1 MINUTES OF LIMA CITY COUNCIL LIMA, OHIO May 4, 2015 The Council of the City of Lima met in regular session at 7:00 p.m. Attending were: Mayor David Berger; Tony Geiger, Law Director; John Payne, Deputy Law Director; Randall Bartels, Auditor; Amy Odum; Dir. Of DCD; Gary Sheely, Dir. of Util.; Howard Elstro, Dir. of Public Works; Chief Martin, Chief Heffner, and Sally Clemans, Clerk. The invocation was given by Councilor McLean followed by the Pledge of Allegiance. ROLL CALL showed the following members present: Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. PRIVILEGE OF THE FLOOR: Dr. Carol Fails spoke regarding education. She said the NAACP is a civil rights organization that fights for the rights of all citizens on a volunteer basis. She voiced concerns over the hiring of minority teachers in the Lima City Schools. She met with the superintendent but only 6 people were present. She reached out to a superintendent in another district in Ohio with similar demographics and he said he reached out and the staff now includes 50% African American educators. The NAACP reached out to the school board to share specifically information how this was accomplished but Lima City School officials have chosen not to engage on 5 occasions. She shared personal information on her background. (A complete copy of Dr. Fail s comments are on file in the Council office.) THE FOLLOWING ITEMS WERE PRESENTED ON THE CONSENT CALENDAR: a. Minutes of the previous meeting not read since each received a copy. b. City Planning Commission minutes of April 22, c. Bd. of Health minutes of March 13, Tebben moved that item Aa@ of the consent calendar be received, filed, and approved and that items Ab-c@ be received and filed, seconded by Lowe, motion carried. THE FOLLOWING COMMUNICATIONS WERE PRESENTED: 1. From the Dir. of Comm. Dev. regarding legislation to place tax assessments. Moved by Glenn, seconded y Adams, that the communication be received and filed. Legislation is on the agenda. Motion carried. [1]
2 2. From the Finance Dir. regarding legislation for budget amendments. Moved by Miles, seconded by Glenn, that the communication be received and filed. Legislation is on the agenda. Motion carried. 3. From the Finance Dir. regarding the 2015 Tax Budget. Moved by Tebben, seconded by McLean, that the communication be received and filed. Motion carried. It was moved by Tebben and seconded by McLean, that the hearing be set for June 8, 2015 at 7:00 p.m. Motion carried. 4. From the Deputy Dir. of Utilities regarding legislation to amend Ord Moved by McLean, seconded by Tebben, that the communication be received and filed. Legislation is on the agenda. Motion carried. 5. From the Dir. of Utilities regarding legislation to enter into contract with Black and Veatch Corporation. Moved by McLean, seconded by Lowe, that the communication be received and filed. Legislation is on the agenda. Motion carried. 6. From the Dir. of Human Resources regarding life insurance for part-time employees. Moved by Lowe, seconded by Glenn, that the communication be received, filed, and the Law Director authorized to prepare the necessary legislation. Motion carried. 7. From William Lyons requesting renewal of the agreement with Cheap Sign Company for bus shelters. Moved by Tebben, seconded by Gordon, that the communication be received and filed. Legislation is on the agenda. Motion carried. 8. From Square Fair, Inc. requesting permission to hold the Toast to the City, Moved by Lowe, seconded by Gordon, that the communication be received and filed. Motion carried. 9. From the Dir. of Comm. Dev. regarding legislation to approve the minutes of the Tax Incentive Review Council. Moved by Glenn, seconded by Adams, that the communication be received and filed. Legislation is on the agenda. Motion carried. PETITIONS: Alley Vacation 600 Block S. West St. Petitioned for by Rose Marie Ruble. Glenn moved, seconded by McLean, that the petition be received and filed; that the Law Director prepare the necessary legislation; that the Clerk cause publication of the legal ad and notify abutting property owners of the Public Hearing to be held on June 22, 2015 at 7:00 p.m. Motion carried. REPORTS OF OFFICIALS: Howard Elstro, Director of Public Works, presented the 2015 demolition list. Only 24 [2]
3 properties will be demolished with CDBG funds. 79 were demolished last year. About 55% were done by the owners. CDBG funds are the only funds they have to work with this year. The Department of Comm. Dev. has done a study of the demolitions need and there are about 500 additional properties that need demolished. (A complete copy of the report is on file in the Council office.) THE FOLLOWING ORDINANCES WERE PRESENTED: Authorizing the Mayor to terminate an easement agreement established in Ordinance No Adams moved, seconded by Glenn, that the ordinance be placed on a third reading. Motion carried Levying special assessments for property maintenance code charges on premises in the City of Lima, Ohio. Glenn moved, seconded by Adams, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote Amending the 2015 Annual Budget. Miles moved, seconded by Glenn, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote Authorizing the Mayor to enter into a Licensing Agreement with Lyons Industries, Inc. DBA The Cheap Sign Company. Tebben moved, seconded by McLean, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote Authorizing Continuation and Amendments to the following Enterprise Zone and Community Reinvestment Area Agreements based on the recommendations of the Tax Incentive Review Council. Glenn moved, seconded by Adams, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote Authorizing the Mayor to advertise for bids and enter into contract for the Regeneration of the Granular Activated Carbon Contractors. McLean moved, seconded by Tebben, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote. [3]
4 Authorizing the Mayor to enter into contract with Black and Veatch Corporation. McLean moved, seconded by Gordon, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote Amending Ordinance No McLean moved, seconded by Tebben, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote Repealing Section of the Codified Ordinances of Lima, Ohio. Lowe moved, seconded by Tebben, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 8; Gordon, McLean, Lowe, Tebben, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by an 8-0 vote. MISCELLANEOUS BUSINESS: Councilor McLean congratulated June Blauvelt for the award she received from Apollo from the State of Ohio. She and her husband are great volunteers and she is very deserving. The dumpsters at St. Gerard were very busy this last Saturday. He said Allen County Refuse were a shining star with their help. He said this will continue all month. The sites are listed on the web. Councilor Lowe said that the High Octane Drum Line is a success. It is open to everyone age They meet at Bradfield on Tuesday from 6:00-7:00 p.m. Councilor Tebben said the Boulevard N/A filled 4 dumpsters. He said this is a great opportunity to get rid of items. The Boulevard N/A will meet Tuesday at 7 p.m. and Lt. Ron Holman will be the speaker. Councilor Tebben expressed concerns over parking in yards, etc. He would like to see a possible quicker response and make it a ticketable offense. Tebben moved, seconded by Glenn to refer parking issues to the Safety Services Committee. Motion carried. Tebben also said with the number of rental properties increasing he thinks we should look at our zoning code. Tebben moved, seconded by Adams, that the issue of zoning on properties in the city, be referred to the Public Works Committee. Motion carried. Councilor Adams reminded everyone to vote tomorrow. She said they are expecting a low turnout. City wide pride clean-up for Hope N/A will be on May 16 th at Unity from 9-12 p.m. Councilor Glenn said there will be a CDBG meeting May 7 th. He asked Ms. Odum to explain. She said the first meeting was tonight to talk about the 5 year plan. There will be an application briefing on May 7 th at 5:30 p.m. The deadline for applications will be May 22 nd. Councilor Glenn said the Southside N/A clean-up will be Sat. at 4 th St. Missionary Church and [4]
5 May 30 th at MLK. He said they are taking some kids that turned 18 to vote. He said the rent-a-kid program is back again but he has someone taking it over for him. He said it is good to keep working with our youth. Councilor Miles said kudos to June Blauvelt. I applaud her. She said get out and vote. She said May 7 th is National Prayer Day. Go out to UNOH and participate. We need to come together as a community. There is power in prayer. The Westside N/A will meet May 17 th at 6:00 p.m.. An Officer will be speaking on Home Security. Councilor Gordon called a Safety Services Committee meeting for Monday, May 11 th at 6:00 p.m. He said for the clean-up, you can take up to 9 tires out to the Collet St. Garage. He said the Johnny Appleseed Parks is on the ballot if you are interested in your parks. He said Be good to each other.
