1 CITY OF TOLLESON CITY COUNCIL MINUTES PARK AND RECREATION CENTER 9555 WEST VAN BUREN STREET TUESDAY, APRIL 10, 2012 CALL TO ORDER 7:00 P.M. Mayor Gámez called the Regular Scheduled City Council Meeting to order at 7:00 P.M. INVOCATION/PLEDGE OF ALLEGIANCE Invocation delivered by City Attorney Ruby, and Pledge of Allegiance led by Council Member Albert Mendoza. ROLL CALL Mayor Gámez, Vice Mayor Farr, Council Members Erives, Espinoza, Laborin, Mendoza, and Rodriguez were present. Finance Director Baumgardt, Field Operations Director Earp, City Engineer Gilmore, Fire Chief Good, City Clerk Hagen, Assistant City Manager Lopez, Economic Development Director Magallanez, City Manager Medrano Jr., Police Chief Rodriguez, and City Attorney Ruby were present. FINAL CALL TO SUBMIT SPEAKER REQUEST FORMS All citizens and interested parties wishing to speak before the Council shall fully complete a Speaker Request Form and, if possible, submit the form(s) to the City Clerk, or designee prior to the meeting being convened; but in any case submissions should be made no later than the Presiding Officer announcing the Final Call to Submit Speaker Request Forms. Sufficient Speaker Request Forms are located in the lobby of the Council Chambers. All speakers will be limited to 3 minutes unless otherwise noted by the Mayor. 2 Page 2 of 6 BUSINESS FROM THE FLOOR - PUBLIC HEARINGS AND ACTION 1. Approve Proclamation for the month of May 2012 as Motorcycle Safety and Awareness Month. City Attorney Ruby read Proclamation. Proclamation proclaimed by Mayor Gámez, and the motorcycle enthusiasts once again thanked Mayor, Council, and staff for their proclamation and support over the last three years and installation of the share the road signage in Tolleson. 2. Public Hearing Soliciting comments from interested parties in reference to an application for a Use Permit as submitted by Dirk Rehbein, 9620 West Van Buren Street, Tolleson, Arizona 85353, to allow rental of U-Haul trucks and trailers from existing self-storage business use, within a Commercial-2 (C-2) Zoning District. Public Hearing opened at 7:03 P.M. and closed at 7:26 P.M. Owner Dirk Rehbein was present and discussed with Mayor and Council that at time of purchase of the self-storage facility, the occupancy rate was 18%. Today the occupancy rate is 50%. Dirk stated that the presence of multiple U-Haul moving trucks in a variety of sizes has contributed to increase occupancy and moving truck rental sales. The positioning of U-Haul trucks placed in the front of the commercial/retail building on Van Buren Street has been an effective mechanism in renting moving trucks as well as storage units. Overall having the U-Haul trucks upfront has increased walk-in business. In addition, there are one, sometimes two trucks parked in the back of the commercial/retail building for additional advertisement. Mayor and Council discussed with Dirk the business hours which are Monday thru Friday from 8:00 A.M. to 5:00 P.M., Saturday hours are 8:00 A.M. to 3:00 P.M. and closed on Sunday. It was also confirmed that all trucks are parked in the storage lot after business hours with the exception a late truck return, those trucks are moved to the storage lot at opening of the business the next day. Traditionally during the winter there can be up to 40 U-Haul trucks on the lot at any given time. As summer approaches there are less trucks as most people do not move in the heat of the Arizona summers. City Manager Medrano referred to the original owners use permit which only allowed for 8 Budget trucks with no trucks being visible on the front of this parcel. In addition, discussion included dust mitigation compliance and parking vehicles on the undeveloped property of this overall parcel. City Engineer Gilmore presented a time restraint of two years for this use permit with truck parking only during regular business hours of 8:00 A.M. to 5:00 P.M., 3:00 P.M.

3 Page 3 of 6 on Saturday. He confirmed that until complete build out of the parcel, ingress/egress is sufficient at this time. He reviewed all signage advantages including the multi-tenant sign and addressed the importance of ensuring dust mitigation per Maricopa County standards. Mayor reiterated the importance of all Tolleson businesses need to be successful and to survive the challenging times of our current economy. City Manager Medrano Jr. and City Engineer addressed the issue of a two year time limit on this use permit and/or to review when the development to the west occurs, whichever comes due first. City Manager expressed concern regarding overall visibility of those entering/exiting this development. Council Member Rodriguez stated that one large U-Haul with signage on the truck describing other trucks available for rent should be sufficient. City Attorney Ruby reiterated the importance of having a stipulation that addressed the future development of the parcel to the west and/or a two year limit on this use permit, as well as stating the exact number of U-Haul trucks and where they should be placed on the parcel to ensure visibility and ease of ingress/egress for all patrons. City Engineer Gilmore s professional review is 1 truck at 33 feet from entrance of parcel. Council Member Espinoza inquired about the option of renting additional parking spaces in the parking lot. Six spaces can accommodate 3 smaller trucks. Vice Mayor Farr stated that there was plenty of space for 1 truck at 33 feet from the entrance. 3. Approve/Deny Use Permit Application as submitted by Dirk Rehbein, 9620 West Van Buren Street, Tolleson, Arizona 85353, to allow rental of U-Haul trucks and trailers from existing self-storage business use, within a Commercial-2 (C-2) Zoning District. Motion made to approve Use Permit by Council Member Laborin and 2 nd by Council Member Erives. Use Permit was approved provided it will expire on the earlier of: two (2) years from the date of approval or the commencement of construction on the undeveloped parcel immediately to the west of the subject property. Further, the applicant was approved for one (1) truck to be parked in the west driveway of the subject property as an advertising sign, provided the vehicle can be parked in a location that is safe as determined by the City Engineer, Fire Chief, and Police Chief. Motion carried 7-0. CONSENT AGENDA ACTION ITEMS a. Approve Minutes: Regular Scheduled City Council Minutes of March 27, b. Approve Claims and Bills (claims and bills submitted for approval are all claims and bills incurred no later than 24 hours prior to the council meeting) and may be reviewed at City Hall during regular business hours.

4 Page 4 of 6 c. Approve Resolution No of the Mayor and Council of the City of Tolleson, Arizona, adopting the Investment Policy for the City. Motion made by Council Member Laborin and 2 nd by Council Member Mendoza to approve Consent Agenda Items a. c. Motion carried 7-0. REGULAR AGENDA ACTION ITEMS PROPOSED TO BE HEARD 1. Council to consider and, if advisable, approve committee Community Grant recommendations for spring in an aggregate award amount of $3, The recommended recipients are: JAG: Jobs for Arizona s Graduates in the amount of $2, for the Tolleson Union High School After-School JAG Program that encourages youth to stay in school as well as provide career and college programming. Southwest Valley Literacy for $ Project is Tolleson-based Tutor Recruitment and Training for 5 new tutors. Tutors are trained to work 1:1 (or 1: a few). Back to School Clothing Drive for $ Project is New Clothes, New Beginnings Annual Clothing Distribution. Seventy students from P. H. Gonzales and Desert Elementary are registered, and 123 students attended the back to school clothing drive. Vice Mayor Farr reviewed the matrix and recommendations for approval of the above applicants. Vice Mayor stated that the difference between the applicants being funded was the programming and delivery of direct services that add value to the citizens of Tolleson, whereas the other applications requested funding for t-shirts and snacks at their events. Council Member Rodriguez inquired as to why only $ was recommended for the Back to School Clothing Drive which was confirmed that they have multiple large corporate sponsors and funds were limited for this funding cycle. Motion made to approve the above recommendations by Council Member Laborin and 2 nd by Council Member Rodriguez. Motion carried Approve Resolution No of the Mayor and Council of the City of Tolleson, Maricopa County, Arizona, relating to a City of Phoenix foreign trade zone subzone designation for CIW Enterprises, Inc. s and the Cookson Company, Inc. s proposed project located within the City s jurisdiction. Motion made to approve by Vice Mayor Farr and 2 nd by Council Member Rodriguez. Motion carried 7-0.

Motion made to approve by Council Member Laborin and 2 nd by Council Member Rodriguez. Motion carried 7-0. CITY MANAGER S REPORT OF CURRENT EVENTS Assistant City Manager John Paul Lopez - Community events update/announcements of upcoming activities. John Paul gave an update on the employee first family picnic on Saturday, March 24 th and on Whoopee Daze the weekend of April 19 th. Thursday the community event starts off with the traditional Youth Day celebration. John Paul and Mayor also discussed the excitement of having Little Joe perform. Council Member Rodriguez thanked Randy Babchuk and the Tolleson employees/teens as well as the VFW for another successful Easter Egg Hunt and acknowledged Representative Tovar s presence. Chief Rodriguez presented Mayor and Council with the State of Arizona s 100 year law enforcement coin. Mayor and Reyes gave an update on the West Valley Mayors and Managers meeting that Tolleson hosted this morning focusing on working together as a stronger region and capitalizing on the revenue at the ports of entry that are being enhanced to encourage commerce between Arizona and our Mexico borders. Also discussed was the need to improve the State s overall image due to the effect of Senate Bill ADJOURNMENT Motion made to adjourn at 7:39 P.M. by Council Member Laborin and 2 nd by Council Member Rodriguez.
