4 Frewrd This bylaw is made under sectin 147 f the Lcal Gvernment Act 2002 (LGA). This bylaw cvers such matters as specificatin f public places, days and times where the bylaw applies, the pwers f the Plice, and exemptins t the bylaw. It shuld be read in cnjunctin with sectins 147, 169, 169A and 170 f the LGA. Part 17: Liqur Cntrl in Public Places f the Mastertn and Suth Wairarapa Cnslidated Bylaw 2012 is revked at the time f the Alchl Cntrl Bylaw 2018 cming int frce. 1. Title and Cmmencement 1.1. The title f this bylaw is Mastertn District Cuncil Alchl Cntrl Bylaw This bylaw shall cme int frce thrughut the Mastertn district n 12 December Scpe 2.1. The purpse f this bylaw is t enhance safety and the public enjyment f public places by prviding fr alchl cntrl in specified public places, and fr specified days, times and events. 3. Definitins Alchl: Has the meaning given by sectin 5(1) f the Sale and Supply f Alchl Act Public Place: A place that is pen t r is being used by the public, whether free r n payment f a charge, and whether any wner r ccupier f the place is lawfully entitled t exclude r eject any persn frm it, but des nt include licensed premises. Special Licence: Allws the sale r supply f alchl t anyne attending a particular event, private functin, street party, sprting event. Special licences can be either n site fr cnsumptin n the premises, r ff site fr cnsumptin elsewhere. 4. Alchl Prhibitin (Alchl Free Znes) 4.1. The cnsumptin r pssessin f alchl in a public place (including while in a vehicle) within the Business District as shwn in the First Schedule, is prhibited at all times The cnsumptin r pssessin f alchl in a public place (including while in a vehicle), within the Queen Elizabeth Park restricted area shwn in the Secnd Schedule, is prhibited during the times shwn belw: 9.00 pm Mnday t Sunday nights thrugh t 7.00 am n the fllwing day The cnsumptin r pssessin f alchl in a public place (including while in a vehicle), within the Skate Park Queen Elizabeth Park restricted area shwn in the Third Schedule, is prhibited at all times. In additin t the prhibitins under clauses 4.1 t 4.3, the Cuncil by reslutin publicly ntified, may rder a prhibitin f alchl cnsumptin r pssessin (including while in a vehicle) fr certain events r ther specified times within specified public places in the Mastertn district A prhibitin made under clause 4.4 must be publicly ntified at least 14 days in advance f the special event, in accrdance with sectin 170(3) f the LGA. The Plice pwers f search under sectin 170(2) f the LGA applies t these events. 5. Cuncil Permissin 5.1. Any persn may apply t the Cuncil fr prir written permissin fr any activity that wuld be in breach f any prhibitin under this part f the bylaw A special licence may be issued under the Sale and Supply f Alchl Act 2012 in respect f any lcatin r event, and subject t the terms f that special licence will include waivers and dispensatin accrding t thse terms. 6. Signage 6.1. The Cuncil will erect signage within public places cvered by this bylaw t prvide infrmatin t the public n the terms f the bylaw. The size, lcatin and terms f this signage shall be at Cuncil's discretin T avid any dubt, the absence f signage in any public place des nt authrise breach f this bylaw. 7. Offences and Penalties 7.1. Any persn wh breaches this bylaw cmmits an ffence and may be liable t: a) an infringement fee pursuant t the Lcal Gvernment (Alchl Ban Breaches) Regulatins 2013; and b) the penalty prvisins f sectin 239A f the LGA T avid any dubt, a persn breaches this bylaw and cmmits an ffence wh: a) cnsumes r pssesses any alchl in a public place in breach f a prhibitin under this bylaw; r b) breaches, r permits a breach f, the terms f any Cuncil permissin granted pursuant t clause 5.2 f this bylaw An infringement ntice r reminder ntice issued under this bylaw shall be in the frm required under the Lcal Gvernment (Alchl Ban Breaches) Regulatins Mastertn District Cuncil Alchl Cntrl Bylaw Page 3

6 8. Pwer t Amend by Reslutin 8.1. The Cuncil may, by reslutin publicly ntified: a) amend r vary the hurs r days when the cnsumptin r pssessin f alchl is prhibited in a public place; b) add schedules; c) make additins r deletins frm the schedules; r d) substitute new schedules Where Cuncil intends t make a reslutin under clause 4.4 r 8.1, cnsultatin will be undertaken as required, in accrdance with the requirements f sectin 156 f the LGA. 9. This bylaw des nt repeat r paraphrase thse statutry prvisins, and accrdingly thse prvisins shuld be read in cnjunctin with this bylaw. In particular, the fllwing prvisins are nted: Sectin 147 empwers the Cuncil t make this bylaw. It als defines 'alchl' and 'public place'. In additin, sectin 147(3) sets ut a number f specific exemptins when the bylaw will nt apply with respect t the transprtatin f unpened bttles r cntainers. Sectin 169 prvides the Plice with pwers f search and seizure, withut warrant, t enfrce the bylaw. The Plice are respnsible fr enfrcing the bylaw. Sectin 170 sets ut certain cnditins impsed n the Plice pwers f search under sectin 169. This bylaw has n effect n any ther Plice pwers f search, seizure and arrest r any ther statutry ffences. Fr the avidance f dubt, this area includes the entire legal rad reserve f the streets which frm the bundary f the area specified abve, up t the bundaries with adjining prperties and including the carriageway, berms and ftpaths. Where the public place meets r is crssed by anther rad, the bundary f the public place shall be deemed t cntinue in an unbrken straight line acrss the ther rad. Fr the avidance f dubt, this area includes the entire legal rad reserve f the streets which frm the bundary f the area specified abve, up t the bundaries with adjining prperties and including the carriageway, berms and ftpaths.
