1 MINUTES ST. CLAIR SHORES CITY COUNCIL MEETING MAY 7, 2018 Regular Meeting of the City Council, held in the Council Chambers, located at Jefferson Avenue., St. Clair Shores, Michigan. Present: Absent & Excused: Also Present: Mayor Kip C. Walby, Council Members Peter Accica, John Caron, Ronald Frederick, Candice Rusie and Chris Vitale Council Member Rubino City Manager Michael Smith, City Clerk Mary Kotowski, Director Doug Haag and City Attorney Robert Ihrie 1. CALL TO ORDER, ROLL CALL AND PLEDGE OF ALLEGIANCE Mayor Walby called the meeting to order at 7:00 p.m. Ms. Kotowski, City Clerk, called the roll, and a quorum was present. The Pledge of Allegiance was recited. Motion by Council Member Caron, supported by Council Member Rusie to excuse Council Member Rubino. 2. PROCLAMATIONS & PRESENTATIONS a. Women s Civic League Scholarship Awards Sarah DeDonatis, Women s Civic League, presented two students with awards for essays they submitted for a scholarship award. She thanked everyone who participated in this competition. b. May 12, 2018 National Association of Letter Carriers 26 th Annual Food Drive Mayor Walby presented the following proclamation to Michael Sheridan: PROCLAMATION DESIGNATING SATURDAY, MAY 12, 2018 FOR THE NATIONAL ASSOCIATION OF LETTER CARRIERS 26th ANNUAL FOOD DRIVE WHEREAS, the upcoming Letter Carrier-U.S. Postal Service Food Drive is our 26th annual nationwide food drive taking place in 10,000 cities across America; and WHEREAS, the citizens of St. Clair Shores have always contributed generously to our annual food drive; and WHEREAS, the need for food throughout Macomb County has increased dramatically over the past few years; and WHEREAS, the Macomb Food Program is the recipient of most food collected in St. Clair Shores and distributes food through a network of over 50 pantries throughout Macomb County; and WHEREAS, Kroger has generously donated 600,000 bags to be attached to the food drive postcard announcing the food drive to facilitate bagging of donated items; and WHEREAS, this simple food drive takes place right at your mailbox on the second Saturday in May; NOW, THEREFORE, BE IT RESOLVED that Saturday, May 12, 2018, be proclaimed Letter Carrier-U.S. Postal Service Food Drive Day in St. Clair Shores and all citizens of the City be encouraged to donate nonperishable food items to be left at their mailbox and participate in this largest one-day food drive in the world. 2 c. St. Clair Shores 66 th Memorial Day Parade Mayor Walby presented the following proclamation to the members of the Memorial Day Parade Committee: Proclamation in honor of the 66th ST. CLAIR SHORES MEMORIAL DAY PARADE May 27, 2018 WHEREAS, the 66th St. Clair Shores Memorial Day Parade on Harper Avenue this year continues our City's time-honored tradition remembering those men and women who are or who have served in our armed services; and WHEREAS, we Americans are grateful to all those who have put on our Nation's uniform and recognize the service of our 2018 Grand Marshal Vito "Bill" Pellegrino, World War II Veteran; and WHEREAS, with this year's Parade theme "Never Forget Their Sacrifice", we recognize that the nation's military strength is not found in its defensive systems and weapons alone, but it is the personal character of the men and women in uniform, their faith, readiness, will and devotion that makes a nation's armed forces proud and strong; and WHEREAS, the 66th St. Clair Shores Memorial Day Parade would not happen without all the hard work and tireless efforts of the current St. Clair Shores Memorial Day Parade Committee Members: Chair Cheryl Furdos, Vice-Chair Vincent Carr, Secretary Mary Beth Okray, Treasurer Charles Palermo, Council Member Liaison Candice Rusie, Members George Carter, Charles Hall, Sarah Lanyon, Rosalie Lavigne, Robert Muha, Kyle Nicholson, David Rube/lo, Greta Rube/lo, Advisory Committee Members Dennis Krasnicki, Chad Miller, Jamie Victory and all their predecessors; NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the City of St. Clair Shores, on behalf of all our residents, do hereby declare Sunday, May 27, 2018 as the 66th St. Clair Shores Memorial Day Parade Day. Presented this 7 th day of May Cheryl Furdos, Memorial Day Parade Committee Chair, and Dave Rubello, Memorial Day Parade Committee member, gave a video presentation promoting this year s special guest Nancy Kerrigan. They thanked everyone who is working to make this parade possible. d. 9-Mack Merchants Association Junefest June 2, 2018 Gloria Kinne, 9 Mack Merchants Association member, spoke about their upcoming 23 rd Annual Junefest on June 2, 2018 from 10 a.m. to 5 p.m. There will be a craft fair, entertainment and activities for children. e. 23rd Annual Nautical Coast Cleanup Dave Rubello, Waterfront Environmental Committee member, introduced several committee members of the group and spoke about the upcoming Nautical Coast Cleanup scheduled for May 20, This group has removed 734 tons of debris from the lake since the inception of this program. 3. AUDIENCE PARTICIPATION ON AGENDA ITEMS (2 MINUTE TIME LIMIT) - None 4. REQUEST APPROVAL OF METRO ACT PERMIT FOR HORIZON NETWORK PARTNERS Background: The petitioner is requesting permission to install fiber-optic facilities within the City s road right-of-way in various locations at the south end of the city. This fiber will be deployed to provide additional capacity for T-Mobile as well as system upgrades for 5-G technology. This system is permitted under the Metro Act. Mr. Smith stated this agreement has been reviewed by the City s cable attorney Michael Watza. There is insurance for this project. City Council Meeting May 7, 2018 Page 2 of 5

3 Item 4 (Cont d): This is to cover the south end of the City and the right-of-way for T-Mobile. It is a start to many phases and will help a bit with service. Moved by Council Member Rusie, supported by Council Member Accica to approve the request for approval of the METRO Act Permit as submitted with Horizon Network Partners, with up-to-date bond and insurance, as recommended by the City Manager. 5. BIDS/CONTRACTS/PURCHASE ORDERS - None 6. CONSENT AGENDA All items listed on the consent agenda are considered to be routine and will be enacted by one motion and approved by a vote of City Council. There will be no separate discussion of the items unless the Mayor and or a Council Member so requests, in which event the item will be removed from the general order of business and considered under the last item of the Consent Agenda. Moved by Council Member Caron, supported by Council Member Frederick to approve the Consent Agenda items a g as follows: a. Bills April 26, 2018 $6,850, Resolved to approve the release of checks in the amount of $6,850, for services rendered, of the report that is 30 pages in length, and of the grand total amount of $6,850,457.69, $1, went to other taxing authorities. b. Request Approval to Publish Notice of Public Hearing on the Proposed FY Budget Resolved to Publish Notice of Budget Public Hearing g. Request for resolution allowing the City to accelerate winter tax bills under $100 to the summer installment Resolved to adopt the following resolution: WHEREAS, the State of Michigan has approved Public Act 184 and 185 of 2012 providing local tax collecting units the option of accelerating certain millages from the winter tax collection levy to the summer tax collection levy if the tax and other amounts billed total $100 or less; and WHEREAS, the City of St. Clair Shores levied mills as part of the 2017 winter tax collection levy and will have approximately 23,386 tax bills that could be collected as part of the 2018 summer tax collection levy and save the City expenses for preparing, mailing, and collecting the taxes; and WHEREAS, the City wishes to save its resources and take advantage of the option to accelerate the winter tax levy to the summer tax levy for small tax bills of $100 or less; and WHEREAS, the City will forward this Resolution to seek approval from the Macomb County Board of Commissioners NOW THEREFORE BE IT RESOLVED that, pursuant to MCL a (2)(b) the City Council authorizes the summer collection in July, 2018 for the property tax bill amounts that will total $ or less per individual tax bill and that otherwise would be collected as part of the 2018 winter tax levy. 7. UPDATES AND FOLLOW-UPS FROM COUNCIL MEETING - None 8. COMMENTS BY INDIVIDUAL COUNCILPERSONS Council Member Rusie made an announcement about upcoming events around the City. Council Member Caron asked if there are new completion dates for the 10 Mile Project. Mr. Smith said that they completed the last shaft today. He will provide Council with an update once it is available. Mr. Caron spoke about the I-696 project and the traffic lights at the mile roads. He sent an to the County regarding the traffic light at 12 Mile. He congratulated our new County Clerk appointment Kathy Smith. Council Member Frederick announced Opening Day for the St. Clair Shores Baseball/Softball league on May 20. He thanked the Police Officers who helped with the Cub Scout tour of the Police Department. He announced the Drive For Your Community event on May 10 to support the St. Clair Shores Special Needs Playground program, and he announced upcoming events at the Library. Council Member Vitale announced the May 8 Macomb County Special election. He asked about the recent resident drainage issue. 5 He announced an I-94 entrance ramp cleanup this Saturday. Council Member Accica said how nice Blossom Heath looks. Veterans Memorial Park is also looking good. He and his son worked on the St. Gertrude field. Elba Street has a drainage issue, and the inspector needs to look at this again. The neighbor raised the lot, and it is now above the drain out there. He asked about the letter that went out to the 10 Mile area regarding curbs and walks. Mr. Smith will look into this. It is not part of the sidewalk program. 9. CITY MANAGER S REPORT Mr. Smith announced that the first Farmer s Market event is May 20, Mr. Frederick announced the Hazardous Waste Day. 10. AUDIENCE PARTICIPATION (5 MINUTE TIME LIMIT) Mike Collins, St. Clair Shores resident, spoke about a tree in his yard that he feels is a hazard. He would like a definition on what makes a tree a hazard. Dwayne Dye, Roseville resident, said the City may be at risk for possible legal litigation regarding prisoners requiring medical care. Jamie Victory, St. Clair Shores resident, spoke about things going on in the City during the summer. Michele McAleer, St. Clair Shores resident, said she is running for Democratic delegate for her precinct. She would like to help prepare a disaster preparedness plan with the people in her precinct. 11. MAYOR S COMMENTS - None 12.
