Chairman Young presided and asked for a report on the Ferry Street s ewe r c ollaps e. : Mr. McLaughlin, using a view graph and charts showing a diagram of the construction of the portion of the Ferry Street sewer that had collapsed, said that this last Sunday raoming ataout 3OO feet of the Ferry Street sewer collapsed. The sewer is 8 feet by 10 feet and about 30 feet deep. t was tauilttaefore 89O and has a timtaer taottom, what is called rubble walls, that is to say,,masonry bonded with old mortar, and a three ring brick arch. The Corps of Engineers built 400 feet of new sewer from the pump station taack to the point where the collapse started when the Corps constructed the flood protection levee. The collapse is complicated tay taeing under the old Merchants Bridge and the Terminal Railroad runs trains over it constantly. As he descritaed the setting and the cave-in, Mr. McLaughlin showed photographic slides of the situation. He said further,that the railroad had wooden piling, which has not moved. However, a water main,has taroken and Western Union has cables here. n some areas, the street has been depressed 3 feet. There is some danger of flooding the businesses in this area, of which Procter & Gamtale is the taiggest. They have been informed and are taking steps to cope. Mr. Zavadil said that we hoped-to have plans ready for contractors in 1 or -/2 weeks and would- expect to take bids the,27th of April. He said that the repairs raust be raade as soon as is possible. There was seme little discussion about the amounts of raoney involved and. possible sources. t was considered possible that there raight be a national disaster eligibility.

2 Mr. McLaughlin added that the railroad personnel did not seem worried, but they did put in steeltaracingto protect the bridge. The District has filled the hole to give some support to the piers, but there is no easy or quick way to.resolve the problems. Mr. Flick reported that the Maintenance Department had purchased a "slimline" pump for $10, This'was an eraergency purchase in order to help control flooding in sewers, and the pump's advantage is that it will fit through a manhole. - Joumal of theraeetingof March 28, 1979 (836th) was read. Mr. Enger.said-,that this project is to construct a ponding area and outfall-sewer line in the City of Des Peres between Grupp arid Ballas Roads, south bf Manchester Road. _The City of Des Peres has asked, the District to participate with it in 'the solution of the stormvrater probleras. Bischof, Borghi, Lee and Young, was again presented and read, appropriating $11, from the Operation, Maintenance, and Construction raproveraent Fund of Gravois Creek to be used for the construction of sanitary sewers in Sutadistrict No. 445 (Leraay Ferry & Buckley) in St. Louis County, Missouri. Mr. Brady said that this sraall subdistrict, consisting of parts of four lots, of which three are improved, lies in south St. Louis Gounty near the intersection of Lemay Ferry and Buckley Roads. He said that although it was originally intended to be a tax bill project, the property owners wished to pay their share in cash with the District '.s payment for the outfall sewer. LOUS SEWER DSTRCT VJHERE THE DSTRCT HAS ASSUMED THE OPERATON AND MANTENANCE OF EXSTNG STORM WATER'FACLTES, Proposed Ordinance-No , introduced March 28, 1979 by MesS-rs_._Bis.chof, Borghi-, Lee-and Y-eung-r-was-aga-in~pre-s-ent''e'd~and read"^ redefining the boundaries of that area of The Metropolitan St. Louis Sewer District,where the District has assumed the Pperation and raaintenance of existing storm water facilities. Mr. Wiegers said that this ordinance redefines the stormvrater portion of the District boundaries as amended by a number of ordinances into a single ordinance so that it may be referred to as a single ordinance. n response to a question from the Chairman, Mr. Clardy said that the statement of the boundaries description in this ordinance is the same verbiage as is in the prior taxing ordinances. The original boundary as set -out in the Plan has been amended-over,a great number of years, priraarily by ordinarices annexing areas to that- original -District. - Each time this -vras done, the annexing ordinance described the area, being armexed by metes andtaoundsand then declared such area annexed to the District. ' This ordinance is for adrainistrative convenience,raakingit unnecessary to repeat as a description the numtaers and dates :bf adoption of ajl the ordinances which annexed territory to the origirial District. The Chair then'recognized Mr. George Satare, who said that this ordinance and the following ones that were on the same sutaject appeared to tae in violation of Section on Page l8 of the Plan of the District. This istaecausethat section, which is entitled "Ordinances and amendments to be set forth in full", states that such changes should be -set forth in full (Mr. Satare then read the entire Article aloud). He said that this - involved two or three separate areas and that the ordinance was in violation of this section as it did not set out amendments to the referred ordinances in full. Mr. Clardy then said that the ordinances in question do not violate Section of the Plan since they do not amend or otherwise change any existing ordinance, nor do they change or amend any of the taoundaries of the District or sutadistrict, as the case raay be. 5 simply a restatement of a description of an existing boundary raade by - referring to the. numerous ordinances which would make the changes by amending the taoundary. This and the following ordinances would tae recorded so that they could then tae referred to. Mr. Satare requested that this be held until the next meeting, but the Chairman stated that he' would not-do so.'- He then ruled that the ordinances do not violate the Plan since there is'no amendment or change to any existing ordinance. Mr. Wiegers said that this itera is sirailar to the two preceding ones, except it concerns the boundaries of the Coldwater Creek Trunk Subdistrict. Mr. Kaiser said that the agreement for the purchase and sale of the outstanding capital stock of the Fenton Sewer Company- is substantially that which was furnished the entire Board much earlier in draft. t is also

7 authorized by the Trustees' Committee and was expected to. be executed by the end of the year. However, there was pending litigation. Basically, there were problems of broken sewer connections and. we would tae agreeatale if the contractor involved would repair each such connection. There is now a commitment to that effect and we recoramend proceeding. The District would pay $760, for the capital stock of the company and would acquire approximately $300, in cash. Additionally, a piece of land now in use, but expected to tae ataandoned eventually, is to be sold back for $100, The terms of the purchase provide that "the District would pay interest only at the rate of seven percent per annum for six years until March 31, 1986 and then pay off the principal at the rate of $110, per year, in addition to the interest on the unpaid balance. Projected income is about $l60, a year frcm a user charge. Operation and maintenance is expected to be some $86, nterest is about $46, This totals approximately $.132,200.00, which leaves a reserve of $27, After seme little discussion among the Trustees and Mr. Kaiser, motion made by Mr. Lee, seconded by Mr. Borghi, for unanimous consent of all members present for introduction and final voting on proposed Ordinance Wo at this meeting. 8 Mr. Flick said that the ordinance sets out the schedule of connection fees and asked if it was necessary to have a public hearing since the resolution required' one if a service charge is increased. Mr. Kaiser replied that the Charter does not require such a hearing and a resolution of the Board requires it if there is an increase in the rate. He said that it is his opinion that until the rate is raised frora that which the users are presently paying, it is not necessary to have a hearing. Ordinance Wo was presented and read, providing revenue for the operation and general purposes of the Fenton Service Area of The Metropolitan St. Louis Sewer District; providing a. schedule of charges effective April 1, 1979, 'to be collected on all the real property, whether public or private, served directly or indirectly.by the public sewer systems and facilities of the Fenton Service Area; prescritaing the manner in which and time at which such charges are totaepaid; pro-vlding for the collection and enforceraent of collection of such charges and providing penalties for violations thereof. Mr. Flick said that this ordinance establishes a schedule of service charges, as well as surcharges. The only difference between this and the bill rendered tay the Fenton Sewer Gompany is that theirtaillis quarterly andtaeginningwith June, we vrill betailling $24.60 for each six months.. Proposed Ordinance No was presented and read, authorizing and directing the Executive Director and Secretary-Treasurer to execute a Supplemental Utility Agreement with the State Highway Commission of Missouri for the adjustment of certain District.facilities pursuant to highway improvements. Mr. Zavadil showed on a wall map the location of a section of Fee Fee sewer crossing Craig Road just south of Page Avenue. He said that when the State Highway Department reconstructed that portion of Craig Road it found the sewer unacceptable. The sewer would not support added weight and it W'as necessary to replace with a new sewer with a concrete encasement. The Highway Department has constructed this line and their portion of the cost is $15, and the District's share is $11, Motion made by Mr. Lee, seconded by Mr. Cento, that proposed Ordinance Wo be introduced. taken: M. Mr. Enger referred to a wall raap showing the location of the proposed stormvrater sewer as lying in the City of Crestwood just south of Big Bend Road. The sewer will extend from a culvert under Big Bend Road just east of Liggett Boulevard, crossing Diversey Drive and Banbury Court, then discharging into a branch of the Gravois Creek. He said that it consists.
