1 REGULAR MEETING, MAYOR AND COUNCIL, CITY OF COVINGTON, GEORGIA, CITY HALL, MAY 5, 2014, 6:30 PM. Mayor Ronnie Johnston presided with Mayor Pro-Tem Michael Whatley, Council members: Janet A. Goodman, Keith Dalton, Hawnethia Williams, Chris Smith, and Ocie Franklin, City Manager Leigh Anne Knight, Deputy City Manager Billy Bouchillon, Deputy Clerk Tammie Lovering, City Attorney E. A. Crudup, Jr., and Associate City Attorney Frank Turner, Jr. present. City Clerk Audra M. Gutierrez was absent. Mustard Seed Faith Ministries, Inc. s Pastor Jimmy A. Copeland opened the meeting with prayer. Mayor Johnston led everyone in the Pledge of Allegiance. Mayor Johnston presented a proclamation honoring Older Americans Month. 1. Motion made by Council member Whatley, seconded by Council member Goodman to approve the minutes from the Regular Council Meeting held on May 5, Audience member Steve Bray expressed concerns regarding gypsy signs littering the City. 2. Motion made by Council member Smith, seconded by Council member Dalton to approve the final reading of an ordinance for the City of Covington: "AN ORDINANCE OF THE CITY OF COVINGTON, GEORGIA, TO AMEND THE COVINGTON MUNICIPAL CODE, ENACTED AND ADOPTED ON THE 16TH DAY OF OCTOBER, 2001, AS AMENDED BY PREVIOUS AMENDMENTS, TO ALTER CERTAIN PROVISIONS OF SECTIONS OF CHAPTER OF THE SAID CODE RELATING TO SIGNS, TO REPEAL CONFLICTING ORDINANCES AND FOR OTHER PURPOSES." 3. Motion made by Council member Goodman, seconded by Council member Franklin to amend the agenda to add, Discussion of Walkers Bend Resolution. 4. Motion made by Council member Franklin, seconded by Council member Dalton to amend the agenda to add, Discussion of change order for DWSRF Water Main Replacement- Phase I. Floyd Street residence Hugh Burnett was in attendance to express his concerns regarding future upgrades to Legion Field and presented a list of questions for the City to answer at a later date. CoC

2 Ms. Melissa Perignat of Holt Net Zatcoff & Wasserman LLP and Mr. Chip Bulloch of TowerCom V, LLC were in attendance to discuss a SUP to construct a new 199 ft. tall telecommunications support structure with a variance from the northern property boundary to be located at 6163 Monticello Street. Audience members James Milligan, Michael Milligan, Polly Milligan, Jackie Lindsey, and Allan Lustenberger were in attendance in opposition of the aforementioned SUP. 5. Motion made by Council member Whatley, seconded by Council member Dalton to deny the afore-mentioned SUP. Associate City Attorney Frank Turner, Jr. recommended the Council table the discussion in order to look into the matter further before making a decision. Council member Whatley withdrew the previous motion. 6. Motion made by Council member Whatley, seconded by Council member Franklin to table the discussion of a SUP to construct a new 199 ft. tall telecommunications support structure with a variance from the northern property boundary to be located at 6163 Monticello Street. Motion carried with Council members Whatley, Goodman, Williams, and Franklin voting for. Council member Smith and Dalton voting against. 7. Motion made by Council member Smith, seconded by Council member Goodman to allow the applicant requesting the rezoning of 1184 Monticello Street from NR-1 to Neighborhood Mixed Use to withdraw the application without prejudice. 8. Motion made by Council member Williams, seconded by Council member Franklin to approve a text amendment to Section Table of Permitted Uses to include Specialty Trade Contractors as a permitted use in the Light Industrial Zoning District. Council members Goodman, Williams, and Franklin voting for. Council members Whatley, Smith, and Dalton voting against. Motion denied with Mayor Johnston voting against, breaking 3-3 tie. 9. Motion made by Council member Smith, seconded by Council member Goodman to approve a text amendment to Section Supplemental Use Regulations Bed and Breakfast Inn to include: The owner or operator shall seek a separate special use permit as an accessory, events facility in order to host an event(s) for guests and non-residents on the property of the bed and breakfast inn. 10. Motion made by Council member Franklin, seconded by Council member Whatley to approve a license to sell alcoholic beverages for off-premises consumption only for: CoC

3 MHSM, Inc. d/b/a Don s Superette 3251 Highway Motion made by Council member Goodman, seconded by Council member Williams to deny a request for temporary road closure for one hour on Monticello Street between Pennington and Conyers Streets on September 27, Motion carried with Council members Whatley, Goodman, Smith, Williams, and Franklin voting for. Council member Dalton voting against. 12. Motion made by Council member Franklin, seconded by Council member Dalton to approve the low bid from Consolidated Pipe & Supply in the amount of $22,383.21, to purchase materials for a waterline extension at the Covington Municipal Airport. Consolidated Pipe & Supply $22, Southern Pipe $25, Fortiline Waterworks $25, Motion made by Council member Dalton, seconded by Council member Smith to approve the sole bid from NAFECO in the amount of $25,460.00, to purchase two thermal imaging cameras for the Covington Fire Department. 14. Motion made by Council member Whatley, seconded by Council member Dalton to approve the execution of GEFA loan documents in the amount of $4,500, for the Drinking Water State Revolving Fund Loan. 15. Motion made by Council member Dalton, seconded by Council member Goodman to approve a Change Order to GDOT Clark Street TE Project in the amount of $5, Motion made by Council member Goodman, seconded by Council member Whatley to approve the following confirmations for GMA District 5 Officers for : President Joel Seymour First Vice President Ronnie Maxwell Second Vice President Mark Fitzpatrick CoC

4 17. Motion made by Council member Williams, seconded by Council member Smith to approve the following confirmation for GMA District 5 Officers for : Third Vice President - Rick Prince 18. Motion made by Council member Whatley, seconded by Council member Dalton to nominate Council member Goodman as the City s voting delegate for the 2014 GMA Annual Business Meeting. 19. Motion made by Council member Goodman, seconded by Council member Williams to approve the adoption of a resolution supporting the construction of the Overlook at Walker s Bend as an affordable housing for older persons residential community and a letter of support. Motion carried with Council members Whatley, Goodman, Williams, and Franklin voting for. Council member Smith and Dalton voting against. 20. Motion made by Council member Goodman, seconded by Council member Dalton to approve a Change Order for the DWSRF Water Main Replacement Project Phase 1 in the amount of $108, with the First United Methodist Church s share being $30, and the City s portion being $78, Motion made by Council member Dalton, seconded by Council member Whatley to approve adding, Discussion of the acceptance of the appraised value in the amount of $255,000.00, for the property known as Parker s Pasture which contains 97 +/- acres. 22. Motion made by Council member Smith, seconded by Council member Whatley to approve the purchase of 97 +/- acres known as Parker s Pasture in the amount of $255, Deputy City Manager Billy Bouchillon stated the City s Public Works Department received reaccreditation last week and was found to be fully compliant. Comments from the City Manager: -Work Session at the Office of Economic Development on June 3 rd at 5:30 PM to discuss the CID. -Work Session with the Planning Commission on June 10 th at 5:30 PM to discuss the Parking Ordinance. -Last Budget WS on Thursday at 5:30 in the Council Room. 5 Council member Franklin stated she would like the City to look at all of the green space available in the City. Council member Dalton stated he attended the Georgia Public Safety Memorial Ceremony with Mr. Steve Horton earlier today. Council member Williams stated she recently attended the Senior Leadership Workshop at Turner Lake Park. Council member Goodman stated tomorrow is Election Day. Council member Smith asked the status of the property in the Mill Village. Associate City Attorney Frank Turner, Jr. updated Council member Smith. Comments from the Mayor: -Please keep two City Electric Department employees who were recently injured in your prayers Mike Jones and Joe McVey -Council member Goodman was recognized by the Black Heritage Preservation Committee earlier this year Being no further business meeting adjourned at 8:35 PM.
