8 MSC 88/2/3 (Secretariat) - Outcome of the sixty-first session of the Marine Environment Protection Committee This document reports on the outcome of the sixty-first session of the Marine Environment Protection Committee. MSC 88/2/4 (Secretariat) - Report on the 2010 Conference of Parties to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978 This document reports on the 2010 Conference of Parties to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, Agenda Item 3 - Consideration and adoption of amendments to mandatory instruments Background: The following draft amendments to mandatory instruments will be considered for adoption at MSC 88: 1. Amendments to the 1974 SOLAS Convention (MSC 88/3); 2. Consequential amendments to the 1988 SOLAS Protocol) (MSC 88/3/1); 3. Amendments to the International Convention for Safe Containers, 1972 (MSC 88/3/2); 4. Amendments to the International Code for Fire Safety Systems (FSS Code) (MSC 88/3); and 5. Amendments to the International Life-Saving Appliance Code (LSA Code) (MSC 88/3). The following draft Code which will be made mandatory will be considered for adoption at MSC 88: 6. Draft International Code for the Application of Fire Test Procedures, 2010 (2010 FTP Code) (MSC 88/3/3); The following draft amendment-related guidelines will be considered for approval at MSC 88: 7. Draft Guidelines for evaluation of and replacement of lifeboat on-load release mechanisms (MSC 88/3/4). The following is the summary of the abovementioned items: 1. Amendments to the 1974 SOLAS Convention The expanded Committee will consider, for adoption, draft amendments to the International Convention for the Safety of Life at Sea, 1974, as amended. The proposed amendments, approved by MSC 87, are contained in annex 1 to document MSC 88/3. Note that these amendments also include proposed new paragraph 5 of SOLAS regulation III/1, the adoption of which MSC 87 postponed to this session pending the outcome of the ad hoc Working Group on Lifeboat Release Hooks on the draft Guidelines for evaluation of and replacement of lifeboat on-load release mechanisms. The following changes will be considered for adoption: External Affairs 08/11/10 8 of 40

9 Draft Amendments to SOLAS regulation II-1/41.6 (MSC.216(82)) At MSC 87, a Non-Governmental Organization member requested confirmation on the application date of the new requirements of regulation II-1/41.6 (supplementary lighting in cabins of passenger ships) which was adopted by MSC.216 (82)). The requirements are given in Annex 3 of that resolution which entered into force on 1 July If the resolution is strictly (legally) applied, it would mean that the requirements are applicable to ships constructed on or after 1 January, 2009 when they entered into force on 1 July 2010 owing to regulation II-1/1.1 which was introduced by the same resolution (in Annex 2), in a light of SOLAS Article VIII(e). While the IMO Secretariat confirmed that was the correct reading of the text in a legal context, many delegations expressed that it was not the intent of the Committee. Therefore, MSC 87 approved MSC.1/Circ.1372 as an interim measure for clarifying that the requirement shall only apply to passengers ships constructed on or after 1 July 2010, and simultaneously, approved draft amendments to the SOLAS Convention subject to the final adoption at the MSC 88 session. Draft amendments to SOLAS regulation II-2/1 (Application) and II-2/3 (Definition) (Subject to the final adoption at MSC 88) In order to make the 2010 FTP Code mandatory, amendments have been prepared for the final adoption at MSC 88. Please refer to the section on the 2010 FTP Code below. Draft amendments to SOLAS regulation II-2/7.4.1 MSC 87 approved amendments to SOLAS regulation II-2/7.4.1, regarding fixed fire detection and fire alarm systems, and the chapter 9 (fixed fire detection and fire alarm systems) of the FSS Code, regarding fixed fire detection and fire alarm systems with a view to adoption at MSC 88. The draft amendments to the SOLAS regulation II-2/7.4.1 introduces the requirement for fixed fire detection and fire alarm systems in enclosed spaces containing incinerators to be harmonized with the standard specification for shipboard incinerators. As the requirements for such systems are contained in the new draft amendments to chapter 9 of the FSS Code, the Fire Protection Sub-Committee (FP 53) submitted this SOLAS amendment to MSC 87 (rather than MSC 86) for approval and subsequent adoption at MSC 88. Implications: Manufacturers of fire detection and alarm systems, ship designers, shipyards, ship owners, ship managers and Flag Administrations (and their Recognized Organizations). Application: Once adopted by MSC, it is intended that new ships will be required to have a fixed fire detection and fire alarm system in enclosed spaces containing incinerators. Draft amendments to the SOLAS Regulation III/1 on load release mechanisms External Affairs 08/11/10 9 of 40

10 Background: Due to the failure of on-load release mechanisms on lifeboats, amendments to SOLAS and the LSA Code have been proposed to enable the development of more reliable equipment. The evaluation of existing mechanisms is also required and these SOLAS/Code amendments are supported by Guidelines. The Guidelines as drafted in an MSC circular called for the completion of several steps prior to the acceptance, or otherwise, of a hook. These steps included: Design review; Reporting the results of plan reviews to the Organization; Hook stability test; Reporting the results of hook stability tests to the IMO; Procedures for replacement of non-compliant release mechanisms MSC 87 considered the draft MSC circular, and in the following intensive discussion, recognized that the matter, being of a very complex technical nature, had been discussed for several years in the DE Sub-Committee and needed to be concluded comprehensively, i.e. any interim solution would not be acceptable. It noted, in particular, that the possible replacement of a large number of hooks would affect the entire world fleet and that all involved parties, e.g., flag States, manufacturers, shipowners, surveyors, etc., need to work together on this matter. Subsequently, the Committee agreed that an intersessional meeting of an MSC Working Group on Lifeboat Release Hooks should be held from 20 to 22 October 2010, to finalize the draft MSC circular on Guidelines for evaluation and replacement of lifeboat on-load release mechanisms and to review the proposed new paragraph 5 of SOLAS regulation III/1, and to submit a report to MSC 88. Reference is to be made to MSC 88/3/4 below. Implications: Shipowners & Ship managers: Existing ships: Identify whether installed lifeboats on-load release mechanisms have been evaluated and identified as being of a safe design/have a good safety record. If not, replacement of release mechanisms will be required. Further, if the manufacturer of the hooks onboard is no longer in existence, there may be a possibility that such hooks will be required to be replaced, as design appraisal etc may not be possible. New ships: On-load release mechanisms on lifeboats installed on/after the entry into force date of the amendments to the LSA Code will be required to comply with the new requirements in full. Manufacturers: Ensure that past and existing lifeboats on-load release mechanism designs have been evaluated as being a safe design/have a good safety record. If not, then clients will require replacement mechanisms. New mechanisms will be required to comply with the new requirements of the LSA Code in full and be suitably type approved. Manufactures will be required to undergo a re-approval process for hooks that have previously been approved. There may be additional costs for this process. Flag Administrations and their Recognized Organizations (classification society): Ensure that existing lifeboats on-load release mechanism designs are evaluated to verify whether they are of a safe design/have a good safety record and share this information with other Administrations. Application: Lifeboat on-load release hooks as required by SOLAS chapter III (passenger ships regardless of tonnage engaged on international voyages and cargo ships (nonpassenger ships) of 500 gt or over engaged on international voyages). 11 Draft amendments to regulation V/18 MSC 87 approved draft amendments to SOLAS regulation V/18, subject to adoption at MSC 88, to reflect the annual testing of the automatic identification system (AIS) equipment as follows: The automatic identification system (AIS), shall be subjected to an annual test. The test shall be conducted by an approved surveyor or an approved testing or servicing facility. The test shall verify the correct programming of the ship static information, correct data exchange with connected sensors as well as verifying the radio performance by radio frequency measurement and on-air test using e.g., a Vessel Traffic Service (VTS). A copy of the test report shall be retained on board the ship. Implications: Provided that the Safety Equipment survey or Passenger Ship Safety survey is carried out in conjunction with the Safety Radio survey, this may not introduce any practical problems. However, the method to verify actual data in the transmission may require careful consideration. Application: Ships required to carry AIS on board, these being: all passenger ships regardless of tonnage, and cargo ships (non-passenger ships) of 300 gt or over (engaged on international voyages) or 500 gt or over (engaged on non-international voyages). Draft amendments to SOLAS regulation V/23 The MSC 87 approved draft amendments to SOLAS regulation V/23 which prohibits the use of the mechanical hoist, subject to final adoption at MSC 88. There are also a number of changes made to the requirements to enhance the safety of pilot transfers. There is an associated draft Assembly Resolution (amendments to A.889 (21) which will be submitted for adopted at 27 th Session of the Assembly which is scheduled to take place in November 2011). Implications: Shipbuilders and manufacturers are to take into account the requirements for new installations. Although the NAV Sub-Committee failed to clearly state the intent in the document, it is considered according to the opinions expressed during the NAV session, that using one single ladder for both purposes as means of embarkation and disembarkation at port (SOLAS regulation II-1/3-9) and pilot transfer (SOLAS regulation V/23) will be no longer be possible. Application: New pilot transfer arragements installed on or after the entry into force date. However, prohibition of the use of mechanical hoists will apply to all ships, including existing ships. Draft amendments to Appendix-Certificates MSC 87 approved draft amendments to the form of the Safety Construction, Safety Equipment, Passenger Ship Safety, Nuclear Cargo Ship Safety and Nuclear Passenger Ship Safety certificates following recently adopted amendments to SOLAS chapters II-1 and III with a view to adoption at MSC 88. These amendments will record whether ships were subject to alternative design and arrangements. It is expected that these amendments will enter into force on 1 July External Affairs 08/11/10 11 of 40

Consequential amendments to the Protocol of 1988 relating to the International Convention for the Safety of Life at Sea, 1974 (Appendix-Certificates) The expanded Committee will consider for adoption draft amendments to the Protocol of 1988 relating to the International Convention for the Safety of Life at Sea, The proposed amendments, approved by MSC 87, are contained in the annex to document MSC 88/3/1. These amendments are consequential changes to the form of the Safety Construction, Safety Equipment, Cargo Ship Safety and Passenger Ship Safety certificates following recently adopted amendments to SOLAS chapters II-1 and III and will record whether ships were subject to alternative design and arrangements. It is expected that these amendments will enter into force on 1 July Amendments to the International Convention for Safe Containers, 1972 (CSC 1972) The Committee will consider for adoption draft amendments to the International Convention for Safe Containers, The proposed amendments to the Convention, approved by MSC 87, are contained in the annex to document MSC 88/3/2. These amendments cover containers with one door off, a new annex for control and verification, marking of containers with reduced stacking or racking ability, and reviews of the examination programmes. It is noted that the CSC 1972, as amended, has still not entered into force due to insufficient ratifications. Implications: Shipowners and container manufacturers will have to account for any agreed changes in the strength limits and inspection regimes. Application: All containers. 4. Amendments to the International Code for Fire Safety Systems (FSS Code) The expanded Committee will consider for adoption draft amendments to the International Code for Fire Safety Systems (FSS Code). The proposed amendments, approved by MSC 87, are contained in annex 2 to document MSC 88/3. The following changes will be considered for adoption: Draft amendments to chapter 9 of the FSS Code MSC 87 approved amendments to SOLAS regulation II-2/7.4.1, regarding fixed fire detection and fire alarm systems, and the chapter 9 (fixed fire detection and fire alarm systems) of the FSS Code, regarding fixed fire detection and fire alarm systems with a view to adoption at MSC 88. The draft amendments to the SOLAS regulation II-2/7.4.1 introduce the requirements for fixed fire detection and fire alarm systems in enclosed spaces containing incinerators to harmonize with the standard specification for shipboard incinerators. Implications: Manufacturers of fire detection and alarm systems, ship designers, shipyards, shipowners, ship managers and Flag Administrations (and their Recognized Organizations). Application: Once adopted by MSC, it is intended that new ships will be required to have a fixed fire detection and fire alarm system in enclosed spaces containing incinerators. 5. Amendments to the International Life-Saving Appliance Code (LSA Code) Background: As the matter was not concluded at MSC 87, the discussion is to be finalized at MSC 88, following the intersessional working group in October. The proposed amendments are contained in annex 3 to document MSC 88/3. This sets out new criteria for safer lifeboat on-load release hooks. Implications: Shipowners & Ship managers: Existing ships: Identify whether installed lifeboats on-load release mechanisms have been evaluated and identified as being of a safe design/have a good safety record. If not, replacement of release mechanisms will be required. New ships: On-load release mechanisms on lifeboats installed on/after the entry into force date of the amendments to the LSA Code will be required to comply with the new requirements in full. Manufacturers: Ensure that past and existing lifeboats on-load release mechanism designs have been evaluated as being a safe design/have a good safety record. If not, then clients will require replacement mechanisms. New mechanisms will be required to comply with the new requirements of the LSA Code in full and be suitably type approved. Flag Administrations and their Recognized Organizations (classification society): Ensure that existing lifeboats on-load release mechanism designs are evaluated to verify whether they are of a safe design/have a good safety record and share this information with other Administrations. Application: Lifeboat on-load release hooks as required by SOLAS chapter III (passenger ships regardless of tonnage engaged on international voyages and cargo ships (nonpassenger ships) of 500 gt or over engaged on international voyages) 6. Draft International Code for Application of Fire Test Procedures, 2010 (2010 FTP Code) (Subject to the final adoption at MSC 88) The Committee will consider for adoption the draft International Code for Application of Fire Test Procedures, 2010 (2010 FTP Code) (set out in document MSC 88/3/3), in conjunction with the adoption of draft amendments to SOLAS regulation II-2/3.23 (set out in annex 1 to document MSC 88/3). MSC 87 approved the draft 2010 FTP Code with a view to adoption at MSC 88 in order to achieve a more unified approach for the Code. The entry into force date of the External Affairs 08/11/10 13 of 40

14 amendments is to be defined at MSC 88 (tentatively it is expected to be 1 July 2012 as contained in the draft text of amendments). This is a comprehensive revision of the existing FTP Code. The following major changes will be introduced: Inclusion of all relevant resolutions and circulars on fire test procedures; Part 5 extensively re-written to include previous Part 5, Part 6, A. 653 (16) and A.687 (17), as they were essentially the same; New Part 10 - Test for fire-restricting materials for high speed craft; New Part 11 - Test for fire-restricting divisions for high speed craft; Expiry period for fire test certificates (15 years); and Revised test report format (7 new additional items in the report). Implications: Fire test laboratories will be required to carry out testing and evaluation in accordance with the new procedures once the SOLAS amendments enter into force. Manufacturers of materials which are subject to these tests (e.g. fire restricting materials) will require testing to the new procedures (after some introductory period) and renewal testing (after 15 years expiry period), which may lead to a significant increase in cost. Application: To the testing, evaluation and approval of products which are subject to the requirements of the Fire Test Procedure Code referenced in the SOLAS Convention. Such products include: fire bulkheads, fire windows, fire doors, deck coverings, bulkhead and ceiling exposed surfaces, bulkhead and deck penetrations, upholstered furniture, bedding components, draperies, curtains, paints, varnishes, etc. 7. Draft Guidelines for evaluation of and replacement of lifeboat on-load release mechanisms The Committee will consider with a view to approval the draft Guidelines for evaluation of and replacement of lifeboat on-load release mechanisms, in conjunction with the adoption of the proposed new paragraph 5 of SOLAS regulation III/1. The draft guidelines were finalised at the intersession working group meeting in October and are available as document MSC 88/3/4. 15 MSC 88/3/3 (Secretariat) - Adoption of the International Code for Application of Fire Test Procedures, 2010 (2010 FTP Code) The Committee is invited to adopt the draft International Code for Application of Fire Test Procedures, 2010 (2010 FTP Code). MSC 88/3/4 (Chairman of the Working Group) - Report of the Ad Hoc Working Group on Lifeboat Release Hooks The document presents the report of the Ad Hoc Working Group on Lifeboat Release Hooks, established by MSC 87. The Committee is invited to approve the report of the group in general and in particular to:.1 approve the draft MSC circular on Guidelines for evaluation and replacement of lifeboat release and retrieval systems (paragraph 22 and annex 1);.2 endorse the group's recommendation to instruct DE 55 to further consider the detailed proposals on design review made by the ILG (ISWG LRH/2/3) under its agenda item "Development of a new framework of requirements for life-saving appliances" (paragraph 15);.3 endorse the recommendation of the group to instruct DE 55 to further consider the testing provisions of the Guidelines, with a view to developing relevant amendments to the Revised recommendation on testing of LSA (paragraph 20);.4 instruct DE 55 to urgently develop a procedure for reporting the results of each type of existing lifeboat release and retrieval system evaluation to the Organization and seek the Council's concurrence for the development of a relevant GISIS module (paragraph 23);.5 consider the modification to the draft amendments to SOLAS regulation III/1.5 agreed by the group and take action as appropriate (paragraph 24 and annex 2);.6 approve the draft MSC circular on Early application of new SOLAS regulation III/1.5 (paragraph 25 and annex 3);.7 note that the group, keeping in mind its terms of reference, did not pursue a proposal to further modify the proposed amendments to chapter IV of the LSA Code approved at MSC 86 (paragraph 27); and.8 instruct DE 55 to consider the matter of use of FPDs (paragraph 29). Agenda Item 4 - Measures to enhance maritime security Background: The Committee will consider: 1. the results of experience gained by SOLAS Contracting Governments, international organizations and non-governmental organizations with consultative status from the use of MSC.1/Circ.1192, MSC.1/Circ.1193 and MSC.1/Circ.1194, for further consideration of action to be taken; 2. the results of experience gained when handling defects, deficiencies and nonconformities identified during verifications of compliance with the provisions of SOLAS chapter XI-2 and the ISPS Code and when resolving conflicts between safety and security, for further consideration of action to be taken; and 3. issues which need to be resolved in relation to the implementation of the provisions of SOLAS chapter XI-2 and of the ISPS Code, taking into account, when doing so, the guidance which has been issued since MSC 77, for further consideration of action to be taken, External Affairs 08/11/10 15 of 40

MSC 88/4/1 (Canada) - Best practices for clearance programmes of international and domestic transportation This document invites the Committee to consider the dissemination of the declassified version of a G8 Roma/Lyon Transportation Security Sub-Group (TSSG) paper outlining best practices in transportation security clearance and credentialing programmes. MSC 88/4/2 (Canada) - Enhancements to the ISPS Code This document invites the Committee to consider: the development of maritime supply chain resilience best practices; the incorporation into the ISPS Code earlier-approved security provisions on special purpose ship personnel; the development of guidance for a compliance and enforcement programme for port facility security assessments; and actions against non-flagged vessels. MEPC 88/4/3 (Marshall Islands) - Operational issues regarding BMP v3 guidance on SSAS alert routeing to UKMTO and the availability of related commercial services This document addresses the recent Best Management Practice recommendation to route Ship Security Alerts to the UKMTO and its operational impacts while bringing attention to an existing Ship Security Report System designed for the purpose intended. MSC 88/4/4 (Secretariat) - Outcome of the thirty-sixth session of the Facilitation Committee This document provides information on the outcome of FAL 36 on maritime security matters of interest to the Committee. 17 Agenda Item 5 - Goal-based new ship construction standards Background: Goal-based ship construction standards (GBS) consists of the following 5 tiers I. Goals II. Functional requirements III. Verification of compliance (detailed costly verification vs. practical selfassessment with a possibility to drill into specific Rule requirements) IV. IMO requirements, national requirements, classification rules V. Industry standards and practices IMO s involvement will be Tiers I, II and III. The work on Tiers I and II have been completed and amendments to SOLAS approved for adoption at this session. IMO also agreed to apply an audit approach to verification. The Convention would allow classification societies to apply amendments to the Rules without waiting results of the verification. There will be a separate discussion on the Ship Construction File, IPR and extent of the provision of information. Amendments to the SOLAS Convention and relevant guidelines were adopted at MSC 87 which will enter into force on 1 July They are: 1. International goal-based ship construction standards for bulk carriers and oil tankers, adopted by resolution MSC.287(87) (MSC 87/26, paragraph 3.47 and annex 1); 2. associated amendments to SOLAS chapter II-1 to make the above standards mandatory, adopted by resolution MSC.290(87) (MSC 87/26, paragraph 3.48 and annex 4); 3. Guidelines for verification of conformity with goal-based ship construction standards for bulk carriers and oil tankers, adopted by resolution MSC.296(87) (MSC 87/26, paragraph 5.32 and annex 12); 4. Guidelines for information to be included in a Ship Construction File, approved as circular MSC.1/Circ.1343 (MSC 87/26, paragraph 5.33); and 5. timetable and schedule of activities for the implementation of the GBS verification scheme (MSC 87/26, paragraph 5.34 and annex 13). The Committee will consider any documents submitted by Member Governments and international organizations under this agenda item. The following are listed as longterm remaining items: 1. assessment of the experience gained from the application of GBS and incorporation of lessons learned into the Generic guidelines for developing goalbased standards (MSC 87/5); 2. validation of the results of the safety level approach by comparing with the prescriptive approach (MSC 88/5/1 (Germany), MSC 88/5/2 (Republic of Korea)); 3. determination of the current safety level of the rules/regulations; 4. application of GBS to other ship types on an incremental basis; 5. expansion of GBS to cover every aspect of the design and construction of new ships; 6. consideration of whether all new or revised IMO regulations, classification rules and other mandatory standards should be followed by a commentary in an agreed format, explicitly stating which functional requirements are addressed and providing the substantial basis for the regulation; and External Affairs 08/11/10 17 of 40

(Documents submitted) MSC 88/5 (Secretariat) - Outcome of MSC 87: future work on goal-based standards This document recalls the outcome of MSC 87 regarding goal-based new ship construction standards and the considerations of the Committee with respect to future work on the agenda item. MSC 88/5/1 (Germany) - A proposal for the further development in consideration of the future safety-level based standards This document provides a proposal for the future safety-level based standards. In the views of Germany, the following items should be included in a future work plan: finalize the draft Guidelines for GBS to a degree suitable for the preparation of regulations for future safety-level based standards within current or future review processes (definition of goals and functional requirements, etc.), taking into consideration recent experiences, e.g., in the discussions of the IGF Code and the International Code of safety for ships operating in polar waters; clarify how the acceptable safety level should be specified (basic philosophy of safety-level based standards); and specify the model to determine the safety level of standards. MSC.88/5/2 (Republic of Korea) - Information on long-term considerations for the continued development of GBS This document provides information on long-term considerations relevant to validation of the results of the safety level approach by comparing with the prescriptive approach. The Republic of Korea considers that, although there are many aspects influencing the ship's safety such as ship structure, machinery, equipment, stability, manoeuvrability, collision, grounding, and fire protection, it is considered that the ship's structure is the most important item in validating the results of the safety level approach by comparing with the prescriptive approach. This document has been developed with this in mind, focusing on the ship's structural safety. 19 Agenda Item 6 - LRIT-related matters Background: The Committee will be invited to consider: 1. developments in relation to the operation of the LRIT system since MSC 87 (MSC 88/6); 2. the report of the Ad Hoc LRIT Group under the terms of reference approved by MSC 86 (MSC 88/6/1); and 3. any relevant submissions regarding LRIT-related issues by SOLAS Contracting Governments and international organizations, and to establish, as decided at MSC 87, a Working Group on LRIT-related Matters to advise the Committee on relevant matters. The proposal on annual conformance test (MSC 88/6/4) will have significant impact on the current survey and certification scheme. LR position: To note discussions, particularly with regards to the discussion on annual conformance test. Implications: Should the proposal on annual conformance testing be agreed, this will have an impact on the shipboard testing, survey and certification regime. The remainder of the discussions are not envisaged to have an impact upon shipowners and builders. The results of the discussions on LRIT Data Exchange system will mostly affect Flag Administrations. (Documents submitted) MSC 88/6 (Secretariat) - Developments in relation to the completion of the establishment and testing of LRIT Data Centres and the operation of the LRIT system since MSC 87 This document reports on a number of the main actions taken by the Secretariat in relation to the establishment and testing of LRIT Data Centres and the operation of the LRIT system since MSC 87 and as on Tuesday 21 September MSC 88/6/1 (Secretariat) - Report of the ninth session of the Ad Hoc LRIT Group1 This document contains the report of the ninth session of the Ad Hoc LRIT Group. The Committee is invited to note the information provided in this report and, in particular, to: 1. encourage SOLAS Contracting Governments that had established LRIT Data Centres to continue reporting on any issues relating to LRIT shipborne equipment not operating as expected within the LRIT system and advise on the progress made regarding the rectification of the various malfunctions; and strongly urge Administrations to put in place appropriate arrangements so that the various equipment malfunctions were dealt with in a prompt and effective manner, including, if necessary, the replacement or the installation of dedicated equipment for transmitting LRIT information if the efforts to rectify the various malfunctions were not resolved within a reasonable period (paragraphs 3.3 and 3.4); 2. formally adopt the amendments to MSC.1/Circ.1259/Rev.3 accepted by the Group (paragraphs 4.10, 4.12, 4.27 and 4.31, and annex 2); External Affairs 08/11/10 19 of 40

MSC 88/7/1 (NACE International) - Suggested footnote for table 1 in the Performance standard for protective coatings for cargo oil tanks of crude oil tankers (resolution MSC.288(87)) This document proposes modifying footnote 4 to table 1 of the Performance standard for protective coatings for cargo oil tanks of crude oil tankers (resolution MSC.288(87)). The NACE International standard is an alternative for testing the salt limit, and was revised as requested by the Committee to expand the evaluation to three salt levels (30, 50 and 85 mg/m 2 ). MSC 88/7/2 (IACS) - Testing of Free-fall Lifeboats This document brings to the attention of the Committee what appears to be an inconsistency concerning the testing of free-fall lifeboats (FFLB) release systems. The following action is requested: 1. to note that, while the tests now required of FFLB release systems may be carried out by free fall launching of the boat, this does not appear to be explicitly required by the regulations. IACS therefore considers it necessary to clarify whether it is the intention of the regulations to allow the various operational tests to be performed without requiring free fall launching of the FFLB; and 2. The Committee is invited to note that the contents of this paper have been submitted to the 54th session of the DE Sub-Committee, with the view that comments from the experts at the DE Sub-Committee would benefit and facilitate the Committee in determining a proper course of action. MSC 88/INF.3 (NACE International) - Revised standard for alternatives to testing the salt limit as related to resolution MSC.288(87) This information document provides the revised NACE standard SP as requested by the Committee. This standard is an alternative for testing the salt limit in table 1 of Performance standards for protective coatings for cargo oil tanks resolution MSC.288(87). Implications: The items listed as 6, 7 and 8 in document MSC 88/8 will affect survey and plan approval of the High Speed Craft. The impact are limited as these are, in most cases, clarification of the requirements based upon the understandings of the original intent of the requirements. Shipowners: once decision is made, to convey these circular/amendments to shipmasters/superintendents to as it may help proper implementation and avoidance of any problem at PSC. Shipbuilders: to note the clarifications presented in these instruments, but primarily clarification part is for the application to the existing craft. Flag Administrations and their Recognized Organizations: to provide instructions to surveyors on those points clarified by the COMSAR Sub-Committee. The concept of regional satellite service given in MSC 88/8/1 may fundamentally change current GMDSS regime. MSC 88/9/3 (Japan) - Comment on the draft MSC circular on Unified Interpretation of chapter 12 of the International Code for Fire Safety Systems This document invites the Committee to consider an effective date of the draft circular on Unified Interpretation of chapter 12 of the International Code for Fire Safety Systems, emanating from FP 54. MSC 88/10/1 (Netherlands) - Use of asbestos on board ships This document expresses concerns regarding the actual prohibited use of asbestos on board ships and proposes to issue an MSC circular with the aim to raise awareness and improve enforcement regarding the use of asbestos on board ships Agenda Item 11 - Safety of navigation Background: The Committee will consider matters emanating from the 56 th session of the Safety of Navigation (NAV) Sub-Committee and take action as indicated in paragraph 2 of document MSC 88/11. LR position: Although no substantial discussion is envisaged at the Committee level, LR is to closely monitor the final approval of the draft circulars indicated as action items 3 and 4 of document MSC 88/11 introduced below. LR will closely monitor the discussion on the submission document MSC 88/11/1 (IACS). Implications: The circular indicated in action items 3 and 4 of document MSC 88/11 below is general guidance for the maintenance of software on navigational equipment, however, the update of ECDIS software may have PSC implication (PSC officer may look into the status of the update of the system in addition to the update of Electric Navigational Chart). Owners are to bring these circular to the attention of ship masters and superintendents. MSC 88/11/1 (IACS) - Request for clarification in relation to carriage of speed log systems for ships of 50,000 gross tonnage and upwards This document contains a request for clarification in relation to carriage requirement for speed log devices for ships of 50,000 gt and upwards. Based on the discussion at NAV 56 as referred to in paragraph 3 above, IACS re-presents below alternatives 1 and 3 from document NAV 56/19/2, and seeks the Committee's advice as to which alternative is appropriate: 1. both regulations fulfilled by one device capable of measuring and indicating both speed through water and speed over the ground in forward and athwartships direction. Any single failure in such device may render both functions inoperable; and 2. both regulations fulfilled by two separate devices, i.e. one speed and distance measuring and indicating device capable of measuring speed through water and one separate speed and distance measuring and indicating device capable of measuring speed over the ground in forward and athwartships direction. It originates from a major Human Element research programme commissioned by the United Kingdom and published in "The Human Element a guide to human behaviour in the shipping industry". It further recommends that the Organization, via the Joint MSC/MEPC Human Element Working Group takes appropriate action to develop guidelines for the development of just culture and promotes its adoption by the shipping industry. MSC 88/16/2 (Secretariat) - Outcome of the first meeting of the IMO/ILO Joint Ad Hoc Working Group on Guidelines for medical examination of seafarers and contents of ships' medicine chests This document provides information on progress in the work of the Joint IMO/ILO Ad Hoc Working Group on Guidelines for medical examination of seafarers and contents of ships' medicine chests. MSC 88/INF.11 (Secretariat) - Launch of the Seafarers' Rights International Centre This document advises the Committee of the launch of the Seafarers' Rights International Centre and outlines the expected scope of the Centre's work. Agenda Item 17 - Formal safety assessment Background: The Committee will consider the outcome of the FSA Correspondence Group which was instructed to prepare a draft revised FSA Guidelines and a draft revised Guidance on the use of HEAP and FSA, and any relevant submissions by Governments and international organizations regarding formal safety assessment related issues. Having analysed the submissions to MSC 88, the Secretariat, in consultation with the Chairman and the Vice-Chairman, concluded that it would be premature to establish an FSA Experts Group at this session.
