1 City of Utica June 14, 2016 The City Council meeting was called to order by Mayor Noonan at 7:24 p.m. Members present: Sikora, Osladil, Terenzi, Montag, Czapski, Noonan Absent: Cuddington Executive Session Motion by Osladil, seconded by Terenzi, to recess to executive session to discuss litigation and personnel matters. Voting by roll, all ayes, motion CARRIED. The City Council meeting was reconvened by Mayor Noonan, who led the pledge of allegiance at 7:30 p.m. Minutes of 5/10/16, 5/17/16 & 5/24/16 Motion by Sikora, seconded by Terenzi, to approve the minutes of 5/10/16, 5/17/16 & 5/24/16. Voting all ayes, motion CARRIED. Assessing- Nancy Strehl, Assessor MTT# CBQ Ventures, LLC Motion by Montag, seconded by Sikora, to approve the MTT# CBQ Ventures, LLC (Kentucky Fried Chicken), as presented. Voting all ayes, motion CARRIED. Michigan Week Awards Mayor Noonan presented the Michigan Week Awards as follows: Employee of the Year: Donna Anderson Volunteer of the Year: Kelly Calandrino Beautification Award: Khan & Siahmoon Asgarally Custer Business of the Year: USA Tire, Rick & Meghan Michelon Organization of the Year: Boy Scouts of America- Matthew Zelasko-Barrett / Daniel Pisarski Special Award: SMART Fred Barbret Congratulations were given by all. Public Hearing- 7:45 p.m. Pesco, 6833 Auburn, Greenspace/landscaping Variance Motion by Sikora, seconded by Terenzi, to open the public hearing at 7:45 p.m. Voting all ayes, motion CARRIED. Ron Wolbert, employee, was present to request a 15 ft. green space / landscaping variance in the front open space of 6833 Auburn Road. This would allow hi-low access, removing the use of the road shoulder which endangers employees. Discussion was held on water drainage. The City Planner recommends a 10 pathway, Planning commission recommended approval. As there were no other comments, motion by Sikora, seconded by Montag, to close the public hearing at 7:59 p.m. Voting all ayes, motion CARRIED. Motion by Sikora, seconded by Noonan, to

Budget FY 2016/2017 & Tax Millage Rate Motion by Montag, seconded by Terenzi, to open the public hearing at 8:00 p.m. Voting all ayes, motion CARRIED. Phil Paternoster explained the proposed budget, appropriations ordinance and tax millage rates for FY 2016/2017. As there were no further comments from the public, motion by Sikora, seconded by Montag, to close the public hear at 8:10 p.m. Voting all ayes, motion CARRIED. Motion by Sikora, seconded by Terenzi, to adopt the FY 2016/2017 Budget, as presented. Voting by roll, all ayes, motion CARRIED. Appropriations Ordinance & Millage Rates 2016 Phil Paternoster, Treasurer, proposed the millage rates for tax year 2016 as follows: General operating Public Safety Public Library Street Debt Motion by Sikora, seconded by Terenzi, to adopt the millage rates and the 2017 appropriation ordinance, as presented. Voting by roll, all ayes, motion CARRIED. Unfinished Business Douglas & Carol Levy, Louise Ct., Water Bill Council agreed that no reduction would be granted, the City offers a payment plan up to 3 years as records show the water consumption was used. Doug Levy requested to pursue the matter with the DPW Superintendent. John Ellis- Hot Dog Stand Request As the petitioner was not present, no action taken. Riverwalk Festival June Linda Davis-Kirksey and John Sattmann were present to inform Council of the Riverwalk Festival held June There will be a petting zoo, musical entertainment, activities, characters, carnival, fireworks and Lions beer tent. SMART will be providing bus transfers from several locations. All are invited to attend. Ballpark Fireworks Request After much discussion concerning the noise from the fireworks and timing of shows, motion by Noonan to approve the Friday fireworks with a 10:30 p.m. show time. Motion fails for lack of support. Council agreed to create a committee of Department Heads and others (8 max.) for ongoing review of the Ballpark effects. Motion by Terenzi, seconded by Sikora, to approve the Ballpark fireworks for the next 4 Fridays, show no later than 10:20 p.m. Voting all ayes, motion CARRIED. Consent Business None.

3 Page 3 of 6 Correspondence Motion by Montag, seconded by Sikora, to receive and file the correspondence from: Nancy & Bill Osey, Shred Day Thank You, Gabriel Shall Family, Thank You, UCS Foundation For Educational Excellence, Thank You, Derek Miller, Macomb County Treasurer, Ballpark Thank You, Deb Obrecht, Thank You. Voting all ayes, motion CARRIED. New Business Department Reports Mayor Noonan Mayor Noonan thanked all for the support during Jerry s illness. Council Reports None. Building- Jason Rhoades Michigan Residential 2015 Building Code Update Jason Rhoades, Building Inspector, was present to request updating the MI Residential Building Code to 2015 allowing the City to be current with construction codes. Motion by Sikora, seconded by Osladil, to approve the adoption of the Michigan Residential 2015 Building Code. Voting all ayes, motion CARRIED. Inspection Fee Increase Request Jason Rhoades, Building Inspector, was present to request increasing Electrical, Mechanical and Plumbing minimum inspection fee from $35.00 to $50.00 and Business Registration; new from $35.00 to $50.00 and renewal from $25.00 to $40.00, due to the increased costs of City operations. Motion by Sikora, seconded by Terenzi, to approve the Inspection fee increase from $35.00 to $50.00 and Business Registration from $35.00 to $50.00 and $25.00 to $40.00, as presented. Voting all ayes, motion CARRIED. Fire- Kevin Wilseck, Chief Joe Blevins & Brian Rowley, Resignations Motion by Osladil, seconded by Sikora, to receive, file and thank Joe Blevins and Brian Rowley for their service. Voting all ayes, motion CARRIED. 2 Recertified Philips MRX Heart Monitor Purchase Request & Budget Amendment Kevin Wilseck, Chief, was present to request the purchase of 2 re-certified Philips Mrx heart monitors at a cost of $21,990.00, as the old units are obsolete. Motion by Terenzi, seconded by Terenzi, to approve the request to purchase 2 re-certified Philips Mrx heart monitors at a cost of $21,990.00, as presented. Voting all ayes, motion CARRIED. Budget amendment Motion by Sikora, seconded by Osladil, to approve the budget amendment to Ambulance Fund for the purchase of the 2 re-certified Philips Mrx heart monitors at a cost of $21, Voting all ayes, motion CARRIED.

4 Page 4 of 6 Thermal Imaging Camera Purchase Request Kevin Wilseck, Chief, requested permission to purchase 2-Flir Thermal Imaging Cameras at a cost of $ as the current one is unreliable. Motion by Sikora, seconded by Osladil, to approve the request to purchase 2-Flir Thermal Imaging Cameras, as presented. Voting all ayes, motion CARRIED. Police- Dave Faber, Chief Liquor License Transfer, Black Rock Utica LLC Dave Faber, Chief, explained the Liquor License request for Black Rock Utica, LLC. They currently have three locations and are opening three more in Michigan, all reports are positive. No action necessary. Computer Purchase/Budget Amendment Request Dave Faber, Chief, explained the request to purchase new computer equipment as the current system has been repaired numerous times since 2006 with patches, used equipment replacements, CLEMIS is no longer supplying and the department has no IT service. SYO Computer Engineering Services currently serves City Hall and has saved the City funding over the years. Chief Faber is recommending installing, purchasing and engaging the services of SYO, at a total cost of $42, Motion by Czapski, seconded by Terenzi, to approve the purchase, software, installation and IT services of SYO Computer Engineering, at a cost of $42,462.08, as presented. Voting all ayes, motion CARRIED. Budget Amendment Motion by Terenzi, seconded by Montag, to approve the budget amendment to , Liquor Control and Drug Forfeiture to split the cost of the computer purchase/ installation. Voting all ayes, motion CARRIED. Chief Faber also informed all that the recent Shred Day was a success along with the workshop held for theft at churches. DPW- Bill Lang, Superintendent Treasurer- Philip Paternoster May Financial Report Phil Paternoster, Treasurer, reported on the May financial records of the City. Annual Budget Amendments Motion by Terenzi, seconded by Noonan, to approve the FY 2016 Budget Amendments as follows: General Fund #101 Mayor $ 2,140 Clerk $ 6,950 Elections Revenues $ 8,030 Expenditures $ 1,810

5 Page 5 of 6 Miscellaneous Administration Revenues $ 109,320 Expenditures $ 3,050 Ambulance Revenues $ 20,000 Expenditures $ 34,000 Major Street Fund #212 Revenues $100,000 Expenditures $100,000 Building Code Enforcement Fund #248 Revenues $ 20,000 Expenditures $ 85,000 Year end amendments, as requested. Voting by roll, all ayes, motion CARRIED. Administration- Beth Ricketts, City Clerk SMART Credit Transfer Beth Ricketts, City Clerk, requested permission to transfer our Municipal Credit of 4,674 and Community Credit of 6,640 for FY 2017 to Shelby Township, Depart. of Parks, Recreation & Maintenance. Our over 50 & handicap residents may use Shelby s bus service. Motion by Sikora, seconded by Osladil, to approve the transfer the City s FY2017 SMART Credits to Shelby Township, in the total amount of $11, Voting all ayes, motion CARRIED. November Council Meeting Date Change Beth Ricketts, City Clerk, requested to change the November 8, 2016 Council meeting date to November 15, 2016, due to the conflict with the Presidential Election that day. Motion by Terenzi, seconded by Sikora, to approve changing the November Council Meeting to November 15, Voting all ayes, motion CARRIED. Landlord License Fee Increase Request Motion by Sikora, seconded by Terenzi, to approve the Landlord Fees as follows: Single Family Dwellings $ Duplex Units $ Multiple Units (three or more) $ for first unit and $50.00 for each additional unit. Re-inspection fee $ Penalty/ Late Fee $ Voting all ayes, motion CARRIED. Library- Marsha Doege, Director Landscaping Thank You Marsha Doege, Director, thanked all the volunteers who donated plants, planted and renewed the Library landscaping. Parks and Recreation Commission

6 Page 6 of 6 Mayor Noonan reminded all of the upcoming Old Mill Arts N Crafts Festival, July and the Car Show, with swap meet and gasoline alley on August 13, Historic District Commission City Attorney- James McGrail Planning Commission John Culcassi, City Planner, reported that the work on the Master Plan is going well. Also there are some amendments to the sign ordinance that will be presented at the July meeting. Senior Housing Steering Committee Brownfield Redevelopment Authority Bills Payable Motion by Sikora, seconded by Terenzi, to approve the payment of all bills as presented. Voting all ayes, motion CARRIED. Communication from the Public Fred Sawyer, Cass, was present with concerns pertaining to Regency Manor at Cass. He presented Council with multiple pictures of blight. The Building Inspector will be notified for enforcement. Adjournment As there were no further comments from the public, motion by Montag, seconded by Terenzi, to adjourn the meeting.
