1 LEGISLATIVE MEETING-TUESDAY MARCH 27, 2012 PAGE 1 The North Strabane Township Board of Supervisors held its Legislative Meeting, Tuesday, March 27, 2012, at 7:00 P.M., at the Township Municipal Building, 1929 Route 519, Canonsburg, Pennsylvania ATTENDING THE MEETING Stephen Motzer, Chairman Jeff Stanley, Vice Chairman Bill Brooks, Supervisor Sonia Stopperich, Supervisor Brian Spicer, Supervisor ALSO ATTENDING THE MEETING Frank R. Siffrinn, Manager-Secretary Jim Jeffries, Solicitor Joe Sites, Engineer Deanna M. Kelly, Stenographer Mr. Motzer called the meeting to order followed by the Pledge of Allegiance and Roll Call. PUBLIC COMMENTS Cindy Pastovich, 2033 Trillium Court Canonsburg, PA I would like to introduce myself. My name is Cindy Pastovich. I have been a North Strabane Township resident for close to 54 years. I just wanted to address a question to you about a process. We have submitted via Concord Green, a request for the right-to-know process. I am the Phase 1 President. I have received s stating we would receive these documents if we agreed to pay from them. I just wanted to know where the documents are. Mrs. Kelly, Stenographer, handed Ms. Pastovich the documents along with the invoice. Ms. Pastovich indicated once our engineer reviews them and makes sure everything is there that we requested, then we will pay the invoice. Solicitor Jim Jeffries gave the following report: An appeal was filed by Mr. and Mrs. George to the Commonwealth Court of Pennsylvania. Last week, we received notice from the court that the George s made a request to raise new issues that were not included. That was denied by the court. As far as the Township is concerned, we are just waiting for the court to give us guidance. I have instructed code enforcement to enforce Judge Bell s order. Engineer Joe Sites gave the following report:

This ordinance rezones acres located on Chesnic Drive from R-3 (high-density residential) to C-1 (highway commercial) for the purpose of developing multi-family dwellings. Hiring of a Code Enforcement Officer hiring of Robert Scharding, 6017 Parkvue Extension, Pittsburgh, PA as a temporary part-time code enforcement officer at a rate of $22.00 per hour, with no benefits. Appointments appointment of Sonia Stopperich to the Parks and Recreation Board for a 5- year term. (term to expire December 31, 2016 ). ROLL CALL OF VOTES: 4 YES 1 ABSTAIN (Mrs. Stopperich) appointment of Bill Brooks to the Municipal Authority Board to fill the unexpired term through December 31, ROLL CALL OF VOTES: 4 YES 1 ABSTAIN (Mr. Brooks) ANY OTHER BUSINESS Mr. Spicer inquired about the letter he wrote dated March 9, 2012, regarding Township vehicles and equipment, and why it was not considered for the agenda? Mr. Motzer replied that is a personnel policy issue. It does not need to be placed on an agenda or discussed in public. It is an administrative item. The manager is in the process of writing the policy. We will discuss these items in an executive session. CORRESPONDENCE None. MARCH 2012 BILL LIST March 2012 Bill List and Supplemental Bill List. PUBLIC COMMENTS Kenneth Appetta, 1043 Woodlawn Drive Canonsburg, PA The original plan for the Concord Green townhomes were Phases 1 and 2, excluding the single family homes. It was my understanding, by verbal agreement, that Phase 2 was to be part of Phase 1 Homeowners Association. We were told by the developers the merger did occur and we were part of Phase 1. We were recently let go from the HOA. My question to you - is this correct? Ms. Moyar replied the developer came to the Township requesting a relocation of phasing lines because there was a discrepancy on HOA documents, and all townhouses should be in one HOA. The developer asked for the phase line to be moved. It did not affect anything regarding property, roads, deeds, and property lines. All it did was erase a phase line between 1

4 LEGISLATIVE MEETING-TUESDAY MARCH 27, 2012 PAGE 4 and 2 and move it to the end of the townhouses, so all townhouses can be in one phase. That is what the developer requested. That is what the Township reviewed and improved. Mr. Siffrinn stated for the record it had been reported incorrectly that there are clouds on deeds. That is not the case. The recorder of deeds of Washington County herself investigated the matter and stated the deeds have not been affected or clouded. There was a brief discussion between Mr. Jefferies and Mr. Stevenson, Attorney for Phase 1. I am Jim Summers. I represent Mr. and Mrs. McCloskey. Your solicitor and manager are correct. This matter does not involve the Township. This dispute is between the townhouse owners of Phases 1 and 2, and the developers. I would like to correct a few things. This is a recharacterization plan that was prepared by Mr. McCloskey at his expense to resolve these issues. He did this for a smooth merger between the two phases into one Homeowners Association. Neil Kelly 1441 Route 519, Eighty Four, PA I just have an accounting question for Mr. Siffrinn. The three police vehicles that were purchased. Why are they out of two different funds? Mr. Siffrinn replied two of the vehicles will be paid from the General Fund and the other vehicle paid from the Capital Reserve Fund. No specific reason. Henry Compana, 1060 Woodlawn Drive, Canonsburg, PA When we entered into the Homeowners Association we paid $500 upfront and $85 a month. We received notification a month ago that our services would end. With that, we no longer have grass cutting or snow removal. I moved there for the purpose I would not have to cut the grass or remove the snow due to my bad back. On my title it is stamped that I am in Phase 1, but I am in Phase 2. What is our recourse? Mr. Siffrinn replied that Mr. Compana should consult with an attorney. The matter has nothing to do with the Township. REMARKS FROM SUPERVISORS Mr. Motzer stated last week we were discussing the pole lights at Frac Tech located on Route 519. I had to drive the fire truck on Route 519 at night and passed Frac Tech. Those lights are terrible. Mr. Siffrinn replied we have directed code enforcement to visit the site. Mr. Stanley thanked Chief Strimel for addressing the traffic issue at the Canonsburg off ramp. There was an officer there early in the week directing traffic. I heard from a number of residents. It was less stressful exiting Interstate 79. EXECUTIVE SESSION The Board convened to executive session to discuss personnel matters at 7:51 P.M. The Board reconvened from executive session at 8:20 P.M.
