Are yu ready t pursue yurs? Yu must apply fr ACT nminatin f a Skilled Nminated (subclass 190) visa after cmpleting an Expressin f Interest n the Department f Hme Affairs SkillSelect. Befre ldging an applicatin fr ACT nminatin, it is recmmended that yu btain specific migratin advice relevant t yur circumstances frm the Department f Hme Affairs r a Registered Migratin Agent. The ACT Skilled Migratin Prgram is managed by Skills Canberra within the ACT Gvernment s Chief Minister, Treasury and Ecnmic Develpment Directrate. Abut these Guidelines These guidelines explain hw t ldge an applicatin fr ACT nminatin f a Skilled Nminated (subclass 190) visa. Yu must demnstrate that yu meet the nminatin criteria and have a genuine cmmitment t live in Canberra fr at least tw years frm date f permanent arrival / visa grant. Yu must sign a declaratin that yu acknwledge and agree t meet the bligatins attached t the ffer f ACT nminatin at Attachment A.

2 Department f Hme Affairs Criteria Befre yu submit an applicatin fr ACT nminatin, yu must be satisfied that yu meet the Department f Hme Affairs criteria fr a Skilled Nminated (subclass 190) visa. The Skilled Nminated (subclass 190) visa is a pints-based visa fr skilled wrkers wh are nminated by a state r territry because their ccupatins are in demand in that jurisdictin. ACT nminates eligible highly skilled wrkers with ccupatinal skills needed in Canberra t drive ecnmic grwth. Yu must apply fr ACT nminatin f a subclass 190 visa. If yur applicatin is successful and yu are nminated by the ACT, yu are awarded five additinal pints twards yur verall pints scre. Yu nly need 60 pints t be eligible t apply fr a subclass 190 visa. Skill Select Befre yu can apply fr ACT nminatin, yu must cmplete an Expressin f Interest (EOI) thrugh Department f Hme Affairs SkillSelect. Yu must select the ACT as yur preferred lcatin t live in Australia. Yu must have a minimum 60 pints. Once the EOI is submitted n SkillSelect, yu must apply fr ACT 190 nminatin by cmpleting the nline Applicatin fr ACT nminatin. If yur applicatin fr ACT nminatin is apprved, yur EOI will be cnfirmed n SkillSelect and the visa invitatin will be autmatically issued by Department f Hme Affairs. Yu will be unable t update the EOI nce ACT nminatin is cnfirmed. Yu will then have 60 days t apply fr a Skilled Nminated (subclass 190) visa. ACT nminatin des nt guarantee that the Skilled Nminated (subclass 190) visa will be granted. Applying fr ACT nminatin frm verseas If yu are living verseas, yu may be eligible t apply fr ACT nminatin if yur ccupatin is in demand and pen n the ACT Occupatin List; and yu meet the nminatin criteria. If yur ccupatin is clsed n the ACT Occupatin List, yu may still be eligible t apply fr ACT nminatin if yu have clse ties (jb ffer r family) in Canberra; and yu meet the nminatin criteria that is in effect n the date yu ldge the applicatin fr ACT nminatin. NOTE: If yu, r any dependents, are living r have lived in anther Australian state r territry within the last twelve mnths, yu are nt eligible t apply fr ACT nminatin. If yu d nt have a genuine jb ffer, yu must research the ACT labur market and prvide evidence that there are sufficient emplyment pprtunities (at least five and n mre than eight pprtunities) in yur nminated ccupatin in Canberra; and that yu have: Skills and recent experience relevant t the researched emplyment pprtunities; Skills and experience relevant t the ACT ecnmy. Experience in heavy industry, manufacturing, prductin, mining; shipping, gas and il, head ffice banking and railways are nt generally cnsidered relevant industries; A genuine cmmitment t settling in Canberra fr at least 2 years frm date f permanent arrival in Australia; Canberra. 3 Access t sufficient financial assets t fund yur migratin and settlement in Canberra while yu seek emplyment. Applying fr ACT Nminatin while in Australia Canberra residents If yu are currently in Australia, yu must be living in Canberra befre yu are eligible t apply fr ACT nminatin. If yur immediate family (spuse/partner and children) are currently in Australia, they must als be living in Canberra befre yu are eligible t apply fr ACT nminatin. NOTE: Yu are nt eligible t apply fr ACT nminatin if yu, r any members f yur immediate family are living, wrking r studying in anther Australian state r territry. Yur nminated ccupatin des nt have t be pen r in demand in Canberra. Yu may nminate any ccupatin n the Department f Hme Affairs List f Eligible Skilled Occupatins as lng as yu have the relevant skill assessment fr the nminated ccupatin; and yu meet the nminatin criteria that is in effect n the date yu ldge the applicatin fr ACT nminatin. Eligibility fr ACT nminatin will vary depending n which visa yu currently hld, r last held if yu are n a bridging visa: Subclass 457 visas If yu are the hlder, r the dependent f the hlder f a subclass 457 visa, yu must meet the fllwing criteria befre yu are eligible t apply fr ACT nminatin: If yu have NOT lived in anther Australian state r territry within the last tw years: Yu have lived in Canberra fr the last three mnths; and Yu are wrking fr an ACT emplyer in a skilled ccupatin (as defined by ANZSCO skill level 1 t 4). If yu HAVE lived in anther Australian state r territry within the last tw years: Yu have lived in Canberra fr the last 12 mnths; and Yu are wrking full time fr an ACT emplyer in the nminated ccupatin. Other temprary residence visas If yu are the hlder, r the dependent f the hlder f a temprary resident r prvisinal visa including subclass 400 series (excluding 457 and 485 ), diplmatic, business r a prvisinal spuse visa, yu must meet the fllwing criteria befre yu are eligible t apply fr ACT nminatin: If yu have NOT lived in anther Australian state r territry within the last tw years: Yu have lived and wrked in Canberra fr the last six mnths; and Yu are wrking fr an ACT emplyer in a skilled ccupatin (as defined by ANZSCO skill level 1 t 4). Yu d nt have t be wrking in yur nminated ccupatin. The emplyment des nt have t be full time. Yu must prvide at least tw current payslips t evidence yur emplyment. If yu HAVE lived in anther Australian state r territry within the last tw years: Yu have lived in Canberra fr the last 12 mnths; and Yu are wrking fr an ACT emplyer in yur nminated ccupatin fr at least six mnths. 4 Visitr visa If yu are the hlder f visitr visa, yu must meet the fllwing criteria befre yu are eligible t apply fr ACT nminatin: If yu have NOT lived in anther Australian state r territry within the last tw years: Yu are living in Canberra and yu have a genuine jb ffer with an ACT emplyer in yur nminated ccupatin. If yu HAVE lived in anther Australian state r territry within the last tw years: Yu have lived in Canberra fr the last 12 mnths and yu have a genuine jb ffer with an ACT emplyer in yur nminated ccupatin. Student r temprary graduate visa If yu are the hlder f a student r temprary graduate visa yu must meet the fllwing criteria befre yu are eligible t apply fr ACT nminatin: Yu have lived in Canberra fr the last 12 mnths; and If yu have NOT lived r studied in anther Australian state r territry within the last tw years: Yu have cmpleted and graduated (r yu are the dependent f a graduate) frm a CRICOS registered curse at Canberra institutin. The curse must be, at minimum, a Certificate III r higher qualificatin; and have a minimum duratin f ne academic year (40 weeks); and Yu are wrking fr an ACT emplyer in a skilled ccupatin (as defined by ANZSCO skill level 1 t 4). Yu d nt have t be wrking in yur nminated ccupatin. The emplyment des nt have t be full time. Yu must prvide at least tw current payslips t evidence yur emplyment. If yu HAVE lived r studied in anther Australian state r territry within the last tw years: Yu are wrking full time fr an ACT emplyer in yur nminated ccupatin fr at least six mnths immediately befre applying fr ACT nminatin. Student visa hlders (with visa cnditin 8105) wrking 20 hurs per week are deemed t meet the full time criterin. Yu must prvide payslips t evidence six mnths emplyment. r Yu have cmpleted and graduated (r yu are the dependent f a graduate) frm a CRICOS registered curse at Canberra institutin. 5 Pstgraduate curse Canberra tertiary institutin If yu are the hlder, r the dependent hlder, f a student visa (subclass 500 series) wh is currently studying, r has cmpleted a pstgraduate curse at a Canberra university, yu must meet the fllwing criteria befre yu are eligible t apply fr ACT nminatin: Yu have lived in Canberra fr the last 12 mnths; and Yu are either: In receipt f a stipend and / r schlarship frm the University / gvernment agency(that cvers yur living expenses) that is nging fr at least 3 mnths frm ACT nminatin applicatin date; r Wrking an ACT emplyer in a skilled ccupatin (as defined by ANZSCO skill level 1 t 4). Yu d nt have t be wrking in yur nminated ccupatin. The emplyment des nt have t be full time. Yu must prvide at least tw current payslips t evidence yur emplyment. ACT Occupatin List The ACT Occupatin List identifies the skills that are currently in demand, r pen in Canberra. The demand fr each ccupatin is used t determine availability f ACT nminatin fr that ccupatin. While a majr analysis f the demand fr ccupatins will be undertaken twice a year (in February and August) the demand fr each ccupatin will be reviewed n an nging basis. Once it is determined that the demand fr an ccupatin has been met, the ccupatin will be clsed withut further ntice. The ACT Occupatin List is nt linked t specific jb vacancies and it is nt a guarantee f a jb in a nminated ccupatin. Yu must be satisfied that there are sufficient emplyment pprtunities in yur nminated ccupatin befre yu apply fr ACT nminatin. Yu must als understand that the demand fr yur particular ccupatin may change befre yu arrive permanently in Canberra. Yu will cmpete fr jbs with all peple in the labur market as part f a nrmal selectin prcess. Yur success will depend n emplyer requirements, yur relevant skills, yur experience and yur level f English language ability. Open Occupatins Yu are eligible t apply fr ACT nminatin if yur ccupatin is in demand and listed as pen n the current ACT Occupatin List; and yu meet the nminatin criteria. Clsed Occupatins If yur ccupatin is listed as clsed n the ACT Occupatin List, yu are nt eligible t apply fr ACT nminatin unless yu meet the fllwing criteria: Canberra residents: Yu are eligible t apply fr ACT nminatin f a clsed ccupatin if yu meet the nminatin criteria. Overseas residents: Yu are eligible t apply fr nminatin f a clsed ccupatin if yu meet the nminatin criteria and yu have clse ties t Canberra; either a: Canberra. 6 OR Genuine ffer f emplyment in the nminated ccupatin. The emplyer must be actively perating in the ACT. The emplyment cntract must in accrdance with Australian legislatin and the salary paid at market rate. While it is expected that the ffer is fr a full time psitin, a part time psitin may be accepted if the applicant can demnstrate that the salary is sufficient t supprt their lifestyle in Canberra. Yu must als demnstrate that yu meet the nminatin criteria. Clse family member (spuse / partner f the applicant; r parents, brther, sister, grandparents, step parents, step siblings f the main applicant r their spuse / partner) wh is an Australian citizen / permanent resident and has resided in Canberra fr the last twelve mnths. Applicatin fr ACT Nminatin Cmplete the nline applicatin fr ACT nminatin f a subclass 190 visa at Canberra. Create Yur Future and attach the fllwing infrmatin t the nline applicatin: SkillSelect EOI: Attach a cpy f the SkillSelect Expressin f Interest (EOI) recrd f respnse which shws the persnal, educatin, English and emplyment details submitted. The ACT MUST be selected as yur preferred lcatin n the EOI. Applicants wh select Any r express interest in living in anther state r territry will nt meet the ACT nminatin criteria. Skilled Occupatin: Emplyability: Attach a cpy f a current skill assessment in the nminated ccupatin. Fr Canberra residents. Attach emplyment cntract and payslips fr the required perid f emplyment; r Pstgraduate stipend. If yu d nt have wrk rights, attach evidence f a genuine jb ffer frm an ACT emplyer in the nminated ccupatin. Fr verseas residents: Attach evidence f a genuine jb ffer by an ACT emplyer in yur nminated ccupatin; r Attach evidence that there are, currently, sufficient ACT emplyment pprtunities in yur nminated ccupatin that are relevant t yur skill set and recent experience. The evidence must include: Persnal research int recent advertised psitins relevant t the nminated ccupatin (a minimum f 5 vacancies and nt mre than 8). Yu must prvide a cpy f the full advertisement (saved as a.pdf): It is essential that the date f the jb advertisement as well as the lcatin f the jb is clearly displayed; Canberra. 7 Australian qualificatins Web links alne are nt acceptable and, if prvided withut the accmpanying advertisement, will result in the criterin nt being met. An emplyment statement fr each advertisement. Yu must explain hw yur qualificatins, knwledge and experience relate t and meet the requirements fr each f the jb advertisements. Please nte: Yu must be able t demnstrate that yu have the relevant qualificatins, skill set and wrk experience etc. t meet the criteria f the advertised psitin; fr example if the psitin requires: A certain number f years relevant wrk experience: yu must have that experience; A minimum qualificatin: yu must hld that qualificatin; Australian wrk experience: yu must have that experience; Citizenship / security clearance, yu must be a citizen r have the clearance. Jb advertisements must be recent. Advertisements must be dated n mre than 6 weeks befre submissin f the applicatin. Jb advertisements must be relevant t the nminated ccupatin; fr example: If the nminated ccupatin is a Real Estate Agent we will nt accept jbs fr Prperty Manager; If the nminated ccupatin is a HR Adviser, we will nt accept jbs fr recruitment cnsultants; If the nminated ccupatin is fr a manager, we will nt accept assistant, supprt r junir psitins. Emplyment pprtunities requiring Australian citizenship and/r an Australian Security clearance will nt be accepted as evidence f emplyability. Jb advertisements related t a psitin vacancy directly r indirectly related t wrking with the Australian (Federal) Gvernment will nt be accepted unless yu can demnstrate that Australian citizenship and r a security clearance is nt a jb requirement. Supplying an advertisement fr a Federal Gvernment jb which des nt mentin citizenship is nt sufficient evidence that it is nt required. 9 Financial capacity: Fr Canberra residents experience is nt mandated but it must be clear that yu have enugh recent, relevant experience in yur nminated ccupatin t be emplyable in Canberra. Yur wrk experience must be in an industry relevant t the ACT ecnmy. Experience in heavy industry, manufacturing, prductin, mining; shipping, il, head ffice banking and railways are nt generally cnsidered relevant industries. Yu are nt required t prvide evidence f yur financial capacity. Fr verseas residents: Settlement statement: Attach yur signed and witnessed Declaratin f Financial Capacity t shw that yu have access t sufficient financial resurces t fund yur migratin t Australia and settlement in Canberra while yu are securing emplyment. Yu need t be realistic abut emplyment expectatins nce yu arrive in Canberra as it can take up t 3 mnths t secure emplyment. This timeframe is nly indicative, as the emplyment market fluctuates at different times f the year. Yur ability t secure emplyment quickly will depend n yur research f the Canberra labur market and the relevance f yur skill set and experience t the market. Yur signature n the Declaratin f Financial Capacity must be witnessed by an authrised persn. See Attachment B fr infrmatin abut wh is authrised t witness this declaratin. Yu are nt required t prvide dcumentary evidence t supprt yur financial psitin with yur applicatin. Hwever, yu must be able t prvide such dcuments if requested by yur case fficer. Fr Canberra residents Yu are nt required t prvide a settlement statement. Fr verseas residents Shw that yu have researched the cst f living in Canberra and that yu have a sund understanding f the settlement csts invlved while yu seek emplyment: If yu are using a migratin agent, yu must attach a settlement statement that includes: Evidence f research int the cst f living in Canberra, including rent, fd, transprt and entertainment. Estimated cst f relcatin t ACT in Australian Dllars, including but nt limited t: flights; freight; and initial accmmdatin. Estimated cst f living in Canberra fr yu and any dependants, in Australian Dllars. If yu are nt using a migratin agent, the settlement research is included as part f the nline applicatin. Canberra. If yu have lived, wrked r studied interstate within the last tw years, yu must demnstrate that all members f yur immediate family (spuse/partner and children if applicable) meet the Canberra residence criteria. Fr verseas residents: In n mre than tw pages, explain in yur wn wrds, why yu want t live in Canberra fr at least tw years frm date f permanent arrival: Tell us why Canberra s lifestyle suits yur way f life mre than any ther city in Australia. Include evidence that yu have persnally researched Canberra s lifestyle and attractins. Statements that are bviusly cpied frm anther surce (and nt written in yur wn wrds) will nt meet the genuine cmmitment t Canberra criteria. If yur spuse / partner (if any) intend t wrk, include evidence that they have als researched emplyment pprtunities in Canberra and are satisfied that they are emplyable. If yu, yur spuse / partner r any dependents have studied r lived in anther Australian state r territry within the last 12 mnths, yu are nt eligible t apply fr ACT nminatin. A clse family member includes parents, brther, sister, grandparents, step parents and step siblings f the main applicant r spuse / partner. Fr Canberra residents Yu are nt required t prvide evidence if yu have family living in ther parts f Australia. Fr verseas residents: If yu have clse family members living in Australia yu must attach the fllwing infrmatin: Clse family living in Canberra: passprt and/ r birth certificates t evidence the familial relatinship; letter f supprt frm yur Canberra relative; evidence f their 12 mnth residence in the ACT; and evidence f their Australian residency / citizenship. Clse family living in ther parts f Australia: attach a statement explaining why yu have chsen t live in Canberra and nt with them in their state/territry. Canberra. 11 Nminatin by anther Australian state / territry: If yu have applied t anther Australian state r territry fr nminatin f a skilled migratin visa, yu must attach a statement explaining why yu are nw applying t the ACT. Persnal Infrmatin: Attach a cpy f yur passprt. This must be current (valid fr travel purpses) and shw yur persnal details and any pages shwing Australian visas. Attach a cpy f any current Australian visa grant ntificatin. Fr bridging visa hlders, attach a cpy f the visa grant ntificatin fr the last substantive visa yu held. Attach a cpy f yur spuse / defact partner s passprt (if applicable). If yu are using a migratin agent, attach a cmpleted and signed frm 956 Advice by a migratin agent/exempt persn f prviding immigratin assistance. If yu are already living in Canberra: Attach bank statements t demnstrate that yu have lived in Canberra fr the required length f time. The statements must shw shpping activity, ATM withdrawals, salary etc. Evidence that yur spuse / defact partner (if applicable) is als living in Canberra if they are in Australia i.e. Drivers Licence r prf f age card, prf f emplyment, bank statements etc. Service fee: A$300 A nn-refundable service fee must be paid t cmplete yur applicatin. The service fee may be paid nline at time f applicatin; r yu can pay later by Credit card r EFT. If yu are paying later by EFT, a cpy f the EFT receipt must be ed t migratinservices@act.gv.au. The payment will be cnfirmed within three wrking days. The applicatin will nt be queued fr prcessing until the payment is cnfirmed. Hw t ldge yur Applicatin fr ACT Nminatin Yu must cmplete the nline applicatin fr ACT nminatin (at Canberra.Createyurfuture), attach all supprting dcumentatin and pay the service fee. The service fee must be paid, and cnfirmed befre the applicatin is ldged and queued fr prcessing. All applicatins will be prcessed in queue rder If yu are a Migratin agent acting n behalf f a client, yu must register and create an accunt befre yu can access the nline applicatin prtal. If yu are an individual applying fr ACT nminatin f a 190 visa, and yu are nt using a migratin agent, yu are nt required t create an accunt. The service fee must be paid and cnfirmed befre the applicatin is ldged and queued fr prcessing. All applicatins will be prcessed in queue date rder. Yu must demnstrate that yu meet the nminatin criteria that is in effect at the date f applicatin ldgement. The assessment f the applicatin fr ACT nminatin will be based slely n the supprting dcuments prvided at the time f applicatin. Additinal dcuments in supprt f the applicatin will nt be accepted nce the applicatin is submitted. Canberra. 13 Ntificatin f utcme Yu will be ntified f the utcme f the applicatin by . Apprval: If the applicatin fr ACT nminatin is apprved, yur EOI n SkillSelect will be cnfirmed and the Department f Hme Affairs will immediately issue the visa invitatin. Once the visa invitatin is issued, yu will nt be able t update the EOI. Yu must apply fr the Skilled Nminated (subclass 190) visa within 60 days. Refusal: If the applicatin fr ACT nminatin is refused, yu will be infrmed f the reasns why the applicatin did nt meet the nminatin criteria. Any request fr a recnsideratin f a refused applicatin will be based slely n the supprting dcuments prvided at time f applicatin. Additinal dcumentatin will nt be accepted.
