AZ), Bruce Poliquin (R-ME), Terri Sewell (D-AL), David Kustoff (R- TN), and Kathleen Rice (D-NY). The bill has 65 bipartisan cosponsors from across the country. The bill addresses federal regulations that have jeopardized access to manufactured housing financing, disrupted the market, and as a result caused eroding home values for existing owners. The legislation ensures that manufactured housing financing is available for consumers of manufactured homes. The High Cost test imposed by the Consumer Financial Protection Bureau (CFPB) resulted in reduced access to credit by our borrowers, and also increased lender liability associated with small-balance loans. Some lenders reduced or stopped providing such loans to our consumers. HR 1699 modifies the definition of high-cost loans so that manufactured home loans are not unfairly swept under this designation simply due to their small size HR 1699 also clarifies that the definition of Mortgage Originator and Loan Originator do not include Retailers of manufactured or modular homes, unless a Retailer receives compensation from the sale of the loan or assists the consumer during the loan application process. MHI s government affairs team worked diligently on Capitol Hill with House leadership, H.R cosponsors and champions of manufactured housing to secure passage of this important legislation. The grassroots outreach, which included MHIA President Ken Anderson and MHIA members, Cody Pearce, Joe Stegmayer, Manuel Santana and others - was instrumental in helping Representatives understand the importance of this bill to their constituents and to seeing through the misleading claims made by DC-based consumer groups. In his remarks, Representative Barr said, Homeownership for many is part of the American Dream, but overbroad burdensome regulations arising out of the Dodd-Frank Act are limiting the ability of Americans to realize that dream. As members of Congress we have an obligation to protect the American people from regulations that harm their ability to purchase affordable homes for themselves and their families. We need to end government policies that are issued under the guise of consumer protection, when those policies actually are protecting Americans right out of homeownership. A Senate Bill (S 1751) has also been introduced and has been initially approved by the Senate Banking Committee. During our last Legislative Session, both Senators, McCain and Flake, were cosponsors. 2 Applications are Being Accepted for the Dave Blank Memorial Scholarship Program The Dave Blank Memorial Scholarship is an educational scholarship created by the Manufactured Housing Industry of Arizona (MHIA) in the fall of 2016 to honor the memory of Dave Blank who worked for an industry manufacturer for 27 years. Dave Blank firmly adhered to a very high code of ethics and led by example. Dave was dedicated to his family and understood the value of a good education and what a difference it can make in a person s life. Dave Blank The Dave Blank Memorial Scholarship establishes educational programs and opportunities for students who are directly related to a member of the Manufactured Housing Industry of Arizona Association, including spouse, children and grandchildren. The Scholarship is currently limited to $1, per calendar year. The Scholarship Committee will make selection awards to outstanding scholars or students with compelling needs. What types of scholarships and grants are available? The Dave Blank Memorial Scholarship will make financial aid available to students accepted to enroll or currently enrolled at any accredited university or college. The amount of the current award is limited to $1, per year and may vary based on individual needs and/or qualifications. How does a student qualify? MHIA Member related students must forward a copy of the application to the Scholarship Committee at the MHIA office. The application s presentation and thoroughness weigh heavily. The Scholarship Committee will base its decisions on need and/or merit. When are the applications due? Applications are due at the Scholarship Committee office no later than March 28th, for the fall semester of the coming school year. All information must be completed for consideration. When are the awards announced? The Scholarship Committee reviews applications and makes award decisions in early June. Recipients will be notified by mail immediately following the meeting. 5 Senate Banking Committee Passes Bill Giving MH Retailers Relief from Dodd-Frank Act On December 5th, the Senate Banking Committee passed legislation to clarify that a manufactured housing retailer or seller is not considered a loan originator simply because they provide a customer with some assistance in the mortgage loan process. This is a key tenet of S. 1751, the Preserving Access to Manufactured Housing Act, which excludes manufactured housing retailers and sellers from the definition of a loan originator so long as they are only receiving compensation for the sale of a home. The language was passed as a part of S. 2155, the Economic Growth, Regulatory Relief and Consumer Protection Act, which is a package of reforms intended to improve the national financial regulatory framework and promote economic growth. S was passed by the Senate Banking Committee by a bipartisan vote of 16 to 7. In opening the Committee s consideration of the bill, Senate Banking Committee Chairman Crapo (R-ID) said, The reforms in this bipartisan bill help tailor the current regulatory landscape, while ensuring safety and soundness and relieving the burden on American businesses that are unfairly being treated like the largest companies in our economy. MHI worked closely with Senator Joe Donnelly (D-IN), author of the Preserving Access to Manufactured Housing Act (S. 1751) and long-time supporter of manufactured housing, to include this important consumer access provision in the package. The language, included in Section 107 of the package, amends the Truth in Lending Act (TILA) to exclude from the definition of mortgage originator an employee of a retailer of manufactured or modular homes who does not receive compensation or gain for taking residential mortgage loan applications while maintaining consumer protections. U.S. Senator Joe Donnelly said, For many hard-working Hoosiers and Americans, manufactured housing provides the most affordable option available when they look to buy a home. I m pleased the bipartisan regulatory relief legislation that I helped craft and that passed the Senate Banking Committee includes a provision based on my Preserving Access to Manufactured Housing Act. This measure would help prevent federal regulations from getting in the way of financing that families need as they step into homeownership. The passage of S by the Senate Banking Committee affirms MHI s longstanding position that it is inappropriate for a manufactured housing retailer or seller - whose business is to sell homes and who is not receiving any gain or compensation for minimally helping the borrower with the mortgage loan process - to be subjected to compliance requirements and potential liability for areas that are clearly designed to apply only to the actual entity making the mortgage loan. MHI will continue working with its champions as the bill moves through the legislative process. The inclusion of this language in the Senate s financial regulatory relief package is the result of MHI s persistent efforts to ensure the needed changes contained in the Preserving Access to Manufactured Housing Act are passed into law as soon as possible. In addition to the Senate regulatory reform package, H.R. 1699, the Preserving Access to Manufactured House Act, was passed by the U.S. House of Representatives on December 1. The language was also passed as a part of the House s financial reform package (H.R. 10) in June. In September, the House also passed the bill s provisions as a part of its Fiscal Year 2018 Appropriations package. Page 5

7 Manufactured Housing Month in 2018 Ken Anderson met with Governor Ducey s staff this week to request that the Governor consider a month in the near future Manufactured Housing Month.
