2 SUBSTITUTE ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO: SECTION 1. Sectin f the Municipal Cde f Chicag is hereby amended by inserting the language underscred, as fllws: Htel. (a) Definitins. As used in this sectin: "Anti-sexual harassment plicv" means the written plicy required under subsectin (e)(t) f this sectin. "EmplyeeCs)" means any natural persn wh wrks full time r part time at a htel fr r under the directin f the licensee r any subcntractr f the licensee fr wages r salary r remuneratin f any type under a cntract r subcntract f emplyment, whether express r imphed. "Guest" means any invitee t a htel, including registered guests, persns ccupying guest rms with registered guests, visitrs invited t guest rms by a registered guest r ther ccupant f a guest rm, persns patrnizing fd r beverage facilities prvided by the htel, r any ther persn whse presence at the htel is permitted by the licensee. The term "guest" des nt include emplyees. guests. "Guest rm" means any rm made available by a htel fr vemight ccupancy by (Omitted text is unaffected by this rdinance) "Panic buttn" r "ntificatin device" means a prtable emergency cntact device that is designed s that an emplyee can quickly and easily activate such buttn r device t effectively summn t the emplyee's lcatin prmpt assistance by a htel security fficer, manager r ther apprpriate htel staff member designated by the licensee. "Restrm" means any rm equipped with tilets. "Sexual harassment" means any unwelcme sexual advance, request fr sexual favrs, r ther verbal r physical cnduct f a sexual nature. 1

(Omitted text is unaffected by this rdinance) (3) Investigatins t enfrce the prvisins f subsectin (e) f this sectin may be cnducted, as apprpriate, by the Department f Business Affairs and Cnsumer Prtectin r Chicag Cmmissin n Human Relatins ("CCHR"). Investigatins t enfrce subsectin (f)(3) f this sectin shall be cnducted by CCHR. (e) Legal duties. Each license engaged in the business f htel shall a duty t: (1) equip emplyees wh are assigned t wrk in a guest rm r restrm, under circumstances where n ther emplyee is present in such rm, with a panic buttn r ntificatin device. The emplyee may use the panic buttn r ntificatin device t summn help if the emplyee reasnably believes that an nging crime, sexual harassment, sexual assault r ther emergency is ccuning in the emplyee's presence. Panic buttns and ntificatin devices shall be prvided by the licensee at n cst t the emplyee; (2) develp, maintain and cmply with a written anti-sexual harassment plicy t prtect emplyees against sexual assault and sexual harassment by guests. Such plicy shall: (a) encurage emplyees ("cmplaining emplyee") t immediately reprt t the licensee instances f alleged sexual assault and sexual harassment by guests ("ffending guest"); (b) describe the prcedures that the cmplaining emplyee and licensee shall fllw in such cases; (c) instruct the cmplaining emplyee t cease wrk and t leave the immediate area where danger is perceived until htel security persnnel r members f the Plice Department arrive t prvide assistance; (d) ffer temprary wrk assignments t the cmplaining emplyee during the duratin f the ffending guest's stay at the htel, which may include assigning the emplyee t wrk n a different flr r at a different statin r wrk area away frm the ffending guest; (e) prvide the cmplaining emplyee with necessary paid time ff t: (i) sign a cmplaint with the Plice Department against the ffending guest, and (ii) testify as a witness at any legal prceeding that may ensue as a result f such cmplaint, if the cmplaining emplyee is still in the licensee's emply at the time such legal prceeding ccurs; (f) infrm the emplyee that the Illinis Human Rights Act, Chicag Human Rights Ordinance and Title VII f the Civil Rights Act f 1964 prvide additinal prtectins against sexual harassment in the wrkplace; and (g) infrm the emplyee that subsectin (f)(3) f this sectin makes it illegal fr an emplyer t retaliate against any emplyee wh reasnably uses a panic buttn r ntificatin device, r in gd faith avails himself r herself f the requirements set frth in subsectin (e)(2)(c); (e)(2)(d), (e)(2)(e) f this subsectin, r disclses, reprts r testifies abut any vilatin f this sectin r rules prmulgated thereunder. Nthing in this subsectin (e)(2) shall be cnstmed t relieve the licensee frm cmpliance with Sectin 2

4 ; and (3) prvide all emplyees with a cun'ent cpy in English, Spanish and Plish f the htel's anti-sexual harassment plicv, and pst such plicy in English, Spanish and Plish in cnspicuus places in areas f the htel, such as supply rms r emplyee lunch rms, where emplyees can reasnably be expected t see it. (e){jq Prhibited acts., It shall be unlawful fr any licensee engaged in the business f, htel t: (Omitted text is utia,ffected by this rdinance) (3) retaliate against any emplyee fr: (i) reasnably using a panic buttn r ntificatin device, r (ii) availing himself r herself f the requirements set frth in subsectin (e) (2)(c), (e)(2)(d) r (e)(2)(e) f this sectin, r (iii) disclsing, reprting, r testifying abut any vilatin f this sectin r any rule prmulgated thereunder. Any cmplaint alleging a vilatin f this subsectin (f)(3) shall be filed by the aggrieved party with the Chicag Cmmissin n Human Relatins ("CCHR") n later than 180 days after the ccurrence f the alleged vilatin and in accrdance with rules duly prmulgated by the Cmmissiner f CCHR. Tw r mre adjudged vilatins f this subsectin (f)(3) within any 12-mnth perid may result in license suspensin r revcatin in accrdance with Sectin Prvided, hwever, that: (A) the subject matter f any such disciplinary hearing r prceeding under Sectin shall be limited t the issue f whether the required number f adjudged vilatins f this subsectin (f) (3) ccurred within any 12-mnth perid; (B) the licensee shall nt be permitted at such disciplinary hearing r prceeding t challenge the adjudged vilatins themselves, nr any underlying facts asserted r determined therein; and (C) n fines shall be impsed n the licensee as a result f such displinary hearing r prceeding under Sectin (f) (g) Penalty - License revcatin - One year wait fr new license - Exceptins. (1) fa Except as therwise prvided in subsectin (f)(3)(c) f this sectin, and in additin t any ther penalty prvided by law, any persn wh vilates any requirement f this sectin r any rule r regulatin prmulgated thereunder shall be subject t a fine f nt less than $ nr mre than $ fr each ffense. The Chicag cmmissin n human relatins Cmmissin n Human Relatins shall receive and investigate cmplaints f vilatins f this chapter, except where such duty is mdified by intergvernmental agreement^ and cmplaints f vilatins f subsectin (f)(3) f Sectin , and shall prepare and prvide necessary fnns fr such cmplaints. N persn shall refiise r fail t cmply with any subpena, rder r decisin issued in the curse f r as a result f an investigatin. SECTION 3. Sectin f the Municipal Cde f Chicag is hereby amended by inserting the language underscred, as fllws: Retaliatin prhibited. N persn shall retaliate against any individual because that individual in gd faith has made a charge, testified, assisted r participated in an investigatin, prceeding r hearing under this chapter r under subsectin (f)(3) f Secfin SECTION 4. Fllwing its passage and publicatin, that prtin f this Ordinance that creates subsectin (e)(1) f Sectin shall take fiiu frce and effect n July 1, The remainder f this Ordinance shall take full frce and effect 60 days after its passage and publicatin.
