For example, when Hurricane Irene hit the East Coast this year, in Connecticut alone, a record 650,000 households lost power, many of them for several days. In Vermont, food had to be airlifted to towns cut off by flooding. All told, Newsweek reported Hurricane Irene killed 43 people in the United States, and estimates of the damage range up to $20 billon. This panel will address issues covering governmental and insurance industry responses and features Charleston Mayor Joseph Riley, who mastered the response to Category 4 Hurricane Hugo in 1989 and won international accolades for his vision, Birmingham Mayor, William Bell, who weathered and learned from the tornados which sliced across Alabama this year, and Brad Kierserman, Chief Counsel of the Federal Emergency Management Agency (FEMA), previously served and Associate General Counsel for Operations and Enforcement in the Department of Homeland Security (DHS) Office of the General Counsel. Moderator: James D. Myrick, Womble Carlyle, Charleston, SC Brad J. Kierserman, Chief Counsel, Federal Emergency Management Agency (FEMA), Washington, DC The Honorable Joseph P. Unfortunately, in the world around us today, we too often read about the devastating physical, emotional and economic loss from disasters caused by acts of nature. Experts from all disciplines respond to natural disasters and help us become better prepared to handle these disasters in the future. The experts on this panel have responded to these events on the beach, in the courtroom, and in the field in their respective disciplines and will assess national preparedness, the likely hot spots geographically and what can and must be done now to avert even worsened consequences. 2

Michelle will provide strong business arguments supported by government and climatical statistics that show a clear increase in the number of natural and man made disasters over the past few years. Next, Bert Wolff, from Chubb & Son, will review the nuts and bolts of a solid business continuity plan, including detail on how to set up and implement the plan and what types of information needs to be included in the plan and the importance of updating the plan before and after a disaster strikes. The Second part of our discussion will be introduced by Doug and presented by his partner, John Vishneski. John will review the multitude of issues that a business faces after a disaster strikes, focusing mainly on business interruption insurance coverage issues. A fact pattern based on an actual case involving an industrial accident will be used to illustrate how to address the various issues faced by a business after a disaster strikes including: Determining Applicable Insurance Coverage, General Liability Coverage, Compliance With Property Insurance Policy Conditions During Claim Investigation, and Issues Impacting First Party Property/Business Interruption Claim.
