1 1 Planning Board Meeting Minutes August 17, 2011 Present: Chairman John McGrath, Vice-Chairman Keith Cloutier Members: William Hultgren, Patricia Tanona Planning Board Alternate: Jean Vincent Staff: Planning Director Alan Gordon and Administrator Assistant Jayne Garney Not Present: Trish Gill Chairman McGrath opened the meeting at 7:00 p.m. Member Bill Hultgren made a motion to approve payment for payroll. Member Patricia Tanona seconded the motion. All members were in favor. Member Keith Cloutier made a motion to approve payment for bills. Member Patricia Tanona seconded the motion. All members were in favor. Mr. McGrath reviewed mail and correspondence John McGrath read a memo from CMRPC stating there is an upcoming Regional Transportation Plan Seminar if anyone would like to attend. 7:11 p.m. Helgerson Site Plan Completion/Performance Guarantee Town Planner Alan Gordon read a letter from Graves Engineering, Inc. dated August 2, 2011 stating final inspection has been complete. Member Patricia Tanona made a motion to release the Southbridge Savings Bank letter of credit for the project. Member Keith Cloutier seconded the motion. All members were in favor. Member Keith Cloutier made a motion to send a letter to Building Commissioner Curtis Meskus confirming proper field completion at 79 Bay Path Road. The Board authorized Mr. Gordon to sign the permanent occupancy permit on their behalf when the Building Commissioner converts the applicant s temporary occupancy permit to a permanent permit. Member Patricia Tanona seconded the motion. All members were in favor.
2 2 7:15 p.m. Bianculli Site Plan Application-Public Hearing Chairman McGrath read the public hearing notice. Applicant Ms. Brenda Bianculli was present to review the site plan application. Engineer Mr. Steve Bresette, of Jalbert Engineering, Inc. was present to review the site plan application to operate an accounting and tax preparation business in an existing residential structure located at 114 Masonic Home Road in the Village District. Mr. Jalbert stated there are 4 standard parking spaces proposed with one handicapped space. Mr. Bressette stated the windows, siding and deck have all been replaced. Member Jean Vincent asked questions regarding the location of parking spaces and access. Member Keith Cloutier made a motion to close the public hearing. Member Patricia Tanona seconded the motion. All members were in favor. Member Keith Cloutier made a motion to approve the Bianculli Site Plan Application with the following conditions: 1. All work proposed in the special permit application must be completed within two (2) years from the date of approval. An extension of time for completion may be requested prior to the completion deadline, and may be granted by the Planning Board. 2. The Planning Board and the Building Commissioner s policy is that no Certificate Of Occupancy or Operation, either temporary or permanent, for site plan and special permit-approved projects shall be issued prior to the Planning Board or its designated agent signing of said Certificate Of Occupancy and/or Operation. The Planning Board will not provide said signature prior to the Planning Board or its agent(s) confirming that all requirements and conditions of this plan approval have been properly adhered and completed. 7:22 p.m. Haggerty Landing Approval Extension & Ponnakin Hill Estates review Member Keith Cloutier made a motion to approve a one-year extension of the Haggerty Landing definitive subdivision plan approval period to August 17, 2012.
3 3 7:25 p.m. OMA Group, LLC Site Plan Application-Public Hearing Chairman McGrath read the public hearing notice. Applicant Mr. Doug Monson was present for the site plan review to install and operate a commercial solar energy facility at 157 Worcester Road (Route 20) Engineer Michael Scott, P.E. of Waterman Design Associates, Inc. reviewed the site plan with the Board along with Mr. Roberto Bachman of Solar Flair, Inc. Mr. Scott stated the ground mount solar arrays will be built on 3.8 acres. There is 9.51 total acres on the site located at 157 Worcester Road (Route 20) Mr. Scott stated that there is only routine maintenance involved with the solar panels. The panels can sit on a 7% grade. The Board asked what the panels are made of. Mr. Bachman stated silicon with aluminum frames, steel racks and concrete blocks. The Board discussed security around the solar panels. Mr. Scott stated there is a security lighting proposed, a warning sign on the fence, and a security camera. Chairman McGrath asked if anyone from the public would like to speak. Police Chief Jim Pervier asked what the quality of the camera was going to be. Town Planner Alan Gordon recommended that applicant Mr. Doug Monson and the Police Chief should meet prior to installation of the security camera system to review the quality. Member Keith Cloutier made a motion to close the public hearing. Member Bill Hultgren seconded the motion. All members were in favor. Member Keith Cloutier made a motion to approve the OMA Group, LLC site plan application with the seven (7) conditions as detailed in the site plan approval permit. Member Bill Hultgren seconded the motion. All members were in favor. 7:35 p.m. Mroczkowski Realty Trust Site Plan Application Public Hearing Chairman McGrath continued the public hearing from the July 13 Board meeting.
4 4 Present at the meeting was Engineer Mr. Mike Loin from Bertin Engineering, Ted and Terek Mroczkowski, and Police Chief Pervier. Town Planner reviewed the August 17, 2011 latest Graves Engineering review. Mr. Gordon stated there are only 5 remaining items to address. The Board reviewed both the Conley Associates and District 3 MassDOT traffic reports. Conley Association had three items of concern: 1. The proposed 1800 square foot building with the proposed bakery is all set, if a fast food is ever proposed then a new traffic study will need to be performed. 2. Town Planner Alan Gordon asked if the farm stand is proposed to stay. Mr. Mroczkowski stated yes. The Board stated that if the farm stand is to remain in the parking lot, it needs to be added back into the traffic study because it adds 30 trips per day. 3. The report stated the driveway closest to the Route 20 intersection needs to be closed. Mr. Gordon stated that all three traffic engineers state that the site expansion will have serious traffic safety issues if that driveway remains open. Member Keith Cloutier stated he is a Police Officer and there has never been an issue at that location. Mr. Cloutier suggested leaving the entrance open, and monitor it to see if there are any accidents. Town Planner stated with two comments from both Conley Associates and Mass DOT, even if it is currently safe at the intersection now, with the size and scale of the retail proposed, there will be a change in flow in traffic and there is a disaster ready to happen. Member Patricia Tanona stated she feels that the Planning Board should not go against Conley & Associates and MassDOT because they are the traffic engineering professionals. Member Keith Cloutier stated he feels that customers will cross two lanes of traffic if you close the entrance. He stated to keep the entrance open and review it for a year. Chairman McGrath stated the intersection is a problem, and closing it will help this. Mr. McGrath stated the light is 50 feet from the driveway, and that is not acceptable anymore. An example of this is the new ClamBox in Auburn, MA. There is huge issue with traffic accidents at this location.
5 5 Mr. McGrath stated the traffic engineers stated in their reports to close it, so it needs to be closed for safety issues. Applicant Mr. Mroczkowski asked if Conley Associates has actually been at the site for the review. Mr. Gordon stated yes, absolutely. Applicant Terek Mroczkowski stated to the Board doesn t 34 years having a business at the intersection mean anything. Mr. Gordon stated that two different experts have come to the same conclusion, that the issue is a problem occurring with the much expanded use of the site. The Board reviewed the traffic reports from Traffic Engineering Consultant Ali Khorasanai per the Connelly and MassDOT Comments. Member Patricia Tanona made a motion to close the public hearing. Member Bill Hultgren seconded the motion. All members were in favor. Member Keith Cloutier made a motion to approve the Mroczkowski Realty Trust Site Plan application with the seventeen (17) conditions as detailed in the site plan approval decision. 8:35 p.m. Planning Board Discussion Ponnakin Hill Subdivision update Mr. Gordon updated the Board that he has received a commitment letter from Mr. Matt Sosik from Hometown Bank stating the final roadwork completion items for Phase I will be complete by August 31, Mr. Gordon stated the review of the As-Built Plan will be scheduled for the September 21 Board meeting. Mr. Mike Loin stated he will submit the As-Built Plan by September 14, :40 p.m. Approval-Not-Required Oxford Road Member Keith Cloutier made a motion to approve the ANR on Oxford Road to create one house lot. Member Patricia Tanona seconded the motion. All members were in favor. Minutes: May 4, 2011 Member Bill Hultgren made a motion to approve the May 4, 2011 minutes.
