1 ITEM #01 1 MINUTES OF THE ENCINITAS CITY COUNCIL REGULAR MEETING JUNE 22, 2011, 6:00 P.M., 505 SOUTH VULCAN AVENUE TELECONFERENCE WITH MAYOR JAMES BOND FROM WINE COUNTRY RESORT, 2500 AIRPORT ROAD, PASO ROBLES, CA CALL TO ORDER/ROLL CALL Deputy Mayor Stocks called the meeting to order at 6:07 P.M. Present: Absent: Mayor James Bond (via teleconference), Council Members Teresa Arballo Barth, Kristin Gaspar, Maggie Houlihan (until 9:15 P.M.) and Jerome Stocks. None. Also Present: City Manager Cotton, City Attorney Sabine, Recreation Superintendent Fazzio, Recreation Supervisor Thill, Interim Parks and Recreation Director O Grady, Associate Engineer Kellar, Park and Beach Superintendent Frenken, Planning and Building Director Murphy, Engineer Maher, Director of Engineering Services Cota-Robles, City Clerk Cervone, and Deputy City Clerk Bingham. There being a quorum present, the meeting was in order. SPECIAL PRESENTATIONS/PROCLAMATIONS Proclamation for Larry Marquardt proclaiming him Cardiff-by-the-Sea Mayor for the day on July 2, 2011 Presented by Deputy Mayor Stocks. Presentation by Recreation Superintendent Fazzio regarding July is Parks and Recreation Month Recreation Superintendent Fazzio gave a brief presentation and congratulated various volunteers for the city. ORAL COMMUNICATIONS Sanford Shapiro requested Council consider not appealing the pavement management lawsuit decision. 2 ITEM # /22/11 Regular Meeting Lori Brenckman discussed her company Earth s Compassion Team, a project developed to support more compassionate leadership worldwide. Kathleen Lindemann requested that when the City was purchasing products for a City event, that they consider purchasing from businesses located in the City. Brenda Dizon invited all to attend Cardiff s 100 th Anniversary party on Saturday, July 2, 2011 at Glen Park. Donna Westbrook discussed her concerns regarding the Shea Homes housing project. CHANGES TO THE AGENDA Council Member Houlihan requested the following be deleted from the Regular meeting minutes: Houlihan moved, Gaspar seconded to appoint Council Members Barth and Gaspar as the ad-hoc committee to assist with community related orientation for the new City Manager.. CLOSING AND ADOPTION OF THE CONSENT CALENDAR Houlihan moved, Barth seconded to close and adopt the amended Consent Calendar with the change to the meeting minutes. Motion carried. Ayes: Barth, Bond, Gaspar, Houlihan, Stocks. Nays: None. 1. Approval of Minutes of the Regular Meeting. Contact Person: City Clerk Cervone. STAFF RECOMMENDATION: Approve Minutes. 2. Approval of Warrants List. Contact Person: Finance Director Smith. STAFF RECOMMENDATION: Approve Warrants. 3. Acceptance of Glen Park Play Equipment Replacement Project #PR to Robertson Industries, Inc. and authorize filing of a Notice of Completion. Contact Person: Park and Beach Superintendent Frenken. STAFF RECOMMENDATION: Accept the completion of demolition, authorize the filing of a Notice of Completion, and authorize the release of retention. 4. Award of a contract to Hale Engineering in the amount of $138,271 and authorization for a 10% contingency to prepare design plans, specifications, and estimate for sewer 06/22/11 Reg. Mtg. 3 ITEM # /22/11 Regular Meeting improvements on Second Street, C Street, and Third Street (CEE08B). Contact Person: Director of Engineering Services Cota-Robles. STAFF RECOMMENDATION: Award a contract to Hale Engineering Corporation in the amount of $138,271 plus a 10% contingency for a not-toexceed amount of $152,098 for design of the Second Street, C Street, and Third Street sewer improvement project. REGULAR AGENDA 5. Council to make appointments to the Youth Commission effective July 2011 for a oneyear term and make one appointment to the Environmental Commission to fill a vacancy with a term ending March Contact Person: City Clerk Cervone. STAFF RECOMMENDATION: Make appointments to the Youth Commission and one appointment to the Environmental Commission to fill a vacancy. Sanford Shapiro and Julie Graboi addressed Council before the votes were taken. City Clerk Cervone stated that Garth Murphy requested that his application for Environmental Commission be removed from consideration and requested Council consider choosing 5 Youth Commissioners from the 11 th 12 th grade applicants due to lack of applications from 9 th & 10 th graders. COUNCIL CONSENSUS: There was Council Consensus to choose 5 youth commissioners from the 11 th 12 th grade applicants. The following votes were cast for appointments to the Youth Commission. 4 ITEM # /22/11 Regular Meeting The following were appointed to the Youth Commission: Alexander Barth, Delilah Forrest Alec Maskiewicz, Matthew Conger, Gabrielle Eyl, Lauren Barth, Nick Ferreirae, Kelly Lawson, Derrik Marow, Katherine Ozorio, and Maylee Sands. ENVIRONMENTAL COMMISSION 1 APPOINTMENT TO BE MADE Barth voted for Lisa Shaffer; Bond voted for Alice Jacobson; Gaspar voted for Alice Jacobson; Houlihan voted for Lisa Shaffer; Stocks voted for Alice Jacobson. Alice Jacobson was appointed to the Environmental Commission with a term ending March Authorization to solicit bids for the construction of Encinitas Community Park, authorization to solicit bids for contract growing of plant materials, and authorization to begin undergrounding of project-related utilities. Contact Person: Interim Director of Parks and Recreation O Grady. STAFF RECOMMENDATION: Authorize staff to solicit bids for the construction of the Encinitas Community Park, authorize staff to solicit bids for the plant materials needed for the park construction, and authorize project-related utility relocation and undergrounding by SDG&E and private contractors. The following speakers addressed Council: Tony Kranz, Thomas Barker, Miles Wood, J.T. Pulford, Donna Westbrook, Darius Shayegah, Gerald Sodomka, Brad Roth, Laurie Michaels, Joel Camarillo, Maria Lindsay, and Oly Norris. Gaspar moved, Houlihan seconded to authorize staff to solicit bids for the construction of the Encinitas Community Park, authorize staff to solicit bids for the plant materials needed for the park construction, authorize project-related utility relocation and undergrounding by SDG&E and private contractors and include bid alternates for a possible skate park and dog park. Motion carried. Ayes: Barth, Bond, Gaspar, Houlihan, Stocks. Nays: None. Staff was directed to work with the skating community when developing the skate park. Deputy Mayor Stocks declared a recess from 8:26 P.M. to 8:34 P.M. 7. Consider adoption of Resolution for the summary vacation of five feet of existing right-of-way along 185 W. Jason Street and approval of a standard cross section for this residential street segment. Contact Person: Senior Engineer Maher. 5 ITEM # /22/11 Regular Meeting Elizabeth Gabrych, representing Hilltop Trailer Park owners, addressed Council. Houlihan moved, Gaspar seconded to approve the typical cross section shown in Exhibit H1 for West Jason Street and deny the vacation request. Stocks made a substituted motion and Barth seconded, to deny the vacation request and to return to a future City Council meeting to discuss the issue of the cross section and road design. Motion carried. Ayes: Barth, Bond, Gaspar, Houlihan, Stocks. Nays: None. Before Item #8 was heard, Council Member Houlihan left the Council Chambers due to illness. 8. Report on the status of the City Ventures development project at 1492 Hymettus Avenue (Case Nos TMDB/DR/ CDP/EIA and DR/CDP). Contact Person: Director of Engineering Services Cota-Robles and Director of Planning and Building Murphy. STAFF RECOMMENDATION: Receive the report. Deputy Mayor Stocks recused himself from Item #8 and left the Council Chambers to avoid a possible conflict of interest and turned the meeting over to Council Member Barth. The following speakers addressed Item #8: Suzi Shatto, Julie Redler, Kenneth Redler, Julie McGill, Vicki Campbell, Scott Campbell and Maria Lindsay. Gaspar moved, Barth seconded to extend the City Council meeting past 10:00 P.M. Motion carried. Ayes: Barth, Bond, Gaspar. Nays: None. Absent: Houlihan, Stocks. The public speakers continued: Gerald Sodomka, and Russell Levan. COUNCIL CONSENSUS: There was Council Consensus to receive the report. Present: Absent: Mayor James Bond, Council Members Teresa Arballo Barh, Kristin Gaspar, Maggie Houlihan, and Jerome Stocks. None. PLEDGE OF ALLEGIANCE SPECIAL PRESENTATIONS/PROCLAMATIONS Proclamation to Lloyd Shier, WWII Veteran A proclamation was presented by Mayor Bond to Lloyd Shier. Presentation regarding the July 18,2011, Public Health Element Public Workshop by Associate Planner Strong Associate Planer Strong presented a brief report on the General Plan Public Health Element workshop. ORAL COMMUNICATIONS George Hejduk spoke of his concerns regarding encroachment of sidewalk dining tables in the downtown Encinitas area, an easement next to the public works facility that needs attention Julie Graboi welcomed the new City Manager Gus Vina. 8 Regular Meeting Kathleen Lindemani spoke of her concerns regarding the naming of the Encinitas Community Park. CLOSING AND ADOPTION OF THE CONSENT CALENDAR Council Member Houlihan requested the following change to page 6 of the City Council Regular meeting minutes:. When doing a Request for Informtion from vendors, th Staff should get the information from at least 2 different vendors if possible. Houlihan moved, Stocks seconded to close and adopt the Consent Calendar along with the change to the regular minutes. Motion carried. Ayes: Barth, Bond, Gaspar, Houlihan, Stocks. Nays: None. 1. Award of contract for the construction of Balour Drive Sidewalk Improvements (A, Community Development Block Grant and Safe Routes to School Project) to Tri- Group Construction and Development, Inc., in the amount of $246,435 (CMSlOH). Contact Person: Director of Engineering Services Cota-Robles. STAFF RECOMMENDATION: Authorize the Director of Engineering Services to enter into a contract with Tri-Group Construction and Development, Inc., in the amount of $246,435, to construct the Balour Drive Sidewalk Improvement Project and to authorize overall expenditures not to exceed $423, Reg. Review and allocation of Community Grant Program application requests for Fiscal Year Contact Person: Arts Administrator Giliam and Executive Assistant Zenns. STAFF RECOMMENDATION: Approve allocations and make any desired additional allocations. Before Item #5 was heard, Council Member Gaspar and Deputy Mayor Stocks recused themselves and left the Council Chambers to avoid a possible conflct of interest. The following speakers addressed Item #5: Wendy Morrs, representing the Assistance League of Rancho San Dieguito; Judy Thur and Lucy Zizka, representing the Coastal Communities Concert Band; Joe McNalley, representing Hutchins Consort; Lauren Pause, representing the Community Resource Center; Erin Knight, representing the La Jolla Playhouse; and Paula Kirp~lani, representing the Leucadia 101 Main Street Association. Council Member Houlihan requested that Council reduce the allocation for the Friends of the Encinitas Librar by $3,000 since they were already subsidized by the City forrent at the library. COUNCIL CONSENSUS: There was Council Consensus to keep the staff recommended allocation for the library as is and to agendize the issue of changing the criteria for grants for organizations receiving subsidies' for a future City Council meeting. Mayor Bond declared a recess from 7:25 P.M. to 7:38 P.M.
