1 PROCEEDINGS Lordstown Village Council Regular Meeting (WHEREAS, the regular meeting before the Lordstown Village Council commenced on, at 6:10 p.m. and proceedings were as follows:) (Lord's Prayer and Pledge of Allegiance to the Flag) MR. EBLING: SOLICITOR DUTTON: CHIEF MILHOAN: CHIEF EASTHAM: MS. BORDNER: MRS. GIBSON: MR. KOGELNIK: COUNCIL: Bill, if we could have roll call, please. Mayor Hill? Here. Here. Clerk Blank, present. Treasurer, George Ebling? Here. Solicitor Paul Dutton? Police Chief Brent Milhoan? Fire Chief Travis Eastham? Planning, Zoning, Economic Development, Kellie Bordner? Parks, Buildings, Grounds, Street Commissioner, Dale Grimm? Recreation, Marty Gibson? Here. Board of Public Affairs? (NO RESPONSE ABSENT.) Municipal Engineer, Chris Kogelnik? I didn't hear anything from the Board of Public Affairs, so I won't ask for any of them to be excused. Can I have a motion for adoption of the agenda? Moved by Jones. second? Second by Reider. Comments? All in favor? Aye. Opposed? 1
2 Motion carried. COUNCIL: I'll entertain a motion for disposal of the minutes for the regular meeting held September 18, Moved by Sheely. Second? Second Radtka. Comments? All in favor? Aye. Opposed? COUNCIL: Motion carried. I'll entertain a motion for payment of the bills. Moved by Bond. Second? Second by Reider. Comments? All in favor? Aye. Opposed? SOLICITOR DUTTON: MR. EBLING: Motion carried. Mayor's report. We had a real good Apple Cider Festival last weekend. It was probably one of the best ones. We heard nothing but compliments and comments on it. I'd like to give a shout out to everybody who had anything to do with it because it went very well. I heard maybe one or two grumbles, but if that's all you get, it's been a success. That's all I have for the Mayor's report. Clerk's report? No report, Mayor. Solicitor's report? No report well, I guess there is something. The Court of Appeals issued its opinion in favor of the Village of Lordstown in the Gensberg case, and I shared that with you. Matt Ries, who happens to be Vito's brother-in-law, handled that quite well. As Matt said, 99.9 percent of the cases of this nature would end here. But it's hard to predict whether they will appeal to the Ohio Supreme Court. So, as of the moment, there is no pending litigation. Any questions for Paul? Treasurer's report? No report. No one is here from the Board of Trustees of Public Affairs. Village Engineer's report? 2
3 MR. KOGELNIK: MR. KOGELNIK: MR. KOGELNIK: CHIEF MILHOAN: CHIEF EASTHAM: MS. BORDNER: Yes, Mayor. I'd like to apprise the Board of a couple things. Number one, we have a kick-off meeting that's planned for the Highland Avenue sanitary sewer project. I believe that's this Friday. At that meeting, we just go over the various items we're working on already for that project. Also, with the BPA, we're working on revising the rules and regulations for the sanitary sewer and for the water system. And we're also going to be designing and completing the design and bidding out the meter manhole for Imperial. The last thing, for LEC, we're closing out that construction contract. The last remaining item is the SCADA system and any ancillary punch list items. We'll be providing the BPA with the record drawings from that project. Thank you very much. Are there any questions? Will that all be done and paid out by the end of the year? Oh, yeah. It should be. If the village wishes, if there's something, like, grass not catching or something like that or a fence that needs to be altered, there might be a minor amount of retainage that is held for construction until What time is the kick-off meeting? I don't know exactly. I think Bruce wanted to tell us exactly what time on the 6th he wanted to meet. Thank you. Thank you, Chris. Special reports. Police Chief Milhoan? Yes, Mayor. I've submitted my monthly report for September. If you have any questions, I'll answer them. Any questions for Brent? Fire Chief Eastham? No report. Any questions for Travis? Planning and Zoning Administrator and Director of Economic Development, Kellie? No report. Questions for Kellie? Parks, Grounds, Buildings, and Street Superintendent, Mr. Grimm? No report this evening, Mr. Mayor. Questions for Dale? Yes, Dale. After the last meeting at the last meeting you said you'd talked to the guy about the van from Myers. You said about percent. Did you take it down there? Yes, we did. We took it down and Myers actually submitted a proposal of $42,000, which is higher than the percent was actually a lower percentage rate, taking into account the mileage and stuff that was on the van. I did discuss it with Paul, and I don't know which committee it needs to go back to whether it's yours? Does it go back to your committee and then we need to advertise for bids or put it on the government web site? However the committee wishes to move forward with that. We can use the $42,000 as a base bid. Did they put a deadline on your office? No, they didn't. 3
4 MRS. GIBSON: MS. ARLOW: MS. SCHRADER: I'm sure it won't be a year or two out, Bob. Thanks, Dale. You're welcome. Recreation, Marty? No report. Questions for Marty? Do we have any correspondence this evening? No correspondence, Mayor. Public remarks. If you'd like to make a public remark, after I acknowledge you, please come to the microphone and give your name and address so we can get it recorded in the minutes correctly. Public remarks? Kay? Kay Arlow, 6050 Highland Avenue. As a representative of the Apple Cider Festival, I'd like to thank everyone who attended, and especially every one of you who helped in the ticket booth. We really, really appreciate it. Thank you. And it did help. Thank you. Any other public remarks? Donna? Donna Schrader, Highland Avenue, Lordstown. I want to publicly thank this Council for what they did for this village this year with the new ambulance service. I never thought I would be one to use it, but I was down at Dollar General when I got sick. I started driving home and just pulled right into the Fire Department, and they were so kind to me. Trav, you've got a couple good guys that helped me. I just wanted to thank everyone. Thank you very much. Any other public remarks? (NO RESPONSE.) Hearing none are there any Council remarks? (NO RESPONSE FROM COUNCIL.) Hearing none, Committee reports. Finance, Yes, Mr. Mayor. We have three pieces we'd like to have support on tonight. And, also, I'd just like to make everyone aware that our Finance meetings are going to be held at 1:00 instead of noon from now on. So, if anybody wants to attend, it's 1:00. Any questions for Ron? Parks, Buildings, Grounds, General Improvements, Streets and Sidewalks, We just have the one piece of legislation that was discussed at our last Council meeting. And we'd like to see that passed so the county knows that we are committed to doing this. Any other questions for Karen? Thank you. Public Safety and Welfare, Yes, Mr. Mayor. Just the one piece of legislation from the Safety Committee that we would like to see passed this evening. That's all. Thank you. Any questions for Don? Thanks, Don.
