AT LOS ALTOS CITY HALL, 1 NORTH SAN ANTONIO ROAD, LOS ALTOS, CALIFORNIA ESTABLISH QUORUM PRESENT: ABSENT: (Council): Mayor Bruins, Mayor Pro Tem Prochnow, Councilmembers Mordo, Pepper and Satterlee; and (Planning and Transportation Commission): Chair Moison, Vice Chair Meadows, Commissioners Bodner, McTighe, Oreizy and Samek Commissioner Bressack DISCUSSION ITEMS 1. El Camino Real Corridor: Provide direction on the appropriate level of development for the El Camino Real Corridor so staff can draft modifications to the existing policies and regulations that best reflect the desired level of development Public Comments Jeff Potts stated that the current zoning along El Camino Real works well and that the City needs high density housing along El Camino Real. Mircea (no last name given) encouraged maintaining the current zoning standards along El Camino Real. Bryan Robertson encouraged the Council to focus on developing the intersection of El Camino Real and San Antonio Road and to explore creating live/work spaces. Sue Russell, representing the League of Women Voters, stated that the El Camino Real Corridor is the best location for high-density housing and below market rate units. Action: Councilmembers and Commissioners provided feedback on short- and long-term considerations for the El Camino Real Corridor and provided direction for the process to lift the development moratorium. Mayor Bruins called for a recess at 9:15 p.m. The meeting resumed at 9:23 p.m.

Second Living Units: Provide guidance to staff regarding possible changes to the City s regulations regarding the development of secondary units Public Comment Los Altos resident Roy Lave supported reducing the lot size restrictions for secondary units. Action: Councilmembers and Commissioners provided feedback related to secondary living units. 3. Affordable Housing Program: Accept the report and direct staff accordingly Action: Councilmembers and Commissioners directed staff to look at what other agencies are doing related to administration of affordable housing programs. The Planning and Transportation Commission members left the meeting Council Calendar: Discuss and set the Council meeting calendar for the remainder of 2016 City Manager Jordan presented the report. Action: Councilmembers set the following 2016 dates for meetings: October 25, November 8 (if needed and Consent Calendar items only), November 15, December 6 (Council reorganization) and December 13 (Councilmember Mordo will participate via telephone). CHANGES TO THE ORDER OF THE AGENDA At the request of the Council, item number 2 was continued to a future meeting. Mayor Bruins announced that the City Council would hold Open Office Hours on October 26, 2016 from 9:00 a.m. to 11:00 a.m. at Veterans Community Plaza. She further announced the Pumpkin Carving with a Cop on October 29, 2016 from 4:00 p.m. to 6:00 p.m. PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA Abigail Ahrens and Upuia Ahkiong requested the Council recognize November 19 th as Women s Entrepreneurship Day. CONSENT CALENDAR A member of the public pulled item number 5. Action: Upon a motion by Councilmember Satterlee, seconded by Councilmember Pepper, the Council unanimously approved the Consent Calendar, with the exception of items number 2 and 5, as follows: 1. Approved the minutes of the September 27, 2016 regular meeting and October 4, 2016 special meeting.

4 Page 2 of 5 2. Adopt Resolution No authorizing the transfer of surplus funds from the Avalon Assessment District to the General Fund continued to a future meeting. 3. Adopted Resolution No endorsing the carbon fee and dividend legislation proposed by the Citizens Climate Lobby. 4. Approved the Third Amendment to the Santa Clara Valley Urban Runoff Pollution Prevention Program s Memorandum of Agreement and directed the City Manager to execute the amendment on behalf of the City. 5. Introduce and waive further reading of Ordinance No to repeal and reenact the Building and Construction Code, Title 12 of the Municipal Code, to adopt, by reference, the 2016 California Code of Regulations, Title 24, with added local amendments pulled for discussion (see page 2 below). 6. Adopted the revised Investment Policy. ITEMS PULLED FROM CONSENT CALENDAR 5. Ordinance No : Building and Construction Code Amendments: Introduce and waive further reading of Ordinance No to repeal and reenact the Building and Construction Code, Title 12 of the Municipal Code, to adopt, by reference, the 2016 California Code of Regulations, Title 24, with added local amendments Councilmember Satterlee suggested changing the square footage for remodels which triggers requiring installation of fire sprinklers from 500 square feet to 750 square feet. Action: Upon a motion by Councilmember Satterlee, seconded by Councilmember Mordo, the Council unanimously introduced and waived further reading of Ordinance No to repeal and reenact the Building and Construction Code, Title 12 of the Municipal Code, to adopt, by reference, the 2016 California Code of Regulations, Title 24, with added local amendments, changing the square footage for remodels which triggers requiring installation of fire sprinklers from 500 square feet to 750 square feet. Letter re: Aircraft noise: Discuss and approve sending a letter to the Santa Clara County Select Committee on Aircraft Noise regarding Los Altos interest in noise mitigation solutions Councilmember Mordo introduced the item. Los Altos resident Tami Mulcahy (speaking on behalf of herself, April Anair, Pilar Parduci and Tim Mulcahy) encouraged the Council to support a regional solution to aircraft noise. Los Altos resident Nancy Williams, and Robert Jaros opposed the DAVYJ flight path. Marie-Jo Fremont explained the position that Palo Alto took regarding aircraft noise. Los Altos resident Don Gardner (speaking on behalf of himself, Jean Kirk, Timon Gardner and Hui Yang) presented data on why there is more aircraft noise and encouraged the Council to support various measures to reduce aircraft noise. John Dean Smith opposed all proposed flight paths and encouraged the Council to send a letter rejecting the FAA Feasibility Study. Los Altos resident George Fanucci encouraged the Council to support requiring planes to fly at higher elevations. Los Altos resident Thomas Slappendel supported moving air traffic further south and encouraged the Council to support a long-term solution to aircraft noise. Action: Upon a motion by Councilmember Satterlee, seconded by Councilmember Pepper, the Council unanimously approved the Mayor sending the draft letter to the Santa Clara County Select Committee on Aircraft Noise on behalf of the City regarding Los Altos interest in noise mitigation solutions, with amendments as she sees appropriate. Mayor Bruins called for a recess at 10:00 p.m. The meeting resumed at 10:08 p.m. PUBLIC HEARING 8. Ordinances No and : Downtown Building Committee recommendations: Introduce and waive further reading of Ordinance No amending roof structure classifications, their height limits and coverage limits; adding definitions for Penthouse and tower; and amending the design review findings; and do not introduce and waive further reading of Ordinance No reducing the height limit in the CD and CD/R3 Districts

Public Comments John Barton, Kristen Barton and Kevin DeNardi, Los Altos residents Robin Abrams, Emeric McDonald, Abigail Ahrens, Marci Gerston, Liz Nyberg, Alex Glew, Dennis Young (representing the Los Altos Chamber of Commerce), and Meris Ota (representing Los Altos Community Investments) opposed the proposed height limit reduction in the CD and CD/R3 Districts. Kim Cranston, representing Los Altos Property Owners Downtown and Jeff Gilman, representing the Tan Group, supported the staff recommendations to approve the proposed code amendments except for the proposed reduction in the height limit. Los Altos resident Curt Powell encouraged the Council to maintain the beauty of the community. Los Altos residents Pat Marriott, Denis Salmon, Teresa Morris, Roger Heyder, Susan Mensinger, Anita Enander, Catherine Nunes, Jim Jolly and Gerry Madea supported adoption of both ordinances. Fred Sischka, representing Los Altos Village Association, and Los Altos resident Nancy Bremeau encouraged the Council to delay reducing the height limit to the completion of the Downtown Plan. Los Altos resident Bill Maston encouraged the Council to complete an economic analysis and an environmental impact review prior to adopting the ordinances. Los Altos resident Roberta Phillips encouraged the Council to impose a development moratorium for Downtown until after completion of the Downtown Plan. Mayor Bruins and Councilmember Mordo expressed concerns that reducing the height limit in the CD and CD/R3 Districts may not address the perceived problems along First Street and supported looking at other ways to reduce the bulk and mass of future developments. Action: Upon a motion by Councilmember Satterlee, seconded by Councilmember Mordo, the Council unanimously introduced and waived further reading of Ordinance No amending roof structure classifications, their height limits and coverage limits; adding definitions for Penthouse and tower; and amending the design review findings, as amended to limit the height of towers to 12 feet. Action: Upon a motion by Councilmember Satterlee, seconded by Mayor Pro Tem Prochnow, the Council introduced and waived further reading of Ordinance No reducing the height limit in the CD and CD/R3 Districts, by the following vote: AYES: Pepper, Prochnow and Satterlee; NOES: Bruins and Mordo; ABSENT: None; ABSTAIN: None.

Ten-year Capital Improvement Program Planning: Receive the report on the City s ten-year financial status and needed Capital Improvement Projects and provide direction as needed This item was continued to a future meeting. 10. Tentative Council Calendar: Review the Tentative Council Calendar and provide direction on placement of items on the Calendar Action: Councilmembers discussed the Tentative Council Calendar and came to the following general consensus: add an update on the regional housing linkage fee nexus study and indicate that the traffic calming near Blach and Egan Schools update would occur following the Los Altos School District s decision regarding locating the Bullis Charter School.
