1 CITY OF KIRKWOOD PLANNING AND ZONING COMMISSION September 18, 2013 PRESENT: Gil Kleinknecht, Chairman Wanda Drewel, Secretary/Treasurer Cindy Coronado Tad Skelton James O Donnell Madt Mallinckrodt Allen Klippel ABSENT: Greg Frick, Vice Chairman Dan Stauder Pursuant to notice of meeting duly given, the Planning and Zoning Commission convened on Wednesday, September 18, 2013, at Kirkwood City Hall. Zoning Administrator Ryan Spencer and Administrative Assistant Patti Dodel also attended the meeting. 1. Chairman Kleinknecht called the meeting to order at 7:00 p.m. Mr. Frick and Mr. Stauder were absent and their absence was excused. 2. Motion was made by Mr. O Donnell and seconded by Mr. Mallinckrodt to approve the minutes as written for the September 4, 2013, meeting. The motion was unanimously approved by the members present (Mr. Frick and Mr. Stauder were absent). 3. PZ SITE PLAN REVIEW 915 NORTH KIRKWOOD ROAD Submitted: Automatic Recommendation: Petitioner, Shannon Mette {Subcommittee - Mr. Skelton (chair), Mr. Frick (secretary), and Ms. Drewel} Mr. Skelton reported that revised site and landscaping plans were submitted on September 6 and the subcommittee expects to have a report at the October 2 meeting. 4. PZ SPECIAL USE PERMIT (PET DAY CARE CENTER) AND SITE PLAN REVIEW - THE WATERING BOWL, 140 PROSPECT AVENUE Submitted: Automatic Recommendation: Petitioner, Jeremy King {Subcommittee Mr. Frick (chair) and Mr. Stauder (secretary)} Neither subcommittee member was present. Zoning Administrator Spencer advised the Commission that the subcommittee had prepared a report for tonight; however, Mr. King requested the item be continued. Jeremy King, co-owner of The Watering Bowl, stated he will be submitting a revised site plan that moves the dog run to the south side of the building and is proposing a ten-foot high chain link fence with sound-absorbing curtain material attached. This type of sound proofing was recently installed at the Brentwood location. David Borella, owner of 150 Prospect, and Mark Borella, owner of the September 18, 2013 Page 1
2 business at 150 Prospect, spoke in opposition, citing potential for noise issues. 5. STAMPED "RECEIVED AUGUST 13, 2013, CITY OF KIRKWOOD PUBLIC WORKS The petitioner is requesting a Special Use Permit and Site Plan Approval to construct a two-story building to serve a Church at 100 Kirkwood Place. The main sanctuary will include seating for 422 individuals and a separate fellowship hall will provide seating for 120 individuals. Classrooms will be located on the lower level. These classrooms will serve children from birth to high school age and will be primarily utilized on Sunday mornings. A large outdoor amphitheater will be the main focus on the west side of the facility and will allow for special church and public activities. The subject property was formerly the Pitman Place residential subdivision, but was rezoned from R-4 to B-2 in January 2004 to allow for a mixed use development that was never constructed. 3 COMPREHENSIVE PLAN: This site is designated for Mixed Use Development by the Vision 2015 Comprehensive Plan. The proposed development is institutional in nature and will have a pedestrian oriented public space which is an appropriate use and is consistent with the policies presented by the Plan. LAND USE AND ZONING: The subject property is zoned B-2 General Business District and is currently a vacant lot. Surrounding land uses and zoning include the following: To the south: To the north: To the east: To the west: Directly abutting the site is a Drive-Thru Restaurant zoned B-2, General Business District. Directly abutting the site is a Church Administrative Office and Parking Lots zoned B-2, General Business District. Across South Taylor Avenue is a Church and the City of Kirkwood Public Works facility zoned I-1, Light Industrial District. Directly abutting the site are Retail uses zoned B-2, General Business District. DEPARTMENTAL/AGENCY COMMENTS: Electric: Engineering: Fire: Water: No Comments No Comments Establish a fire lane on both sides of Kirkwood Place per phone conversation with Fire Marshal Leo Meyer (9/16/2013). DISCUSSION: Zoning Matters signs were placed on the property on August 28, The petitioner s agent presented the plan at the September 4, 2013, Planning and Zoning Commission meeting; discussion was held and a subcommittee was appointed. The subcommittee met on site September 11, 2013, with the petitioner s agent Tyler Stephens, petitioner Michael Porter of Greentree Community Church and Zoning Administrator Ryan Spencer. Notice of the meetings had been properly posted. September 18, 2013 Page 3
4 Planning and Zoning 4 September 18, 2013 The discussion focused on several topics including the Kirkwood Road entry being repaved with an alternative material; such as asphalt and the current pave stones being re-utilized in pedestrian areas around the proposed building. There was also a discussion about the potential noise impacts of the outdoor amphitheater, but the consensus of all parties was that the noise would not be a critical issue due to the orientation of the amphitheater (to the west), the screening of the amphitheater by a portion of the building and the physical distance of the amphitheater from adjacent properties. Finally, discussion centered around traffic circulation and the need to prevent on-street parking along Kirkwood Place. RECOMMENDATION: The Subcommittee recommends that this petition be approved with the following conditions: 1. The project shall be constructed and maintained in accordance with the site plan stamped Received August 13, 2013, City of Kirkwood Public Works, except as noted herein. Prior to proceeding to City Council, revised plans that incorporate all conditions of approval herein shall be submitted to the Public Works Department. 2. A performance guarantee in the amount of $117,500 shall be submitted to the City of Kirkwood within six months of approval and prior to the issuance of any permits. 3. An administrative fee in the amount of $3,150 shall be submitted before acceptance of the performance guarantee by the City. The fee supports site inspection and project administration costs. 4. Prior to the issuance of any permits, provide documentation that the 11,280 square foot ingress/egress easement area is under the same ownership as the remaining portion of adjusted Lot The entrance/exit for construction vehicles shall be from South Taylor Avenue. 6. Kirkwood Place, a private access to adjoining property owners, shall be designated as fire lanes on the north and south sides for a distance of 188 feet from Kirkwood Road and shall be marked in accordance with the Kirkwood Fire Lane Policy as established by Ordinance Six-inch (6 ) high, full-depth concrete curbs shall be constructed to City standards along all parking, driveway areas, parking lot, and landscape areas within the site. 8. An accessible route in compliance with ADA standards shall be provided from the proposed accessible parking spaces to the accessible entrance of the building. 9. One of the accessible parking spaces provided on site shall be designated with an additional placard that states Lift Van Accessible. Additionally, the reserved parking signs shall

Dumpster enclosures are required to screen all dumpsters on the site and shall be constructed of sight-proof materials (e.g. board-on-board, masonry, vinyl, split-faced concrete masonry units, etc.) not less than six feet in height. Latching gates of similar or complementary materials shall be required to completely enclose the dumpster. 11. The driveway pavement to the dumpster area and the dumpster pad shall be constructed of seven-inch (7 ) thick concrete pavement on a six-inch (6 ) thick rock base. 12. Within six months of Planning and Zoning action and prior to proceeding to City Council, a variance shall be obtained from the Board of Adjustment for a front setback variance of from South Taylor Avenue. 13. The Architectural Review Board shall approve the building architectural scheme prior to the issuance of a building permit. 14. The Architectural Review Board shall approve all signs prior to the issuance of a sign permit. 15. The petitioner shall comply with all standard conditions as listed in Exhibit A. Respectfully submitted, Wanda Drewel Jim O Donnell Mr. Stehens commented that Condition No. 7 requiring concrete curbs around all parking, driveway areas, the parking lot, and landscape areas within the site posed a financial hardship; and their plan reflects curbing around approximately 70 percent of what is being required. After discussion, the Commission decided to take action on the report as read and Mr. Stephens can present this hardship to the City Council. The motion to approve the special use permit and site plan was unanimously approved by the members present (Mr. Frick and Mr. Stauder were absent). Motion was made by Ms. Coronado and seconded by Ms. Drewel to approve the report as read. The motion was unanimously approved by the members present. 6. PZ SPECIAL USE PERMIT (RESTAURANT WITH DRIVE THRU) AND SITE PLAN REVIEW MCDONALD S, 350 SOUTH KIRKWOOD Submitted: Automatic Recommendation: Petitioner s Agent, Jeff Brocco Bob Polk, Principal of Farnsworth Group, stated McDonald s is in the process of replacing all their red mansard roof restaurants. The Kirkwood restaurant will have a similar architectural style to the one recently constructed in Webster Groves. Land disturbance will be minimal. Mr. Polk added that they are agreeable to the 23 conditions and staff will review the landscaping plan to determine if any of the variances that were listed on the September 5, 2013, letter have been met.
6 Planning and Zoning 6 September 18, 2013 Mr. Polk stated the pavement connecting the two curb cuts on Kirkwood Road is to allow a patron to circle back through the parking lot if they were unable to find a parking space and to allow a patron utilizing the drive thru window to go back through the parking lot and exit onto Taylor Avenue. Chairman Kleinknecht appointed Mr. Klippel (chair) and Mr. Mallinckrodt (secretary) to the Subcommittee; and the subcommittee scheduled a meeting for September 24, 2013, at 8 a.m. 7. PZ AMEND ZONING CODE ARCHITECTURAL REVIEW IN ALL COMMERCIAL DISTRICTS AND LIGHT INDUSTRIAL DISTRICT {Subcommittee - Mr. Stauder (chair), Mr. Mallinckrodt (secretary), and Mr. Klippel} Zoning Administrator Spencer reported the subcommittee is still debating the time periods. 8. PZ AMEND ZONING CODE COMMUNITY UNIT PLAN AMENDMENT PROCEDURE Mr. Skelton reported the subcommittee should have a report at the October 2 meeting. 9. PZ AMEND ZONING CODE DOMICILIARY HOMES Mr. Skelton reported the subcommittee should have a report at the October 2 meeting. 10. PZ AMEND ZONING CODE MAXIMUM CURB CUT WIDTH Mr. Skelton reported the subcommittee should have a report at the October 2 meeting. 11. PZ AMEND ZONING CODE REVISE FLOOR AREA RATIO AND CORNER LOT SETBACKS Mr. Skelton reported additional information is being compiled, and the subcommittee should have a report at the October 2 meeting. The subcommittee scheduled another meeting for September 20 at 9 a.m. 12. PZ AMEND SUBDIVISION CODE REVIEW CRITERIA Mr. Skelton reported the City Attorney is reviewing this issue. 13. A training session for the Commission regarding ethics, sunshine law, conflicts of interest, etc. will be held on October 10 from 7 p.m. to 9 p.m.
