1 MINUTES CITY OF PANAMA CITY CITY COMMISSION MEETING SEPTEMBER 25, :01pm 1. Opening Prayer Pastor Jay Rosario of the Panama City Seventh-Day Adventist Church delivered the opening prayer. 2. Pledge Of Allegiance To The Flag. 3. Roll Call And Approval Of Minutes for the September 14, 2017 City Commission Meeting. City Clerk Darlene Hachmeister called the roll with the following members present: Mayor Greg Brudnicki, Commissioners Kenneth E. Brown, Billy Rader, Mike Nichols and Jenna Haligas. Also present: City Manager Jeffrey Brown and City Attorney Nevin Zimmerman. Commissioner Rader moved to approve the minutes for the regularly scheduled City Commission meeting of September 14, On a roll call vote 4. Public Hearing for the Discussion and Adoption of the Final Millage Rates and Annual Budgets for the City of Panama City and the Panama City Downtown Improvement District for Fiscal Year This is to serve as the Final Public Hearing under the TRIM Act. Mayor Brudnicki said this public hearing is for the discussion and adoption of the millage rates and annual budgets for the City of Panama City and the Panama City Downtown Improvement District for fiscal year 2018 beginning October 1, 2017 and ending September 30, This is to serve as the final public hearing under the TRIM ACT. City Manager Jeff Brown said on September 14, 2017, the first public hearing under the TRIM Act was conducted by the City Commission at which time millage rates of mills for the City's General Fund operating purposes and mills for the Downtown Improvement District were adopted. Together they constitute a current aggregate millage rate of mills, an increase of.40% over the current aggregate rolled-back rate of mills. 1

2 The annual budgets under consideration contain expenditures which total $86,156,948 excluding interfund transfers for the City, and $195,500 for the Downtown Improvement District. Mr. Alvin Peters of 25 East 8th Street, questioned recreational opportunities available and fee assessment. Commissioner Rader stated that he'd like to encourage people to apply for assistance with fees. Commissioner Haligas stated that she is part of a Blue Ribbon Task Force that works in a partnership with other organizations to keep the City's resources accessible for all citizens. Commissioner Nichols commented that the funding for Mardi Gras came from the Tourist Development Council. Mr. William Swift of 1505 Dunnett Court, feels that children that use the facilities at Leisure Services could better be met by increasing the budget for Leisure Services. Commissioner Haligas reiterated that her task force is working on mentoring and making the City's resources accessible and creating a better environment. 4.a. Consideration of Resolution No setting the Ad Valorem Tax Millage Rates. Commissioner Nichols moved adoption of setting the Ad Valorem tax millage rates of mills for the City of Panama City general fund and mills for the Panama City Downtown Improvement Board. On a roll call vote Commissioners Brown, Rader, Nichols, Haligas and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. Commissioner Haligas explained that the new police officers would allow community policing so they could build relationships with children, elderly and the community. Commissioner Brown stated that he has confirmed with the police department that community policing has begun and would continue to grow. 2

3 The resolution was read by title only, as shown below: RESOLUTION A RESOLUTION PROVIDING FOR THE ADOPTION OF A FINAL MILLAGE RATE FOR THE CITY OF PANAMA CITY, FLORIDA AND THE PANAMA CITY DOWNTOWN IMPROVEMENT DISTRICT FOR THE YEAR BEGINNING JANUARY 1, 2017 AND ENDING DECEMBER 31, 2017, FOR OPERATING PURPOSES; PROVIDING FOR THE ALLOWANCE OF HOMESTEAD EXEMPTION. 4.b. Consideration of Resolution No adopting the Fiscal Year 2017/18 Budget. Commissioner Nichols moved adoption of the budgets for the City of Panama City and the Downtown Improvement District for Fiscal Year On a roll call vote Commissioners Brown, Rader, Nichols, Haligas and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. 4 5. Unfinished Business 5.a. Final Reading of Ordinance No amending the Municipal Code article IV Solid Waste Chapter 23. Commissioner Nichols moved to approve Ordinance On a roll call vote ORDINANCE NO AN ORDINANCE AMENDING CHAPTER 23 UTILITIES - AMENDING ONLY SECTIONS OF ARTICLE IV- SOLID WASTE-, OF THE GENERAL ORDINANCES; PROVIDING A BROWN GOODS DEFINITION; PROVIDING FOR AN ENVIRONMENTAL SERVICES MANAGER; PROVIDING FOR THE CITY TO ALLOW FOR FRANCHISE AGREEMENTS FOR COMMERCIAL ACCOUNTS; REMOVING THE RATES AND PROVIDING THAT RATES WILL BE ESTABLISHED BY RESOLUTION; PROVIDING THAT PUBLIC WORKS CAN PICK-UP EXCESS SOLID WASTE DURING NORMAL COLLECTION TIMES; AND PROVIDING FOR AN EFFECTIVE DATE. 5.b. Final reading of Ordinance No voluntary annexation of.542 acres of property located at 141 Jenks Circle. Commissioner Brown moved to approve Ordinance On a roll call vote ORDINANCE NO AN ORDINANCE OF THE CITY APPROVING THE VOLUNTARY ANNEXATION OF.542 ACRES OF UNINCORPORATED PROPERTY LOCATED AT 141 JENKS CIRCLE, BAY COUNTY, FLORIDA, INTO THE CITY, AS FURTHER DEFINED HEREINAFTER, AMENDING THE WARDS AND BOUNDARIES OF THE CITY TO INCLUDE SAID LAND AND PROVIDING FOR AN EFFECTIVE DATE. 4

Commissioner Rader moved to approve Ordinance On a roll call vote ORDINANCE NO AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN FUTURE LAND USE MAP OF THE CITY TO REFLECT A LAND USE DESIGNATION OF RESIDENTIAL FOR ONE PARCEL OF PROPERTY LOCATED AT 141 JENKS CIRCLE, PANAMA CITY, FLORIDA, PROVIDING FOR A REPEALER, PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE. 5.d. Final Reading of Ordinance 2628 proposal to add a section regarding murals to the sign regulations chapter of the land development regulations.. Commissioner Nichols moved to approve Ordinance On a roll call vote ORDINANCE NO AN ORDINANCE AMENDING CHAPTER 106 SIGN REGULATIONS OF THE LAND DEVELOPMENT REGULATIONS ADDING A SECTION 12A MURALS ; PROVIDING A MURALS DEFINITION; LOCATIONAL CRITERIA; REQUIRING COMMITTEE AND STAFF LEVEL REVIEW OF MURAL PROPOSALS PRIOR TO APPROVAL; ENSURING THE CONTINUED MAINTENANCE AND REPAIR OF APPROVED MURALS; ESTABLISHING PENALTIES AND REMEDIES FOR VIOLATIONS; AND PROVIDING AN EFFECTIVE DATE. 7

8 6. Consent Agenda 6.a. Wedding of Ashly Radcliff on October 21, 2017 from 11:00 am - 3:00pm. 6.b. First Baptist Church Wild Game Dinner on November 16, 2017 from 4:00pm - 9:00pm. 6.c. Ukulele Festival with the Ukulele Orchestra of St. Andrews from October 13, 2017 thru October 15, 2017 from 8:00pm - 10:00pm. 6.d. Octoberfest, an event with the Panama City Downtown Improvement Board on October 7, 2017 from 1:00pm - 6:00pm. 6.e. Consideration to award a contract to Waterfront Property Service LLC dba Gator Dredging in the amount of $227, for the Lake Huntington Channel and Watson Bayou north dredging project. 6.f. Consideration to award a contract to Ameritech LLC in the amount of $ for the Martin Luther King, Jr Recreation Center roofing project. 6.g. Consideration to declare two trucks as surplus property and send to auction. Commissioner Nichols removed item 6e from the Consent Agenda to discuss separately. Commissioner Brown moved to approve all items on the Consent Agenda with the exception of item 6e. On a roll call vote Commissioners Brown, Rader, Nichols, Haligas and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. Commissioner Nichols moved to approve item 6e that was on the Consent Agenda. On a roll call vote Commissioners Brown, Rader, Nichols, Haligas and Mayor Brudnicki voted YEA. NAYS : None. The City Clerk certified the motion passed by a 5-0 vote. Commissioner Nichols advised that there are a lot of people in the St. Andrew's area that will be able to use their boats now, due to the dredging. Commissioner Brown said YES! All agreed that this was a long time coming. 8

9 7. City Manager 7a. Consideration of adopting Resolution No amending the garbage collection rates. Commissioner Rader moved to adopt Resolution On a roll call vote The resolution was read by title only, as shown below: RESOLUTION NO A RESOLUTION OF THE CITY OF PANAMA CITY CONCERNING GARBAGE COLLECTION (SOLID WASTE) RATE INCREASES THROUGH AND INCLUDING FISCAL YEARS , , , , AND ; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR THE SEVERABILITY OF ANY PART OF THIS RESOLUTION DECLARED INVALID; AND PROVIDING FOR AN EFFECTIVE DATE. 8. Audience Participation Mr. William Swift of 1505 Dunnett Court, Chairman of the Glenwood Working Partnership referenced Florida Statute and expressed concerns about individuals being relocated due to an adopted redevelopment plan. 9.
