In supersession to this department Notification No. MPP F(1)2/2005-VII dated the Governor of Himachal Pradesh is pleased to notify the amendments in State ydro Power Policy 2006 to the following extent:-- 1. 2 1114 jkti=] fgekpy izns'k] 4 twu] 2015@14 T;s"B] The Principal Promoters are also allowed to sell/transfer their equity beyond 51% during the implementation period of the Project in the name of any third party which is competent enough to develop the Project in a better manner and possesses resources higher than the existing allotted Companies who have shown their inabilities to go ahead with the implementation of the Project due to various constraints including lack of finances for the Project implementation, subject to fulfillment of the following terms and conditions: i. Provided that a detailed proposal showing competency in terms of Financial & Technical credential of the New Entity willing to acquire the Project, is submitted for consideration of the Government by either of the parties, alongwith firm letter of consent and valid resolutions duly passed by the Board of Directors of both the Companies, stating that all liabilities & responsibilities assigned in favour of the allottee Company shall be acceptable to the new entity. ii. Provided that an undertaking to the effect that all liabilities as well as payments due in favour of the original allottee Company are duly accepted by the new entity. iii. Provided that the new entity should possess adequate financial as well as technical competences in such a manner that the credentials of the new entity should meet the strengths required for prequalification as per the allotment terms and conditions. In lieu of allowing change/transfer of equity of Principal Promoters, a Rs. 50,000/- per MW subject to maximum of Rs. 50 lakh is to be deposited at the time of signing Tripartite Agreement for transfer of Project along with all liabilities/responsibilities in the name of new entity. The above provisions will be applicable to Projects of all sizes. This shall come into force from the date of its publication in the Himachal Pradesh Rajpatra. In partial modification to this department Notification No. MPP- F(10) 24/2011, dated 5th October, 2011 and subsequent modifications carried out thereafter from time to time, regarding revised guidelines for management of Local Area Development Fund (LADF), the Governor, Himachal Pradesh is pleased to make the following amendments in the Revised Guidelines for Management of Local Area Development Fund (LADF) in respect of Hydro Electric Projects, reads as under: (a) Additional 1% (one percent) Free Power after commissioning of hydro power projects shall be earmarked for the LADF to provide a regular stream of revenue for income

The revenue to be generated out of sale of 1% Additional Free Power on account of LADF shall be disbursed amongst the beneficiary families in the following proportion in line with the notification dated i. 50% of the total amount of LADF to be divided to all families in PAA equally subject to BPL families getting higher amount as per the policy notified on ii. Balance 50% of the total amount of LADF to be divided between the families in the ratio of the land acquired in their respective Panchayat subject to BPL families getting higher amount as per the policy notified on The LADF will be administered by a committee called the Local Area Development Committee (LADC) which will be constituted for each Project separately, immediately after signing of the Implementation Agreement. All the LADCs constituted within the District shall function under the overall super intendance and control of the Local MLA/ Deputy Commissioner.
