Consider and act on a Resolution affirming the City of Uvalde s support for the creation of a Groundwater Conservation District for Val Verde County. 13. Alonzo Garcia, a citizen and owner of Big Al s, located at 1104 W. Main Street explained that he was against a zone change from business to residential for his neighbor, Santa Perez. Ms. Perez is on this evening s agenda as an action item for a zone change for property situated at 1106 W. Main Street. Agenda Item No. 9 - Bills 9A. Consider and act on payment of bills over $5, from March 25, 2015 through April 10, Motion made by Councilman Stephen E. Balke to approve the bills over $5,000. Proclamation declaring April 12-18, 2015 as National Library Week. Mayor Don McLaughlin, Jr. read a proclamation declaring April 12-18, 2015 as National Library Week. Agenda Item No. 11 Public Hearing 11A. Open a public hearing to consider and act on the request of Santa Perez, applicant, for a Zone Change from a Business 2 to Residential 3 to use as a residential property. The property is located at 1106 West Main St., NCB 247, Fairground Subdivision, Block 2, Lot 5, City of Uvalde, Uvalde County Texas. The City of Uvalde opened the Public Hearing on Agenda Item 11A at 6:17 p.m. Santa Perez, applicant and owner of 1106 W. Main Street gave a history of the neighborhood and the re-zoning along that portion of West Main Street. Mr. Garcia, owner of Big Al s, and her neighbor, is against her rezoning from Commercial to Residential because he wants to purchase her lot for additional parking. Ms. Perez had a beauty salon at the location but was not able to make a profit. She explained that there is not a lot of traffic on the west side and, as a result, there are many vacant business properties along that portion of W. Main Street. She wants to make her property into a rental property with a one bedroom one bathroom to earn enough rent to pay the insurance and property taxes. Rodrigo Rodriguez, a citizen, and a member of the Planning and Zoning Board explained that the board had voted against Ms. Perez s application since it would be considered spot zoning. The City of Uvalde closed the Public Hearing on Agenda Item 11A at 6:28 p.m. 12. REPORT 12A. Report by Police Chief Eric Herrera on the Uvalde Police Department s Annual 2014 Report. Police Chief Eric Herrera presented the Uvalde Police Department s Annual 2014 Report. Chief stated that the crime rate has dropped from by 21.94%. Complaints by citizens consisted of only 7 which is excellent due to the amount of contact the department has with the public 24 hours a day 365 days a year. Use of force consisted of 5 displays of the Taser with only two uses of the Taser. Traffic accidents have increased from 258 in 2013 to 329 in Dispatch room is scheduled to be completed by the first week of May. The new police department body cameras are due to arrive next week which will help to protect the officers. Chief wanted to thank Mayor and Council for their support of the police department along with the support from the community which makes their jobs a lot easier out on the street. 006

7 12B. Report by Joe A. Cardenas, Assistant City Manager on the status of the Skate Park construction and scheduled Grand Opening. Joe Cardenas, Assistant City Manager, explained that the skate park was almost close to completion with the Grand Opening scheduled for May 9, NEW BUSINESS 13A. Consider and act on a request of Kyle Graham, Youth Minister - Getty St. Church of Christ for use of the Willie De Leon, Jr. Civic Center at a discounted rate starting Sunday, June 28 th through Thursday, July 2, 2015 to be used by several area churches to promote a summer event (HOTT Days) for teens and families who will serve and work rehabilitating homes and public areas in the Uvalde Community. Motion to approve the request of the HOTT Days area churches request for use of the Civic Center was made by Councilman Chip King to waive the fee and collect a $336 refundable security deposit. Motion was seconded by Mayor Don McLaughlin, Jr. Motion carried B. Consider and act on the request of Santa Perez, applicant, for a Zone Change from a Business 2 to Residential 3 to use as a residential property. The property is located at 1106 West Main St., NCB 247, Fairground Subdivision, Block 2, Lot 5, City of Uvalde, Uvalde County Texas. Motion made by Councilman Chip King to deny the rezoning but to approve a one-year residential special use permit. Councilman Stephen E. Balke seconded the motion. Motion carried C. Consider and act on an application for Outside the City Limits water services for Bruce Kingsbery for property located at 220 Sage Lane, Uvalde, Texas Motion made by Councilman Chip King to approve the OCL application of Mr. Bruce Kingsbury for water services located at 220 Sage Lane. Councilman John H. Flores, Jr. seconded the motion. Motion carried D. Consider and act on an application for Outside the City Limits sewer services for Fausto and Alicia Contreras for property located at 508A and 508B Commerce Lane, Uvalde, Texas Motion made by Councilman Chip King to approve the OCL application for Mr. and Mrs. Contreras for sewer service located at 508A & 508B Commerce Lane. Motion was seconded by Councilman Stephen E. Balke. Motion carried E. Consider and act on a grant agreement between the Texas Parks and Wildlife Department and the City of Uvalde for the Municipal Pool Improvement Project. Motion made by Councilman Stephen E. Balke to approve of the grant agreement between the Texas Parks and Wildlife Department and City of Uvalde for the Municipal Pool Improvement Project. Councilman John H. 8 13F. Consider and act on a three year Lease Agreement between the City of Uvalde and the Uvalde Youth Baseball Little League. Motion made by Councilman Stephen E. Balke to approve a three (3) year Lease Agreement between the City of Uvalde Youth Baseball Little League and the City of Uvalde. Motion was seconded by Councilman Chip King. Motion carried G Consider and act on a two year Membership Agreement between the Cooperative Teamwork & Recycling Assistance and the City of Uvalde for the sale of recyclable materials. Motion made by Councilman Chip King to approve the two year Membership Agreement between the Cooperative Teamwork & Recycling Assistance and the City of Uvalde for the sale of recyclable materials. Councilman John H. Flores, Jr. seconded the motion. Motion carried H. Consider and act on settlement of unpaid paving assessment liens. Motion made by Councilman Stephen E. Balke for settlement of paving assessment liens for the original amount of the lien plus 15% percent interest (not compounded). Mayor Don McLaughlin, Jr. seconded the motion. Motion carried I. Consider and act on a Resolution Supporting Public Notices in Newspapers. Motion made by Councilman Chip King to approve the Resolution supporting public notices in newspapers. 12 Proclamation WHEREAS, WHEREAS, WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS The Community Council of South Central Texas, Inc. was established as a Community Action agency on May 11, 1965; and The service area encompasses the South Central and Southwest Texas Counties of Atascosa, Bandera, Comal, Edwards, Frio, Gillespie, Guadalupe, Karnes, Kendall, Kinney, Kerr, Live Oak, McMullen, Medina, Real, Uvalde, Val Verde, Wilson and Zavala; and Community Action Agencies were created when the Economic Opportunity Act of 1964 was signed into law; and Community Action Agencies have a 51-year history of promoting selfsufficiency for the limited income; and Community Action Agencies have made an essential contribution to individuals and families in Texas by providing them with innovative and cost-effective programs; and Community Action Agencies are needed as major participants in the reform of the welfare system as we know it; and Welfare reform in Texas has benefited from the state s partnership with community action agencies; and The limited income continue to need opportunities to improve their lives and their living conditions, thus ensuring that all citizens are able to live in dignity; and Texas and the entire United States must continue to promote economic security by providing support and opportunities for all citizens in need of assistance; NOW, THEREFORE, in honor of the 50th Anniversary of the Community Council of South Central Texas, I Don McLaughlin, Mayor of Uvalde, Texas do hereby proclaim May 2015 as COMMUNITY ACTION MONTH in Uvalde, Texas in recognition of the hard work and dedication of Uvalde s Community Action agency. Because of the faith of many of our founding Fathers, public prayer and national days of prayer have a long-standing and significant history in American tradition; and This tradition predates the founding of the United States of America when the Continental Congress issued a proclamation setting aside a day of prayer in In 1952, Congress established an annual day of prayer, and in 1988, the law was amended, designating the first Thursday in May as the official National Day of Prayer; and This year, May 7, 2015, marks the 64th consecutive observance in cities throughout the United States, and the 8 th consecutive observance in Uvalde County; and This year s theme is LORD, HEAR OUR CRY. I Kings 8:28 as our Scripture for this year: Hear the cry and the prayer that your servant is praying in your presence this day. and In the county of Uvalde, we acknowledge that the Lord is our God who HEARS, and our prayer for our cities and America is that as we sincerely seek the heart and will of God. That we may place our hope in Him and become a people who use our voice to CALL UPON THE NAME OF THE LORD and continue to be One Nation under God! We believe that God is shifting people to a place of honor toward God as well as a heart with genuine repentance. We believe that there is not only power in prayer, but power in people that pray. We decree and declare that the people of God will rise up and take their rightful place and manifest His will in the land! Our nation was founded on Godly principles, and with His grace, favor, and mercy our Nation and Cities will continue to stand strong, as we rally the army of God of our city to man their stations and fight the good fight of faith as a united body. For He says, where there is unity of heart and repentance of sin He will command His blessing and Heal Our Land. May God work in us both to will and to do His good pleasure.
