3 CITY OF WEST RICHLAND CITY COUNCIL MEETING TUESDAY, JUNE 20, Call to Order Mayor Gerry called the meeting to order at 7:00 p.m. 2. Roll Call Mayor Brent Gerry and Mayor Pro Tem Rich Buel were present. Council Members Richard Bloom, Gail Brown, Don Engelman, Steven Shupe, and Ken Stoker were also present. Staff members present were Community Development Director Aaron Lambert, Police Chief Ben Majetich, Finance Director Jessica Platt, Public Works Director Roscoe Slade, City Attorney Bronson Brown, and City Clerk Julie Richardson. Upon motion by Councilmember Engelman, seconded by Councilmember Stoker, Council unanimously excused Councilmember John Smart from the meeting. 3. Pledge of Allegiance Councilmember Shupe led the Council, staff, and audience in the recitation of the Pledge of Allegiance. 4. Approval of Agenda Mayor Gerry announced that item 10, Citizens Public Comment, will be moved directly under presentations. Also, under presentations, Community Development Director Lambert will provide information on 4950 Arena Road and The Garden, LLC, DBA Nirvana Cannibus Company. Upon motion by Councilmember Shupe, seconded by Councilmember Engelman, Council unanimously approved the agenda as revised. 5. Presentations Community Development Director explained that The Garden, LLC transferred their license from Prosser to Benton County with plans to open a cannabis store. The requested location is in unincorporated Benton County and is a single parcel located within the corporate boundaries of the City of West Richland. The City of West Richland was not aware of this until last week, and we have no jurisdiction. However, he contacted the Liquor Control Board (LCB) and was told the manager was out for the week and he should write a letter. He wrote and sent the letter advising that a daycare is located 151 feet away. He also wrote that West Richland has banned the retail sale, production and processing of marijuana and this use is incompatible with the neighboring properties. Mr. Lambert said he has not received a response. Councilmember Bloom clarified that the County Commissioners did not approve the cannabis licenses, but they previously approved the retail sale, production and processing of marijuana in the county. The Liquor Control Board issues the licenses. Councilmember Engelman also said the license is granted by the Liquor Control Board. That board notifies the county of the license transfer, but not the city since we don t have jurisdiction. The following West Richland residents (most live close to 4950 Arena Road), expressed their opposition to having a cannabis store on that property in their neighborhood. They pointed out a Richland School District bus stop is right across the street from the proposed store and a daycare is 151 feet away. A suggestion was made to have a write-in campaign to Governor Jay Inslee and the Liquor Control Board. 1

Consent Agenda Upon motion by Councilmember Brown, seconded by Councilmember Engelman, Council unanimously approved the consent agenda as presented. a. Approve Payment of Bills b. Approve and Authorize the Mayor to Execute Benton County Emergency Management Transition and Buy-In Agreement d. Award Transportation Improvement Board 2017 Emergency Repair Project e. Accept Asbestos Abatement Contract for Maintenance Shop Storage Building as Complete f. ORD - Adopting City s Comprehensive Water System Plan and Amending WRMC Sections and ORDINANCE AN ORDINANCE OF THE CITY OF WEST RICHLAND, WASHINGTON, RELATING TO COMPREHENSIVE WATER SYSTEM PLAN AMENDING SECTIONS AND TO THE WEST RICHLAND MUNICIPAL CODE g. ORD - Revising Corporate Boundary to include portion of Kennedy Road ROW ORDINANCE AN ORDINANCE OF THE CITY OF WEST RICHLAND, WASHINGTON, REVISING THE CORPORATE BOUNDARY OF THE CITY OF WEST RICHLAND TO INCLUDE A PORTION OF KENNEDY ROAD. 5 ORDINANCE ALSO DECLARES THAT THE PROVISIONS OF THE ORDINANCE ARE SEVERABLE FROM ONE ANOTHER AND SETS FORTH THE EFFECTIVE DATE OF THE ORDINANCE AND PROVIDES FOR PUBLICATION BY SUMMARY 7. Ordinances, Resolutions, Motions, and Public Hearings a. Public Hearing Six-Year Transportation Improvement Program Public Works Director Slade presented a recommendation to approve resolution adopting the Six Year Transportation Improvement Program. He provided an overview of the proposed changes between the 2017 TIP and the 2018 TIP. Mayor Gerry opened the public hearing at 7:40 p.m. There being no public comments, Mayor Gerry closed the hearing at 7:41 p.m. b. RES Adopting Six-Year Transportation Improvement Program RESOLUTION A RESOLUTION OF THE CITY OF WEST RICHLAND, WASHINGTON, ADOPTING THE SIX-YEAR TRANSPORTATION IMPROVEMENT PROGRAM Councilmember Stoker moved to approve resolution 14-17, seconded by Councilmember Engelman. The motion carried unanimously. 8. Unfinished Business There was no unfinished business. 9. New Business There was no new business. 10. Citizens Public Comment Merle Johnson commented that the city is in the process of amending their zoning code. Considering what is happening with the property discussed earlier in this meeting, he asked council to remove all Commercial General from the zoning code. Mr. Johnson also said that hemp is starting to be grown in Washington State. Hemp is different than marijuana. He said the city needs to prepare itself for the future. Pat Dobson commented on the pot holes on Collins Road. She also heard the city was trying to rezone Flat Top Park to Commercial which she disagrees with. Also, the two BLM properties off Collins Road were supposed to be turned into parks but now they are being zoned residential. John Muenks likes the way West Richland is and isn t looking for a lot of development. Dan Richey agrees with the previous sentiment regarding green space. He commented that it is hard to control the types of businesses that locate in Commercial General. 11. Announcements, Reports & Comments a. Staff Reports Community Development Director Lambert commented on rezoning and the Comprehensive 3

6 Plan, stated that the zoning designation on all city owned parks was changed to park use at the last workshop, so Flat Top is not being zoned commercial. Regarding the BLM properties, the city applied to acquire those properties in 2007, but BLM hasn t gone through the process to surplus it yet. As soon as the city acquires it, it will be designated as park use. Finance Director Platt will be sending the Annual Financial Report to Council. Public Works Director Slade advised there will be a staff report at the next meeting to accept the repairs at the Senior Center as complete. He commented that the increased traffic on Bombing Range is due to people cutting through West Richland to get to Richland. He also said one of the projects awarded this evening was for patching Collins and other roads that were damaged due to the rough winter. There are plans to rebuild the bottom of Collins Road in the future. Captain Majetich said there was a 7% decrease in crime in West Richland for 2016 and a total of 36% for the past two years. b. Council Reports Councilmember Shupe reported on the 2060 Affordable Housing Steering Committee meeting. The committee awarded funds to a teen shelter. Councilmember Bloom commented that the location of 4950 Arena Road is wrong on Google Maps. He also explained the new Ben Franklin Transit route 210. Ben Franklin Transit is working on becoming more travel friendly with less transfers. Mayor Pro Tem Buel suggested that Community Development Director Lambert contact Richland School Superintendent Schulte regarding the siting of the marijuana store. He also advised that his work scheduled may affect his attendance for Monday, Tuesday and Wednesday meetings next week. 12. Executive Session There was no executive session. 13. 7 CITY OF WEST RICHLAND CITY COUNCIL WORKSHOP Monday, June 26, :30 P.M. 1. Call to Order Mayor Gerry called the meeting to order at 5:31 p.m. 2. Roll Call Mayor Brent Gerry was present. Council Members Richard Bloom (excused at 6:55 for another meeting), Gail Brown, Don Engelman, Steven Shupe, John Smart, and Ken Stoker were also present. Staff members present were Community Development Director Aaron Lambert, Senior Planner Mike Stevens and Planner Karin Volpe. Upon motion by Councilmember Stoker, seconded by Councilmember Engelman, Council unanimously excused Mayor Pro Tem Rich Buel from the meeting. 3. WRMC Title 17, Zoning Community Development Director Lambert and Senior Planner Stevens continued going through the proposed changes to Title 17, Zoning. Council Members provided their input and suggested changes. Roll Call Mayor Brent Gerry and Mayor Pro Tem Rich Buel (arrived 6:20) were present. Council Members Richard Bloom, Gail Brown, Don Engelman, Steven Shupe, John Smart, and Ken Stoker were also present. Public Hearing Amendments to WRMC 18.25, Critical Areas Mayor Gerry opened the public hearing for the 2017 Comprehensive Plan Periodic Update, Amendments to WRMC Title 17, Zoning and Amendments to WRMC 18.25, Critical Areas at 6:03 p.m. Councilmember Engelman moved to continue the public hearings to August 8, 2017, seconded by Councilmember Stoker. Roll Call Mayor Brent Gerry and Mayor Pro Tem Rich Buel were present. Council Members Gail Brown, Don Engelman, Steven Shupe, John Smart, and Ken Stoker were also present. Staff members present were Community Development Director Aaron Lambert, Senior Planner Mike Stevens and Planner Karin Volpe. Upon motion by Councilmember Engelman, seconded by Councilmember Brown, Council unanimously excused Councilmember Bloom from the meeting. 3. WRMC Title 17, Zoning Senior Planner Stevens provided a red-lined version of changes to the current zoning code and provided an overview. Council Members will review the document and a workshop will be held to discuss on Monday, July 17, 2017 at 5:30 p.m. 4.
