1 251 The Regular Meeting of Oakmont Borough Council was called to order at 7:55 PM by President Winkler. Present: Messrs. Benusa, Bland, Favo, Kennedy, Myers and President Winkler, members of Council; Mayor Peoples; Solicitor Shoop; and, Roger A. Dunlap, Jr., Borough Manager and Ex-Officio Borough Secretary Excused: Mr. Fitchwell Visitors: Byron Beard, Marsha Berger, Nancy DeTar, Thomas Bonaroti, Kathie Bonaroti, Natalie Cichoski, Ken Doyno, Carolyn Fuchs, Dan Fuchs, David J. The following reports from Borough Officers and Departments were circulated among the members of Council for examination and review: Borough Treasurer s Report for the month of August 2005, dated August 31, 2005, shows a Book Balance in the General Fund, as of August 31, 2005, of $928,586.89; Budget Report for August 2005 Police Department Report for the month of August 2005; Wage Tax Report of Collections for the month of August 2005; Hoffman Kennel Report for the month of August 2005; Secretary s Report of Collections for the month of August 2005; and, Volunteer Fire Department Report for the month of August At 7:57 PM, President Winkler continued the Public Hearing from August 29, The purpose of the Hearing was to receive testimony relative to proposed Ordinance No. O , amending the Zoning Ordinance by establishing a Mixed Use District and a Riverfront Overlay District.

2 252 The Public Hearing concluded at 8:46 pm. A record of the Hearing can be found in transcript form and is attached to these Minutes. Borough Manager Roger Dunlap referred Council Members to the 2006 Budget Calendar he had prepared for their consideration. Based on the proposed calendar, the 2006 Budget Ordinance is slated for passage at the December 12, 2005 Regular Meeting of Council. Mr. Favo offered Resolution No. R , and moved for its adoption, for the approval of Claims from the General Fund (Fund #1, Voucher Nos to 22042) in the amount of $275,572.85; from the Payroll Fund (Fund #2, Voucher Nos to 6081) in the amount of $146,099.76; from the Sewer Revenue Fund (Fund #6, Voucher Nos to 6580) in the amount of $81,039.36; from the Library Fund (Voucher Nos to 2970) in the amount of $49,117.51; and, from the Centennial Fund (Voucher Nos. 388 to 399) in the amount of $827.96, for a total of $552, Mr. Kennedy seconded the motion, and all those members of Council present voted in the affirmative. Ordinance Book Volume 29, Page 57, as Resolution No. R Mr. Favo offered a motion to adopt the 2006 Minimum Municipal Obligation (MMO) for the Police Pension Plan. Mr. Kennedy seconded the motion. Mr. Dunlap noted that the Police Pension Fund was fully funded and required no obligation for funding on either the part of the Borough or its police officers. Mr. Favo offered a motion to adopt the 2006 Minimum Municipal Obligation (MMO) for the General Employees Pension Plan. Mr. Bland seconded the motion. Mr. Bland noted that the General Employees Pension Fund was not fully funded and required an obligation of $8000 in 2006 on the part of the Borough. Mr. Bland offered Resolution No. R , and moved for its adoption, a resolution approving, adopting and placing into

3 253 immediate effect the Emergency Operations Plan of the Borough of Oakmont, dated June Mr. Benusa seconded the motion. Mr. Kennedy asked if this had been discussed before. President Winkler said that it had. He asked about the designation of titles in the Plan. Emergency Management Coordinator Hugh Teitelbaum said that slots had been created for appointment at a later date. He added that a core committee had already been formed that included Theresa Creighan and Jason Krut. Mayor Peoples mentioned that, in the past, the Borough had called upon qualified community members to assist in emergency situations, and that these residents were still available when needed. President Winkler commended all those who had prepared the Emergency Operations Plan. Ordinance Book Volume 29, Page 58, as Resolution No. R In light of testimony taken at the Public Hearing, the motion to adopt Ordinance No. R was tabled, and will be acted upon at a future meeting. Mr. Benusa offered Resolution No. R , and moved for its adoption, a resolution urging the rescindment of the Stop Work Order on the Alle-Kiski Bridge and Connector Project, and to immediately resume work on the project through to completion. Mr. Bland seconded the motion, and all those members of Council present voted in the affirmative. Ordinance Book Volume 29, Page 59, as Resolution No. R Mr. Benusa offered a motion to authorize the execution of a Confirmation of Assignment with HRG, Inc. for engineering review services for the Walgreens Development, relative to the Highway Occupancy and Traffic Signal Permits. Mr. Favo seconded the motion. Mr. Dunlap explained that the Developer s Agreement with Walgreens property owner, The Paradise Group, called for a $2,000 payment to the Borough to cover engineering and other fees

4 254 expended by the Borough. This $2,000 has been spent. The Borough is asking for an additional $2,500, which will not be a surprise to the developer. Mr. Myers offered a motion to authorize the execution of Pay Application No. 3 in the aggregate amount of $26, for Library accessibility improvements. Mr. Kennedy seconded the motion, and all those members of Council present voted in the affirmative. Mr. Kennedy reported that the fall activities schedule has begun at Riverside Park. A Cow Paddy Bingo, sponsored by the school rowing club, will be held on September 24. Steve Stock, 801 Plum Street, complained about commercial vehicles being parked on a lot owned by the Harvaneks on Plum Street. Karen Valenti, 1036 Fifth Street, said that she had had a recent reoccurrence of flooding on her property. She felt it was the Borough s responsibility to maintain the creek bed at the rear of her property, which she feels is the cause of her problem. Natalie Cichoski, 1049 Fifth Street, said she had just become aware that there was an underground creek on her property. She wrote a letter to the Borough concerning this to which the Borough has never responded. Ms. Cichoski said she wanted a letter of intentions from the Borough and a copy of the Borough Engineer s letter concerning this issue. Ted Sokol, 720 Plum Street, wanted to thank the Borough for getting the sewers cleared on Plum Street and for removing the piles of dirt from his property left there after the flood. He asked if the Borough had heard anything from the Corps of Engineers. Mr. Dunlap said a letter had been sent to the Corps early on to which there was no response. Mr. Winkler said the Borough would continue to follow-up on this. There being no further business to conduct that evening, Mr. Kennedy offered a motion to adjourn the meeting, which passed.
