Initial submissions were exchanged and collated by correspondence. Noting the wide range of opinions expressed in these submissions, a meeting of the CG was called to consider the submissions and develop a consensus view. Consensus was achieved and a number of conclusions were reached. This report reflects the views expressed by correspondence, the outcome of the meeting and includes the various proposed amendments to IMO instruments Action to be taken: Paragraph 21 Related documents: MSC 78/26, NAV 50/19, SOLAS chapter V, HSC Code, chapter 13, MSC 78/24/3, MSC 78/24/17, MSC 78/24/18, resolution A.817(19), as amended, and SN/Circ.207 Introduction and Background 1 During its seventy-eighth session, the MSC decided to include a high-priority item on Evaluation of the use of ECDIS and ENC development on the provisional agenda for NAV 51. The NAV Sub-Committee was further instructed to give preliminary considerations to the matter at its fiftieth session. At NAV 50, it was decided to set up a Correspondence Group on ECDIS and RCDS. The Correspondence Group was tasked to give consideration to documents MSC 78/24/3, MSC 78/24/17 and MSC 78/24/18 and exchange preliminary views on the following subjects:.1 Conditions for possible introduction of ECDIS carriage requirements: - schedule for phase in; - ship types affected;.2 Possible authorization of use of ECDIS in RCDS mode without a requirement to carry an appropriate portfolio of paper charts; For reasons of economy, this document is printed in a limited number. Delegates are kindly asked to bring their copies to meetings and not to request additional copies.

2 NAV 51/ Indication of acceptance of RNCs by individual coastal States based on the survey to be conducted by IHO as requested by NAV 50;.4 Definition of, and/or criteria for, the term appropriate portfolio of paper charts : - when ECDIS is used in the RCDS mode; - as ECDIS back up;.5 Instruments required to monitor the promulgation of official digital charts and paper charts related to ECDIS operation, and provide this information to interested parties;.6 Consider possible implications for IMO instruments, and submit a report of its deliberations to NAV 51. Norway accepted to chair the Correspondence Group and asked for interested parties to participate. 2 Initial submissions were exchanged and collated by correspondence. Noting the wide range of opinions expressed in these submissions, a meeting of the Correspondence Group was arranged to consider the submissions and develop a consensus view. This meeting was held from 27 to 28 January 2005 and hosted by the International Hydrographic Bureau in Monaco. Consensus was achieved and a number of conclusions were reached. Various proposals were also drafted for subsequent consideration by NAV Written inputs were received from the following countries and organizations; Australia, Denmark, Canada, Finland, France, Germany, the Netherlands, Norway, Poland, the Russian Federation, the United Kingdom, the United States, IHO, ICS, IEC, TC 80 and CIRM. 4 Participants at the meeting represented the following countries and organizations; Australia, Denmark, Canada, Finland, France, Germany, the Netherlands, Norway, the Russian Federation, the United Kingdom, the United States, IHO and CIRM. 5 This report reflects the views expressed by correspondence, the outcome of the meeting and includes the various proposed amendments or additions to IMO instruments for consideration by NAV 51. Conclusions of the Correspondence Group 6 The Correspondence Group found that most of the six subjects above were interdependent. Nevertheless, for clarity and ease of reporting, the outcomes of the discussions will be reported against each of the subjects. Subject No.1: Conditions for possible introduction of ECDIS carriage requirements 7 The Correspondence Group noted the comments from its members, and considered that there was a sound basis to implement a phased mandatory carriage requirement for ECDIS for certain classes of vessel. The increased use of ECDIS will directly contribute to the safety of navigation and protection of the environment. A phase-in programme for the carriage of ECDIS

3 - 3 - NAV 51/6 will also provide certainty and direction to mariners, data distributors, equipment manufacturers and Hydrographic Offices. These measures will accelerate the use and support of ECDIS which will benefit mariners and at the same time contribute to increasing the rates of ENC production. 8 As a result, the group propose amendment to SOLAS chapter V, regulation 19 (annex 1) and the High-Speed Craft (HSC) Code chapter 13 (annex 2). The group considered that the timetable for the implementation of the mandatory carriage requirements should commence approximately three years after adoption by the Maritime Safety Committee (MSC). The first priority should be the High-Speed Craft (HSC), followed at intervals by other classes of ship. Such an implementation timetable would provide adequate notice of the requirement and allow sufficient time for installation, training and other associated preparations to be made in ships. 9 The implementation timetable takes into account the increasingly rapid production rates of electronic navigational charts (ENC). The IHO reported to the group that ENC coverage would be well advanced by the time of the first implementation date. Subject No.2: Possible authorization of use of ECDIS in RCDS mode without carriage of paper charts 10 The Correspondence Group found the widest range of divergent views on this subject thereby making it difficult to reach a conclusion or provide a definitive recommendation. The Correspondence Group took into account the report on IHO Member States views on the subject (ref: IHO C/L 41/2004). Furthermore, after consideration of Subject No.4, and the development of improved guidance on an appropriate folio of paper charts, it was found that the various positions previously expressed by some Member States during the Correspondence Group discussions and at previous sessions of NAV Sub-Committee could be reconciled and accommodated under the proposed new guidance for Subject No.4. As a result, the Correspondence Group decided that it was not necessary to address Subject No.2 any further. Subject No.3: Indication of acceptance of RNCs by individual coastal States based on the survey to be conducted by IHO 11 The IHO reported on the results of a survey of IHO Member States and Member States of IMO. 35 States have responded to the IHO survey. 16 accepted the use of ECDIS in RCDS mode of operation in those waters under their jurisdiction and where no ENCs are available. These States indicated that an appropriate folio of paper charts is to be carried on board and used when ECDIS is in the RCDS mode of operation. 19 States reported that they do not accept the use of ECDIS in RCDS mode, but accept ECDIS using ENCs with paper charts as the back-up arrangement for ECDIS. These results were taken into consideration during the work of the Correspondence Group, particularly in relation to Subject No.2 and Subject No The IHO will also report its finding separately to NAV 51. Subject No.4: Definition of, and/or criteria for, the term appropriate portfolio of paper charts 13 The Correspondence Group considered the guidance provided in six different implementation models already promulgated by certain Administrations (Australia, Denmark, Germany, the Russian Federation, the United Kingdom and the United States). This was used as

4 NAV 51/6-4 - the basis to revise the guidance and definitions contained in the ECDIS Performance Standard and associated documents. 14 The Correspondence Group noted that according to the ECDIS Performance Standards, an appropriate portfolio of up-to-date paper charts (APC) should be carried where the mariner wishes to use ECDIS in the RCDS mode for areas in which ENCs are not available. In order to clarify this requirement, the Correspondence Group recommends that certain clarifications and definitions be included in various IMO instruments, as follows:.1 Add a definition of appropriate portfolio of up-to-date paper charts to resolution A.817(19), as amended (ECDIS Performance Standards), Appendix 7, new paragraph 2.7 (see annex 3)..2 Reword resolution A.817(19), as amended (ECDIS Performance Standards), Appendix 7, paragraph 1.2 for clarification (see annex 3)..3 Reword footnote to SOLAS chapter V, regulation 19, paragraph for clarification (see annex 1). Subject No.5: Instruments required to monitor the promulgation of official digital charts and paper charts related to ECDIS operation, and provide this information to interested parties 15 The IHO reported that its Member States have indicated support to establish a comprehensive online catalogue of available official charts (ENC, RNC and relevant paper charts). This catalogue would be an upgrade and extension of the Electronic Navigational Chart (ENC) availability database, already posted on the IHO website. The Correspondence Group supported this initiative as being a most appropriate way of achieving the desired outcome of Subject No.5. The IHO will also inform NAV 51 separately of this proposal. This catalogue will support the determination of an appropriate folio of paper charts, addressed at Subject No.4. Subject No.6: Possible implications for IMO instruments 16 As a result of the work of the Correspondence Group, a number of proposals for specific amendments to various IMO instruments have been made. In summary these are: - SOLAS chapter V, regulation 19 (Proposal in annex 1 and paragraph 14.3). - HSC Code, chapter 13 (Proposal in annex 2). - Resolution A.817(19), as amended (ECDIS Performance Standards), Appendix 7, (Proposal in paragraphs 14.1 and 14.2). 17 No other implications for IMO Instruments were identified. Other Matters for consideration of the Sub-Committee 18 The Correspondence Group suggests that IMO invites its coastal Member States to consider which paper charts would meet the appropriate portfolio of paper charts in waters under its jurisdiction and where ENCs do not exist, and communicate this information to the International Hydrographic Organization for inclusion in the online chart catalogue reported

The IMO may wish to advise its Member States to consult the relevant hydrographic authorities in the determination of this guidance. 19 The Correspondence Group also considered whether the proposed amendments or additions to IMO instruments would result in any requirement for the carriage of equipment additional to ECDIS. They concluded that no additional equipment would be required beyond that identified in the proposals. 20 In the light of the proposed clarifications for an appropriate portfolio of paper charts, NAV 51 may wish to consider reviewing SN/Circ.207 to ensure consistency with the proposed clarifications proposed in this report. The Circular may be supplemented or replaced by operational guidelines including the merits and shortcomings of using ENC, RNC and paper chart respectively, during navigation. Actions requested of the Sub-Committee 21 The Sub-Committee is invited to:.1 consider the report from the Correspondence Group;.2 consider the proposed amendments to SOLAS chapter V, regulation 19 in annex 1 to implement a phased mandatory carriage requirement for ECDIS;.3 consider the proposed amendments to HSC Code 13 in annex 2 to implement a phased mandatory carriage requirement for ECDIS;.4 consider proposed amendments to resolution A.817(19), as amended (ECDIS Performance Standards), Appendix 7 in annex 3, to reflect the clarifications and definitions to the term Appropriate portfolio of up-to-date paper charts, when ECDIS is used in the RCDS mode;.5 consider amendments to SOLAS chapter V, regulation 19, footnote to sub-paragraph in annex 1, to reflect the clarifications and definitions to the term Appropriate portfolio of up-to-date paper charts as ECDIS back-up;.6 support the IHO initiative to establish a comprehensive online catalogue of available official charts which will facilitate the determination of appropriate portfolio of up-to-date paper charts ;.7 invite coastal Member States to consider which paper charts would meet the appropriate portfolio of paper charts in waters under its jurisdiction and where ENCs do not exist and communicate this to the IHO for inclusion in the online chart catalogue;.8 advise coastal Member States to consult the relevant hydrographic authorities in the determination of appropriate portfolio of paper charts in waters under its jurisdiction and where ENCs do not exist; and.9 consider the need for reviewing SN/Circ.207 to ensure consistency with the proposed clarifications for an appropriate portfolio of paper charts. ***

7 NAV 51/6 ANNEX 1 DRAFT RESOLUTION MSC.[...](xx) (adopted on xxxxxxx) ADOPTION OF AMENDMENTS TO THE INTERNATIONAL CONVENTION FOR THE SAFETY OF LIFE AT SEA, 1974, AS AMENDED THE MARITIME SAFETY COMMITTEE, RECALLING Article 28(b) of the Convention on the International Maritime Organization concerning the functions of the Committee, RECALLING FURTHER article VIII(b) of the International Convention for the Safety of Life at Sea (SOLAS), 1974, hereinafter referred to as "the Convention", concerning the procedures for amending the Annex to the Convention, other than the provisions of chapter I thereof, HAVING CONSIDERED, at its [eighty-first] session, amendments to the Convention proposed and circulated in accordance with article VIII(b)(i) thereof, 1. ADOPTS, in accordance with article VIII(b)(iv) of the Convention, amendments to the Convention, the text of which is set out in the Annex to the present resolution; 2. DETERMINES, in accordance with article VIII(b)(vi)(2)(bb) of the Convention, that the amendments shall be deemed to have been accepted on [1 January 2007], unless, prior to that date, more than one third of the Contracting Governments to the Convention or Contracting Governments the combined merchant fleets of which constitute not less than 50% of the gross tonnage of the world s merchant fleet, have notified their objections to the amendments; 3. INVITES Contracting Governments to note that, in accordance with article VIII(b)(vii)(2) of the Convention, the amendments shall enter into force on [1 July 2007] upon their acceptance in accordance with paragraph 2 above; 4. REQUESTS the Secretary-General, in conformity with article VIII(b)(v) of the Convention, to transmit certified copies of the present resolution and the text of the amendments contained in the Annex to all Contracting Governments to the Convention; 5. 8 NAV 51/6 ANNEX 1 Page 2 ANNEX PROPOSED DRAFT AMENDMENTS TO THE INTERNATIONAL CONVENTION FOR THE SAFETY OF LIFE AT SEA, 1974, AS AMENDED Regulation 19 CHAPTER V SAFETY OF NAVIGATION Carriage requirements for shipborne navigational systems and equipment 1 Amend footnote to paragraph to read as follows: * Paper nautical charts sufficient to meet the requirements of sub-paragraph.4 and regulation 27 may be used as a back-up arrangement for ECDIS. Other back-up arrangements for ECDIS are acceptable (see Appendix 6 to resolution A.817(19), as amended). 2 Add new paragraph 2.8 as follows: 2.8 All ships of [3,000] gross tonnage and upwards engaged on international voyages and tankers of [500] gross tonnage and upwards engaged in international voyages and passenger ships of [500] gross tonnage and upwards engaged on any voyage shall be fitted with an Electronic Chart and Display Information System (ECDIS), as follows:.1 ships constructed on or after [1 July 2010];.2 ships engaged on international voyages constructed before [1 July 2010];.2.1 in the case of passenger ships, not later than [1 July 2011];.2.2 in the case of tankers, not later than the first survey for safety equipment on or after [1 July 2011];.2.3 in the case of ships, other than passenger ships and tankers, not later than [1 July 2012]; and.3 passenger ships not engaged on international voyages constructed before [1 July 2010], not later than [1 July 2012]..4 The Administration may exempt, from the application of the requirement of this paragraph, ships that will be taken permanently out of service within two years after the implementation date specified in sub-paragraphs.2 and.3. 3 Renumber the existing paragraph 2.8 as 2.9 and the existing paragraph 2.9 as ***

11 NAV 51/6 ANNEX 3 DRAFT RESOLUTION MSC.xx(81) (adopted on xxxxxxx) ADOPTION OF AMENDMENTS TO THE RECOMMENDATION ON PERFORMANCE STANDARDS FOR ELECTRONIC CHART DISPLAY AND INFORMATION SYSTEMS (ECDISs) (RESOLUTION A.817(19), AS AMENDED) THE MARITIME SAFETY COMMITTEE, RECALLING Article 28(b) of the Convention on the International Maritime Organization concerning the functions of the Committee, RECALLING ALSO resolution A.825(19), by which the Assembly resolved that the functions of adopting performance standards for radio and navigational equipment, as well as amendments thereto, shall be performed by the Maritime Safety Committee on behalf of the Organization, HAVING CONSIDERED amendments to existing performance standards adopted by the Assembly and prepared by the fifty-first session of the Sub-Committee on Safety of Navigation, 1. ADOPTS the amendments to the Recommendation on Performance Standards for Electronic Chart Display and Information Systems (ECDISs) (resolution A.817(19), as amended), set out in Annex to the present resolution; 2. RECOMMENDS Member Governments to ensure that:.1 ECDIS installed on or after (1 January 2008) conform, respectively, to performance standards not inferior to those set out in resolution A.817(19), as amended, and Annex to the present resolution; and.2 ECDIS installed on 1 January 2000 and before (1 January 2008) conform, respectively, to performance standards not inferior to those set out in resolution A.817(19), as amended by resolution MSC.64(67), Annex 5 and resolution MSC.86(70), Annex 4.

12 NAV 51/6 ANNEX 3 Page 2 ANNEX AMENDMENTS TO THE RECOMMENDATION ON PERFORMANCE STANDARDS FOR ELECTRONIC CHART DISPLAY AND INFORMATION SYSTEMS (ECDISs) (RESOLUTION A.817(19), AS AMENDED) Modify Appendix 7, paragraph 1.2 as follows: 1.2 When operating in RCDS-mode, an appropriate portfolio of up-to-date paper charts should be carried on board and be readily available to the mariner. IHO maintains an up-to-date world-wide catalogue that indicates which charts meet the requirements of such an appropriate portfolio. This catalogue is compiled from inputs provided by coastal States. Consideration should be given to this catalogue when determining the appropriate portfolio of up-to-date paper charts. Add to Appendix 7, a new paragraph 2.7: 2.7 An appropriate portfolio of up-to-date paper charts (APC) should cover those sections of the intended voyage where ECDIS will be operated in the RCDS mode. These paper charts are to be of a scale that will show sufficient detail of topography, depths, navigational hazards, aids to navigation, charted routes, and routing measures to provide the mariner with information on the overall navigational environment. In conjunction with ECDIS in RCDS mode, such charts should provide adequate look-ahead capability.
