(1) This Act may be called the Himachal Pradesh Court Fees (Amendment) Act, (2) It shall be deemed to have come into force on 3 rd day of February, Insertion of new section 42A. After section 42 of the Himachal Pradesh Court Fees Act, 1968, the following new section shall be inserted, namely : 42A. Special provision regarding suits, appeals, revision etc. filed by or on behalf of the State Government before the Court. Notwithstanding anything contained in any other provisions of this Act, where a suit, appeal, revision, review or other pleading or document is filed or presented by or on behalf of the State Government or its officers in their official capacity before any court, no court fee shall be chargeable in respect of such suit, appeal, revision, review or other pleading or document under the provisions of this Act.. 3. Repeal of the Himachal Pradesh Ordinance No. 1 of 2017 and savings. (1) The Himachal Pradesh Court Fees (Amendment) Ordinance, 2017 is hereby repealed. (2) Notwithstanding such repeal anything done or any action taken under the Ordinance so repealed shall be deemed to have been done or taken under the corresponding provisions of this Act. Consequent upon Cadre Review, 2017 of Himachal Pradesh Forest Service and to impart greater effectiveness to the protection mechanism of the Forest Department the Governor, Himachal Pradesh is pleased to re-organize/re-structure the Flying Squad Divisions of the Forest Department as under: 1. These shall be two Flying Squad Divisions in the State with Headquarters at Shimla (South) and Dharamshala (North) respectively. 2. The Flying Squad Division Shimla shall have jurisdiction over Shimla, Rampur, Nahan, Bilaspur (T) Forest Circles and Wildlife Circle (South) Shimla. 3. The Flying Squad Division Dharamshala shall have jurisdiction over Mandi, Kullu, Hamirpur, Dharamshala, Chamba (T) Forest Circles, Wildlife Circle (North) Dharamshala and Greater Himalayan National Park, Shamshi Kullu Circles. 4. These divisions shall work under the supervision of APCCF (Forest Management) and overall control of Pr. Chief Conservator of Forests (HoFF), HP. 5. These divisions shall perform the following duties:- (i) Intelligence gathering about forest and wildlife related offences and taking action thereupon and sharing the inputs with the APCCF (Management) and PCCF (HOFF); (ii) Detection and checking of illicit felling of trees in Government & Private Forests and smuggling of timber;

11 jkti=] fgekpy izns'k] 18 ebz] os'kk[k] (iii) Checking of timber distribution grants, including marking and appropriate utilization of trees; (iv) Checking of smuggling of forest produce; (v) Checking of illicit felling and smuggling of timber in private sale cases; (vi) Checking of extraction of timber and resin by the HP State Forest Corporation Ltd.; (vii) Looking into the complaints of encroachment on forest land specifically marked by the APCCF (Management/PCCF (HOFF); (viii) Detection and checking of offences related to wildlife; (ix) Handing over of cases of Forest Offences to the local Police/Vigilance Deptt. in which inter-district/inter-state/organized commission of offences is detected with the prior approval of the PCCF (HOFF); (x) Holding of enquiries into the complaints received by them or referred to them by the Government or the Pr. Chief Conservator of Forests (HOFF), HP; (xi) Prosecution of Forest offences in the appropriate courts of Law in those cases which are detected by these divisions; and (xii) Any other duty as may be assigned by the Government or the PCCF from time to time. 6. The assignment of above duties to the Flying Squad Divisions shall not affect the duties of the territorial divisions who shall be primarily responsible for all protection measures within their respective jurisdictions. 7. Both the Forest Divisions will send monthly progress report of activities done in the proforma attached at Annexure-A. The PCCF shall submit quarterly progress report to the Govt. 8. The Officers of the flying squads will be made appropriate delegation under the relevant statutes and rules framed thereunder to perform their job. 9. The PCCF (HOFF) shall issue standard operating procedures for jobs to be performed by the flying squads wherever required. 10. Posting of staff in these divisions shall be done by the Pr. Chief Conservator of Forests, HP on tenure basis and all vacant posts of these divisions shall be filled within a period of one month from the issuance of this Notification.
