1 PROPOSED ORDINANCE ORDINANCE NO AN ORDINANCE AMENDING THE CODE OF THE CITY OF KISSIMMEE FLORIDA TITLE XIV PLANNING AND ZONING CHAPTER 14 2 CITY OF KISSIMMEE LAND DEVELOPMENT CODE AMENDINGING SECTION THROUGH 163 SIGNS PROVIDING NEW SIGN REGULATIONS REMOVING SECTION COMMUNITY REDEVELOPMENT AREA OVERLAY SIGN DESIGN STANDARDS AMENDINGING SECTION THE DEVELOPMENT REVIEW PROCESS AMENDING THE ROLE OF THE ARCHITECTURAL REVIEW COMMITTEE AMENDINGING SECTION TERMS DEFINED AMENDING DEFINITIONS TO REF LECT ADDITIONAL SIGN TERMS REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF KISSIMMEE FLORIDA THAT CHAPTER 142 IS AMENDED TO READ AS FOLLOWS SECTION 1 SIGNS PURPOSE INTENT A B C It is the purpose of this subchpter to promote nd protect the public helth sfety generl welfre nd esthetics of the city by regulting existing nd proposed signs nd other street grphics within the city It is further intended to protect property vlues crete better business climte enhnce the physicl ppernce of the community nd preserve the nturl beuty of the city Also it is intended to improve vehiculr sfety nd reduce visul pollution The esthetic impct of signs is n economic fct which my ber hevily upon the enjoyment nd vlue of property therefore the regultion of signs is vlidly justified on the bsis of conserving the vlue of property nd encourging the most pproprite use of lnd throughout the municiplity Furthermore it is not irrtionl for community scitizens to pln their physicl surroundings in such wy tht unsightliness is minimized D Not withstnding nything contined in this chpter to the contrry it is further intended tht ny sign erected pursunt to the provisions of this Chpter or otherwise lwfully existing with commercil messge my t the option of the owner contin noncommercil messge in lieu of commercil messge The noncommercil messge my occupy the entire sign fce or ny portion thereof The sign fce my be chnged from commercil to noncommercil messges or from one noncommercil messge tu nother s frequently s desired by the owner of the sign provided tht the sign is not prohibited sign nd provide tht the size height setbck nd other dimensionl criteri contined in this chpter hve been stisfied 1

2 APPLICABILITY A B The provisions of this chpter shll pply to ll new signs erected within the City Overly Districts 1 Properties within the Downtown Kissimmee CRAO District must dhere to the requirements set forth in the CRAO Design Mnul Where the Mnul remins silent this chpter shll pply 2 Properties within the Vine Overly District must dhere to the requirements 54 Where remins silent this chpter shll pply set forth in 142 C D E Non conforming signs existing t the time of doption of this chpter tht were previously pproved nd received building permit shll be considered leglly non conforming signs until such time the sign is determined to be bndoned hs been destroyed substntilly dmged or ltered to n extent exceeding 50 of the vlue of the sign Upon losing leglnon conforming sttus sid signs must be removed within sixty 60 dys Non conforming signs existing t the time of doption of this chpter tht were not leglly estblished must obtin permit within thirty 30 dys of notice by Code Enforcement nd must be brought into complince with in 6 months of permit issunce Sid signs shll not be considered leglly conforming upon obt ining permit but must dhere to the provisions of this chpter which my necessitte ltertion or removl of sid sign Non conforming temporry signs existing t the time of doption of this chpter must be removed within thirty 30 dys of its doption unless different time frme hs been llowed in n pproved building permit GENERAL PROVISIONS A Mesurement of Copy Are The surfce re of ny sign fce must be computed from the smllest rectngles circles ovls or tringles which will enclose ll words letters figures symbols designs nd pictures together with ll frming bckground mteril colored or illuminted res nd ttention ttrcting devices forming n integrl prt of the overll disply At time ofbuilding permit submittl the pplicnt must indicte which method ofinesurement hs been utilized for the proposed copy re Figure 1 explins methods ofcopy re mesurement tht must be used for ll new signs h 1 r Q t re h x 1 re h x 1 re Pi x r2 re Pi x b Figure 1 Methods of Copy Are Mesurement The following shll lso pply to copy re mesurement for ll sign types 2
