APPROVAL OF MINUTES Mr. Brenneman made a motion for approval of the February minutes. The motion was seconded by Mr. Clark, voted on and carried, as submitted. Ms. Coble abstained. COMMUNICATIONS a. Project Review Correspondence The list was submitted to the file by Chairman Kuhl. b. Acknowledgments None FINANCIAL REPORT 1

2 Ms. Dell pointed out that the February financial report was a simulated report as the audit was not complete as of yet. The first 2 months of the year do not have many items that are too noteworthy. Any adjustments will be made per the audit and then finalized. Ms. Coble noted that the financials are subject to change, per the audit report and that these are preliminary drafts and are just provided to give the board information. There being no more questions or comments, Mr. Kuhl stated that the estimated February Financial Report has been received and reviewed and will be placed in the file for the 2015 audit. COMMITTEE REPORTS a. Alternative Energy Committee Ms. Coble noted that they met on February 25, 2015 and they received a lot of great input. Ms. Coble noted that Eric Bortner had some excellent input. As of now, they have a draft ordinance, but no dates have been set for the next meeting. b. Report of New Member Committee Ms. Dell noted that they had advertised for a new member without any success. Ms. Dell also stated that they were going to do additional outreach. They have phoned several different people, unfortunately they have not had anyone accept the offer. Ms. Dell suggested possibly placing an advertisement in a more local paper. Mr. Brenneman suggested running an ad on the local TV channels under the community section. STAFF REPORTS Ms. Dell stated that there is a public survey out now for the Historic Preservation Plan. Ms. Dell also noted there is a public committee meeting on Wednesday, March 25, 2015 at 4:00pm at the West Manchester Township Building for the Stormwater Authority Feasibility Study. It s the first public meeting. If you are interested in attending and haven t already signed up, you can still attend. Ms. Dell stated that there is a lot going on with Federal funding for Housing and Urban Development (HUD). We ve gotten the official numbers for the upcoming year. They are a little lower, but the budgeting was conservative so we will be okay. Ms. Dell stated that staff members will be reporting on the Hazard Mitigation Plan and the Bridge Plan Funding options later in the meeting. Mr. Heffner mentioned reactivating the Intensive Agriculture sub-committee. Ms. Coble stated that they should probably wait until the next meeting when Mr. Kenny and Mr. Earp are available. 3 Attorney Rehmeyer stated that the annual Statements of Financial Interest for the Planning Commission members should be filled out and sent in as soon as possible. He would also recommend the approval of the Intergovernmental Cooperation Agreement, as he was involved with that process. UNFINISHED BUSINESS a. Intergovernmental Cooperation Agreement Between YCPC and Participants with the Chesapeake Bay Pollutant Reduction Plan Mr. Brenneman questioned page 29, the Cost Sharing Summary. Ms. Dell then referenced him to page 15 and explained the formula used. Ms. Dell noted that Mr. Rehmeyer was more than involved with this agreement. He drafted the original agreement that got the whole process started. Ms. Dell stated that there are 44 municipalities including the County of York that are participating members with financial contributions. The County Planning Commission is being asked to adopt the agreement because we are the administrating agent for this. The Planning Commission is responsible for managing the funds. The Planning Commission will be reimbursed for the their costs and expenses, as explained on page 19. Following the discussion Ms. Coble made a recommendation to approve the Intergovernmental Cooperation Agreement Between YCPC and Participants with the Chesapeake Bay Pollutant Reduction Plan. The motion was seconded by Mr. Brenneman, voted on and carried as stated. b. County Bridge Plan - Funding Options Mr. Clark presented an overview of the reason he is asking for funding for the County Bridge Plan. Mr. Clark then explained the Pros and Cons of the different funding options. Ms. Bitner noted that the original Bridge Plan showed a funding deficit starting in 2020, and that was replacing one bridge per year. Ms. Dell noted that the original Bridge Plan was the first time the County took a systematic approach to evaluate the maintenance, rehab or replacement of the bridges. Discussion ensued...regarding: the number of county bridges, the category of roadway they are located on which is typically a local road, the volume of traffic the bridges carry and which funding option best addresses the need. The April meeting will include further discussion on this topic. NEW BUSINESS PLEASE NOTE - Projects are not necessarily in the same order as the agenda. Y C PC PROJECT # CHANCEFORD TOWNSHIP ZONING ORDINANCE AMENDMENT TEXT: LOT FRONTAGE 3

4 The purpose of this project is to review and comment on a proposal by Chanceford Township Officials to amend the Township s Zoning Ordinance with regard to Lot Frontage. This amendment has been submitted for review in accordance with Section 609(e) of the Pennsylvania Municipalities Planning Code (PA MPC). Chanceford Township Officials have submitted an amendment to Article III General Provisions creating a new Section 313 Lot Frontage as follows: Section 313 Lot Frontage All new lots must adjoin on a dedicated public street by the full required frontage as defined in this Ordinance, unless the lot complies with the requirements of Section 703 of the Chanceford Township Subdivision and Land Development Ordinance. The staff of the York County Planning Commission recommends the Zoning Ordinance Amendment not to be adopted as submitted, offering comments/concerns for consideration. The LGAC Executive Committee reviewed the proposed Zoning Ordinance Amendment and recommended it to not be adopted as submitted. They need to provide a definition for lot frontage. Ms. Coble made a motion not to recommend the Zoning Ordinance Amendment be adopted as submitted. The motion was seconded by Mr. Brenneman, voted on and carried as stated YCPC PROJECT # PENN TOWNSHIP ACT 537 SEWAGE FACILITIES PLAN UPDATE A proposed Act 537 Sewage Facilities Plan Update for Penn Township has been submitted to the York County Planning Commission for review and comment, as required by Section 304 of the Pennsylvania Municipalities Planning Code (PA MPC), and Section 71.31(b) of the Pennsylvania Sewage Facilities Act, Act 537. The purpose of this project is to evaluate the adequacy of existing sewage facilities, identify needs areas, and to identify/evaluate alternatives, as necessary, for the continued use of existing facilities and the implementation of a sewage management program. The staff of the York County Planning Commission recommends the Act 537 Sewage Facilities Plan Update not to be adopted, as submitted, offering a comment in support of that recommendation. The LGAC Executive Committee reviewed the Act 537 Sewage Facilities Plan Update and recommends it not be adopted as submitted. 4

5 Mr. Brenneman made a motion to recommend the Act 537 Sewage Facilities Plan not be adopted as submitted. The motion was seconded by Ms. Coble, voted on and carried as stated. Mr. Bortner abstained. YCPC PROJECT # PENN TOWNSHIP SUBDIVISION AND LAND DEVELOPMENT ORDINANCE AMENDMENT TEXT: Recreation Dedication The purpose of this project is to review and comment on a proposal by Penn Township Officials to amend the Penn Township Subdivision and Land Development Ordinance. This amendment is being submitted for recommendations in accordance with Section 505(a) of the Pennsylvania Municipalities Planning Code (PA MPC). The staff of the York County Planning Commission recommends the Penn Township Subdivision and Land Development Ordinance Amendment not be adopted as submitted. The LGAC Executive Committee reviewed the proposed Subdivision and Land Development Ordinance Amendment and recommended approval of this project. Ms. Lang would like the Amendment revision to include language consistent with the Municipalities Planning Code, that allows the funds to be expended for facilities that are reasonably accessible. Ms. Lang made a motion to recommend the Subdivision and Land Development Ordinance Amendment not be adopted as submitted. The motion was seconded by Ms. Coble, voted on and carried as stated. Mr. Bortner abstained. OTHER BUSINESS a. York County Historic Preservation Plan - Update Ms. Evans handed out flyers for the Historic Preservation Survey. She encouraged everyone to take the survey and then pass the fliers on to anyone else who may be interested. Ms. Evans then thanked the Planning Commission for allowing her time to update them on the Historic Preservation Plan. Ms. Evans then invited everyone to attend the Steering Committee that meets every other month. Ms. Evans noted the three basic purposes of the York County Historic Preservation Plan. She then went on to outline each chapter and it s status. b. York County 2013 Hazard Mitigation Plan Annual Evaluation and Action Summary Mr. Livergood provided an overview of the York County 2013 Hazard Mitigation Plan Annual Evaluation and Action Summary. Mr. Livergood stated that to date they have received no comments on the plan. Mr. Kuhl questioned whether this plan includes rail 5

6 transit of hazardous materials. Mr. Livergood stated that it is addressed in the plan, however, there is no real idea of what is actually being transported in these areas. Mr. Livergood stated that the area along the river where the rail transit travels, falls under EMA Services. Mr. Heffner stated that York County does have a very good plan in place. Mr. Brenneman suggested a tour of the 911 Center and Mr. Livergood will work with them to arrange the tour. PERSONNEL a. Recommendation for Part-time Financial Specialist Ms. Dell highlighted the memo and resume for Ms. Kimberly Walston for the position of Part-time Financial Specialist. There being no questions or comments, Ms. Coble made a motion for approval of Ms. Walston to the position of Part-time Financial Specialist, at the recommended salary. The motion was seconded by Mr. Brenneman, voted on and carried as stated. Ms. Dell noted that the Planning Commission picnic will be held June 11, 2015 at 5:30 pm at John Rudy Park. Ms. Coble noted that CGA is hosting a baseball game May 8, Mr. Rehmeyer also mentioned that he is hosting an educational workshop regarding Conflict of Interest.
