Open meeting, Invocation, Pledge of Allegiance- Mayor Frazier called the meeting to order at 6:30 p.m. and lead the invocation. 1

2 2. Roll Call- Ronnie Lanier was absent from the Council Meeting. 3. Discuss and consider Resolution No , of the City of Crandall Texas, canvassing and certifying the election returns, including the returns of early voting ballots cast in connection with the election held on Saturday May 7, 2016, for the election of three (3) Council Members Mayor Frazier read the Summary of Election Results prepared by Kaufman County Elections. The total vote counts were as follows: Shannon Barnes 183 Mike Parker 164 Jeffrey A. Hill 108 J. David Lindsey 126 Ron Lanier 124 Danny Kirbie made a motion to approve Resolution No , of the City of Crandall, Texas, canvassing and certifying the election returns, including the returns of early voting ballots cast in connection with the election held on Saturday May 7, 2016, for the election of three (3) Council Members. Shannon Barnes seconded the motion. Motion carried with a unanimous vote from the Council. 4. Administer the Oath of Office, Statement of Elected Official and Election Certificate to Shannon Barnes, Mike Parker, and David Lindsey by Mayor Frazier Mayor Frazier administered the Oath of Office, Statement of Elected Official and Election Certificate to Shannon Barnes followed by Mike Parker and David Lindsey. 5. Discuss and consider appointing a Mayor Pro Tem Danny Kirbie made a motion to appoint Mike Parker as Mayor Pro Tem. Shannon Barnes seconded the motion. The motion carried with a unanimous vote from the Council. 2

3 6. Public Hearing: On a request for approval of a Site Plan for CrossFit Crandall as requested by Kristy Scarbrough. The location of property is at 207 Ledbetter, Crandall, Texas Mayor Frazier opened the Public Hearing at 6:40 p.m. John Corbitt spoke to the Council regarding the approval of the Site Plan for Crossfit Crandall. Mr. Corbitt stated Ms. Scarbrough is trying to expand her business and make the business nicer. Mr. Corbitt stated that all engineering plans have been approved and that he doesn t see any reason why they would not be able to proceed. Mr. Corbitt stated that the building will be a better building for the community that is going to be aesthetically pleasing. Denise Koleszar, 6462 County Rd. 495 Kaufman, Texas, stated that she was excited that CrossFit has decided to stay in the Crandall neighborhood instead of expanding to Forney or Kaufman. Ms. Koleszar stated that she believes that the location will improve the look of the Highway. Dorothy Baucom, 205 Ledbetter, asked it the new building would increase her taxes. Mayor Frazier stated that Kaufman County Appraisal Districts will set Ms. Baucom s tax appraisal. Mr. Frazier stated that Ms. Baucom would have to address the Appraisal District in regards to taxes. Ms. Baucom questioned what effect the business will have on value of her property? Mayor Frazier informed Ms. Baucom that she would have to speak to the Appraisal District regarding her tax evaluation. Ms. Baucom asked what type of business was CrossFit Crandall? Mayor Frazier informed Ms. Baucom that CrossFit Crandall is a health and fitness center. Ms. Baucom asked if customers would park in back or side of the property. Ms. Baucom was informed that is parking is in the back of the building. Mayor Frazier advised Ms. Baucom that the business has met all City regulations and guidelines. Ms. Baucom asked if parking would be allowed on Ledbetter and was informed no parking would be on Ledbetter. Ms. Baucom had concerns regarding the noise levels but was assured that other than weight lifting all noises will be minimal. Ms. Baucom asked for the hours of operations. Kristy Scarbrough informed Ms. Baucom that her first class begins at 5:15 a.m. and her last class of the day was 8:30 p.m. however, she was closed most of the business day. Ms. Baucom asked where customers would enter the building and was advised that the entrance will face HWY 175. Ms. Baucom asked if outside lighting will be used. Ms. Scarbrough informed Ms. Baucom that the outside lighting would only be on during business hours. Mayor Frazier stated that these ordinances have already been set by previous ordinances pertaining to HWY business. Ms. Baucom asked what size is the building and was informed by Mr. Corbitt that the business was 24 x50. 3

4 Robby Simonds, 201 Ledbetter, questioned the outside lighting. Mr. Corbitt advised Mr. Simonds that the only lights they will have will be what is required by the city. Mr. Simonds questioned if the minimum setback was reached and was informed that all required setbacks have been met. Mr. Simonds had concerns regarding the noise but was assured that noise levels are minimal. Mr. Simonds asked if Ms. Scarbourgh was planning on having additional hours and the number of cars that would be parked at a time. Ms. Scarbourgh stated at some point she may open more hours but the gym will not ever be opened all day. Ms. Scarbourgh stated on average maybe five (5) cars could be parked at a time. Mayor Frazier stated that this project has gone through all planning processes that any other business would have gone through. Mayor Frazier closed the Public Hearing at 7:04 p.m. 7. Discuss and consider approval of a Site Plan for CrossFit Crandall as requested by Kirsty Scarbrough. The location of property is at 207 Ledbetter, Crandall, Texas Mike Parker stated that he has looked over the plans and the City has made sure the all the specifications have been met. Mr. Parker reminded the citizens that if illegal parking or noise violations become an issue to contact Code Enforcement. Shannon Barnes made a motion to approve a Site Plan for CrossFit Crandall as requested by Kristy Scarbrough. Mike Parker seconded the motion. The motion carried with a unanimous vote from the Council 8. Adjourn Shannon Barnes made a motion to adjourn seconded by Danny Kirbie. The motion carried with a unanimous vote from the Council.
