One-third of the Senate and every member of the House of Representatives are at home pounding the campaign trail as they prepare for the upcoming election. Midterm elections are often regarded as a referendum on the sitting President s and/or incumbent party s performance. They usually don t turn out well for the party of the President; over the past 21 midterm elections, the President s party has lost an average of 29 seats in the House and an average of 6 seats in the Senate. 2 Senate Races Update Source: The Cook Political Report Current Senate Lineup: 53 Democrats, 45 Republicans, 2 Independents (32 seats up in 2014) Democrats are at a disadvantage of having to defend 21 seats with Republicans defending 15. Republicans would need a net gain of six seats to take the majority and are on track to pick up between four and seven seats, meaning it will be a slim majority for either party. House Races Update Source: The Cook Political Report Current House Lineup: 233 Republicans, 199 Democrats, 3 Vacancies Republicans hold the majority in the House with 233 seats. For Democrats to take control of the House they would need to secure 17 seats. Large shifts or a change in partisan control of the House are unlikely due to President Obama s low approval ratings and the GOP s midterm turnout advantages. Republicans appear on track to expand their House majority by between two and 12 seats.

3 Pharmacy Bills Continue to Gain Support in Congress NCPA has continued to educate members of Congress and their staffs about NCPA s legislative priorities and bills. NCPA Federal Legislative Priorities H.R Preferred Network Fairness Legislation On May 6th legislation was introduced by Representatives Morgan Griffith (VA) and Peter Welch (VT) that would allow independent pharmacies to participate in preferred networks if: one or more of their stores are located in a health professional shortage area; one or more of their stores are located in a medically underserved population; and if they can meet terms and conditions that are comparable to other in-network pharmacies. Wilson, Joe [SC-2] H.R Generic Drug Pricing Transparency Bill On April 9th legislation was introduced by Representatives Doug Collins (GA) and Dave Loebsack (IA) that would provide transparency and fairness to community pharmacies regarding their reimbursements for generic drugs. This measure would require pharmacy benefit managers (PBMs) to disclose the rate of reimbursement in the contract and to update that rate at least once every seven days to reflect fluctuations in the market. Young, Don [AK] S. 867 PBM Audit and Generic Drug Pricing Transparency Legislation This bill addresses the lack of generic pricing transparency on the part of PBMs in the Medicare Part D program and promotes fairness by curbing abusive PBM audit practices. It would ban extrapolation, prohibit recoupments based on minor typographical errors that have

4 no financial harm to patient or plan, and assure recoveries made in cases of fraud, waste, and abuse be returned to taxpayers and beneficiaries, not retained by PBM middlemen. Lead Sponsor: Sen. [CT] H.R Provider Status Bill This bill would recognize pharmacists as providers under the Medicare Part B program. If enacted, pharmacists would be able to perform services for patients consistent with the state scope of practice law in which they practice for patients that reside in medically underserved areas. The bill would allow pharmacies the opportunity to submit a corrective action plan prior to having their DEA license revoked or suspended. It also seeks to create a more collaborative partnership between drug manufacturers, wholesalers, retail pharmacies, and federal enforcement and oversight agencies.
