1 MINUTES BUSHNELL CITY COUNCIL REGULAR MEETING 117 EAST JOE P. STRICKLAND, JR. AVENUE OCTOBER 3, :00 P.M. Meeting was called to order by Mayor Spaude followed by the Invocation and The Pledge of Allegiance. Mayor Spaude welcomed all present and explained the manner in which to be heard during the meeting. City Clerk CONSENT AGENDA 1. APPROVAL OF THE MINUTES FOR THE REGULAR COUNCIL MEETING AND FIRST BUDGET HEARING HELD SEPTEMBER 8, APPROVAL OF THE MINUTES FOR THE SECOND AND FINAL BUDGET HEARING HELD SEPTEMBER 19, APPROVAL OF THE FINANCIAL REPORTS. 4. APPROVAL OF THE PIGGYBACK BID FOR BUDGETED PURCHASE OF AN INTEGRATED FINANCIAL SOFTWARE PACKAGE. Motion made by Councilman Swain, and seconded by Councilwoman Davis, to approve the consent agenda. 2 CITIZEN S FORUM (LIMITED TO 2 MINUTES PER PERSON). Hal Lyons, 1895 W CR 48- Mr. Lyons made a request to convert the Downtown Plaza Park into a sculpture park. Mr. Lyons also stated that the sculptures would make nice photo opportunities, and he would be interested in donating a sculpture. Motion made by Councilman Swain, and seconded by Councilwoman Davis, to move item #7 to the beginning of New Business. NEW BUSINESS 7. RESOLUTION , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BUSHNELL, FLORIDA, IN MEMORY OF AND EXPRESSING APPRECIATION TO SANDRA KAY MCCOY, COUNCILWOMAN SEAT THREE, FOR THE DEDICATION, DEVOTION, AND LOYALTY TO THE CITY OF BUSHNELL, AND ITS CITIZENS. Motion made by Councilman Swain, and seconded by Councilwoman Davis, to approve Resolution , in memory of, and expressing appreciation to Sandra Kay McCoy, Councilwoman seat three; for the dedication, devotion, and loyalty to the City of Bushnell, and its citizens. Roll call vote: Councilman Swain Yea, Councilwoman Davis Yea, Vice-Mayor Durham Yea, and Mayor Spaude Yea. Motion made by Mayor Spaude, and seconded by Councilwoman Davis, to read New Business items 1-3 by title only. 1. SECOND AND FINAL READING OF ORDINANCE , AN ORDINANCE OF THE CITY OF BUSHNELL, FLORIDA, ANNEXING CERTAIN REAL PROPERTY INTO THE CORPORATE LIMITS OF THE CITY BY VOLUNTARY ANNEXATION; REDEFINING THE BOUNDARIES OF THE CITY TO INCLUDE SUCH LANDS; AND PROVIDING AN EFFECTIVE DATE. PARCEL N17D501. OWNERS: DAVID AND CHARLENE FRY. Motion made by Vice-Mayor Durham, and seconded by Councilman Swain, to pass Ordinance on the second and final reading. SECOND AND FINAL READING OF ORDINANCE , AN ORDINANCE OF THE CITY OF BUSHNELL, FLORIDA, PROVIDING FOR A SMALL SCALE COMPREHENSIVE PLAN AMENDMENT DESIGNATING CERTAIN REAL PROPERTY ANNEXED INTO THE CITY AS MHDR, MEDIUM HIGH DENISTY RESIDENTIAL, ON THE FUTURE LAND USE MAP; AND PROVIDING AN EFFECTIVE DATE. PARCEL N17D501. OWNERS: DAVID AND CHARLENE FRY. Motion made by Councilman Swain, and seconded by Councilwoman Davis, to pass Ordinance on the second and final reading. Roll call vote: Councilman Swain Yea, Councilwoman Davis Yea, Vice-Mayor Durham Yea, and Mayor Spaude Yea. 3. SECOND AND FINAL READING OF ORDINANCE , AN ORDINANCE OF THE CITY OF BUSHNELL, FLORIDA, DESIGNATING CERTAIN REAL PROPERTY ANNEXED INTO THE CITY AS A RMH-6, RESIDENTIAL MANUFACTURED HOME, ZONING DISTRICT; AND PROVIDING AN EFFECTIVE DATE. PARCEL N17D501. OWNERS: DAVID AND CHARLENE FRY. Motion made by Vice-Mayor Durham, and seconded by Councilman Swain, to pass Ordinance on the second and final reading. Roll call vote: Councilman Swain Yea, Councilwoman Davis Yea, Vice-Mayor Durham Yea, and Mayor Spaude Yea. 4. TABLED ITEM- FIRST READING OF ORDINANCE , AN ORDINANCE OF THE CITY OF BUSHNELL, FLORIDA, CHANGING THE ZONING OF CERTAIN REAL PROPERTY FROM RESIDENTIAL TO A C-1, NEIGHBORHOOD BUSINESS AND PROFESSIONAL OFFICES, ZONING DISTRICT; AND PROVIDING AN EFFECTIVE DATE. PARCEL N16E036. OWNER: DAVID SOMERS. Motion made by Councilman Swain, and seconded by Vice-Mayor Durham to take item #4 off the table. Councilman Swain asked those present if they would like to speak regarding the rezoning of the Somers property. Melinda Etheredge, 324 N. Broad- Ms. Etheredge informed the Council and those present that her and her family are opposed to the rezoning of the Somers property. Ms. Etheredge also stated that the property was a nuisance, the police were often called to the residence, and their safety was a concern. Ms Etheredge further stated that she does not feel that a commercial entity belongs in a residential neighborhood. OCTOBER 3, 2016 REGULAR MEETING MINUTES Page 3
4 Motion made by Councilman Swain, and seconded by Vice-Mayor Durham to deny the zoning request of Ordinance Roll call vote: Councilman Swain Yea, Councilwoman Davis Yea, Vice-Mayor Durham Yea, and Mayor Spaude Yea. Motion carried 4/0. 5. TABLED ITEM- RECOMMENDATION FROM THE BACE TO APPROVE THE SPECIAL EXCEPTION ON PARCEL N16A195, TO ALLOW FOR COMPOUND USE OF PROPERTY FOR HOUSING LAW OFFICE, CHARITABLE ORGANIZATION, AND ALLOW FOR RESIDENCE. Motion made by Councilman Swain, and seconded by Vice-Mayor Durham to take item #5 off the table. Councilman Swain asked those present if they would like to speak regarding the special exception. Martha Kithcart, 212 East Noble Ave- Ms. Kithcart requested the section remain residential. Councilman Swain stated that this area was all residential surrounding property, with the exception of the government property across the street. Motion made by Councilman Swain, and seconded by Vice-Mayor Durham to deny the special exception on parcel N16A195. Barbara Maddox, 315 North Rutland Street- Ms. Maddox stated that she was opposed to the special exception, and would like to keep the area residential. Mayor Spaude called for a roll call vote: Councilman Swain Yea, Councilwoman Davis Yea, Vice-Mayor Durham Yea, and Mayor Spaude Nay. Motion carried 3/1. 6. RESOLUTION , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BUSHNELL, FLORIDA, APPOINTING JOE P. STRICKLAND TO THE CITY COUNCIL, SEAT NUMBER THREE, OF THE CITY OF BUSHNELL DUE TO THE UNTIMELY DEATH OF COUNCILWOMAN SANDRA "KAY" MCCOY. Motion made by Councilman Swain, and seconded by Vice-Mayor Durham, to approve Resolution , appointing Joe P. Strickland to the City Council, seat number three, of the City of Bushnell due to the untimely death of Councilwoman Sandra Kay McCoy. Roll call vote: Councilman Swain Yea, Councilwoman Davis Yea, Vice- Mayor Durham Yea, and Mayor Spaude Yea. OCTOBER 3, 2016 REGULAR MEETING MINUTES Page 4
5 8. RECOMMENDATION TO APPOINT HANNAH FOSTER AND REAPPOINT FRANK HAMILTON TO THE CEMETERY BOARD OF TRUSTEES. Motion made by Vice-Mayor Durham, and seconded by Councilwoman Davis, to approve the recommendation to appoint Hannah Foster and reappoint Frank Hamilton to the Cemetery Board of Trustees. Councilman Swain stated that Ms. Foster was a quality person in the community. Mr. Swain also stated that he didn t have a problem with Ms. Foster on the board of trustees, but he would like to see someone that lives in the City on the board. Vice- Mayor Durham asked Mr. Swain if he had a person in mind to appoint, Mr. Swain replied, not at this time. Motion made by Mayor Spuade, and seconded by Councilwoman Davis to approve the appointments to the Cemetery Board of Trustees. 9. APPROVAL OF THE RECOMMENDATION TO RETAIN A FINANCIAL ADVISOR. Motion made by Vice-Mayor Durham, and seconded by Councilwoman Davis, to approve the recommendation to retain a financial advisor. 10. APPROVAL OF THE LETTER TO ACCOMMODATE THE REQUEST FROM WEBSTER CEMETERY ASSOCIATION. Motion made by Vice-Mayor Durham, and seconded by Councilwoman Davis, to approve the letter to accommodate the request from Webster Cemetery Association. INFORMATION CITY CLERK REPORT AND REQUEST 1. THE CITY OF BUSHNELL WILL BE PARTICIAPTING IN THE DADE BATTLEFIELD HISTORIC STATE PARK ANNUAL HALLOWEEN EVENT ON OCTOBER 21 ST AND 22 ND, 7:00 P.M. - 9:30 P.M. THE EVENT WILL CONSIST OF A SPOOKY HAUNTED TRAIL DATED TO THE 1850 S TIME PERIOD. City Clerk, Christina Dixon gave the update on the Halloween event at Dade Battlefield. 6 CITY MANAGER REPORT AND REQUEST City Manager, Bruce Hickle informed the Council and those present that the City of Bushnell had received the Certificate of Excellence in Financial Reporting. Mr. Hickle stated that the City has received the award for 15 consecutive years. Mr. Hickle gave recognition to our Finance Director, Jody Young on the achievement. Mr. Hickle informed the Council and those present about the progress of the Sumterville Water Plant grant project. Mr. Hickle stated that the project had gone out for bid, and the bids received were much higher than the grant authorization amount. Mr. Hickle also stated that the low bidder was $696,660.00, and the City has a $385,000 budgeted amount. Mr. Hickle stated that the engineers estimate came in close to the $385,000 amount, but the estimate was done over a year ago. Mr. Hickle further stated that the City will be looking into utilizing the grant proceeds, and doing some of the work to improve the plant. CITY ATTORNEY City Attorney, Felix Adams informed the City Council and those present that City Manager, Bruce Hickle had sent a letter to the editor at the Sumter County Times regarding the litigation with SECO. Mr. Adams stated that the letter was an excellent summary of the litigation between the City and SECO, and everyone should read the article. DEPARTMENT HEAD REPORT AND REQUEST: UTILITY PROGRAMS COORDINATOR - RONDA CASON 1. REMINDER OF THE CUSTOMER APPRECIATION EVENT- OCTOBER 3 RD 5 TH Utility Programs Coordinator, Ronda Cason gave the update on the Customer Appreciation Event. HR DIRECTOR/ASSISTANT CITY CLERK- KELLY MARCOUX FINANCE DIRECTOR - JODY YOUNG ASSISTANT CITY MANAGER ADMINISTRATION SERVICES- SUSAN NOELL 1. UPDATE ON THE MOVIE ZOOTOPIA IN THE DR. MARTIN LUTHER KING JR. PARK. 2. TUESDAY, OCTOBER 4 TH - THE BUSHNELL SENIOR CENTER WILL CELEBRATE THEIR 1 YEAR ANNIVERSARY. Assistant City Manager Administration Services, Susan Noell gave the update on the Movie in the Park and the 1 year Anniversary at the Bushnell Senior Center. 7 DIRECTOR OF PUBLIC WORKS - MIKE EASTBURN FALL FESTIVAL COORDINATOR- RUBY MARK 1. FALL FESTIVAL REPORT. Fall Festival Coordinator, Ruby Mark gave the report on the Fall Festival Festivities. SUMTER COUNTY SHERIFF'S DEPARTMENT - LT. BOB CAPPS DIRECTOR OF ZONING AND CODE COMPLIANCE - DENISE LEE CITY COUNCIL COMMENTS AND INFORMATION Councilwoman Davis wanted to let the Council and those present that the St. James Baptist Church wanted to express their thanks to the City for the letting the church provide concessions at the Dr. Martin Luther King Jr. Park Movie in the Park Event. Jermaine Gordon, Pastor at St. James Baptist Church- Pastor Gordon thanked the City for letting the church take part in the Movie in the Park Event. CORRESPONDENCE 1. LETTER FROM BRIGHTHOUSE. 2.
