1 IMO Ship Recycling Conference Agenda Preview The International Conference on the Safe and Environmentally Sound Recycling of Ships (11 15 May 2009) 17 th April This publication, produced by Lloyd s Register, provides an overview of the agenda for IMO Ship Recycling Conference, and summarises all the documents submitted for discussion at this meeting. 6 The international Conference on the Safe and Environmentally Sound Recycling of Ships will be held from 11 to 15th May 2009 in Hong Kong. Summery of the technical documents and limited synopses for each agenda items are given hereunder. 2. Consideration of the draft International Convention for the Safe and Environmentally Sound Recycling of Ships and any draft Convention Resolutions (Agenda Item 6) Executive synopsis on this agenda item Background: This agenda item completes the discussion on the text of the convention and allows the drafting group to provide the text for adoption. This will therefore finish the technical debate on the convention. Future work from the IMO will now focus on the guidelines for the convention since after adoption the text is locked until the convention enters into force. LR position: LR supports the convention, and look forward to its early ratification. Outstanding items for discussion are included in the papers submitted by IACS. Implications: All ships will be required to build operate and dispose of their ships in a manner that facilitates safe and environmentally sound ship recycling. Application: All ships. (Document submitted) SR/CONF/2 (Secretariat) - Draft text of the International Convention for the Safe and Environmentally Sound Recycling of Ships This document forwards the draft text of the International Convention for the Safe and Environmentally Sound Recycling of Ships, which was approved for circulation to the Conference by the Marine Environment Protection Committee at its fifty-eighth session. SR/CONF/2/Add.1 (Secretariat) - Outcome of MEPC 58 This document is in addition to, and amends the above document to better include some items not reported. SR/CONF/5 (Secretariat) - Draft Conference resolution on the contribution made by representatives of the Parties to the Basel Convention and the International Labour Organization and their Secretariats This document contains a draft Conference resolution on the contribution made by representatives of the Parties to the Basel Convention and the International Labour Organization and their Secretariats at all stages of the development of the Convention. SR/CONF/6 (Secretariat) - Draft Conference resolution on promotion of technical cooperation This document contains a draft Conference resolution on promotion of technical cooperation in relation to the draft International Convention for the Safe and Environmentally Sound Recycling of Ships. SR/CONF/7 (Secretariat) - Draft Conference resolution on future work by the Organization pertaining to the International Convention for the Safe and Environmentally Sound Recycling of Ships This document contains a draft Conference resolution on future work by the Organization pertaining to the International Convention for the Safe and Environmentally Sound Recycling of Ships. 7 SR/CONF/9 (Australia) - Non-Party recycling facilities This document provides options for amendments to the draft text of the International Convention for the Safe and Environmentally Sound Recycling of Ships to address concerns regarding non-party recycling facilities that meet or exceed the Convention s standards. SR/CONF/10 (Norway) - Proposal for amending the application of the draft Convention to be drafted as other relevant IMO Conventions In this document Norway proposes to use a similar approach as the SOLAS, MARPOL, AFS and BWM Conventions in defining the size limitation in the application of the draft Convention. The Conference should note the good experiences gained in defining the application in these instruments, and should ensure that the draft International Convention for the Safe and Environmentally Sound Recycling of Ships is drafted with equal robustness. SR/CONF/11 (Norway) - Proposal for clarifying the requirements in regulation 10 of the draft Convention MEPC 58, viewpoints were raised on regulation This document includes a proposal for clarifying the requirements relative to the final survey. It is of utmost importance that the flag State Administration ensures that the ship is sufficiently prepared for its recycling. In that respect it is crucial that the Ship Recycling Plan is included in the International Ready for Recycling Certificate, and that the task of the flag State Administration is clear. SR/CONF/13 (Greenpeace International and FOEI) - Ensuring sustainable green and safe ship dismantling concerning the entry into force provisions This document contains comments on the entry-into-force provisions of the draft International Convention for the Safe and Environmentally Sound Recycling of Ships. The paper strongly recommends that ship recycling capacity should not be included as a requirement for entry into force. SR/CONF/14 (Greenpeace International and FOEI) - Ensuring sustainable green and safe ship dismantling concerning beaching and the establishment of a mandatory fund This document provides proposals with regard to two fundamental issues which will determine the success or failure of the Convention s ability to set an acceptable human and environmental standard for the breaking of the world fleet. It is imperative that this Convention at a minimum puts a halt to the crudest and most unacceptable shipbreaking method and the externalization of health and environmental costs onto some of the world s poorest communities in developing countries. To this end, the civil society environmental and human rights organizations submitting these proposals strongly recommend that the Convention explicitly recognizes beaching as a substandard practice to be prohibited and establish a mandatory fund that will inter alia enable this fatally flawed method to be phased out. SR/CONF/15 (Marshall Islands) - The role of the Cash Buyer This document further elaborates on the role of the Cash Buyer and proposes a solution to addressing potential issues involving continuity and compliance with provisions of the convention. SR/CONF/16 (Denmark) - Draft Conference resolution on best practices for fulfilling the requirements of the Convention External Affairs 17/04/09 7 of 10

8 This document proposes that best practices for fulfilling the requirements of the International Convention for the Safe and Environmentally Sound Recycling of Ships are explored and monitored by the Organization. SR/CONF/17 (Belgium, Denmark and the Republic of Korea) - Consideration on dispute settlement This document sets out a proposal for a provision on the settlement of disputes relating to the interpretation and application of the Convention in line with the recently adopted provision in the Nairobi International Convention on the Removal of Wrecks, SR/CONF/18 (Norway) - Draft Conference resolution on expression of appreciation to the host Government This document proposes a draft Conference resolution expressing appreciation to the host Government. SR/CONF/19 (France) - Referencing of appendices in the Convention and points of clarification Submitted by France Some appendices are not referenced in any article or regulation of the Convention. For the sake of clarity, it would be useful to add this information. Also, an amendment is proposed to the title of appendix 2 and the title of regulation 18. SR/CONF/20 (France) - Reporting upon completion (Regulation 25) The report on the completion of recycling, as provided for in regulation 25, must be sent by the Competent Authority (recycling State) to the Administration (flag State) and must make it possible to trace the materials that result from dismantling. SR/CONF/21 (France) - Draft Conference resolution on the processing of incorrectly declared waste The inventory of hazardous materials for existing ships may prove to be inaccurate and the processing of incorrectly declared waste will require particular attention. SR/CONF/22 (Norway) - Proposal for clarifying regulations 8 and 9 of the draft Convention Throughout the negotiations the main mechanism of the draft Convention has been that a certified ship shall be recycled at a facility or facilities which is/are authorized to recycle that ship, i.e. that all the Hazardous Materials have to be handled in accordance with the Convention. This document proposes minor amendments to the draft Convention which provide more clarity on this mechanism. The document also proposes amendments which provide more clarity to the agreement reached at MEPC 58 regarding approval of the Ship Recycling Plan (regulation 9.4). SR/CONF/23 (Marshall Islands, Panama, Ukraine, ICS, BIMCO, IACS, OCIMF, INTERTANKO, INTERCARGO and IPTA) - Proposed amendment to draft regulation 5 Inventory of Hazardous Materials The co-sponsors propose amendments to draft regulation 5 of the International Convention for the Safe and Environmentally Sound Recycling of Ships that they consider necessary in order for the Convention to be implemented in a sound, transparent and legally responsible manner. 9 SR/CONF/24 (Marshall Islands, Panama and the International Association of Classification Societies (IACS)) - Proposed amendment to regulation 14 Duration and validity of certificates This document provides the Conference with proposed amendments to regulation 14 of the draft International Convention for the Safe and Environmentally Sound Recycling of Ships. SR/CONF/25 (Marshall Islands and the International Association of Classification Societies (IACS)) - Proposed amendments to appendix 1 Controls of Hazardous Materials This document proposes amendments to appendix 1 Controls of Hazardous Materials, in order to provide consistency with the restrictions for use of hazardous materials permitted in the International Convention on the Control of Harmful Anti-Fouling Systems on Ships, 2001 (AFS 2001), under which ships have been designed, constructed and properly certified. SR/CONF/26 (India) - Preparation of oil tankers for ship recycling This document discusses once again the safety and environmental concerns of India which arise from the lack of explicit requirements for the preparation of oil tankers for recycling by cleaning their cargo and slop tanks and cargo pipes prior to their arrival at the Ship Recycling Facility. India proposes the addition of one paragraph in regulation 8 of the draft Convention in order to address this omission. SR/CONF/27 (India) - The role of the shipowner in the development of the Ship Recycling Plan This document discusses the requirement in regulation 9 of the draft Convention for the Ship Recycling Plan to be developed by the Ship Recycling Facility in consultation with the shipowner. SR/CONF/28 (France) - Proposed amendments to the draft Convention: Improvement in the communication of information (Articles 9 and 12) and clarification on the Ship Recycling Plan approval process (regulation 9) This document proposes amendments to Articles 9 and 12 to ensure that the Organization will be informed of any request for investigation by a Party and will disseminate this information between Parties. The document also proposes amendments to the Ship Recycling Plan approval process (regulation 9). SR/CONF/29 (Marshall Islands, Panama, Ukraine, ICS, BIMCO, IACS, OCIMF, INTERTANKO, INTERCARGO and IPTA) - Proposed amendments to regulation 9 Ship Recycling Plan and to regulation 10 Surveys From the perspective of implementing the International Convention for the Safe and Environmentally Sound Recycling of Ships on behalf of Administrations, the co-sponsors believe that draft regulations 9 and 10 require revision in order that ships can be recycled in a sound, transparent and legally responsible manner. The revisions are presented in a single submission due to the impact that these two regulations have on the documentation available for the verification to be carried out during the final survey. SR/CONF/30 (Denmark) - Entry-into-force provision This document sets out Denmark s concerns regarding the inclusion of a recycling capacity criterion in the entry-into-force provision of the draft Convention.
